The Bihar Special Survey and Settlement (Amendment) Rules, 2026

No.-03/Bhu.A.Ni(6)vishesh survey(Niyamabali)-20/2024-163(8)— In exercise of the

powers conferred under Section-28(1) of the Bihar Special Survey and Settlement Act,

2011 (Bihar Act 24, 2011) (as amended from time to time), the State Government hereby

amends the Bihar Special Survey and Settlement Rules, 2012 (as amended from time to

time) and makes the following amendment rules: -

Short title, extent and commencement.-

(1) These rules may be called "The Bihar Special Survey and

Settlement (Amendment) Rules, 2026."

(2) It shall extend to the whole of the State of Bihar.

(3) Except proviso to rule-15(3), all other provisions of the notification

shall come into force from the date of its publication.

(4) The proviso to rule-15(3) shall be deemed to have come into force

with retrospective effect from the date on which the Bihar Special

Survey and Settlement Rules, 2012 have been brought into force.

The definition of the following new words shall be inserted after

clause-(xvi) of sub-rule-(1) of Rule-2 of the said Rules, 2012:

(xvii)

“Publication of draft final record of rights” means the

publication of the draft final record of rights prepared at the

Special Survey Camp stage under the signature and seal of the

Settlement Officer under section-11(1) of the Act.

(xviii)

"Village record" means the record showing a brief description

of the stage-wise works of special survey and settlement

operation in the notified revenue village in the light of section-3

of the Bihar Special Survey and Settlement Act, 2011.

(xix)

"Municipal Record" means the record showing a brief

description of the stage-wise works of special survey and

settlement operation in the notified municipal area in the light of

section-3 of the Bihar Special Survey and Settlement Act, 2011.

(xx)

“Owner” means, in the case of multi-storey buildings, the

person who holds legal ownership of the individual units of the

building.

Sub-rules (1) and (2) of Rule-4 of the said Rules, 2012 shall be

substituted by the following: -

4(1).-

The Settlement Officer shall publish a proclamation in "Form-1"

for rural areas and in "Form-1'A'" for municipal areas addressed

to the land holders/ persons having any interest in the lands of the

area under special survey and settlement operation directing them

to demarcate their lands for the purpose of pointing out boundary

marks of the land parcels.,

4(2).-

After the publication of the proclamation under foregoing rule-

4(1), the Settlement Officer or any other officer/employee acting

under the authority of the Settlement Officer shall have the power

to enter upon lands, single plots/complexes in multiple ownership

of rural/municipal area under special survey and settlement to

examine and measure such lands by any method, he deems fit and

may clear the lands by cutting down or removing any trees, jungle,

standing crops or other obstructions, as may be necessary for the

purpose of survey. However, no claim or compensation as to cost

can be claimed for the above action.

The following new sub-rule-(1A) after sub-rule-(1) of Rule-6 of the said

rules, 2012 shall be inserted, sub-rule-(2), (3), (4), (6), (7) and (8) of

Rule-6 of the said rules, 2012 shall be substituted: -

6(1A).-

Raiyats of municipal areas under rule-4(1) may submit a self-

declaration in "Form-2'A''' either online or offline.

One copy of the self declaration shall be made over to the

person concerned after initiating and putting date and serial

number by the receiving officer/employee as a token of

acknowledgement of the same.

6(2).-

The self-declaration shall be submitted by the raiyats under rule-

4(1) in rural areas and municipal areas until the completion of the

Kishtewar work.

6(3).-

The landowner/raiyat may provide self-declaration in respect of

land held by him and pedigree in the prescribed "Form-3(1)" in

rural areas and "Form-3(1)(A)" in municipal areas either online

or to the Settlement Office/ Camp office or the Officer/Official

concerned for this purpose.

6(4).-

The self-declaration shall be received by the Assistant Settlement

Officer as per provisions provided in sub-rules-(1) and 1(A) and

the same record of right shall be matched with the help of

different revenue records of right.

6(6).-

Matching of self-declaration with the revenue records shall be

done until the commencement of Khanapuri.

6(7).-

After matching the self-declaration, the concerned Assistant

Settlement Officer shall prepare a verification certificate in

"Form-3" and "Form-3'A"'.

6(8).-

Any self-declaration which could not be matched by the Assistant

Settlement Officer due to non-availability of the relevant records

or due to disputes, a brief reason for non-matching shall be

maintained in a separate register in "Form-4" and "Form-4'A'".

Sub-rule-(1) and (5) of Rule-7 of the said Rules, 2012 shall be

substituted by the following: -

7(1).-

The Kishtewar of a revenue village/Municipal areas shall be

carried out by the preparation of map through modern technology

inclusive of base mapping, demarcation of plots as well as revenue

village and ground verification.

7(5).-

The verification of the map of a revenue village or a revenue

village under the Municipal area shall be completed within a

period not exceeding 30 (thirty) working days from the date of

receipt of the map, however, this period may be extended up to 90

(ninety) working days by the Settlement Officer in case of large

number of plots in the villages/municipal areas.

6. Sub-rule-(1A) after Sub-rule-(1) of Rule-8 of the said rules, 2012, shall

be inserted by the following: -

8(1'A').- For the revenue villages under the municipal areas, the Khanapuri

parties shall be constituted, consisting of the following. The

number of members in the Khanapuri parties being determined as

per the requirements, namely:-

(i)

Officers/personnel of the Department of Revenue and Land

Reforms or the Directorate of Land Records and Surveys:

(ii) Municipal officers/employees:

(iii) Technically competent personnel of Revenue and Land

Reforms Department/Directorate of Land Records and

Surveys or Municipal Establishment.

(iv) More than one Khanapuri party may be formed in one

revenue village in a municipal area.

Sub-rules-(1), (4)(b), (6), (7), (8), (9) & (10) of Rule-9 of the said rules

shall be substituted and Rule-9(3)(B)(VI) of the said rules, 2012 shall

be inserted by the following: -

9(1).-

Before the initiation of Khanapuri work of a revenue

village, a Khatiyani vivarni and a plot register shall be

prepared for rural areas in "Form-5" and "New Form-

6" respectively and for municipal areas in "Form-5'A'"

and "Form-6'A'" respectively.

9(3)(B)(vi).-

For multi-storey buildings situated on a plot of land in

municipal areas, legal possession of land divided

proportionately as per the situation or determination of

ownership proportionately as per consent.

9(4)(B).-

If concerned raiyat is not found present at the time of

spot verification during Khanapuri stage, then the Amin

shall enter the same in the Yaddasht register and proceed

serial wise. If such raiyat makes his presence after fixed

due date, then the land details of such raiyat shall be

entered by Amin with his signature and date in the

Yaddasht register "Form-3(2)" in rural areas and in for

Yaddast register "Form-3(2)(A)" areas in municipal

areas".

Details of revenue records/ documents/ evidences

shall be entered in the Yaddasht register on the basis of

which khata has been opened during Khanapuri stage in

the name of concerned raiyat.

9(6).-

After the verification, the Khanapuri Party shall prepare

raiyatwise Khanapuri purcha in "Form-7" in rural areas

and in "Form-7'A'", raiyatwise or in case of multi-

storey buildings, owner wise in municipal areas, in the

light of available reference revenue records, verification

certificates of self declaration as well as actual field

verification.

9(7).-

The Khanapuri purcha prepared in "Form-7" and

"Form-7'A'" shall be served to the landholders/ owners

including officers concerned with Government land/

public land. Landholders/ owners shall also be made

aware of the entries of the Khanapuri parcha at a

convenient place and on fixed date and time.

9(8).-

Khanpuri purcha prepared in "Form-7" and "Form-

7'A"' shall be served on the raiyat concerned or his near

relative. However, if he declines to receive the purcha

the same will be served on him by pasting it on the front

gate of his house/wall. The person responsible for the

service of the purcha, shall, as far as possible, obtain the

signature of the panchayat representative, village

chowkidar and other local residents on the service report

and the same shall be deemed to be a proper service of

the Khanapuri purcha. Information provided through

public electronic means shall be deemed to be a proper

service.

9(9).-

Claims/objections against the entries of Khanapuri

purcha may be filled by the landholder/owner or any

person

having

interest

the

land

including

representative of the concerned office of the state

government/central

government/public

sector/local

bodies in "Form-8" in rural areas and "Form-8'A'" in

municipal areas and a receipt as a token of

acknowledgement for the same shall be issued to the

person concerned in "Form-9" in rural areas and

"Form-9'A'" in municipal areas.

9(10).-

Claims/objection of the landholder/owner or any other

person having interest in the land received at the camp

office concerned shall be maintained in a separate

10'A'" in municipal areas.

Sub-rule-(1) of Rule-10 of the said Rules, 2012 shall be substituted by

the following: -

10(1).-

The concerned Kanungo / Revenue Officer shall issue separate

notices to the parties concerned for disposal of claims/objections

in "Form-11" in rural areas and "Form-11'A''' in municipal

areas, clearly mentioning therein the place, date and time of

hearing besides a brief account of the claim/objection.

Sub-rule-(1) of Rule-11 of the said Rules, 2012 shall be substituted

by the following: -

11(1).- After completion of Khanapuri work, a draft of Khanapuri record

of rights shall be prepared in "New Form-12" in rural areas and

"Form-12'A''' in municipal areas incorporating the orders with

respect to the claims/objections received during Khanapuri

operation against the entries in Khanapuri Purchas well as the

map.

10. Sub-rule-(1) of Rule-12 of the said Rules, 2012 shall be substituted by

the following: -

12(1).- The draft Khanapuri record of rights including map prepared under

Rule-11(1) and attested by the Assistant settlement officer

concerned under Rule-11(2), shall be published for a continuous

period of 30 (thirty) days in the following manner:-

(i)

by displaying it in the concerned settlement camp,

(ii)

by displaying it at some conspicuous public place in the

concerned revenue village/municipal area;

(iii)

by displaying it on the notice board of the concerned Gram

Panchayat office,

(iv)

By displaying it on the notice board of the circle office/

Municipal Office concerned.

11. Sub-rules-(1), (2), (4), (5) and (7) of rule-13 of the said Rules, 2012 shall

be substituted by the following: -

13(1).-

Simultaneous with the publication of the draft Khanapuri Record

of Rights under Rule-12(1), the Assistant Settlement Officer

concerned shall issue a public notice in "Form-13" in rural areas

and in "Form-13'A''' in municipal areas inviting claims/

objections, if any, with respect to the entries of draft record of

rights including the configuration/ area of the plots shown in the

concerned map.

13(2).-

The public notice shall be displayed by pasting it at prominent

public places of the revenue village/municipal area concerned, on

the notice boards of the gram panchayat/wards of the municipal

areas concerned and the concerned special survey and settlement

camp.

13(4).-

The claims/objections against the entries in Draft Record of

Rights, including the map, may be filed in the Special Survey and

Settlement camp concerned, by a land owner/holder or any person

having interest in the land including representatives of the

concerned office of the state Government/Central Government/

public Sector/ Local bodies in "Form-14" in rural areas and

"Form-14'A'" in municipal areas.

13(5).-

The claims/objections of the landholders/owners or any other

person having interest in the land received at the special survey

and Settlement camp shall be maintained in a separate register in

"Form-15" in rural areas and "Form-15'A''' in municipal areas

and a receipt as a token of acknowledgement for the same shall be

issued to the person concerned in "Form-16" in rural areas and

"Form-16'A''' in municipal areas.

13(7).-

The Assistant Settlement Officer shall issue separate notices to

the concerned parties in "Form-17" in rural areas and "Form-

17'A''' in municipal areas where under a brief account of

claims/objections, mentioning therein the place, date and time of

the hearing.

12. Sub-rules-(2) and (4) of Rule-14 of the said Rules, 2012 shall be

substituted and provided that shall be inserted at the end of Rule-

14(5)(A)(i), 14(5)(A)(ii), 14(5)(A)(iv) and 14(5)(A)(v) and sub-rule-(6)

shall be repealed:-

14(2).-

A detailed comparison of village/municipal boundaries with the

boundaries as shown in the last revenue village/ municipal map

and orders passed at different earlier stages shall be made and

the process shall be called "Muqabla". Care shall be taken that

the area of plots as shown in the draft record of rights matches

with the area shown in the map concerned.

14(4).-

After passing the area by the Assistant Settlement Officer

concerned, a new Terij i.e. 'Abstract of the new rights record' in

"Form-18" in rural areas and "Form-18'B''' in municipal

areas, new plot register in "Form-19" in rural areas and in

"Form-19'A''' in municipal areas shall be prepared by Amins.

14(5)(A)(i).- Provided that after publication of the draft of Record of Rights in

the municipal areas, the Assistant Settlement Officer shall

prepare rent roll in "Form-18'C''', on the basis of the rent

table fixed by the State Government for the municipal area, for

each raiyat/owner of the concerned revenue village of the

municipal area according to the details and nature of the land

held by him.

14(5)(A)(ii).- Provided that after the preparation of rent roll of the concerned

village of municipal areas in view of the provisions of sub-rule-

5(A)(i) of Rule-14, as per land detail and its nature , owned by

all raiyats, concerned Assistant Settlement officer shall publish

draft rent roll for receipt of objections and claims and such

objections shall be received within 15 (fifteen) days from the

date of its publication.

14(5)(A)(iv).- Provided that in Municipal areas, after disposal of claims and

objections received and rent roll prepared in view of sub-rule-

5(A)(ii) of Rule-14, the charge officer shall examine the

raiyatwise/ ownerwise rate of settlement rent roll of the

concerned revenue village as submitted by the Assistant

Settlement Officer. If it is found correct, he shall submit it to

the Settlement Officer for confirmation and sanction.

14(5)(A)(v).-

Provided that in Municipal areas, the Settlement Officer may

sanction raiyatwise/ownerwise settlement rent roll with or

without correction .If correction is required in settlement rent

roll, the same shall be returned to the Assistant settlement

Officer for reconsideration.

For amendment in raiyatwise/ownerwise rent Table of

concerned revenue village received for reconsideration, the

Assistant Settlement Officer shall issue notices to concerned

parties for amendment in raiyatwise/ownerwise rent roll and

after hearing concerned parties, his findings shall be recorded

in case record. After hearing and completing other formalities,

correction will be made in concerned rent roll and rent shall be

incorporated in the relevant columns of New "Form-20" in

rural areas and "Form-20'A''' in municipal areas of record of

rights of the land owned by concerned raiyat/raiyats/owner.

14(6).-

Sub-rule-(6) of Rule-14 of the said Rules, 2012 shall be

deleted.

13. Sub-rules-(1), (3) and (4) of rule-15 of the said Rules, 2012 shall be

substituted and sub-rule-(4)'A' after sub-rule-(4) shall be inserted and sub-rule-(8)

shall be inserted after sub-rule-(7):-

15(1).-

The copies of the draft final record of rights and maps in New

"Form-20" in rural areas and in "Form-20'A''' in municipal

areas shall be finally published under the hand and seal of the

settlement officer of the concerned district.

The same shall be placed for public inspection from the

date of final publication for a continuous period of 30 (thirty)

days in the following manner: -

(i)

by displaying it in the special survey and settlement camp

concerned;

(ii) by displaying it at a conspicuous public place in the revenue

village/municipal area concerned;

(iii) by displaying it on the notice board of the ward concerned

to the revenue village/municipal area;

(iv) by displaying it on the notice board of the concerned circle

office/ nagarpalika Office and online on the website of

Revenue

and

Land

Reforms

Department/

Urban

Development Department.

15(3).-

Any person in revenue villages who has an interest in any land or

a part thereof may file claims/objections within 90 (ninety) days

from the date of draft final publication under section-11(1) of the

Bihar Special Survey and Settlement Act, 2011 (as amended from

time to time) before the notified officer concerned in "Form-21"

in rural areas and "Form-21'A''' in municipal areas.

Provided that if the officer authorized for hearing is

satisfied that there is sufficient reason for the delay, he may

condone the delay in filing the claim or objection received for

hearing.

15(4).-

The notified officer in rural/municipal areas shall issue notices in

"Form-22" in rural areas and "Form-22'A''' in municipal areas

containing therein a brief account of claims/objections to the

parties concerned for the disposal of claims and objections

15(4)'A'.- Against objections received in "Form-22" and "Form-22'A''',

an acknowledgement will be issued to the person concerned in

"Form-23" in rural areas and "Form-23'A''' in municipal areas

as proof of acceptance for the same. The claims, objections

received under the concerned survey and settlement notified will

be maintained in a separate register in "Form-24" for rural areas

and "Form-24'A''' in municipal areas.

15(8).-

On the basis of the new record of rights and plot register, copies

of final record of rights shall be prepared in "Form-25" or rural

areas for its final publication in quadruplicate and in "Form-

25'A''' for municipal areas in quintuplicate after proper checking

and comparison and the process shall be called "Safai". A copy of

the Records of rights for rural/municipal areas called "Raiyati

Fard" shall be made available to the concerned raiyats/owners.

The second copy shall be sent to the concerned Anchal Adhikari

for the preparation of Tenants Ledger register.

The third copy called “Maliki Fard” shall be made

available to the Collector of the District concerned. The fourth

copy shall remain in the custody of the Director, Land Records

and Survey for preservation and for future reference. In municipal

areas, the fifth copy of "Form-25'A''' will be made available to

the concerned Municipal Corporation / Nagar Parishad/ Nagar

Panchayat of the Urban Development and Housing Department.

14. After rule-15 of the said Rules, 2012, rule-15'A' shall be inserted:-

Rule-15'A'.- Appeal

(i)

The government may notify one or more officers not below

the rank of Additional District Magistrate for hearing

appeals against orders passed under Rule-15(7).

(ii)

The Appellate Authority shall not pass any order

modifying, altering or setting aside any order passed by any

officer unless the parties concerned have been given a

reasonable opportunity of being heard.

(iii)

Any person aggrieved by an order passed under Rule-

15(7) may, within 30 (thirty) days from the date of passing

of the order, file an appeal against such order in the Court

of the competent authority empowered to hear appeals

against such order.

(iv)

The Appellate Authority may condone the delay in filing

the appeal if it is satisfied that there are sufficient reasons

for the delay.

(v)

Where an appeal is filed against an order passed under

Rule-15(7), the appellate authority shall demand the case

record from the officer notified under Rule-15(2).

(vi)

The Appellate Authority shall issue notice either in person

or through its authorized representative, to all the parties

concerned in the case, directing them to appear on the

specified date, time and place fixed for hearing of the case.

(vii)

In case any of the parties does not appear even after given

an opportunity for appearance and hearing, the Appellate

Authority may dispose case ex-parte on the basis of

available records/documentary evidences.

(viii) An appeal received against an order passed under Rule-

15(3) shall be disposed of, as far as possible, within 90

working days from the date of filing of the appeal.

(ix)

After disposal of the appeal, the Appellate Authority shall

return the case record to the Settlement Officer for

implementation of its order.

(x)

On receipt of the case record, the Settlement Officer shall

issue a correction slip in the prescribed manner.

(xi)

On receipt of the case record on the basis of the correction

slip, the Settlement Officer shall take necessary action for

making changes in the entries in the record of rights and

map in the prescribed manner.

15. Rule-21 'A' shall be inserted after Rule-21 of the said Rules, 2012.-

21'A'.- Director, Land records and survey, Bihar with the consent of the

Urban Development and Housing Department, shall frame

Technical Guidelines in municipal areas, within 60 (sixty) days

from the date of notification of these rules, for meeting any or all

of the purposes of this act. The said Technical Guidelines shall be

notified by the Revenue and land reform department. The said

Technical Guidelines shall include, besides other things, prevalent

methods of Kistwar by modern technology. The said Technical

Guidelines shall also incorporate works to be done during recess.

Necessary provisions shall also be made in the said Technical

rules regarding the maintenance/publication and making available

record of rights and map of a revenue village in digital form to

interested persons under section-14 of this act.

16.

Form-6, Form-12 and Form-20 of the said Rules, 2012 shall

be substituted.-"Form-6" of the Rules shall be substituted by New

"Form-6", "Form-12" by New "Form-12" and "Form-20" by New

"Form-20".
