Bihar Agricultural Land (Conversion for Non-Agricultural Purposes) (Repeal)
Ordinance, 2026
AN
ORDINANCE
to repeal the Bihar Agricultural Land (Conversion for Non-Agricultural Purposes)
(as amended) Act, 2010 (Bihar Act 11, 2010).
Preamble-Whereas the Bihar Agricultural Land (Conversion for Non-Agricultural
Purposes) (As Amended) Act, 2010 (Bihar Act 11, 2010) is in force in the state for
conversion of agricultural land for non-agricultural purposes and to enact related and
incidental matters.
Furthermore, the provisions of the said Act, along with their impact and
implementation, were duly reviewed in various departmental meetings. The review
revealed that the State is not getting the revenue as expected due to this Act and is
encountering certain obstacles in achieving the objectives of "Ease of Doing Business"
and "Ease of Living" as well as in fostering rapid industrialization.
And whereas the Bihar State Legislature is not in session.
And whereas the Governor of Bihar is satisfied that circumstances exist which
render it necessary to take immediate action to repeal the Bihar Agricultural Land
(Conversion for Non-Agricultural Purposes) Act, 2010.
Therefore, in exercise of the powers conferred by clause (1) of Article 213 of the
Constitution of India, the Governor of Bihar promulgates the following Ordinance:
1. Short title and commencement.—
(1) This Ordinance may be called the "Bihar Agricultural Land (Conversion
for Non-Agricultural Purposes) (Repeal) Act, 2026".
(2) It shall come into force the date of publication in the Official Gazette.
2.
Repeal and Savings.—
(1) The Bihar Agricultural Land (Conversion for Non-Agricultural
Purposes) Act, 2010 (Bihar Act 11, 2010) is hereby repealed.
(2) Provided that notwithstanding such repeal anything done or any action
taken under the said Act shall not be affected. All pending proceeding
under the Act which has not attained finality shall abate.
