Notification
The 6th October 2025
No.-3A-5-Service Condition(MACP)-01/2025-10543/F—In exercise of the powers
conferred by the proviso to Article-309 of the Indian Constitution, the Governor of Bihar
hereby make the following rules to regulate the procedure and conditions for providing the
benefit of modified assured career progression to the employees of the State Government: -
1.
Short Title, Extent and Commencement: -
(i)
These rules shall be called "Bihar State Employees Service Conditions
(Modified Assured Career Progression Scheme) Rules, 2025".
(ii)
It shall be applicable to all regular employees of the State of Bihar. This rule
shall not be applicable to autonomous institutions/public undertakings fully
or partially funded by the State Government.
(iii) It shall come into force with effect from 01/01/2009.
2.
Definitions: In this Scheme, unless the context otherwise requires:
(i)
“cadre” means a service or group of posts forming a distinct unit:
(ii) “Upgradation” means the Grade Pay/Pay Level higher than the basic grade
Identified under the Scheme,
(iii) “Limited Competitive Examination” means an examination for selection to
a higher cadre from amongst the members of a subordinate service or cadre;
(iv) 'Scheme' means the Modified Assured Career Progression Scheme 2025
under these rules;
3.
Scope of the scheme.—
(1)
This scheme shall be applicable to regular employees of Group 'A', 'B' and 'C'
of Bihar Government and shall also be applicable to regular employees of
Group 'D' Prior to 01.06.2018. It can also be applied on single posts of
Group 'A'
The benefit of this scheme will be available to teachers and headmasters
of Rajkiyakrit schools under the provisions issued by the Education
Department.
But the scheme shall not apply to autonomous institutions or public
undertakings fully or partially funded by the State Government.
(2)
The cases for grant of financial upgradation under this Scheme shall be
considered by the same Committee which have been considering the cases of
financial upgradation under the Assured Career Progression Scheme. It will
be kept in mind that the members of the committee shall be such officers who
hold posts at least one grade above the grade under consideration of MACP
and they should not be below the rank of Deputy Secretary and equivalent to
the Government. The Chairperson will be at least one grade above the grade
of the members of the committee.
(3)
The recommendations of the Screening Committee shall be placed for
approval before the Departmental Secretary in cases where the Committee is
constituted in a Department or before the head of the organization/competent
authority in other cases.
8
ǐबहार गजट (असाधारण), 28 जनवरȣ 2026
(4)
The Screening Committee shall follow a time Schedule and meet twice in a
financial year, preferably in the first week of January and the first week of
July, to consider in advance the cases maturing in the next half year.
Accordingly, the cases maturing during the first half year (April-September)
of a financial year shall be considered in the Screening Committee meeting
held in the first week of January. Similarly, in the Screening Committee
meeting held in the first week of July of a financial year, only those cases
shall be considered which will mature in the second half year (October-
March) of the same financial year.
(5)
No stepping up of pay in the pay band or grade pay would be admissible with
regard to junior getting more pay than the senior on account of pay fixation
under MACP Scheme.
Explanation- It is clarified that no past case will be reopened. Further, while
implementing the MACP scheme, the difference in pay scales as a result of grant of
financial upgradation under the old ACP Scheme Rules, 2003 and MACP Scheme,
2010 within the same cadre will not be considered as an anomaly.
4.
Conditions and procedure of the scheme.—The conditions and procedure for
implementing this scheme and approval of financial upgradation will be as follows-
(1)
There shall be three financial upgradations under the Modified Assured
Career Progression Scheme, counted from the direct entry grade on
completion of 10, 20 and 30 years of service respectively. Financial
upgradation under the Scheme will be admissible whenever a person has
spent 10 years continuously in the same grade-pay/pay level.
(2)
The Modified Assured Career Progression Scheme envisages merely
placement in the immediate next higher grade pay/pay level in the hierarchy
of the recommended revised pay bands and grade pay/pay level available
under the state Govt. Thus, the grade pay/pay level at the time of financial
upgradation under the Modified Assured Career Progression Scheme can, in
certain cases where regular promotion is not between two successive
grades/pay level, be different than what is available at the time of regular
promotion. In such cases, the higher grade pay/pay level attached to the next
promotional post in the hierarchy of the concerned cadre/organisation will
be given only at the time of regular promotion.
(3)
Benefit of pay fixation available at the time of regular promotion shall also
be allowed at the time of financial upgradation under the Scheme.
Therefore, the pay shall be raised by 3% of the total pay in the pay band and
the grade pay drawn before such upgradation. There shall, however, be no
further fixation of pay at the time of regular promotion if it is in the same
grade pay as granted under Modified Assured Career Progression Scheme.
However, at the time of actual promotion if it happens to be in a post
carrying higher grade pay than what is available under Modified Assured
Career Progression Scheme, no pay fixation would be available and only
difference of grade pay would be made available.
Example:- In case a Government Servant joins as a direct recruit in the
grade pay of Rs. 1900 in PB-1 and he gets no promotion till
completion of 10 years of service, he will be granted financial
upgradation under Modified Assured Career Progression
Scheme in the next higher grade pay of Rs. 2000. In case of
financial upgradation between 01.01.2006 to 31.12.2015 his pay
9
ǐबहार गजट (असाधारण), 28 जनवरȣ 2026
will be fixed by granting him one increment plus the difference
of grade pay (i.e. Rs. 100). After availing financial upgradation
under Modified Assured Career Progression Scheme, if the
Government servant gets his regular promotion in the hierarchy
of his cadre, which is to the grade of Rs. 2400, on regular
promotion, he will only be granted the difference of grade pay
between Rs. 2000 and Rs. 2400.
(4)
If the pay level sanctioned under the Modified Assured Career Progression
Scheme in the revised pay structure with effect from 01.01.2016 is the same
as the pay level of regular promotion, then no pay fixation will be done at the
time of regular promotion. Even if the pay level granted at the time of actual
promotion is higher than the pay level granted at the time of Modified
Assured Career Progression Scheme, no pay fixation but only fit-in will be
done at the stage corresponding to the pay level of promotion.
Example : In case of financial upgradation after 01.01.2016, after giving
one increment at the relevant stage fit-in will be done in the next
pay level. After getting financial upgradation, if a government
servant gets regular promotion in his hierarchy, his pay will be
only fit-in at the relevant stage in pay level-4. He will not be
given any additional increment at this stage.
(5)
Promotions earned/upgradations granted under the ACP Scheme in the past
to those grades which now carry the same grade pay due to merger of pay
scales/upgradations of posts recommended by the Pay Committee/
Commission shall be ignored for the purpose of granting upgradations
under Modified Assured Career Progression Scheme.
Example:-
(a) A Government servant who is appointed in the hierarchical post in the
pay scale of ₹5000-8000/- and did not get any promotion even after
25 years of service prior to 01.01.2006, in his/her case he/she would
have got two financial upgradations in the next grades in the
hierarchy of his/her cadre under Assured Career Progression Scheme,
viz. Rs.5500-9000/- and Pre-revised salary was Rs.6500-10500/-.
(b) Another Government servant appointed in the pay scale of Rs.5000-
8000/- of his cadre completed 25 years of service but during that
period he got two promotions in the next higher grades of Rs.5500-
9000/- and Rs.6500-10500/-.
(c) In both the cases (a) and (b) above, the promotion/financial
upgradation granted prior to 01.01.2006 in the pre-revised pay scales
of Rs.5500-9000/- and Rs.6500-10500/- under Assured Career
Progression Scheme shall be ignored in view of the merger of
Rs.5000-8000/-, Rs.5500-9000/- and Rs.6500-10500/- in the pre-
revised pay scales recommended by the Pay Committee. Both of them
will be granted Grade Pay of Rs.4200/- in Pay Band-2 as per Finance
Department
Resolution
No.630
dated
21.01.2010
on
the
recommendation of the Pay Committee. On implementation of
Modified Assured Career Progression Scheme, two financial
upgradations of two higher grade pays of Rs.4600/- and Rs.4800/- in
Pay Band-2 will be provided in both the cases (a) & (b) above.
10
ǐबहार गजट (असाधारण), 28 जनवरȣ 2026
(6)
In the case of all employees who have been given financial upgradation
under the Assured Career progression Scheme up to 31.12.2005, their revised
pay shall be fixed with reference to the pay scale sanctioned to them under
the Assured Career Progression Scheme.
(i)
In case of upgradation granted under Assured Career Progression
Scheme between 01.01.2006 and 31.12.2008, the State Government
employee shall have the option under Finance Department Resolution
No. 630, dated 21.01.2010 to get his pay fixed under the revised pay
structure either (a) with reference to his pre-revised pay scale as on
01.01.2006 with effect from 01.01.2006 or (b) with effect from the
date of his financial upgradation under Assured Career progression
Scheme with reference to the pre-revised pay scale granted under
Assured Career progression Scheme. If option (b) is exercised, he shall
be entitled to receive his arrears of pay only from the date of his option
i.e., the date of financial upgradation under Assured Career
progression Scheme.
(ii)
In cases where financial upgradation had been granted to Government
servants in the next higher scale in the hierarchy of their cadre as per
the provisions of the ACP Scheme of 2003, but whereas as a result of
the implementation of Sixth CPC's recommendations, the next higher
post in the hierarchy of the cadre has been upgraded by granting a
higher grade pay, the pay of such employees in the revised pay
structure will be fixed with reference to the higher grade pay granted
to the post. However, from the date of implementation of the MACPS,
all the financial upgradations under the Scheme should be done strictly
in accordance with the recomendation of the pay Commission and in
the hierarchy of grade pays in pay bands as notified vide Resolution of
2010.
(7)
With regard to fixation of his pay on grant of promotion/financial
upgradation under MACP Scheme, a Government servant has an option
under FR22 (1) (a) to get his pay fixed in the higher post/grade pay either
from the date of his promotion/upgradation or from the date of his next
increment. The pay and the date of increment would be fixed in accordance
with the provisions of the resolution regarding pay revision.
(8) (i) Promotions earned in the post carrying same grade pay in the promotional
hierarchy as per Recruitment Rules shall be counted for the purpose of
Modified Assured Career Progression Scheme.
(ii) Consequent upon the implementation of Pay Commitee recommendations,
grade pay of Rs. 5400 is now in two pay bands viz., PB-2 and PB-3. The
grade pay of Rs. 5400 in PB-2 and Rs.5400 in PB-3 shall be treated as
separate grade pays for the purpose of grant of upgradations under Modified
Assured Career Progression Scheme. i.e. in-situ upgradation from PB-
2+4800/- or PB-2+5400/- to PB-3+5400/- after four years of regular and
confirmed service shall be treated as a financial upgradation.
(9)
'Regular service' for the purpose of the Modified Assured Career
Progression Scheme shall commence from the date of joining to a post in
direct entry grade on a regular basis either on direct recruitment basis or on
absorption/re-employment basis. Service rendered on ad-hoc basis before
regular appointment shall be counted for the purpose of granting MACP.
11
ǐबहार गजट (असाधारण), 28 जनवरȣ 2026
Service rendered under contractual employment shall not be counted for the
purpose of financial upgradation. However, past continuous regular service
in another Government Department in a post carrying same grade pay prior
to regular appointment in a new Department, without a break, shall also be
counted towards qualifying regular service for the purposes of Modified
Assured Career Progression Scheme only (and not for the regular
promotions). However, benefits under the Modified Assured Career
Progression Scheme in such cases shall not be considered till the satisfactory
completion of the probation period in the new post.
(10)
The Service, Prior to appointment under the State Government, of
teachers of Rajkiyakrit school and the past Service rendered by a
Government employee in fully or partially funded autonomus institution or
public sector undertaking shall not be counted as regular service.
(11)
'Regular service' shall include all periods spent on deputation/foreign service,
study leave and all other kind of leave, duly sanctioned by the competent
authority.
(12)
The Modified Assured Career Progression Scheme shall also be applicable to
work charged employees, if their service conditions are comparable with the
employee of regular establishment.
(13)
The Modified Assured Career Progression Scheme shall only be applicable to
the employees of the State Government. It shall not be applicable to the
employees of autonomous institutions or public undertakings fully or
partially funded by the State Government and are under the administrative
control of any Department.
(14)
If the employee is not eligible or due to departmental proceedings, etc the
benefit under Modified Assured Career Progression Scheme is kept in
abeyance/delayed and is not granted in any grade pay after 10 years, the
consequential effect will be on the subsequent financial upgradation also and
the same will also get deferred/delayed to that extent.
(15)
On grant of financial upgradation under the Scheme, there shall be no change
in the designation, classification or higher status. However, financial and
certain other benefits which are linked to the pay drawn by an employee such
as House Building Advance, allotment of Government accommodation shall
be permitted.
(16)
Those State employees who do not get promotion despite possessing all the
qualifications/requirements for promotion may be given the benefit of
modified assured career promotion. For this, the requisites and method for
sanctioning financial progression under the Modified Assured Career
progression Rules will be the same as prescribed for regular promotion
against vacancies in the Recruitment/Service Rules. If passing a departmental
examination or any other qualification is prescribed for any promotion, then
it will be a mandatory condition for sanctioning benefits under these rules if
those conditions have been prescribed under the rules/circulars/resolutions.
(17)
Grant of benefits under the Modified Assured Career progression Scheme in
cases of disciplinary/departmental proceedings shall be subject to the rules
regulating normal promotions.
(18)
Under the Modified Assured Career Progression Scheme, only financial
upgradation in the immediate higher Grade Pay/Pay Level is to be provided
on Personal basis only, and shall not amount to actual/functional promotion
12

of the employee concerned. Therefore, no reservation order/roster shall apply
to the Modified Assured Career Progression Scheme and its benefit will be
equally available to all eligible SC/ST employees. However rules of
reservation in Promotion shall be ensured at the time of Regular promotion.
(19)
Financial upgradation under Modified Assured Career Progression Scheme
shall be purely personal for the particular employee and will not have any
effect on his seniority. Hence the senior employees will not get additional
financial upgradation on the ground that the junior employee in that grade
pay/pay level has got higher pay/grade pay/pay level under Modified
Assured Career Progression Scheme.
(20)
Pay drawn in the Pay level/pay band and the grade pay allowed under the
Modified Assured Career Progression Scheme shall be taken as the basis for
determining the terminal benefits in respect of the retiring employee.
(21)
If Group "A" Government employee, who was not covered under the ACP
Scheme has now become entitled to third financial upgradation directly,
having completed 30 year's regular service, his pay shall be fixed
successively in next three immediate higher grade pays in the hierarchy of
revised Pay level/pay-bands and grade pays allowing the benefit of 3% pay
fixation at every stage. Pay of persons becoming eligible for second financial
upgradation may also be fixed accordingly.
(22)
In case an employee is declared surplus in an organisation and appointed in
the same pay-scale or lower scale of pay in the new organization, the regular
service rendered in the previous organisation shall be counted as regular
service in the new organisation for the purpose of giving financial
upgradation under the Modified Assured Career Progression Scheme.
(23)
In case of an employee after getting promotion/assured career progression
seeks unilateral transfer to a lower post or lower pay scale, he shall be
entitled for second and third financial upgradation, only on completion of
20/30 years regular service under the modified Assured Career Progression
Scheme, as the case maybe, from the date of his initial appointment to the
post in the new organization.
(24)
If a regular promotion has been offered but was refused by the employee
before becoming entitled to a financial upgradation, no financial upgradation
shall be allowed because the employee has not stagnated due to lack of
opportunities. If, however, financial upgradation has been allowed due to
stagnation and the employee subsequently refuses the promotion, it shall not
be a ground to withdraw the financial upgradation. He shall, however, not be
eligible to be considered for further financial upgradation till he agrees to be
considered for promotion again and the second and subsequent financial
upgradation shall also be deferred to the extent of period of debarment due to
the refusal.
(25)
Cases of persons holding higher posts purely on adhoc basis shall also be
considered by the Screening Committee alongwith others. They may be
allowed the benefit of financial upgradation on reversion to the lower post or
if it is beneficial vis-a-vis the pay drawn on adhoc basis.
(26)
Employees on deputation need not revert to the parent Department for
availing the benefit of financial upgradation under the Modified Assured
Career Progression Scheme. They may exercise a fresh option to draw the
pay in the pay level/pay band and the grade pay of the post held by them or
13
ǐबहार गजट (असाधारण), 28 जनवरȣ 2026
the pay plus grade pay admissible to them under the Modified Assured
Career Progression Scheme, whichever is beneficial.
(27)
In cource of application of above mentioned provisions following example
should be reffered :-
(a) (1) Where a Government servant (LDC) in Pay Band-1, Grade Pay
Rs.1900/-,/Pay Level-2 gets his first regular promotion to Pay
Band-1, Grade Pay Rs.2400/-,/Pay Level-4 (UDC) after completing
8 years of service and thereafter continues to remain in the same
grade pay for further 10 years without any promotion, he shall be
eligible for second financial upgradation to Pay Band-1, Grade Pay
Rs.2800/Pay Level-5 under Modified Assured Career Progression
Scheme after completing 18 years (8+10 years) of service.
(2)
If he does not receive any promotion thereafter, he would get 3rd
financial upgradation in Pay Band-2 Grade Pay Rs.4200/Pay Level-
6 on completion of further 10 years of service i.e. 28 years
(8+10+10) of service.
(3)
However, if he gets second promotion in Pay Band-2 Grade Pay
Rs.4200/- after further five years of service i.e. on completion of 23
years (8+10+5) of service, he would get third financial upgradation
in Pay Band-2 Grade Pay Rs.4600/ Pay Level-7 after completion of
30 years of service i.e. after 10 years of second assured career
progression.
In the above scenario, his pay will be increased by giving 3%
of the sum of pay band and grade pay received before such
upgradation. But if regular promotion takes place in the same grade
pay or higher grade pay, then no re-fixation of pay will be done at
that time.
(b)
If a Government servant (LDC) in Pay Band-1, Grade Pay Rs.1900/
Pay Level-2 is granted first financial upgradation under Modified
Assured Career Progression Scheme after completing 10 years of
service in Pay Band-1, Grade Pay Rs.2000/- (in Pay Level-3) and
after 5 years he gets first regular promotion (UDC) in Pay Band-
1+Grade Pay Rs.2400/- (in Pay Level-4), then under the Modified
Assured Career Progression Scheme, on completion of 20 years of
service, he will be granted second financial upgradation to the next
higher grade pay i.e. above the grade pay held by the Government
servant to Grade Pay Rs.2800/- (in Pay Level-5). On completion of
30 years of service, he will get third Assured Career Progression to
Grade Pay Rs.4200/- (in Pay Level-6). But if he gets two
promotions before completing 20 years of service, then third
financial upgradation will be admissible on completion of 10 years
of service in that grade pay from the date of second promotion or in
the 30th year of service, whichever is earlier. If a Government
servant has been given two regular promotions or second financial
upgradation under the Assured Career Progression Scheme of
August, 1999 after completing 24 years of regular service, then he
shall be eligible for only third financial upgradation under the
Modified Assured Career Progression Scheme after completing 30
years of service or from 01.01.2009, whichever is later, provided he
14

has not got third promotion in his hierarchy.
(28)
This scheme has been made by superseding the earlier ACP Rules with all its
amendments and clarifications. ACP Rules, 2003 Stands repealed with effect
from 13.07.2010. Hence, financial upgradation under its provisions will be
applicable only till 12.07.2010.
5.
Removal of doubts.—If any doubt arises regarding the interpretation of any provision
of this Scheme, the matter shall be referred to the Government in the Finance
Department, and its decision shall be final.
6.
Overriding effect of this scheme.—Notwithstanding any provision contrary to this
scheme in any other rules, the provisions of this scheme shall have overriding effect.
