BIHAR SMALL AND MEDIUM HEALTHCARE ESTABLISHMENT
(ESTABLISHMENT AND REGISTRATION) REGULATION 2026
No.-18/ Vividh-18/2025/555 (18) Health—In exercise of the powers conferred by
proviso to Article- 162 of the Constitution of India, the Governor of Bihar is pleased to
make the following regulation for regulating the establishment and registration of Small and
Medium Healthcare establishments.
CHAPTER –I
PRELIMINARY
1. Short title, extent and commencement —
(1) This regulation shall be called Bihar Small and Medium Healthcare
Establishment (Establishment and Registration) Regulation 2026.
(2) This shall extend to the whole state of Bihar and shall be applicable to all
the Small and Medium Health care Establishment in the state of Bihar.
(3) This shall come into force from the date of publication in Bihar Gazette.
(4) This Regulation shall not be a part of The Clinical Establishments
(Registration and Regulation) Act, 2010 of Government of India or Bihar
Clinical Establishments (Registration and Regulation) Rules, 2013.
2. Definitions – Unless there in anything repugnant to the Subject or Context, in these
Regulations-
(a) "Authority" means the district registering authority set-up under provision 4
of this Regulation.
(b) "Certificate of provisional registration" means certificate of provisional
registration issued under provision 9 of this Regulation.
(c) " Certificate of permanent registration" means certificate of permanent
registration issued under provision 22 of this Regulation.
(d)
"Healthcare
Establishment
or
Small
and
Medium
Healthcare
Establishment" means- a hospital, maternity home, nursing home,
sanatorium of 1-40 bed/s capacity with or without Day-care medical
Services/OPD Clinics/ Dispensary/Dental Clinics/ Diagnostic Services, by
whatever name called that offers services, facilities requiring diagnosis,
treatment or care for illness, injury, deformity, abnormality or pregnancy
in any recognized system of medicine, established and administered or
maintained by any person or body of persons, whether incorporated or not;
or
(ii) a place established as an independent entity or part of an establishment
referred to in sub-provision (i), in connection with the diagnosis or
treatment of diseases where pathological, bacteriological, genetic,
radiological, chemical, biological investigations or other diagnostic or
investigative services with the aid of laboratory or other medical
equipment, are usually carried on, established and administered or
maintained by any person or body of persons, whether incorporated or not,
or,
(iii) standalone OPD Clinics/Dispensary/Dental Clinics established and
administered or maintained by any person or body of persons, whether
incorporated or not.
and shall include a small and medium healthcare establishment
owned, controlled or managed by—
(a) the Government or a department of the Government;
(b) a trust, whether public or private;

(c) a corporation (including a society) registered under a Central,
Provincial or State Act/Rule, whether or not owned by the
Government;
(d) a local authority; and
(e) a single doctor,
but does not include the small and medium healthcare establishments owned,
controlled or managed by the Armed Forces.
(e) “Recognized System of Medicine” means Allopathy, Yoga & Naturopathy,
Ayurveda, Homoeopathy, Siddha and Unani System of medicines or any
other system of medicine as may be recognized by the Central
Government from time to time.
(f) “Healthcare Practitioner”means a licensed professional authorized by a
state or national council to provide health services, such as diagnosis and
treatment and possess qualifications in recognized systems (e.g.,
Allopathy, Ayurveda, Homoeopathy) and are registered with relevant
government medical councils.
(g) “Register” means the register maintained by the authority, containing the
number of Small and Medium Healthcare establishments registeredunder
provision 27 of this Regulation.
(h) 'Registration' means to register under provision 5 of this regulation with
registering authority.
(i) “Regulation” means The Bihar Small and Medium Healthcare
Establishment (establishment and registration) regulation 2026
(j) 'Standards' means the conditions as set by Health Department, Bihar for the
registration of Small and Medium Healthcare establishments from time to
time.
(k) “State Government” means Government of Bihar.
(l) “Directorate” means Directorate of Health Services, Bihar.
(m) “Annexure”means the Annexures appended to this Regulation.
CHAPTER II
THE STATE COUNCIL AND DISTRICT REGISTERING AUTHORITY FOR
SMALL AND MEDIUM HEALTHCARE ESTABLISHMENT
3. State Council of Small and Medium Healthcare Establishment — (1) State
Government shall by notification constitute a State Council for Small and Medium
Healthcare Establishment.
(2) The State Council shall consist of the following members, namely: —
(a) Special Secretary/Additional Secretary, Health—ex officio
Chairman;
(b) Director-in- Chief (Administration), Directorate of Health Services—
ex officio member
(c) One AYUSH Medical Officer (nominated by Health Department) -
Member
(d) One Deputy Secretary Rank Officer (nominated by Health
Department) -
Member Secretary
(e) One representative of IMA – as Member
(3) The nominated member of the State Council shall hold office for a term of
three years, but shall not be eligible for re-nomination. The nomination of
Ayush Medical Officers shall be in a rotational manner across the various
disciplines of Ayush.

(4) The State Council shall perform the following functions, namely: —
(a) Compiling and updating the State Register of Small and
Medium Healthcare Establishment;
(b) Hearing of appeals against the orders of the authority; and
(c) Publication on annual basis a report on the state of implementation
of standards within State.
4. Authority for registration—(1) The State Government shall, by notification,
set-up an authority to be called the district registering authority for each district
for registration of Small and Medium Healthcare Establishment, with the
following members, namely: —
(a) Civil Surgeon-cum- Chief Medical Officer of respective district-
Chairperson;
(b) District Indigenous Medical Officerof respective district — member
(c) One representative of IMA – member
5. Registration for healthcare establishments— No person shall run a healthcare
establishment unless it has been duly registered in accordance with the
provisions of this Regulation.
6. Condition for registration—(1) For registration and continuation, every small and
medium healthcare establishment shall fulfil the following conditions, namely: —
(i) The minimum standards of facilities and services, minimum
requirement of personnel and provisions for maintenance of records
and reporting as may be prescribed by the Health Department,
Bihar by separate order,
(ii) Such other conditions as may be prescribed by Health Department, Bihar
by separate order.
(iii) Availability of at least one Healthcare Practitioner in concerned recognised
system of medicine during service hour of the healthcare establishment.
The name of Healthcare Practitioner on duty shall be displayed
prominently in such manner so as to be visible to everyone visiting such
establishment.
7. Classification of small and medium healthcare establishments — (1) Small and medium
healthcare establishment of different systems shall be classified into such categories, as
may be directed by the State Government, from time to time.
(2) Different standards may be prescribed for classification of different
categories referred to in sub-provision (1) above.
CHAPTER III
PROCEDURE FOR REGISTRATION
8. Application for provisional certificate of registration — (1) For the purpose of
registration an application in annexure 1 shall be made to the authority. The
application shall be accompanied with a fee of Rs. 500 and such details as is
prescribed in annexure 1.
(2) The application shall be submitted online.
(3) If any healthcare establishment is in existence at the time of the
commencement of this Regulation or before the start of online
registration service under this regulation, an application for its
provisional registration shall be made within three months from the
date of start of online registration service under this Regulation and
a new healthcare establishment which comes into existence after
commencement of online registration service under this Regulation,
shall get provisional registration prior to start of the healthcare
establishment.

(4) If any small and medium healthcare establishment is already registered
under the Bihar Clinical Establishments (Registration and Regulation)
Rules, 2013 shall be deemed registered under this regulation.
However, if any small and medium healthcare establishment is already
registered under any existing law, except Bihar Clinical Establishments
(Registration and Regulation) Rules, 2013, even then it shall apply for registration as
referred to in sub-provision (1) above.
9. Certificate of provisional registration —The authority shall, within a period of
fifteen days from the date of receipt of such application, grant to the applicant a
certificate of provisional registration in the format annexed as annexure 2. If the
provisional registration certificate shall not be granted by the authority with in
stipulated time period, the healthcare establishment shall be considered
provisionally registered.
10. No inquiry prior to provisional registration — The authority shall not conduct
any inquiry prior to the grant of provisional registration.
11. Validity of provisional registration — Every provisional registration shall be
valid for one year from the date of issue of the certificate of registration and
such registration shall be renewable for next two terms for one year each. It
shall be mandatory for the healthcare establishment to obtain permanent
registration certificate from the respective Authority within this stipulated period
of three years.
12. Display of certificate of registration —The certificate shall be kept affixed in a
conspicuous place in the healthcare establishment in such manner so as to be
visible to every one visiting such establishment.
13. Duplicate certificate — In case the certificate is lost, destroyed, mutilated or
damaged, the authority shall issue a duplicate certificate on the request of the
healthcare establishment and on the payment a fees of Rs.500.
14. Certificate to be non-transferable — (1) The certificate of registration shall be
non-transferable.
(2) In the event of change of ownership or management, the small and
medium healthcare establishment shall inform the authority, within
30 days of such change.
(3) In the event of change of category, or location, or on ceasing to
function as a small and medium healthcare establishment, the
certificate of registration in respect of such small and medium
healthcare establishment shall be surrendered to the authority and
the small and medium healthcare establishment shall apply afresh
for grant of certificate of registration.
15. Publication of expiry of registration — The authority shall publish the names
of small and medium healthcare establishments, by 31st December every
calendar year, whose registration has expired or suspended or cancelled.
16. Renewal of registration — The application for renewal of provisional
registration shall be made thirty days before the expiry of the validity of the
certificate of provisional registration along with a fee of Rs. 500 and in case the
application for renewal is made after the expiry of the provisional registration,
the authority shall allow renewal of registration on payment of a fee of Rs. 500
and a late fee of Rs. 500.
17. Application
for
permanent
registration—Application for permanent
registration by a healthcare establishment shall be made to the authority in
prescribed form annexed as annexure 1, and be accompanied by a fee of
Rs. 500.

18. Verification of application — The healthcare establishment shall submit
evidence of having complied with the prescribed minimum standards in such
manner, as may be prescribed by Health Department, Bihar.
19. Communication of objections — If any objections against any healthcare
establishment are received within 30 days of application, such objections shall
be communicated to the healthcare establishment for response within a period
of forty-five days failing which the application/registration may be liable for
rejection/ cancellation.
20. Standards for permanent registration — Permanent registration shall be
granted only when a small and medium healthcare establishment fulfils the
standards for registration as may be prescribed by Health Department, Bihar.
21. Allowing or disallowing of registration — The authority shall pass an order
immediately after the expiry of the prescribed period and within the next thirty
days thereafter either—
(a) allowing the application for permanent registration; or
(b) disallowing the application:
Provided that the authority shall give the institution a reasonable
opportunity of being heard prior to rejecting the application. The rejection shall
be effected by passing a reasoned order.
22. Certificate of permanent registration — (1) The authority shall, if it, allows an
application for registration of the small and medium healthcare establishment,
issue a certificate of permanent registration in prescribed form, annexed as
annexure 2.
(2) The certificate shall be permanent in nature unless suspended or
cancelled by the issuing authority.
23. Fresh application for permanent registration — The disallowing of an
application for permanent registration shall not debar a small and medium
healthcare establishment from applying afresh for permanent registration after
providing such evidence, as may be required, of having rectified the
deficiencies on which grounds the earlier application was disallowed.
24. Cancellation of registration — (1) If, at any time after any healthcare
establishment has been registered, the authority is satisfied that, —
(a) the conditions of the registration are not being complied with; or
(b) the person entrusted with the management of the healthcare
establishment provided wrong or misleading information, it may
issue a notice to the healthcare
Establishment to show as to why its registration under this
Regulation should not be cancelled for the reasons to be mentioned
in the notice.
(2) If after giving a reasonable opportunity to the small and medium
healthcare establishment, the authority is satisfied that there has
been a breach of any of the provisions of this Regulation, it may, by
an order, without prejudice to any other action that it may take
against such healthcare establishment, cancel its registration.
(3) Every order made under sub-provision 24(2) above shall take
effect—
(a) where no appeal has been preferred or opted against such order
immediately on the expiry of the period decided by authority for
such appeal; and
(b) where such appeal has been preferred and it has been dismissed
from the date of the order of such dismissal:

Provided that the authority, after cancellation of
registration for reasons to be recorded in writing, may restrain
immediately the small and medium healthcare establishment from
carrying out its activity, if there is imminent danger to the health and
safety of patients.
25. Power to enter - (1) Entry and search of the clinical establishment can be done by the
District Authority or an officer or team duly authorized by it or subject to such general
or special orders as may be made by the authority. Such a decision will be required to
be taken by majority of members of the District Authority.
(2) Such entry and search of clinical establishments can be conducted if
anyone is carrying on a clinical establishment without registration or does
not adhere to the prescribed minimum standards or has reasonable cause to
believe the clinical establishment is being used for purposes other than it is
registered or contravenes any of the provisions of this Regulation, shall at
all reasonable times enter and inspect any record, register, document,
equipment and articles as deemed necessary.
(3) The inspection team shall intimate the establishment in writing about the
date of visit and reasons for the inspection. The team shall examine all
portions of the premises used or proposed to be used for the clinical
establishment and inspect the equipment, furniture and other accessories
and enquire into the professional qualifications of technical staff employed
or to be employed and shall make any such other enquires as they consider
necessary to verify the statements made in the application for registration
and grant of license. All persons connected with the running of the
establishment shall be bound to supply full and correct information to the
inspection team.
(4) The officer and/or inspection team so constituted by the Authority shall
submit a report within a week of the inspection to the Authority for the
appropriate action.
26. Appeal — (1) Any person, aggrieved by an order of the registering authority
refusing to grant or renew a certificate of registration or revoking a certificate of
registration may prefer an appeal to the State Council within 30 days and in
prescribed form, annexed as annexure 3.
Provided that the State Council may entertain an appeal preferred after the
expiry of the prescribed period if it is satisfied that the appellant was prevented
by sufficient cause from preferring the appeal in time.
(2) Every appeal under sub-provision (1) above shall be made in
annexure 3 and be accompanied with a fee of Rs.1000.
CHAPTER IV
REGISTER OF HEALTHCARE ESTABLISHMENTS
27. Register of small and medium healthcare establishments—(1) The authority
shall within a period of one year from its establishment, compile, publish and
maintain in digital format a register of small and medium healthcare
establishments, registered by it and it shall enter the particulars of the certificate
so issued in a register to be maintained in such form and manner, as prescribed
by Directorate of Health Services, Bihar.
(2) Each authority, including any other authority set-up for the
registration of small and medium healthcare establishments under
any other law for the time being in force, shall supply in digital
format to the State Council of small and medium healthcare

establishments a copy of every entry made in the register of small
and medium healthcare establishments in such manner, as may be
prescribed to ensure that the State Register is constantly up-to-date
with the registers maintained by the registering authority in the
State.
28. Maintenance of State Register of small and medium healthcare
establishments — Health Department, Bihar shall maintain in digital form and
in such form and containing such particulars, as may be prescribed by the
Government a register to be known as the State Register of healthcare
establishments.
CHAPTER V
PENALTIES
29. Penalty —Whoever contravenes any provision of this regulation shall, if no
penalty is provided elsewhere, be punishable, by Registering Authority for the
first violation with a fine of ten thousand
rupees, for any second violation
with a fine of twenty-five thousand rupees and for any subsequent violation with
a fine of fifty thousand rupees.
Despite this, if the healthcare establishment continues to contravene the
provision of this regulation, their registration shall be suspended until the
provisions of this regulation are not complied with.
30. Monetary penalty for non-registration — (1) Whoever run a healthcare
establishment without registration shall, on first contravention, be liable to a
monetary penalty of ten thousand rupees, for second contravention with a
monetary penalty of twenty-five thousand rupees and in case of any
subsequent contravention such healthcare establishment shall be sealed and
legal action may be initiated under the relevant section of Bhartiya Nyaya
Samhita by the Authority.
(2) Any person aggrieved by the decision of the authority may prefer an appeal
to the State Council within a period of three months from the date of the said
decision.
31. Disobedience of direction, obstruction and refusal of information — (1)
Whoever wilfully disobeys any direction lawfully given by any person or
authority empowered under this Act to give such direction, or obstructs any
person or authority in the discharge of any functions which such person or
authority is required or empowered under this regulation to discharge, shall be
liable to a monetary penalty which may extend to five lakh rupees.
(2) Whoever being required by or under this Regulation to supply any
information wilfully withholds such information or gives information
which he knows to be false or which he does not believe to be true,
shall be liable to a monetary penalty which may extend to five lakh
rupees.
(3) For the purpose of adjudging under sub-provision (1) and (2), the
authority shall hold an inquiry in the prescribed manner after giving
any person concerned a reasonable opportunity of being heard for
the purpose of imposing any monetary penalty.
(4) While determining the quantum of monetary penalty, the authority
shall take into account the category, size and type of the healthcare
establishment and local conditions of the area in which the
establishment is situated.
(5) Any person aggrieved by the decision of the authority may prefer an
appeal to the State Council within a period of three months from the

date of the said decision.
(6) The manner of filing the appeal referred to in sub-provision (5)
above shall be such as may be prescribed.
32. Contravention by companies — (1) Where a person committing contravention
of any of the provisions of this Regulation is a company, every person who, at
the time the contravention was committed, was in charge of, and was
responsible to the company for the conduct of the business of the company, as
well as the company, shall be deemed to be guilty of the contravention and
shall be liable to fine.
Provided that nothing contained in this sub-provision shall render any such
person liable to any punishment if he proves that the contravention was
committed
without his knowledge or that he had exercised all due diligence to prevent
the commission of such contravention.
(2) Notwithstanding anything contained in sub-provision (1) above,
where a contravention of any of the provisions of this regulation has
been committed by a company and it is proved that the
contravention has taken place with the consent or connivance of, or
is attributable to any neglect on the part of, any official or partner or
Director shall also be deemed to be guilty of that contravention and
shall be liable to fine.
Explanation —For the purpose of this provision, —
“company” means a body corporate and includes a firm or other
association of individuals.
33. Contravention by Government Departments — (1) Where any violation of the
provisions of these regulation is committed by any Government healthcare
establishment, the Head of such Government healthcare establishment may be
liable for disciplinary proceedings as per the service rule.
Provided that nothing contained in this provision shall render such Head
of the healthcare establishment liable to any punishment if he proves that the
offence was committed without his knowledge or that he exercised all due
diligence to prevent the commission of such offence.
(2) Notwithstanding anything contained in sub-provision (1), where an offence
under this Regulation has been committed by a healthcare establishment and it
is proved that the offence has been committed with the consent or connivance
of, or is attributable to any neglect on the part of, any officer, other than the
Head of the healthcare establishment, such officer shall also be deemed to be
guilty of that offence and shall be liable to be proceeded against and punished
accordingly.
34. Recovery of fine — Whoever fails to pay the fine, the State Council of small
and medium healthcare establishment may prepare a certificate signed by an
officer authorised by it specifying the fine due from such person and send it to
the Collector of the District in which such person owns any property or resides
or carries on his business and the said Collector, on receipt of such certificate,
shall proceed to recover from such person the amount specified thereunder, as
if it were an arrear of land revenue.

MISCELLANEOUS
35. Protection of action taken in good faith.—(1) No suit, prosecution or other legal
proceedings shall lie against any authority or any member of the State Council
or District Authority any officer authorised in this behalf in respect of anything,
which is in good faith done or intended to be done in pursuance of the
provisions of this regulation.
(2) No suit or other legal proceedings shall lie against State Government in
respect of any loss or damage caused or likely to be caused by anything which
is in good faith done or intended to be done in pursuance of the provisions of
this Regulation.
36. Furnishing of returns, etc — Every healthcare establishment shall, within such
time or within such extended time, as may be prescribed in that behalf, furnish
to the authority or the State Council such returns or the statistics and other
information in such manner, as may be prescribed by the State Government,
from time to time.
37. Power to give directions — Without prejudice to the foregoing provisions of
this regulation, the authority shall have the power to issue such directions,
including furnishing returns, statistics and other information for the proper
functioning of small and medium healthcare establishments and such directions
shall be binding.
38. Employees of the authority, etc., to be public servants — Every employee
of the authority, and the State Council shall be deemed to, when acting or
purporting to regulation in pursuance of any of the provisions of this Regulation,
be public servants within the meaning of Bhartiya Nyaya Samhita.
39. Power to remove difficulties — (1) If any difficulty arises in giving effect to the
provisions of this Regulation, the Health Department may, by order/notification,
make such provisions not inconsistent with the provisions of this Regulation as
may appear to it to be necessary or expedient for removal of the difficulty:
