"In view of the above consideration, it is opined that even though the

present Disciplinary Authority may not have the administrative Contral at the

relevant time when the alleged irregularities were committed, the present

disciplinary authority is still entitled to commence disciplinary proceedings

against a regular government employee for his past misconduct as a contractual

employee or as an outsourced employee working through and external agency

under Bihar Governement Servants (Classification, Control and Appeal)

Rules, 2005.

With the above opinion, the file is being returned."
