Notification

The 6^th May 2026

No.- Pra-II/Avaidh Khanan-30/2022-2961/M—In exercise of the powers conferred by

section 15 read with section 23C of the Mines and Minerals (Development and Regulation) Act,

1957, the Governor of Bihar hereby makes the following rules further to amend the Bihar Minerals

(Concession, Prevention of Illegal Mining, Transportation and Storage) Rules, 2019 :-

Short title, extent and commencement:-

(1) These rules shall be called the Bihar Minerals (Concession, Prevention of

Illegal Mining, Transportation and Storage) (Amendment) Rules, 2026.

(2) It shall extend to the whole of the State of Bihar.

(3) It shall come into force from the date of its publication in the Gazette.

A new clause (viii)(a) shall be added after clause (viii) in sub rule 2(1) as

follows.—

(viii)(a) "Director of Exploration" means the Director of Exploration appointed

as such by the State Government;

A new clause (xix)(a) shall be added after clause (xix) in sub rule 2(1)as follows:

(xix)(a) ''Geologist'' means an officer appointed by the Government to perform the

duties of Geologist for the purpose of these rules;

The following Rule 4(A) shall be added after Rule 4 as follows :

4(A) Appointment of Director Exploration.—The State Government may, by

notification, appoint a Director Exploration who shall be responsible for

Exploration of mineral resources in the State.

The following Rule 8(A) shall be added after Rule 8 as follows :

8(A) Power and Function of Director Exploration.—

(1) He shall head the Directorate of Exploration and shall exercise

administrative control over all the Geologist of the Department.

(2) He shall be responsible for coordination with central and private

exploration agencies, and scrutiny, examination and detailed analysis

of exploration reports submitted by various exploration agencies

including assessment of inputs, findings, recommendations, and all

others related works pertaining to mineral exploration activities.

(3) He shall be responsible for exploration, identification and preparation

of feasible mining blocks and for submission of the same to the

department.

The following Rule 9(A) shall be added after Rule 9 as follows .—

9(A) Duties of Geologist:-

(1) It shall be the duty of the Geologist to conduct Reconnaissance Survey,

Geological Mapping, Geophysical & Geochemical Survey, Drilling & Sub-

surface Exploration, Resource Estimation and Feasibility & Report

Preparation in accordance with the provisions of applicable rules.

(2) The Geologist referred shall-

(a) be responsible for periodic updating of minerals resources,

maintenance of bore cores or samples and bore hole logs;

(b) plan for conservation of mineral resources and optimal utilisation of

the minerals and ores in the mining leases;

operation as per the scheme;

(d) prepare the necessary geological maps, plans and sections which are

required to delineate the ore body;

(e) carry out petrological and mineralogical studies of host rock and

mineralized zones;

(f) calculate ore reserves and its grade;

(g) work out the appropriate method of sampling and ensure preparation of

samples accordingly;

(h) carry out all such orders and directions as may be specified from time

to time by the State Government

Rule 14 (a) shall be substituted as follows.—No Person shall acquire in the state

with respect to any minor mineral, more than two mineral concessions.

Provided that the area granted to any single concession holder shall not

exceed 200 (Two hundred) hectares.

Provided further that in case of settlement of sand, this limit shall be

applicable only to rivers mentioned in clause 5(i) of Bihar Sand Mining Policy,

2019. For other rivers the department shall be competent to decide maximum

number/ area of sand block, for each financial year once.

The following new sub Rule 17 (8) and 17 (9) shall be added after sub Rule

17(7) of the Rules .—

17 (8) Financial Assurance.—

(a) A Financial Assurance shall be furnished by the holder of the mineral

concession, for due and proper implementation of the mining plan

which includes progressive mine closure plan and final mine closure

plan, which shall be as follows:-

Provided that the minimum amount of Financial assurance

to be furnished under sub rule 8(a) shall be Rs. 5,00,000/- (Five Lakh

Rupees) for mineral sand and Rs. 30,00,000/- (Thirty Lakh Rupees)

for stone mineral.

(b) The financial assurance shall be submitted in the form of fixed deposit

receipt or bank guarantee from any nationalized bank or scheduled

bank, duly pledged in favour of the Collector/Department/Authorized

Officer by Department.

(c) The financial assurance shall be submitted to the Collector/

Department/ Authorized Officer prior to execution of the lease deed

or sanction of licence concerned. In existing mines, lessee or licensee

shall submit the same within three months from the date of

commencement of these rules. Where lessee or licensee does not

submit financial assurance within aforesaid time, a simple interest at

the rate of 24 percent per annum shall be charged for such delay and

mining activity of lease shall be stopped after two month of such

delay. If amount of financial assurance is not deposited by the lease

holder or settlement holder, then this amount along with interest shall

be realized from security deposit at the end of lease period. No claim

of compensation will be entertained in future in this context.

(d) The financial assurance shall be released on an application submitted

by the lessee or licensee subject to condition that he has satisfactorily

complied with the provisions of the closure plan and the same shall be

verified by the officer authorized by Collector/Department concerned.

17 (9) Reclamation, Relief and Rehabilitation.—

(a)

Where the officer authorized by Collector/Department has

reasonable ground to believe that the protective, reclamation and

rehabilitation measures as envisaged in the mine closure plan in

respect of which financial assurance was given has not been carried

out in accordance with the mine closure plan, either fully or

partially, the Collector/authorised officer shall forfeit the amount of

financial assurance along with interest accrued thereon and same

shall be deposited in District Mineral Foundation Trust.

Provided that no such action shall be taken without giving

an opportunity of being heard to lessee or licensee concerned.

(b) Working in mining lease, quarry, licence or short term permit shall

be carried out by formation of benches. Such benches in mineral

and overburden including weathered mineral shall be formed

separately and the benches in overburden or weathered mineral shall

be kept sufficiently in advance so that their working does not

interfere with the working of mineral.

(c)

In order to ensure optimum production with minimum waste

generation, every lease holder or licensee or short term permit

holder shall endeavour to deploy machinery and equipment as per

mining plan or mining scheme.

(d) The non-saleable mineral at quarry or mine bottom shall be

regularly collected and transported to the surface and stacked

separately. The quarry or mine floor shall be kept reasonably clear

from debris. Small lumps of mineral shall, as far as possible, be

segregated from the dumps and stacked separately for future use.

(e)

The ground selected for dumping of top soil, overburden, waste

material or non-saleable mineral shall be away from workings of

quarry or mine. Before starting mining or quarrying operations,

conceptual ultimate limits of the quarry or mine shall be determined

and dumping ground shall be so selected that dumping is not carried

out within the limits of the ultimate size of the quarry or mine

except where simultaneous back filling is proposed.

9. The following clauses (viii) and (ix) shall be added in sub Rule 18 (2) .—

(viii) In case the application for Consent To Establish/Consent To Operate

(CTE//CTO) is not submitted to the competent authority within the stipulated

time after issuance of environmental clearance, a penalty of Rs. 1,00,000/- for

the first one week, Rs. 2,00,000/- for the next one week and 0.5% of the

highest bid amount for the next two weeks will be imposed on the settlee. In

case the imposed penalty is not deposited, the amount of penalty will be

deducted from the security deposit. Thereafter, if the application for CTE/CTO

is not submitted within next one week, the Collector shall be competent to

cancel the LOI after issuing a show cause notice to the settlee and the security

amount of settlee shall be forfeited.

(ix) Provided also that, if the Collector is satisfied at any time that the lessee is

deliberately or intentionally delaying the process of obtaining any

clearances/approvals at any stage, his security deposit shall be forfeited by the

Collector.

10. Sub Rule 22 (3) along with heading shall be substituted as follows.—

22 (3)- Mode of payment of Royalty/Settlement Amount.—

(a) The auction amount shall be considered to be the settlement amount for

the first year only. The settlement amount from 2nd year onwards shall

be equivalent to 120% of the settlement amount of the preceding year.

(b) Other than security deposit, the lessee shall pay the settlement amount

as per the following time table/payment schedule.

At the time of payment of first instalment by the lessee in each concession year,

post-dated cheque for the amount of second and third instalments shall be deposited

before the concerned Collector/Mining Officer.

Provided that mining lease auctioned before the commencement of this rule

shall continue to deposit their bid amount in yearly basis in equal instalments and each

instalment shall be deposited 60 (sixty) days before the completion of one year from

the date of execution of the lease during the first year followed by the same procedure

in the consecutive years.

Provided further that, if the lessee fails to make payment of instalments as

prescribed in these rules, further generation of e-challan shall be suspended by the

Collector and shall be resumed only after payment of dues along with interest.

Provided also that notwithstanding repugnant in these Rules or otherwise the

lessee shall pay extra royalty for the quantity of mineral extracted and dispatched in

excess of the quantity equivalent to auction amount.

11. New Rules 26A and 26B shall be added after Rule 26 as follows.—

26A. Installation of Weighbridges and CCTVs.—Each mining lease may have an

electronic weigh-bridge, integrated with central server. Every lessee shall

mandatorily install CCTV at weighbridges and at any other place as may be

decided by department which shall be linked with department and every

lessee shall necessarily upkeep/restore backup of CCTV footage of last six

months and shall produce the same as and when required. Any lessee found

to be violating any of the conditions mentioned above shall be liable to be

penalised under these rules and any vehicle found carrying mineral without

proper weighment slip/ e-challan shall be liable to be seized under the

provisions of the Mines and Minerals (Development and Regulation) Act,

1957 or the rules made there under.

26B. Penalty on lessee in case of breach of terms.—

(1)

In case of not installing sign board, not demarcating boundary pillar

with Geo Co-ordinates, not upkeeping backup of CCTV footage and in

case of other violations mentioned in the table, following penalty shall

be imposed by the collector against the lessee for first time violation.-

(2) Transportation of minor minerals shall be carried out only in covered

vehicles painted in a specific colour. In case minor mineral is

transported uncovered or without being specifically coloured or

tampering/switching off the GPS device, following penalties may be

Note :- For violations mentioned in serial no.- 1 and 3, penalty shall

be imposed on owner of the vehicles and for serial no.- 2

penalty shall be imposed on lessee by the Mining Officer.

(3)

In case the lessee encourages illegal transportation of minerals (In case

of loading more quantity than the valid challan), penalty of Rs.

5,00,000/- (Rs. Five lakh) (on each vehicle) shall be imposed by

Collector/Mining Officer for the first time violation.

(4)

In case of violations of sub rules (1),(2) and (3), if the penalties are not

deposited within one month or violations are not rectified or whenever

lessee is found to be indulged in such violation for more than once, the

mining lease may be suspended for a maximum period of 03 months.

Thereafter, if the violation is not rectified or the penalty is not

deposited, action for cancellation of mining lease shall be taken by the

Collector after giving reasonable opportunity of being heard.

(5) (i) For mining, within the restricted area, penalties shall be imposed

under Section 21 (1) of the Mines and Minerals (Development

and Regulation) Act and without prejudice to any other action that

may be taken, the mining lease shall also be liable to cancellation.

(ii) For mining outside the mining lease area or mining more than the

permissible depth in the mining lease area, the quantity of

excavated mineral shall be assessed and the cost of mineral as

defined in Rule 56 along with penalties shall be recovered by the

Collector and without prejudice to any other action that may be

taken, the mining lease shall also be liable to cancellation.

(6) For any action taken under sub rule (4) and (5), the lessee shall not be

eligible for any compensation or extension of lease period whatsoever.

(7) Whoever contravenes the provision of sub rule 30 (1), (2),(3) & (5) and

refuses to make payment shall be punished by the competent Court

with imprisonment for a term which may extend upto two years.

(8) It shall be the duty of lessee to intimate the Collector or District

Mining Officer regarding any illegal mining within a radius of 500

meter of the lease area. If the lessee fails to inform the Collector or

District Mining Officer about such illegal mining in writing, then in the

event of such illegal activity being found, the lessee shall be liable for

action under rule 56 and rule 47 of the Rules, as if such illegal activity

were carried out by him, besides any other legal action taken under the

rules.

12. Sub Rule 28(5) and 28(6) shall be added after sub Rule 28(4) as follows .—

28(5)- Lessee/Concession holder shall not be allowed to remove any extracted/

blasted/produced/crushed material or any other mineral which includes any

mineral material, under any circumstances, from lease area after the expiry or

determination of the lease or cessation by any other manner.

28(6)- Notwithstanding anything contained in these rules, provisions of sub rule 28

(1) (to the extent of revocation and forfeiture) and sub rule 28 (2), (3), (4) and

(5) shall be applicable to all minor minerals.

13. A new clause 29(A) (4) (iii) shall be added after sub clause 29(A) (4) (ii) as

follows.—

(iii) In case of surrendered sand ghat, minimum reserve value shall be fixed as

equivalent to the auction amount for the initial settlement year of previous

concession holder.

Provided that Department may, on the recommendation of Collector

and report of Departmental technical committee revise the minimum reserve

value where it seems to be necessary in the public interest and systematic

development of mineral deposits in accordance with the clause (ii) of above

sub rule.

Provided further that surrendered sand ghat shall only be re-settled for

the remaining period of the previous concession.

14. In the Rule 29A (5) for the words "his security deposit shall be forfeited", the words

"his Earnest Money Deposit (EMD) shall be forfeited" shall be substituted.

15. A new proviso shall be added in Rule 29B (3) .—

Provided that, if the settlee fails to make payment of instalments as prescribed

in these rules, further generation of e-challan shall be suspended by the Collector and

shall be resumed only after payment of dues along with interest.

16. Sub Rule 29 (B) (4) along with heading shall be substituted as follows.—

Default in Payment.—In case of default in payment of any instalment within

prescribed date, a simple interest at the rate of 24 percent per annum shall be

charged up to two months and after that action for cancellation of mining

lease shall be initiated.

17. Rule 29 F along with heading shall be substituted as follows .—

29F. Installation of Weighbridges and CCTVs- Each sandghats may have an

electronic weigh-bridge, integrated with central server, However for adjacent

sandghats, department may allow use of common weighbridge. Every

concession holder shall mandatorily install CCTV at weighbridges and at any

other place as may be decided by department which shall be linked with

department and every concession holder shall necessarily upkeep/restore

backup of CCTV footage of last six months and shall produce the same as and

when required. Any Mineral Concession holder found to be violating any of

the conditions mentioned above shall be liable to be penalised under these rules

and any vehicle found carrying sand without proper weighment slip/ e-challan

shall be liable to be seized under the provisions of the Mines and Minerals

(Development and Regulation) Act, 1957 or the rules made there under.

18. Rule 30 (1) shall be substituted as follows.—

(1) In case of not installing sign board, not demarcating boundary pillar with Geo

Co-ordinates, not upkeeping backup of CCTV footage and in case of other

violations mentioned in the table, following penalty shall be imposed by the

collector against the settlee-

19. A new "note" shall be added after Rule 30 (4) as follows.—

For violations mentioned in serial no.- 1, 2 and 4, penalty shall be imposed on owner

of the vehicles and for serial no.- 3 penalty shall be imposed on settlee by the Mining

Officer.

20. A new sub Rule 30(7) shall be added after sub Rule 30(6) as follows.—

It shall be the duty of settlee to intimate the Collector or District Mining Officer

regarding any illegal mining within a radius of 500 meter of the lease area. If the

settlee fails to inform the Collector or District Mining Officer about such illegal

mining in writing, then in the event of such illegal activity being found, the settlee

shall be liable for action under rule 56 and rule 47 of the Rules, as if such illegal

activity were carried out by him, besides any other legal action taken under the rules.

21. A new proviso shall be added in the rule 37(4) .—

Provided that the Collector after verification by the officials of

agriculture, water resources, revenue, disaster and any other department as he may

deem necessary, is satisfied that any minor mineral/sandy soil deposition has

occurred on the cultivable agricultural land of any person during the same year and

that, removal of such any minor mineral/sandy soil will restore the land to cultivable

condition, the Collector may relax/waive the provision of three kilometre distance

from the river bank and in such cases he may issue permit for disposal of the said

mineral if it does not obviates the necessity of obtaining a mining lease in the area in

respect of which the permit for extraction of any minor mineral/sandy soil has been

applied for. In such cases, all other conditions shall remain unchanged.

Further provided that the area granted under a single mineral disposal

permit shall not exceed 5 (Five) hectares.

22. In the clause (d) of sub Rule 39 (1), the words "Notwithstanding anything

mentioned elsewhere, any and" shall be added at the beginning.

23. A new proviso shall be added in sub Rule 39 (1) .—

Provided that the stockist licence obtained for medium businessmen

category and large businessmen category shall be renewed every year only on

payment of Rs. 10,000/- (Ten Thousand only) and Rs. 50,000/- (Fifty Thousand

only) respectively.

24. Rule 46 (2) shall be substituted as follow.—

Every Mineral Concession holder shall submit every month to the Competent Officer

and upload online on departmental portal developed for this purpose, a true and

correct return for minerals in Form 'I' by the fifteenth day of the following month to

which it relates.

25. Rule 50 shall be substituted as follows.—

50- Exit option for Mineral Concession Holder.—

(1) Notwithstanding anything contained in these rules, at any point after

completion of three consecutive annual mineral concession period,

Concession holder may opt to exit the business after giving Six months’

notice to the Collector, on which decision shall be communicated to the

Concession holder within four months of submission of application. The

Collector after considering merit of application and on his satisfaction,

may allow such Mineral Concession Holder to exit the business.

Provided that if Mineral Concession holder has not paid their

auction amount or settlement amount or has not submitted updated

security deposit or has violated any condition of settlement, then the Exit

application shall be rejected.

Provided further that when exit application is rejected, the

security deposit along with other payments made by Concession holder

shall be forfeited.

(2) In case of acceptance of exit application, the Mineral Concession Holder

may be exempted from any liabilities from future year payments and E-

challan generation shall be continued only for that particular period of

settlement (for which he has already paid his settlement amount) provided

all other conditions of settlement are met. As soon as exit application is

accepted, the Collector shall initiate arrangement for a fresh bidding, to

which settlee shall have no right to object.

(3) If exit application is rejected, then Mineral Concession Holder shall be

liable to pay all dues till end of full settlement period, even if the mineral

block is not operated. The dues shall be liable till such time as the block is

auctioned and fresh lease deed is executed or till the completion of

ongoing settlement period (whichever is earlier). In such cases, if

instalment amount along with all dues is not paid for next payment cycle

as prescribed under these rules, then E-challan generation shall be stopped

and shall be resumed only after full dues amount along with interest is

paid.

(4) In case of fraud or violation of mining or environmental conditions or any

other irregularities reported, no exit option will be available to the Mineral

Concession Holder. Even if, the offense or violation has been

compounded, concession holder will not be permitted to exit the

settlement.

(5) In case of surrender of Concession, no other new lease/concession shall be

granted to Mineral Concession Holder in any form till the period of

concession for which the surrendered lease was granted and also till such

time as all dues are recovered. This debarment shall also apply to all other

legal entities (Company/Firm/Trust/Partnership etc.) of which the mineral

concession holder is Director/ Proprietor/ Trustee/Partner.

26. A new clause 51(1) (d) shall be added after sub clause 51(1) (c) as follows:-

Clause 51(1) (d): Environment Management Cess and Management fee.—

(i)

Every holder of a mining lease or a prospecting licence cum mining lease or

permit holder or any other concession, shall, in addition to the royalty and

other taxes, shall pay an amount equal to 1% of annual auction/settlement

amount/compounded royalty/royalty or at the rate as may be notified by the

state government from time to time towards Environment Management Cess

and Management fee. This rate shall be calculated against annual

auction/settlement amount in case of all settlement, compounded royalty as

per category fixed in case of brick earth/royalty payable by permit holder.

Existing lease holder/permit holder/mineral concession holder shall also be

liable to pay such fee.

(ii) The amount collected towards this head shall be utilised to maintain and

strengthen the existing software and applications managed by department

and in prevention of illegal mining, transportation and storage and/or for

environment protection and/or for such purpose as may be notified by the

Department of Mines and Geology, Government of Bihar from time to time.

(iii) For default in payment till prescribed date, simple interest at the rate 24

percent per annum shall be charged from the mineral concession holder.

(iv) The above provisions shall be deemed to be effective from the date as

notified by the Department.

Provided that if any difficulty arises in giving effect to the

provisions of above rules then the Department of Mines & Geology may

make such provisions as it may deem fit, necessary or expedient for

removing the difficulty.

27. Clause (ii) of sub rule 56 (1) shall be substituted as follows.—

No person shall transport or store any mineral without a valid challan and/or transit

pass specified under rule 41 of these Rules. Also, minerals will not be transported by

unrealistic, unregistered and non-commercial vehicles.

28. In the clause (iv) of sub Rule 56 (2), the word ", etc." shall be added after word

group "tax payable for acquiring land without legal rights".

29. A new proviso shall be added in clause (vi) of sub Rule 56 (2) as follows.—

Provided that, for ascertaining the quantity of mineral in vehicles, where quantity

of mineral is mentioned in only volume terms on challan, the volumetric

estimation/assessment of quantity may be done by standard measurement tape.

However, quantity of mineral shall be assessed only by means of weighbridge if the

quantity of mineral mentioned in challan is in volume and/or weight.

30. Clause (iv) for Sub rule 56 (7) shall be substituted by the following.—

All confiscated tools, arms, boats, vehicles, ropes, chains or other articles

including minerals would be auctioned as per government rules.

31. After sub Rule 67 (3), the following new sub Rule 67 (4) shall be added as

follows.—

67 (4)- Any appeal filed under these rules shall be accompanied with a fee of Rs.

10,000/- to be deposited under the head of Department.

Provided that in case of appeal filed against the seizure/confiscation or any

other matter related to tractors, fee for appeal shall be Rs. 5,000/- only.

32. A new proviso shall be added after sub rule 67 (4) .—

Provided that an application for appeal may be entertained even after the time

specified in sub rule 1 and 2, if the applicant satisfies the appellate authority that he

had sufficient cause for not making the application within time.

33. After sub Rule 68 (4), the following new sub Rule 68 (5) shall be added as

follows.—

68 (5)- Any revision filed under these rules shall be accompanied with a fee of

Rs. 10,000/- to be deposited under the head of Department.

Provided that in case of revision filed against the seizure/confiscation or any

other matter related to tractors, fee for revision shall be Rs. 5,000/- only.

34. Rule 84 shall be substituted by the following :

84- Power to issue directions :-

(1) The Department may, in the interest of systematic development of mineral

deposits, conservation of minerals, scientific mining, sustainable

development and protection of the environment or towards proper

implementation of these rules, issue direction to the owner, agent, manager

or holder of the mining lease/settlement/any licence/permit.

(2) Every direction issued under sub-rule (1) shall be complied by the owner,

agent, manager or holder of the mining lease/settlement/any licence/permit

as the case may be, who in case of any difficulty in giving effect to any

such direction, may apply for modification or rescinding of such direction

and the officer so authorized by the Department in this regard, may either

modify or rescind the direction or confirm the same.

35. A new proviso shall be added in Rule 89 as follows.—

Provided that in the event of any conflict, inconsistency, or discrepancy

between the English version and the Hindi version of these Rules, the English version

shall govern and prevail.

36. Paragraph 7 of Part VII- THE CONVENANTS OF THE LESSEE/ LESSEES of

form B shall be substituted as follows.—

Part VII ) THE CONVENANTS OF THE LESSEE/ LESSEE paragraph 7.—

To allow inspection of workings.—The lessee/lessees shall allow any officer

authorized by the Central Government or the State Government in that behalf to enter

upon the premises including any building, excavation or land comprised in the lease

for the purpose of inspecting, examining, surveying, prospecting and making plans

thereof sampling and collecting any data and the lessee/lessees shall with proper

person employed by the lessee/lessees and acquainted with the mines and work

effectually assist such officer, agents, servants and workmen in conducting every such

inspection and shall afford them all facilities, information connected with the working

of the mines which they may reasonably require and also shall and will conform to

and observe all orders and regulations which the Central and State Governments as the

result of such inspection or otherwise may, from time to time, see fit to impose. If the

lessee or his representative intentionally or deliberately refuses to cooperate or does

not assist during inspection/search/ seizure by the officer authorised in this behalf,

then during the course of such inspection/search/seizure, audio-video recording shall

be considered to be a part of inspection report. Even if inspection report is ex-parte,

findings/observations as contained in inspection report shall be binding to the lessee

and no future relief can be sought by the lessee on this ground.

37. Paragraph 6 of Part IX- General Provision of form B along with heading shall be

substituted as follows :

Lessee to remove his machinery etc on the expiry of lease.—The lessee having first

paid and discharged the rents, royalties and any other dues/sum payable by virtue of

these presents may at the expiration or sooner determination of the said term or within

three calendar months thereafter take down and remove for his own benefit all or any

machinery, plant, building, and other works, erections and conveniences which may

have been erected, set up on placed by the lessee in or upon the said lands and which

the lessee is/are not bound to deliver to the Collector under clause 18 part VII of this

schedule and which the Collector shall not desire to purchase.

Provided that, If the machinery, plant, building, and other works, erections and

conveniences which has been erected, set up or placed by the lessee are not removed

within specified time period then it shall be deemed to become Government property.

Provided further that under any circumstances, Lessee shall not be allowed to

remove any extracted/blasted/produced/crushed material or any other mineral which

includes any mineral material, from lease area after the expiry or determination of the

lease or cessation by any other manner.

38. Column 2 & 3 of Sl. No. 1,2,3, 4 & 16 of Existing schedule IIIA and whole of

Schedule IIIB shall be substituted by the following, namely:-

Entry into force :- 1.

The Revised rate of royalty of Sl. No.- 1 and 16 of schedule- III-A shall be

deemed to be effective from such date as the State Government may, by

notification in the official gazette, appoint.

The Revised rate of royalty of brick earth (Sl. No.- 3 of schedule- IIIA)

and consequently schedule- III B shall be deemed to be effective from

brick session 2026-27 i.e. from 1st October 2026 until revised or

modified further.
