— In exercise of the powers conferred under proviso to
Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the "Bihar
Municipal Planning Service Rules, 2025" under the Urban Development and Housing
Department, Government of Bihar and constitutes the following Rules to regulate recruitment and
service conditions:
1. Short Title, Extent, and Commencement :-
(i)
These rules will be called the “Bihar Municipal Planning Service Rules, 2025.”
(ii) It shall extend to whole of the State of Bihar.
(iii) These rules shall come into force with effect from the date of publication of
notification in the Bihar Gazette.
2. Definitions :- In these Rules, unless the context otherwise requires:-
(i)
"Act" means the Bihar Municipal Act, 2007 (As amended).
(ii)
"Commission" means the Bihar Public Service Commission.
(iii)
"Appointing Authority" means the Appointing Authority as prescribed in the Bihar
Rules of Executive Business, 1979.
(iv)
"Governor" means the Governor of Bihar.
(v)
"Government" means the State Government of Bihar.
(vi)
"Municipality" means an Institution of Self- Governance which includes Municipal
Corporations, Municipal Councils, and Nagar Panchayats.
(vii) "Year" means the Financial Year, i.e., from 1st April to 31st March of the next year.
(viii) "Vacancy within the Year" means vacancies arising due to new posts created in the
cadre, promotions, retirements, resignations, deaths, removals, and dismissals.
(ix)
"Department" means the Urban Development and Housing Department, Bihar.
(x)
"Directorate" means the Directorate of Municipal Administration, Bihar.
(xi)
"Director" means the Director, Directorate of Municipal Administration, Bihar.
(xii) "Departmental Promotion Committee" means the Departmental Promotion
Committee constituted by the department from time to time.
(xiii) "Service" means the Bihar Municipal Planning Service.
(xiv) "Cadre" means the Bihar Municipal Planning Service Cadre
(xv) "Cadre Member" means a member of the Bihar Municipal Planning Service Cadre
governed by these rules.
(xvi) "Cadre Controlling Authority" means the Additional Chief Secretary/Principal
Secretary/Secretary, Urban Development and Housing Department.
(xvii) Any other terms and expressions used but not defined in these rules will have the
same meanings as assigned to them in the Bihar Municipal Act, 2007 (As amended)
and the rules framed thereunder.

3. Cadre Structure :-
(i) The structure of the cadre will be as follows:

(ii)
Number of posts under various categories shall be determined by the Department
from time to time.
(iii)
Grade Pay/Pay level of various categories shall be fixed by the Finance Department
of the Government from time to time.
(iv)
The Department may make interim arrangements as per requirement for filling-up
vacancies in various categories till regular appointment is made in the Cadre and
after regular appointment such interim arrangement shall automatically come to an
end.
4. Direct of Recruitment.—Recruitment in this cadre shall be made on the basic grade post
and vacancies of basic grade shall be filled-up through direct recruitment on the basis of
recommendation of the Commission.
5. Eligibilities :-
1. For direct recruitment to the posts of Basic Grade, minimum educational
qualification shall be Law Graduate from a recognized University/Institute. The
determination of subject and syllabus for direct recruitment on the post of Basic
Category shall be done by the Commission in consultation with the Department.
2. The minimum age limit for direct recruitment on the posts of Basic Category shall
be 21 years and the maximum age limit shall be determined by the General
Administration Department of the Government from time to time category-wise.
3. For fixation of age, 1st August of advertisement year will be deemed as cut-off date.
6.
Process for Direct Recruitment :-
1. The Appointing Authority will ensure calculation of vacancies on the basis of the
status as on 1st April of the year and after obtaining reservation roster clearance
category-wise will send requisition to the Commission by 30th April of the Year.
2. In the light of the requisition, the Commission shall advertise vacancies and will
invite applications from eligible candidates and on the basis of competitive
examination, the Commission will select candidates for recommendation for
appointment.
3. Procedure for conduct of competitive examination shall be determined by the
Commission.
4. The Commission shall prepare merit list of successful candidates on the basis of
result of the competitive examination and will make available recommendation to
the Appointing Authority in accordance with the requisitioned vacancies, category-
wise reservation.
5. After receipt of recommendation of the Commission, it is mandatory to ensure
compliance of the directives issued from time to time by the General Administration
Department of the Government with respect to the appointment process .
7. Probation Period.— Candidates shall be on probation period after appointment through
direct recruitment and probation period shall be of one year. If service is not found
satisfactory during the probation period, then probation period may be extended for another
one year. If during the extended period also, service is not found satisfactory, then the
Appointing Authority may terminate the service of Assistant Municipal Planning Officer.
8. Training.—During probation period, it will be mandatory for the probationer to complete
the training successfully as prescribed by the government from time to time.

9. Departmental Examination :-
1. It will be mandatory for employees appointed on the posts of Basic Category
(Assistant Municipal Planning Officer), to pass in all papers of the Departmental
Examination organized from time to time by the Central Examination Committee,
Board of Revenue, Bihar.
2. Determination of subjects, syllabus, and procedure for Departmental Examination
shall be done by the Board of Revenue, Bihar in consultation with the Department.
3. After appointment and on grant of first annual increment, next annual increment
shall only be admissible after passing all papers in all subjects in the prescribed
Departmental Examination.
10. Confirmation .—Probationary Officer shall be eligible for confirmation of service after
completion of probation under following conditions:
a. His conduct and service during the probation period should be satisfactory.
b. He has successfully completed the prescribed training and has obtained a certificate
in this regard; and
c. He has passed all the papers in all subjects of the prescribed Departmental
Examination.
11.
Seniority.— The inter-se-seniority of the employee appointed in this cadre will be
determined in accordance with the recommended merit list by the Commission.
12. Promotion.—
1. Assistant Municipal Planning Officer confirmed in service may be considered for
grant of promotion based on seniority-cum-eligibility to the extent availability of
vacancies.
2. The minimum qualifying service for consideration of promotion will be same as
determined by the General Administration Department of the Government from time
to time. In this regard, Guidelines issued from time to time by the said department
shall be necessarily followed.
3. Promotion will be considered on the basis of recommendation of the Departmental
Promotion Committee. The Departmental Promotion Committees shall be
constituted by the Department from time to time through separate orders.
4. For grant of promotion, instructions issued from time to time by the General
Administration Department of the Government regarding C.R. / Performance
Appraisal Report, Sealed Envelop Method etc. are expected to be complied with.
13. Reservation.—It will be mandatory to comply with the Reservation Act and Rules of the
Government, as well as the reservation roster determined from time to time for direct
recruitment and promotion and also the directives issued from time to time relating to
reservation.
14.
Power to Make Regulations.—The department may make regulations as per necessity for
making the provisions of this rule effective.
15. Residuary Matters.—In the context of those subjects in which specific provisions could
not be provided in this rule, in such subjects provisions effective for equivalent to
employees in the Govt., will apply for this cadre also.
16.
Interpretation.—In the event of any doubt arising in the interpretation of any provision
of this rule, then, it will be referred to the Department and, in this regard, decision of the
Department in consultation with the General Administration / Legal Department, will be
final.
17. Resolution of Difficulties.—If any difficulties arises in the implementation of the
provisions of this rule, then the power to resolve the difficulty shall be vested in the
Department.
18. Repeal and Savings :-
1.
Rule, Resolutions, Orders, Instructions etc., issued from time to time by the
Department earlier relating to this cadre shall be deemed as repealed from the

ǐबहार गजट (असाधारण), 17 अÈ तूबर2025
2. Notwithstanding such repeal, any thing done or any action taken in exercise of
any power conferred by or under the such rule, regulations, instructions etc. shall
be deemed to have been done or taken in exercise of the powers conferred by or
under this rule as if this rule was in force on the day on which such thing was
done or such action was taken.
