सं. 100/ǐबहार-ǐव.प./02/2026-एम.एल.ए. (1)- यतः, ǐबहार राÏय कȧ ǐवधान सभा के
सदèयɉ Ʈारा ǐवधान पǐरषद के िलए िनवा[िचत Įी नीतीश कुमार का èथान उनकȧ पदाविध, जो
ǐक 06.05.2030 सǐहत उस तारȣख तक थी, के समाƯ होने से पूव[ × याग-पğ देने के कारण
30.03.2026 से ǐरƠ हो गया है; और
यतः, इस Ĥकार हुई ǐरǐƠ को भरने के Ĥयोजन से एक उप िनवा[चन आयोिजत ǐकया
जाना है;
अतः, अब, लोक Ĥितिनिध×व अिधिनयम, 1951 (1951 का 43) कȧ धारा 151, धारा 39
कȧ उपधारा (1) और धारा 56 के अनुसरण मɅ, िनवा[चन आयोग एतÙƮाराः-
(अ) ǐबहार राÏय के ǐवधान सभा सदèयɉ से यह अपे¢ा करता है ǐक वे 20 जून, 2026
(शिनवार) से पूव[ तथा उƠ अिधिनयम और तƨीन बनाए गए िनयमɉ और उनके तहत
जारȣ ǐकए गए आदेशɉ के उपबÛधɉ के अनुसार राÏय कȧ ǐवधान पǐरषद मɅ उƠ ǐरǐƠ
को भरने के Ĥयोजन से एक åयǐƠ िनवा[िचत कर दɅ;
(आ) उƠ िनवा[चन के संबंध मɅ:-
(क)
नाम िनदȶिशत करने कȧ अिÛतम तारȣख
– 08 जून, 2026 (सोमवार);
(ख)
नाम िनदȶशन कȧ संवी¢ा कȧ तारȣख
– 09 जून, 2026 (मंगलवार);
(ग)
अßयिथ[ताएं वापस लेने कȧ अिÛतम
तारȣख
– 11 जून, 2026 (गुǽवार);
(घ)
वहतारȣखिजसकोयǐदआवæयकहुआ
तो मतदान होगा
– 18 जून, 2026 (गुǽवार); और
(ड.) वह तारȣख िजससे पूव[ िनवा[चन सàपÛन
करा िलया जाएगा

No.100/BR-LC/02/2026-MLA (1): - Whereas, the seat of Shri Nitish Kumar in the
Legislative Council of the State of Bihar, elected by the members of the Legislative
Assembly of the State, has become vacant on 30.03.2026 by the reason of his resignation,
before the expiration of his term of office which was up to and including 06.05.2030; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so
caused;
NOW, THEREFORE, in pursuance of Section 151, sub-section (1) of Section 39 and
Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election
Commission hereby-
(A)
calls upon the members of the Legislative Assembly of the State of Bihar to
elect, before 20th June, 2026 (Saturday), and in accordance with the
provisions of the said Act and of the rules and orders made thereunder, a
person for the purpose of filling the said vacancy in the Legislative Council
of the State;
(B) appoints with respect to said election, -
(a) the 8th June, 2026 (Monday), as the last date for making nominations;
(b) the 9th June, 2026 (Tuesday), as the date for the scrutiny of the
nominations;
(c) the 11th June, 2026 (Thursday), as the last date for the withdrawal of
candidatures;
(d) the 18th June, 2026 (Thursday), as the date on which a poll shall, if
necessary, be taken; and
(e) the 20th June, 2026 (Saturday), as the date before which the election
shall be completed; and
(C) fixes the hours from 09:00 am to 04:00 pm, as the hours during which the
poll shall, if necessary, be taken on the date specified above, for the election.

No.100/BR-LC/02/2026-MLA (2): - In pursuance of Section 21, and in exercise of
the powers conferred by sub-section (1) of Section 22 of the Representation of the People
Act, 1951 (43 of 1951), the Election Commission, in consultation with the Government of
the State of Bihar, hereby: -

designates the officer, specified in column (1) of the TABLE below, to be the
Returning Officer, and
(ii)
appoints the officer, specified in column (2) of the said TABLE, to be the
