The Bihar Ferryghat Settlement and Management Rules, 2026
The 6 July 2026
san.no.-08/niyam sanshodhan-03-02/2023-229 (8)/ra.—In exercise of the powers
conferred under section-18 of the Bihar Ferryghat Settlement and Management Act, 2023
(Act No. 8 of 2023) the Government of Bihar hereby makes the following Rules:-
Chapter-I
Preliminary
1.
Short title, Extent and Commencement.-(1) These rules may be called The
Bihar Ferryghat Settlement and Management Rules, 2026.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force on such date as notified by the State Government in
the Official Gazette.
2.
Definitions.-(1) In these rules unless there is anything repugnant in the subject
or context, definitions of words given in Section-2 of the Bihar Ferryghat Settlement and
Management Act, 2023 (Act No. 8 of 2023) shall also be applicable to the same words used
in the Bihar Ferryghat Settlement and Management Rules, 2026.
(2)
In this Rule, unless the context otherwise requires.-
(a)
"Reserve Deposit Amount".-means the minimum amount fixed for
settlement of a Public Ferryghat for a financial year.
(b)
"Ferryghat Reserve Deposit Fixation Committee".-means a
committee constituted under the chairmanship of the district
Collector for determination of reserve deposit amount for the
purpose of Public Ferryghat settlement and collection of tolls.
(c) "Act".- means the Bihar Ferryghat Settlement and Management Act,
2023
(d)
"Passenger Boat".-means any boat that ordinarily carries person
other than the "Navik or "Manjhi" or "the boatman in charge" and
the crew;
(e)
"Cargo boat".-means any boat, which ordinarily carries all kinds of
movable or personal property including animals and cattle;
(f)
"Form".-means a Form appended to these rules;
(g)
"Navik" or "Manjhi".- means persons who are qualified to operate
the licensed boat.
(h)
"Department".-means the Revenue and Land Reforms Department
of the Government.
(i)
"Deputy Collector Land Reforms".-means an officer appointed as
such by the Government or any other such officer notified by the
Government to discharge all or any of the functions of a Deputy
Collector Land Reforms under the Act.
(j)
"Public Ferry Ghat".-means Ghat constructed or operated by the
Government of Bihar or the Government of India or any authority of
both.
(k)
"Lessee".-means a person or parties or Committee who has an
agreement that allow the use of a Public Ferry Ghat.
(l)
"Public Ferry".-means any vessel belonging to and operated by any
authority of the Central and State Government either by itself or
through lessee to a third party.

Chapter- II
Public Ferryghats
3. Procedure to declare, establish, define and discontinue public ferryghats.-
The Collector of the district, on the basis of report from Circle Officer and the Deputy
Collector Land Reforms concerned shall declare/establish/define or concerned discontinue
public ferryghats in the district with prior approval of the Commissioner of the Division
vide a Notification as contained under section-3 of the Act in Format-"A" and that shall be
published in the Official Gazette of the district as well as shall be uploaded on the website of
the district. The Notification shall also be published in three widely circulating local daily
newspaper for consecutive three days.
4. Procedure for settlement of public ferryghats by the Collector/Additional
Collector/Local Authority.-
(1) Under Section 4 of the Act, the power of settlement of public ferryghat
shall be vested in the Collector/Additional Collector/Local Authority.
In the cases of rural areas, the maximum extent of the
delegation of the power of settlement between Gram Panchayat,
Panchayat Samiti and Zilla Parishad shall be done by the Government
from time to time by executive instruction.
In the case of urban areas, the power of settlement will be
vested in the concerned municipal body. The maximum extent of the
power of settlement will be delegated by the government from time to
time by executive instruction.
(2) The settlement of Public Ferryghats shall be done through bidding system
by public auction to the highest bidder for a minimum period of three
financial years and a maximum period of five financial years by the
competent authority based on reserve deposited amount for the purpose
of tolls in the manner as prescribed under sub-rule (1).
Relevant provisions of Bihar Finance Rules, 1950 will be
followed in the auction process.
(3) Determination of Reserve Deposit Amount for public ferryghats for one
financial year shall be done by the Ferryghat Reserve Deposit Fixation
Committee constituted by the Department under the chairmanship of
the district Collector consisting of other ex-officio members and
representatives from the rural and urban local bodies of the district
level, as the case may be. However, if the settlement is done for more
than three years, settlement amount shall be increased by 15% for each
consecutive year after the third year of the settlement. The detailed
procedure to be followed by the Ferryghat Reserve Deposit Fixation
Committee shall be laid down by the Department from time to time.
(4) If, under any compelling circumstances, settlement of a public ferryghat
becomes imperative to be done below the Reserve Deposit Amount,
Reserve Deposit Amount shall be re-determined accordingly with full
justification by the Ferryghats Reserve Deposit Fixation Committee;
but only after soliciting and getting the prior approval of the
Commissioner of the Division.
(5) The process and procedure for determination of Reserve Deposit
Amount of a public ferryghat shall be completed at least three months
earlier before the onset of the new bidding cycle by the district
Collector.

(6) (i) The process for settlement of public ferryghats shall be initiated
three months before the onset of the new financial year or before the
expiry of the terms of the existing leases, as the case may be, and
such advertisement for settlement shall be published in three widely
circulating local daily newspapers for consecutive three days as well
as publicised through other information systems.
(ii) The advertisement shall specify the following.-
(a)
the day, time and place of the bid;
(b) the period for which the ferryghat is to be settled, and the
dates between which the settlement holder or the lessee
shall be entitled to ply the ferry/boat;
(c) the liability or otherwise of the lessee to provide and to
keep in order the landing stages, and the rest houses/ or
traveler's sheds, if any, at either or both terminal of the
crossing of the ferryghat.
(d) the minimum number of crossings to be made daily at
any particular season of the year;
(e)
the normal timing of operation and plying of the
boat/ferry.
(f)
the rates of toll to be levied;
(g) the persons and things to be ferried over free of tolls as
provided under sub-rule-(5) of the Rule-5.
(h) the installments in which the lease amount of the leased
ferryghat is to be paid;
(i)
the amount of the earnest money to be deposited by the
intending bidders before they are allowed to bid at the
auction; and
(j)
such other particulars as the Collector/Additional
Collector/Local authority of the district, as the case
maybe, shall consider necessary.
(7)
A copy of the advertisement and of the rules and the form of agreement
required to be executed shall be posted up in a conspicuous place in the
office of the concerned Competent Authority and shall be duly
displayed on the day of the auction.
(8) On the day fixed, the settlement of public ferryghat shall be done
through public auction and open bidding system or in any other
manner, as prescribed by the Department, to the highest bidder in
respect to the Reserve Deposit Amount.
(9)
All intending bidders shall deposit one-fourth of the Reserve Deposit
Amount before they are allowed to bid at an auction. The deposit shall
be returned to all bidders except one with whom the ferryghat has been
settled in whose case the deposit shall be set off against the amount of
lease settlement required to be deposited by him. If the bidder with
whom the ferry lease is settled, fails to execute the contract under sub
rule-(15) within a date fixed by the Collector which should be not less
than fifteen days after the date of bidding, the Collector may order
forfeiture of the whole amount of the deposit.
(10) After a ferryghat has been settled for the term specified in the
advertisement, no extension, and subject to the provisions of section-11

of the Act, and other provisions of this Rule, no curtailment of the said
term shall be made.
(11) The true copy of lease settlement order shall be made available to all
participants in the bidding.
(12) The powers of the local bodies as Competent Authority, if delegated by
the Department shall remain confined only to the settlement, control
and management of the public ferryghats as prescribed under section-4
of the Act; while the land would remain vested absolutely in the
Department, if it is a government land.
(13) In cases of discontinuance of the public ferries, as per provisions
contained under section-3(1)(g), the land would automatically come
under the absolute control of the Department, if it is a government land.
(14) In cases, in which the ferryghat is leased out for more than a year the
liability for each year's settlement amount shall accrue from the first
day of the financial year.
(15) The contract which the settlement holder or lessee will be required to
execute under Section-4 of the Act shall be in the Form of Agreement
appended to these rules in Format-"B".
(16) The Competent Authority shall, as soon as possible, after the contract
has been executed by the lessee, furnish him free of charge with a copy
of the rules, a list of the authorised tolls duly signed by him as
contained under Section-5 of the Act and a copy of the entries made in
the register as prescribed under clause (a) of Rule-5(10) in respect of
the ferry.
(17) Surrender of Settlement and Lease.-The settlement holder or the lessee
of the tolls of a public ferryghat may surrender his lease on the grounds
of personal reasons on the expiration of one month's notice in writing to
the Collector of the district in which such ferry is situated of his
intention to surrender such lease and on payment of such reasonable
compensation as the Collector may, with the prior approval of the
Commissioner of Division, in each case direct.
(18) No public ferry ghat shall be settled to any person who has a criminal
background or who is a convicted person or against whom criminal
proceedings are pending.
5. Control and Management of Public Ferryghats by the Collector/
Additional Collector/Local Authority.-
(1)
The power of control and management of the public ferryghats shall
vest in the Collector/Additional Collector and in Local Authorities of
rural and urban local bodies, to be exercised by the Local
Authorities, as the case may be, subject to such powers and functions
devolved and delegated by the Government, from time to time, as
contained under section-4 of the Act.
(2) (i) The settlement holder or the lessee shall be bound-
(a)
to provide as many registered and licensed boats and of
such description as the Collector/Additional Collector/
Local Authorities may require;
(b)
to employ such crew in, and to provide such life safety
instruments and equipments for each such boat as
delineated under Chapter-V of these rules.

(ii) The settlement holder or the lessee shall not allow the ferry owner to
carry at a single trip in such a boat:-
(a)
any number of passengers, animals or vehicles, or
(b)
any bulk or other weight of freight in excess of the number
or bulk or weight, as the case may be, which such boat is
authorised to carry and ply as per Chapter-V of these rules.
(3)
The lessee shall be bound to ferry over diligently, carefully and with the
least possible delay to all passengers, vehicles, animals and goods
which may come to ferryghat to be ferried over.
(4)
The rates of tolls to be levied and charged shall be those fixed by the
Collector of the district with prior approval of the Commissioner as
delineated under Section-5 of the Act.
(5)
The lessee under sub-section-(2) of section-5 of the Act, shall not
charge or demand tolls for ferrying over Government stores, animals
and vehicles when accompanied by a challan from the authority
empowered by the Collector, or any public official on emergency duty.
(6)
The ferry shall ordinarily ply between sunrise and sunset; but the lessee
may employ the boats in ferrying passengers across at any time after
sunset, provided each boat so employed carries a light which must be
displayed in a conspicuous part of the boat, but subject to the provisions
of sub-section-(6) and (7) of section-4 of the Act.
(7)
The lessee shall provide and keep in proper order to the satisfaction of
the Collector, the landing stages on both sides of the ferryghats, and
shall move them when necessary according to rise and fall of the water.
He shall also provide proper rest-houses or travelers' sheds on the banks
of the ferry as required by the Competent Authority, and shall make all
proper arrangements and provide all suitable accommodation on the
ferry boats for passengers and goods traffic. He shall fix notice boards
in a conspicuous place at two ends of the ferry showing in legible
writing:-
(i) the schedule of toll applicable to the ferry; and
(ii) the entries made in the register under clause (a) of Sub Rule-8 in
respect of the ferry.
(8) (a) The Competent Authority shall maintain a register showing on
separate pages in respect of each public ferry-
(i)
the name of the lessee and the period of lease.
(ii)
the number and description of the boats which the lessee is
required to provide,
(iii) the number of the crew required to be employed on each boat
and the safety equipment or appliances required to be provided
thereof; and
(iv) the number of passengers, animals and vehicles and bulk
weight of other freight which each boat is authorised to carry
at a single trip.
(v)
the entries relating to each boat shall bear a separate serial
number.
(b) As soon as possible after the entries in respect of any boat have been
made in such register the Competent Authority shall give to the
lessee of the ferry on which such boat is authorised to ply, a copy of
such entries, a colored plate bearing the serial number of such boat,

which shall be the same as the serial number under which the entries
relating to such boat are included in the register, and a plate showing
the particulars specified in sub-clauses-(i) to (iv) of clause (a) of this
rule in respect of such boat.
(9)
In cases, relating to the public ferries where the power of settlement and
management of which has been delegated to the Competent Authority
of the local bodies under the provisions of Section-4 of the Act, the
Local Authority concerned shall furnish a copy of such register and of
every new entry or correction made in an existing entry, to the district
Collector as soon as fresh settlement of any public ferryghat is made, or
any new entry or correction is made therein.
(10) No person shall ply any ferry boat unless-
(a) it complies in all particulars with the entries in the register
prescribed under clause (a) of sub-rule-(8);
(b) there is affixed in a conspicuous place inside the boat the colored
plate showing the particulars specified in sub-clauses (i) to (iv) of
clause (a) of sub-rule-(8) in respect of such boat.
(11) When any public ferryghat, which has been settled and leased out by
the Competent Authority for a given period, is discontinued due to any
compelling reasons or circumstances or under the orders of the
Collector before the expiry of that period, the lessee shall be allowed a
deduction in the lease amount payable for the unexpired portion of the
term of the lease. If it is shown to the satisfaction of the Collector that
the lessee has suffered any loss consequent to the discontinuance of the
ferry, the Collector may allow him such compensation as he deems
reasonable and deserving.
(12) In the event of the ferry being discontinued before the expiry of the
lease as described under sub-rule-(11), all persons who have
compounded for the tolls for its use shall be entitled to receive a refund
calculated as in sub-rule-(4) and unless, the claims of all such persons
have been satisfied by the lease, the Collector shall have authority to
satisfy the claims out of the deposit made by the lessee under sub-rule-
(9) of rule-4
(13) The lessee shall be bound to furnish such return of traffic as may from
time to time be called for by the Competent Authority, and for this
purpose he shall keep up a register of traffic in the form to be
prescribed by the Collector.
(14) The Competent Authority may at any time require the lessee to repair
or replace any boat which he considers to be in a dangerous state of
disrepair and the lessee shall thereupon be bound to repair or replace it
as directed.
(15) The ferry boats belonging to any public ferry shall not be plied when
the current, wind or state of the weather is such as to render the
crossing unsafe and endanger the lives of the passengers as contained
under sub-section-(6) and (7) of section-4 of the Act,
(16) The lessee shall keep at landing stage of each public ferryghat an
inspection book in which inspecting officer may record their remarks,
as prescribed under sub-section-(5) of section-4 of the Act and shall
report to the Competent Authority on weekly basis.

(17) A register showing the demand and collection on account of rents
payable for tolls of public ferries, shall be kept up by the Competent
Authority.
(18) A quarterly statement shall also be kept by the Competent Authority
showing the demand, collection and arrears up to date on account of
settlement amount of public ferries.
(19) The settlement holder or lessee of the tolls of a public ferryghat and
their staff bound to conform to rules.-Whenever the tolls of a public
ferryghat have been duly settled and leased out under section-4 of the
Act, the settlement holder or lessee and every staff of the lessee shall be
deemed to be legally bound to conform to the relevant and imperative
rules made under the Act for the management and control of such
ferries.
(20) In case of carriage of minerals done by public or private ferry, it shall
be mandatory to provide suitable platform for offloading of the
concerned minerals along with a provision for weighing of the minerals
in order to comply with the rules promulgated under Bihar Mineral
(Concession, Prevention of Illegal Mining Transportation and Storage)
Rules, 2019 (as amended from time to time).
(21) The settlement holder shall not allow movement of any item from the
public ferry ghat which is illegal under any Act/Rule/ Circular of the
Government of India or the State Government and on getting the
information, he shall immediately inform the concerned Government
Department.
(22) In case of non- availability of a approach/link road to the newly
established public ferryghat, connectivity can be ensured by taking
recourse to the procedure under The Bihar Raiyati Land Lease Policy,
2014 and The Right of the Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement Act, 2013, as the
case may be.
6. Procedure for Control and Management of Public Ferries by the Local
Authority.-
(1) The immediate control and management of every public ferryghat shall
vest in the Collector/Additional Collector of the district in which such
ferry is situated. However, the Government may, from time to time,
vide issuance of such executive instructions or guidelines, devolve and
delegate the power of control and management to rural or urban local
bodies as contained under section-4 of the Act, to be exercised by the
Local Authorities, as the case may be.
(2) Such Local Authorities of the local bodies shall, except when the tolls
of such public ferryghats are leased out by public auction or bidding,
for a Settlement Year may be directed by the Collector of the district to
make all necessary stop-gap arrangements for the supply of
boats/ferries for the operation of such public ferryghats, and for
collection of the authorized tolls leviable thereat; and also manage and
supervise as well as upkeep the details of incomes accruing from the
collection of tolls subject to and in consistent with the existing rules,
provisions and delineated process or as may be prescribed vide release
of such executive instructions or guidelines from the Department.

(3)
The plying, operation and management of the boat/ferryghat shall be
inspected by an inspecting officer as contained under sub-section-(5) of
the section-4 of the Act, who shall report to the Collector on fortnightly
basis.
Chapter- III
Toll
7. Collection for Tolls.- (1) The Collector of the district, in which a public
ferryghat is situated, with the prior approval of the Commissioner of the Division shall, from
time to time, fix such rates of toll by a declaration to be levied and charged on all persons,
animals and cattle, vehicle, as well as on goods and materials for its collection from the
public ferries in the manners as enshrined under section-5 of the Act,.
(2)
Compounding for tolls.-The Collector of the district, with prior
approval of the Commissioner of the Division, from time to time, may
fix rates at which any person may compound for the tolls payable for
the use of such ferry.
(3)
Refund of the Compounding Amount.-Any person may compound
for tolls payable for the use of the ferry and if the ferry is closed or
discontinued before the expiry of the period for which such person has
compounded for tolls payable for its use, he shall be entitled to receive
a refund of the amount of which shall bear the same proportion to the
whole sum paid by him as the period remaining bears to the whole
period for which he compounded. Such refund shall be made under the
order of the district Collector.
(4) Abatement of Lease Rent.-Where the tolls of a public ferryghat has
been settled and leased out under rule-4, any such declaration for tolls,
if made after the date of the lease settlement or in the midterm of the
Settlement Year shall entitle the lessee to such abatements of the lease
rent payable in respect of the tolls, as may be fixed by the Collector of
the district with prior approval of the Commissioner of the Division.
Chapter -IV
Private Ferries
8.
Management and Control of Private Ferries.-
(1) The ferries other than the public ferries shall be treated and counted as
Private Ferries. The determination and implementation of registration,
operation, total load capacity as well as other life safety instruments
and appliances, etc of the private boat/ ferry shall be regulated by the
respective provisions/rules/guidelines delineated by the Department of
Transport and as well as of Disaster Management Department of the
Government as contained under section-6 and 7 of the Act.
(2) Private Ferries and Private Ferryghats shall be used only for private
purposes by the boat owners and not for levying and collection of tolls
or for any other type of commercial activities and use.
(3)
The Private Ferries shall abide by the followings.-(1) All private
ferries shall be registered in the district in which they are situated and
particulars under the following heads shall be entered in the application
for registration:-
(a) Name of the ferry and names of the villages and thana in which
and the river or water body across which it is situated.

(b) The number and description of the boats to be maintained and
the strength of the crew to be employed on each.
(c) The maximum number of passengers, animals, vehicles and
bulk or weight of goods to be carried by each boat.
(d) The periods or seasons during which the ferry is to be plied
every year.
(4)
Before a private ferry is registered the registration officer shall satisfy
himself that the statements contained in the application are correct.
(5)
If the proprietor of any private ferry does not apply, as required under
sub-rule-(3), for the registration within three months from the
publication of these rules, the registration officer may serve upon him a
written notice requiring him to furnish the particulars stated in sub-rule-
(3), within a stated period of not less than one month; and any
proprietor on whom such a notice has been served in respect of any
ferry shall not maintain the same or allow it to be maintained after the
expiry of the period fixed in such notice, unless the particulars required
by under sub-rule-(3), shall have been furnished to registration officer
as ordered.
(6)
The proprietor of every private ferry shall be bound to adhere and
conform to the terms of his application, or of any statement furnished
by him under sub-rule-(3) and shall not reduce the number of boats or
crews to be maintained by him, or allow any of his boats to carry an
excess number of passengers, animals, vehicles or weight or bulk of
goods.
(7)
The proprietor shall mark on each boat the number of passengers,
animals and vehicles and the bulk and weight of other things it is
authorised to carry at a single trip.
(8)
The ferry shall ordinarily ply between sunrise and sunset but the
proprietor may ply the boats after sunset provided each boat carries a
light which must be exhibited in a conspicuous part of the boat, but
subject to the conditions of sub-rule-(6) and (7) of sction-4 of the Act.
(9)
The ferry shall not ply when the current, wind or state of the weather is
such as to render the crossing unsafe or to endanger the lives of the
passengers.
(10) The Collector may direct that any boat used in any private ferry may be
examined by such officers as he may depute and may prohibit the use
of such boat if he is satisfied that it is of such a kind or in such a
condition that its use is dangerous to life or property.
(11) The owner of every private ferry shall report without delay at the
police-station within whose jurisdiction the ferry is situated, the
occurrence of any accident at the ferry resulting in serious injury or in
loss of life.
(12) The Collector may require the owner of any private ferry to state the
name of any person to whom such ferry may be leased or who may be
placed in charge of such ferry.
(13) The person in charge of a private ferry, and all persons employed in
working a private ferry boat, shall be responsible that such boat shall
not be over laden; and every person having been directed not to enter a
fully laden boat or not to load animals and goods in it, shall be bound to
obey such direction.

(14) The private ferryghats and private ferries may be inspected, from time
to time, by an officer as enshrined under sub-section-(5) of section-4 of
the Act, who shall report to the Collector of the district on weekly basis.
(15) In cases of the urgency or if so required to meet an emergent situation,
the Collector of the district may take over the private ferries and private
ferryghats for contingent and relief work on the basis of payment of a
reasonable and equitable compensation amount to the concerned owner
of the boat/ferry.
(16) In case of carriage of Major or Minor minerals, it shall be mandatory
for all private ferries to comply with the rules promulgated under Bihar
Mineral (Concession, Prevention of Illegal Mining, Transportation and
Storage) Rules, 2019 as amended from time to time. Similarly all
private ferry ghat facilitating carriage of minerals described under Bihar
Mineral (Concession, Prevention of Illegal Mining, Transportation and
Storage) Rules, 2019 shall provide suitable platform for offloading of
the concerned minerals along with a provision for weighing of
the minerals.
Chapter -V
Control of Ferry/Boat operations
9. Registration, Control and Operations of Ferry/Boat.-
(1) Determination and implementation of registration, operation, passenger
carrying capacity, total load capacity and other life safety device,
instruments, etc. of the boat/ferry under the public ferry as well as
under the private ferry shall be regulated by the respective provisions
and rules delineated by the Department of Transport as well as of
Disaster Management Department of the Government, as contained
under section-6 and 7 of the Act.
(2) Life Safety Measures to be Maintained in a Mandatory Way.-To
ensure the safe operation of Ferry/Boat including safety of human life
shall be the specific, imperative and foremost guiding ingredient for
which proper condition of the boat or cargo, its reserve buoyancy,
passenger carrying capacity, life and fire safety crucial appliances and
instruments, minimum staff or crew required to handle the boat or
cargo, etc has to be maintained in a proper and mandatory way.
Chapter -VI
Remission in the settlement of Public Ferryghat.
10. The Remission in the matters of public ferryghats settled under section-4 of the
Act, during the Settlement Year, shall be done as per provisions enshrined under section-8
of the Act, in the following manners:-
(1)
If, after settlement and leasing out of a public ferryghat under section-4
of the Act, losses are caused in the midterm of the Settlement Year due
to any natural calamity/ disaster or any other such compelling reasons,
application for remission of settlement amount for the stipulated period
may be submitted to the Competent Authority concerned along with
requisite fee by the settlement holder or lessee of the concerned public
ferryghat.
(2)
The Competent Authority shall forward the application of remission, so
filed, after recording his opinion to the "Ferryghat Remission

Committee" constituted for the purpose at district level under the
chairmanship of the district Collector consisting of such ex-officio
members and representatives from the rural and urban local bodies of
the district level, as the case may be and as notified by the Department.
(3)
The "Ferryghat Remission Committee" shall examine the claims
involved in the application thoroughly by undertaking the spot and field
verification and after recording its opinion forward the same for
consideration and decision of the Commissioner of Division, along with
all relevant papers, evidences and testimonials thereof.
Chapter -VII
Deposit and utilization of revenue accrued from Public Ferryghats.
11. The revenue accruing from the settlement and lease of public ferryghats by
Competent Authority shall be deposited in the following manners.-
(1)
If the settlement and lease of a public ferryghat is done and executed by
the Local Authority, the revenue accruing from the settlement and lease
of such public ferryghats shall be deposited in the respective revenue
heads of the Local Authorities.
(2)
If the settlement and lease of a public ferryghat is done and executed by
the Collector/Additional Collector of the district, the revenue accruing
from the settlement and lease of such public ferryghats shall be
deposited in the respective revenue heads of the Government.
(3)
A total of 20 percent out of the total revenue as deposited under the
above sub-rule-(1) and sub-rule-(2) shall be earmarked for the expenses
incurred on the control, management basic amenities, upkeep and up-
gradation of such public ferryghats to be utilized by the rural or urban
local bodies, as the case may be, subject to and in consistent with the
existing rules, provisions and delineated processes prescribed by the
Government.
In such cases of settlement where the competent authority will
be the District Magistrate/Additional District Magistrate, after the
settlement amount is deposited in the consolidated fund of the state, the
amount will be obtained from the budgetary provision as per rules and
spent.
In such cases of settlement where the competent authority will
be the local bodies, the management of such ferryghats will be done by
the local bodies in consistent with the provisions of The Bihar
Panchayati Raj Act, 2006 or The Bihar Municipality Act, 2007.
Chapter -VIII
Appeal and Revision.
12. Appeal.-
(1) Any settlement holder or a person aggrieved by any dispute arising out
of lease settlement order of public ferryghats by the local authority
under sub-section-(1) of section-4 of the Act, may file an appeal in
person or by an agent or by a duly authorised advocate in the court of
the concerned Sub-Divisional Officer within 30 (thirty) days from the
date of the lease settlement order under section-10 of the Act.
Provided that, in cases of such settlement, in which the
Collector/Additional Collector is the competent authority subject to

approval, an appeal shall be filed in the Court of the Commissioner of
the Division within 30 (thirty) days from the date of the lease
settlement order.
(2)
If the appeal is filed through a lawyer, it should be accompanied by a
proper and duly executed Vakalatnama with stamp thereon and in case
of appeal through agent, it should be accompanied by the proper
authorisation by the applicant.
(3) An appeal application shall accompany on attested true copy of the
lease settlement order along with other relevant testimonials and
documents against which or concerning which the application is filed.
(4) The Sub-Divisional Officer or the Commissioner of the Division as the
case may be may condone the delay in filing appeal provided he is
satisfied that there are sufficient reasons for the delay.
(5) As soon as an appeal against the order of the competent authority is
filed, the Sub-Divisional Officer or the Commissioner of the Division,
as the case may be, shall call for the lease settlement record of the
public ferryghats from the competent authority concerned.
(6) The Sub-Divisional Officer or the Commissioner of the Division, as the
case may be, shall issue notice to all the parties concerned with the
case, directing them to appear either in person or through their
authorized representatives on the date, time and place fixed for the
hearing of the case.
(7) In case any of the parties does not appear, even after being given a
reasonable opportunity to appear and being heard, the Appellate
Authority may dispose of the case ex-parte on the basis of the available
records.
(8) The time limit for the disposal of the appeal by the Appellate Authority
shall be of 60 (sixty) working days from the date of its filing.
(9) After the disposal of the appeal, the Sub-Divisional Officer or the
Commissioner of the Division, as the case may be, shall return the lease
settlement records to the competent authority concerned for the
implementation of the order.
13. Revision.-
(1) A revision petition against the order of the Sub-Divisional Officer shall
be filed in the Court of the Additional Collector/Collector of the district
within 30 (thirty) days from the date of the order under section-10 of
the Act.
(2)
Every such revision petition shall accompany the attested copy of the
lease settlement order along with other relevant testimonials and
documents.
(3) The Collector/Additional Collector concerned may condone the delay
in filing of the application for revision provided he is satisfied that there
are sufficient reasons for the delay.
(4) As soon as the application for revision is filed, the Collector/Additional
Collector shall call for the lease settlement case record from the Sub-
Divisional Officer concerned.
(5) The Collector/Additional Collector shall issue notice to all parties
concerned with the case, directing them to appear either in person or
through their authorized representatives on the date, time and place
fixed for the hearing of the case.

(6) After the disposal of the revision application, the Collector/Additional
Collector shall return the record to the Sub-Divisional Officer
concerned for implementation of his order.
(7) A revision petition instituted against the order passed by the Additional
Collector/Collector shall be filed in the Court of the Commissioner of
the Division within 30 (thirty) days from the date of the order.
(8) The time limit for the disposal of the revision application by the
Revisional Authority shall be of 30 (thirty) working days from the date
of its filing.
(9) After the disposal of the revision application, the Commissioner of the
Division shall return the case record to the Collector/Additional
Collector concerned for implementation of the order.
(10) In cases, where an appeal has been filed in the Court of the
Commissioner of the Division, a revision petition against the order so
passed by the Commissioner shall be filed before the Board of Revenue
within 30 (thirty) days from the date of the order, which shall be
disposed of in an speedy and expeditious manner within shortest
possible time limit.
(11) After disposal of the revision petition, the Board of Revenue shall
direct the Competent Authority concerned for implementation of
the order.
(12) In case, any of the parties does not appear even after a reasonable
opportunity to appear and being heard has been given, the Revisional
Authority concerned may dispose off the case ex-parte on the basis of
the available records.
Chapter-IX
Penalties in Public and Private Ferries
14. Penalties in Public Ferries for breach of conditions of Settlement Order
and Lease.-
(1) When any settlement holder or any other person authorized by him is
found guilty for breach and violation of the terms and conditions of
settlement of a public ferryghat, as contained under rule-4 and 5 of
these Rules, makes default in the payment of the settlement amount
payable in respect of such settlement and has been convicted of an
offence and breach, as contend under sub-section-(1) and (2) of section-
11 of the Act, the Collector of the district may impose penalties on
them as per provisions of the sub-section-(3) of the section-11 of the
Act.
(2)
Likewise for any breach and violation of the terms and conditions as
laid down under rule-8 of these Rules for the private ferries, penalty for
such breach shall be imposed under sub-section-(3) of section-11 of the
Act.
15. Penalty in ferries for breach of provisions of tolls and traffic.-Every
settlement holder or any other person authorized by him to collect the tolls of a public ferry
who neglects to affix and keep in good order and repair the table of tolls mentioned under
section-5 of the Act or who willfully removes, alters or defaces such table or allows it to
become illegible, or who fails to produce on demand the list of the tolls and every settlement
holder who neglects to furnish and return required under section-5 may be punished under
provisions of sub-section (3) of section-11 of the Act.

16. Penalty in ferries for taking unauthorized toll, and for causing delay.-
Every such settlement holder or any other person authorized by him is found committing
illegal extortion, or taking more than the law-full toll or without due cause delaying any
person, animal and cattle, vehicle or other things may be punished under provision of sub-
section (3) of section-11 of the Act.
17. Penalty in ferries for rash navigation and stacking of timber.-Whoever
navigates, anchors, moors or fastens any vessel/boat or rafts, or stacks any timber in a
manner so rash or negligent as to damage a public ferry shall be punished under provisions
of sub-section (3) of section-11 of the Act and the inspecting authority under sub-section (5)
of section-4 may seize and detain such vessel, raft or timber pending the enquiry and
assessment which would be done by the Collector of the district concerned.
18. Penalties on passengers for offending in public ferries.-
(1) Every person crossing by any public ferry, who refuses to pay the
proper tolls; and every person-
(2)
who with intent to avoid payment of such tolls fraudulently or forcibly
crosses by any such ferry without paying the toll, or
(3)
who obstructs any toll collector or lessee of the tolls of a public ferry or
any of his assistants in any way in the execution of his duty under the
Act, or
(4)
who impedes or obstructs the Navik or Manjhi in discharge of their
duties, or
(5)
who after being warned by any such toll collector, lessee or assistant
not to do so, goes or takes any animals and cattle, vehicles or other
things into any ferry boat or upon any bridge at such a ferry which is in
such a state or so loaded as to endanger human life or property, or
(6)
who refuses or neglect to leave or remove any animals, vehicles or
goods from such ferry boats or bridges on being requested by such toll-
Collector, lessee or assistant to do so, or
(7)
who moors any boat, raft or other substance to or in any way obstructs
any part of a public ferry, or
(8)
who in any way during ferring acts against be nature and ecology of the
water bodies or instigates any other passenger to act for such in any
way, or
(9)
who commits any type of nuisance, misbehaves or use abusive
language to the co-passengers, shall be punished with fines invoked
under provisions of section-12 of the Act.
19. Appeal to the Commissioner.-
(1) Any person aggrieved by the order passed by the such officers
authorized by the Collector of the district under section 11 and 12 of the
Act, may, within 60 (sixty) days from the date of the order, file an
appeal to the Collector of the district.
(2) An appeal application shall accompany on attested true copy of the
order of punishment/fine along with other relevant testimonials and
documents against which or concerning which the application is filed.
(3) The time limit for the disposal of the appeal by the Appellate Authority
shall be of 60 (sixty) working days from the date of its filing.
(4) Any person aggrieved by the order passed by the Collector of the
district, may file an appeal to the Commissioner of the Division within
30 (thirty) days from the date of the order.

(5) The time limit for the disposal of the revision application by the
Revisional Authority shall be of 60 (sixty) working days from the date
of its filing.
Chapter-X
Miscellaneous
20. Stamp duty and fees.-In case of settlement of a public ferryghat by bidding or
public auction as provided under section-4 of the Act, the stamp duty and registration fee
shall be levied in such agreements as per provisions laid down and delineated by the
Prohibition Excise and Registration Department of the Government.
21. Recovery of outstanding settlement amount from lessees.-In case of any
imperative action for recovery of any kind of arrears in the settlement of public ferryghats
from the settlement holder or the lessee, action for recovery of the outstanding amount shall
be initiated by the Collector of the district concerned or any other officer authorized by him
under the relevant provisions of the Public Demand Recovery Act, 1914, as amended from
time to time.
22. Up-keep of list of public ferryghats.-In cases of settlement of public
ferryghats by the local authorities of urban and rural local bodies, all documents and papers
relating to settlement of public ferryghat by the Competent Authority of the rural and urban
local bodies under section-4 of the Act shall be maintained and up-keeped at the level of the
concerned rural and urban local bodies. However, its certified copies shall also be made
available to the respective Circle Officer of the area.
23. Change of purpose not to be allowed.-
(1) Notwithstanding anything as contained under section-17 of the Act, any
change done or executed by the settlement holder or any other person
authorized by him in the land of the public ferryghats and ferry shall be
punished as under sub-section-(3) of section-11 of the Act on the report
of the inspecting officer provided under sub-section (5) of section-4 of
the Act.
(2) Proper maintenance and protection of the nature and ecology of the
water body within the boundaries of public ferryghat, under sub-
section-(1) of section-17, shall be ensured as per delineated guidelines
and instructions of the authorities of the Government and the
Government of India.
24. Removal of Difficulties.-The government may, from time to time, as the need
arises, issue and release such executive instructions or guidelines from the level of
Department for removal of any of the difficulties arising out in implementation of the
provisions of these rules, consistent with the relevant provisions of the Act.

1.
I the lessee, have deposited ______________________with the intent that
the Collector shall hold the same until the determination of the lease, as partial security for
the due performance by me of the stipulations herein contained, and for the observance by
me of the provisions of the Bihar Ferries Settlement and Management Act, 2023 (8 of 2023)
and the Rules framed under it, and may deduct there from any settlement amount which may
become due, or penalties which may be awarded under the said Act or the Rules made there
under.
2.
I, the lessee, do hereby acknowledge to have received a copy of the Rules
under Section-18 of the Act aforesaid, and am aware of the provisions of the Act and the
Rules, which I am legally bound to conform to them. I also acknowledge to have received a
list of the tolls to be levied at the ferry.
3.
The lease to me is to be for_______________(period of lease) _________
namely, from the________________________ to the ______________________and during
this period I shall be bound to ply the ferry from ________________to the
____________________every year.
4.
I hereby agree-
(a) to provide boats for the ferry and to keep boats of such description as
the Collector may require to ply on the ferry and to keep the said boats
in a proper state of repair and fit in every respect for the conveyance
of passengers, animals and vehicles and such freight as I am entitled
to carry in them in accordance with this agreement and the Bihar
Ferryghat Settlement and Management Act, 2023 (08 of 2023) and the
rules made there under;
(b) to employ such a crew in, and to provide such equipment for, each
such boat as the Collector may require;
(c) to make at least (minimum no of crossing) crossings every day, to
make arrangements that the boats should start at the scheduled hours
from the landing places;
(d) to provide and keep in order the landing stages and the travelers' sheds
on either or both banks of the river and slopes and approaches to the
ferry, as required by Rule- 5,
(e) to affix in a conspicuous place where the tolls are taken, near each of
the landing stages, a notice boards showing-
(f) a list of the tolls which I am authorised to demand prescribed prepared
in accordance with Section-5 of the Bihar Ferryghat Settlement and
Management Act, 2023;
(g) the entries made in the register, prepared under clause 8(a) of Rule 5
in respect of the ferry;

(h) to place such boats or any of them as the Collector may from time to
time require at the disposal of the District Officer for flood relief
work;
(i) to beach the ferry boats for inspection by the Collector or any person
authorised by him and to pay the cost of such inspection at such rate
as may be fixed by Collector.
5.
I shall not charge or demand tolls for ferrying over-
(a) mails, mail-carts, dak-runners and Government telegraph messengers
on duty;
(b) any Government stores, animals and vehicles when accompanied by a
challan from the authority empowered by the collector, or
(c) any public official on emergency duty.
(d) The following persons and property, namely:-
(1) All officers and soldiers of-
(i)
The Central and State Government,
(ii) any local corps, or
(iii) any paramilitary force, when on duty or on the march;
(2) All members of a corps of volunteers when on duty or when
proceeding to or returning from duty;
(3) all officers and soldiers of the Indian Reserve Forces when
proceeding from their place of residence on being called out for
training or service, or when proceeding back to their place of
residence after such training or service;
(4) all grass cutters when employed in the service of-
(i)
Regular Forces,
(ii) any local corps,
(iii) Central Service Troops, or
(iv) any corps of volunteers.
(5) all other authorised followers of-
(i)
Central Regular Forces,
(ii)
any local corps,
(iii) Central Service Troops, or
(iv) any corps of volunteers, when they accompany anybody of
such forces, troops or volunteers or any members of such
corps on the march or when they are otherwise moving
under the orders of Military Authority;
(6)
all members of the families of officers, soldiers or authorised
followers of-
(i) Central Regular Forces, or
(ii) any local corps.
when accompanying anybody of troops, or any officer, soldier
or authorised follower thereof on duty or on the march;
(7)
all prisoners under military escort;
(8)
the horses and baggage and the persons (if any) employed in
carrying the baggage of any persons exempted under any of
the foregoing clauses, when such horses, baggage or persons
accompany the persons so exempted under the circumstances
mentioned in those clauses respectively;

all carriages and horses belonging to the Government or
employed in Central Military Service and all persons in charge
of or accompanying the same when conveying any such
persons as hereinbefore in this section mentioned or when
conveying baggage or stores or when returning unladed from
conveying such persons, baggage or stores;
(10)
all carriages and horses when moving under the orders of
military authority for the purpose of being employed on duty.
(11)
all animals accompanying anybody of troops which are
intended to be slaughtered for food or kept for any purpose
connected with the provisioning of such troops; and
(12)
all persons in charge of any carriage, horse or animal
exempted under any of the foregoing clauses when
accompanying the same under the circumstances mentioned in
those clauses respectively.
(13)
Police and other Government servants or employees or local
bodies
and
process-serving
peons,
panchayats
and
village chaukidars when travelling on duty with their bona
fideluggage, horses, palkies of other conveyances;
(14)
members of the district and local boards of district when
travelling on duty connected with their office as such
members;
(15)
coolies engaged in repairing roads with their tools and
instruments;
(16)
persons carrying dead bodies or property sent by police.
6.
I, shall not charge or demand tolls from persons who wade or swim across,
or take cattle or other animals or property across at their own cost and risk, or from persons
who cross themselves, or take other persons across without charge, in their own boats.
7.
I, hereby agree to pay the settlement amount in the following instalments
into the district treasury in the credit of the Government:-

within two days after due date of payment a duplicate challan or treasury receipt in proof of
such payment. But, if at any time before the expiry of the period for which the ferry has
been leased to me, I be removed therefrom for any breach of the terms and conditions of the
lease, or for any wilful breach of any of the rules or Section of the Act, I shall be liable to
pay settlement amount up to and including the instalment due next after my removal.
8.
If the rates of toll are reduced during the currency of my lease or the
exemptions from the payment of it are extended, this agreement is to be modified
accordingly. I shall be given a fair opportunity of satisfying the Collector as to the effect of
the change and if the terms proposed by him thereafter are not such as I can reasonably
accept, I will, according to the law, immediately carry into effect the order reducing the

rates of toll, or extending the exemption from payment of it, but will at the same time state
the amount of settlement amount I may be willing to pay under the altered circumstances of
the case. Should my offer appear to the Collector to be inadequate it shall be competent for
him to remove me, and place another person in charge of the ferry and for such time as I
remain in charge of the ferry after the issue of the order reducing the rates of tolls, or
extending the exemption from payment of it, I shall pay settlement amount only at the rate
tendered by me.
9.
If I make default in the payment of the settlement amount for the ferry or
of any penalty which may be lawfully imposed, or if I do not observe and perform the
covenants herein contained, it shall be lawful for the Collector to remove me from the
charge of the ferry and to settle the same with some other person or hold it under direct
control of the competent authority. After such removal I shall not be entitled to any part of
the proceeds of the ferry or to levy any toll there for. And if the settlement amount on
reletting the ferry falls short of the amount at which it was leased to me, and the
Government thereby incur loss, I shall be held responsible for such difference or loss the
amount of which may be deducted from my deposit. If the deposit does not cover the loss
incurred, the settlement amount due from me, and the amount or toll refunded by the
Collector under Rules of the Act, the total amount which is deficient shall be recoverable
and all sums which I become liable to pay in virtue of this agreement shall be recoverable as
a public demand under the provisions of the Bihar and Orissa Public Demands Recovery
Act, 1914 as amended from time to time. It shall be lawful for the Collector to deduct the
amount of settlement amount which I may default to pay from my security deposit and to
direct me to recoup the same within a given time and on my failure to do so to remove me
from the charge of the ferry.
10.
I will not assign, sublet or part with the possession of the ferry without the
previous consent in writing of the Collector.
11.
I shall not claim any compensation on account of roads being closed for
repairs or on account of inundation or the breaking down of bridges or on account of
deficiency of water in the river on which the ferry is situated.
12. I will circulate and disseminate all instructions related to disaster
management issued from the Government level".
13. In case of emergency in boats, the contact number of the authorized
officer/office/police station will be mandatorily displayed at a visible place in the boats.
