No.-3/M-35/2025-18795/GAD— In exercise of the powers conferred under the proviso

to Article 309 of the Constitution of India, the Governor of Bihar makes the following Rules to

regulate the recruitment, promotion and service conditions of the officers of Bihar Administrative

Service under the General Administration Department.

1. Short title, extent and commencement.—

(1) These Rules may be called as the "Bihar Administrative Service (Recruitment

and Service Conditions) Rules, 2025".

(2) It shall extend to the whole State of Bihar.

(3) It shall come into force at once.

2. Definitions.—In these rules, unless the context otherwise requires,-

(i)

"State Government" means State Government of Bihar;

(ii) "Governer" means the Governer of Bihar State;

(iii) "Constitution" means the Constitution of India;

(iv) "Appointing Authority" means Appointment authority as prescribed in

Bihar Executive Rules, 1979 (as amended from time to time);

(v) “Department” means General Administration Department;

(vi) “Cadre” means the Cadre of Officers of Bihar Administrative Service;

(vii) “Cadre

(viii) "Group" means Groups as determined according to pay scale/pay level;

(ix) “Cadre post” means the posts, sanctioned from time to time, for Bihar

Administrative Service;

(x) “Non-cadre posts” means such posts, other than cadre posts, which are

earmarked for posting of officers of Bihar Administrative Service;

(xi) "State" means the State of Bihar;

(xii) "Commission" means Bihar Public Service Commission;

(xiii) "Year" means Calendar year i.e. the year starting from 1^st Junary to 31^st

December;

(xiv) "Due Date" means the date of notification of these Rules;

(xv) "Selection Committee" means the Committee constituted by the Department

for selection of suitable candidates by promotion to the Basic Grade post;

3. Structure of the Service.—

(i) This shall be a state level gazetted service, whose structure of posts of different

grades shall be as follows-

(ii)

The pay scale/pay level of posts of all grades of this service shall be as

determined by the State Government from time to time.

(iii)

The sanctioned strength of posts of all grades of this service shall be as

sanctioned by the State Government on the due date. Provided that, the State

Government shall, from time to time, create new posts, surrender sanctioned

posts of different grades in this service, or create new grade, as per

requirement.

(iv)

The charge of different posts at the Collectorate level such as Establishment

Deputy Collector, Nazarath Deputy Collector, OSD to D.M. and Incharge of

D.M. Confidencial Cell shall be given only to the officers of this service,

posted in the Collectorate, as per their seniority.

(v)

Officers of this service shall also be posted on non-cadre posts.

Provided that, such posting cannot be made on a post of lower pay scale/pay

level than the pay scale/pay level of the post held by the concerned officer.

(vi)

The officers of this service shall be deputed/deputed in foreign service (such

as Central Government, any other State Government, any Undertaking under

the control of the Central or any other State Government, Municipal body etc.

or any international institution like United Nations Organization, World Bank,

Asian Development Bank etc.) as per requirement,

Provided that, such posting cannot be made on a post of lower pay scale/pay

level than the pay scale/pay level of the post held by the concerned officer.

(vii) The State Government shall review the structure of this service and sanctioned

strength of different grades of posts, on the recommenation of a Committee

chaired by Chief Secretary, after every five years, and shall make amendment

as per the requirement.

Provided that, while reviewing the sanctioned strength and structure of posts

of different grades of this service, the Committee shall also take into account

the provisions, as contained in the Rules of other services/cadres.

Reservation.—The provisions of reservation, as determined by the State Government

from time to time, shall be applicable in appointment or promotion to various grades

of posts in this service.

Appointment to the post of Senior Deputy Collector.—

(a) Determination of vacancies.—

(i) The vacancies of the basic grade posts of this service shall be determined

by the cadre controlling authority as on 1st April every year. The

reservation roster wise requsition for 75 percent of the available

vacancies shall be made available to the Commission by 30th April.

(ii) Action will be taken by the department for appointment by promotion

against the remaining 25 percent reservation category wise vacancy. This

process will continue till the total number of personnel appointed by

promotion becomes 25 percent of the total sanctioned strength of the

basic category posts. Thereafter, on 1st April every year, the vacancies

for appointment through direct recruitment and promotion will be

calculated on the basis of actual vacancy available in the respective

category

(b) Appointment by direct recruitment.—

(i) The 75 percent of the vacancies of the basic grade post- Senior Deputy

Collector- of this service shall be filled by direct recruitment on the

recommendation of the Commission.

(ii) For appointment, it shall be mandatory for the candidate to be a citizen of

India and having graduation or equivalent qualification from a recognized

university.

(iii) The minimum age limit for appointment shall be 21 years and the

maximum age limit shall be as determined by the government from time to

time. Age shall be calculated as on 1st August of the advertisement year.

(iv) The commission shall select suitable candidates, on the basis of combined

competitive examination, as per the reservation roster wise requisition of

cadre controlling authority, against available vacancies, and, recommend to

the department after medical examination, reservation roster wise selected

candidates for appointment.

(v) The department shall appoint the recommended candidates after due

verification of certificates/character and antecedents etc., as required.

(c) Appointment by Promotion.—

(i) The 25 percent of the vacancies of the basic grade post- Senior Deputy

Collector- of this service shall be filled by, promotion of basic grade

employees in pay level-7 of different supervisory services/cadres e.g. Bihar

Revenue Service, Bihar Rural Development Service, Bihar Secretariat

Service and other supervisory services, who had rendered atleast 08 years

of service in pay level-7 and their services has been confirmed.

(ii) It shall be mandatory to have graduation or equivalent qualification from a

recognized university for selection.

(iii) The suitable candidates shall be selected, on the recommendation of a

selection committee, headed by a Member, Bihar Public Service

Commission, amongst the candidates recommended by the different

departments for this purpose. The selection committee shall prepare the

merit list for such purpose on the basis of interview.

(iv) The selection committee shall be constituted by the department through a

separate order.

Probation period.—

(i)

The officers appointed by direct recruitment to the post of Senior Deputy

Collector of the Service, shall remain on probation for 01 (one) year. The

probation period shall be extended for one more year, if the service was not

found satisfactory during the probation period. If the service was not found

satisfactory even in the extended period, the service shall be terminated.

(ii) The officers appointed by promotion to the post of Senior Deputy Collector

of the Service, shall remain on probation for 01 (one) year. The probation

period shall be extended for one more year, if the service was not found

satisfactory during the probation period. If the service was not found

satisfactory even in the extended period, his service shall be returned to the

post, from where he was promoted to this service.

Training.—

(i)

The officers appointed/promoted to the post of Senior Deputy Collector in

the service, shall have to undergo the induction training as prescribed by the

department, during the probation period, and, shall also have to pass the

examination, as prescribed by the training institute, during this training

period.

(ii)

The officers shall have to undergo in-service traning, as prescribed, for

promotion to higher posts in the service.

Departmental Examination.—

(i)

The officers, appointed/promoted to the post of Senior Deputy Collector in

the service, shall have to pass the departmental examination as prescribed by

the Central Examination Committee, Board of Revenue, Bihar, Patna. The

subject, syllabus and procedure of the departmental examination shall be

decided by the Board of Revenue, in consultation with the department. The

departmental examination shall be organized by the Central Examination

Committee, Board of Revenue/Bipard.

(ii)

The officers, appointed/promoted to the post of Senior Deputy Collector in

the service, shall have to submit two revenue records based on the experience

during the training period, which shall be approved by the Revenue and Land

Reforms Department. After approval, these records shall be considered

approved from the date on which they were submitted in the Revenue and

Land Reforms Department.

(iii) The officers, appointed/promoted to the post of Senior Deputy Collector in

the service, shall have to undergo prescribed treasury training during the

training period. The Treasury training shall be approved by the Revenue and

Land Reforms Department. After approval, the treasury training shall be

considered approved from the date on which the treasury training certificate

was issued.

Confirmation.—The service of the officers, appointed/promoted to the post of

Senior Deputy Collector, shall be confirmed on the post of Senior Deputy Collector

in the service after satisfactory service during the probation period, completion of

prescribed induction training, passing in all the papers of departmental examination

and approval of case records as well as treasury training.

10.

Regulation of Pay.—

(i)

The officers, appointed/promoted to the post of Senior Deputy Collector in

the service, shall be granted the first increment after joining as per rules. The

second increment shall be admissible only after passing all the papers of the

departmental examination and approval of treasury training. After the second

increment, the successive increments shall be admissible only after

confirmation of service.

(ii)

Increments withheld due to failure in departmental examination, non-

approval of treasury training or non-confirmation of service, shall be

approved from the date of fulfillment of these requirements, in such a way as

it would have been admissible if these requirements were fulfilled in time,

but the arrear salary on this account shall not be admissible.

11.

Seniority.—

(i)

The inter-se seniority of the Senior Deputy Collector, appointed through

direct recruitment, shall be as per the merit list, determined by the

Commission.

(ii) The inter-se seniority of the Senior Deputy Collector, appointed by

promotion, shall be as per the order of merit determined by the selection

committee.

(iii) In a year, the Senior Deputy Collector, appointed by direct recruitment shall

rank junior to the Senior Deputy Collector appointed by promotion.

(iv) The inter-se seniority of the officers of the higher grade posts in the service

shall be in accordance with their inter-se seniority in the post immediately

below.

12.

Medical Examination.—Yearly health examination, of all the officers above 40

years of age, shall be mandatory, in the month of April at the Institute prescribed by

the government. A copy of the health checkup report shall have to be attached with

the Performance Appraisal Report.

13.

Promotion.—

(i) For promotion from the post of Senior Deputy Collector to the higher grades

of this service, confirmation of service and completion of in-service training

shall be essential.

(ii) In-service training shall be arranged by the department, in which, it shall be

mandatory for the selected officials to participate. In case of non-completion of

traning, the next promotion shall not be considered until such training is

obtained. However, in unavoidable circumstances, if such training was not

arranged by the department, the promotion shall not be denied on this ground

alone.

(iii) The time bound regular promotion to next higher grade of the service shall be

considered, after completion of 'kalawadhi', required in-service training and

other eligiblity conditions like vigilence clearance, PAR etc., on the 1st January

of the following year. The eligibility regarding 'kalawadhi' and training shall be

as follows:-

(iv) The basis of promotion shall be seniority-cum-merit.

(v) Promotion shall be granted on the recommendation of the Departmental

Promotion Committee constituted for the same. The Departmental Promotion

Committee shall be constituted by the department by a separate order.

(vi) For promotion, the meeting of the Departmental Promotion Committee shall be

held in the month of November.

14.

Power to make regulations.—The government may make regulations to implement

any provision of these Rules or to explain any provision contained in these Rules.

15.

Interpretation.—Where any doubt arises as to the interpretation of any of the

provisions of these rules, the matter shall be referred to the General Administration

Department, and the decision of the department, after consultation with the Law

Department, shall be final.

16.

Residuary matters.—The members of this service shall be governed by the

provisions of the government for other equivalant government employees regarding

the matters, for which there is no specific provision in these rules.

17.

Power to relax.—Where the cadre controlling authority is satisfied that any

provision of these rules may cause undue hardship to a member or group of

members of this service, the government may relax that provision of these Rules

regarding that member or group of members.

18.

Repeal and sevings.—

(i)

The Bihar Administrative Service (Cadre) Rules, 1996 and any other

rules, resolution, order, circular, clarification etc., constituted in the

context of members of this service, are here by repealed.
