ARTICAL OF CHARGE FRAMED AGAINST Sri. T. KRISHNAM RAJU, PC 1240 OF 'SDRF' 5TH Bn. APSP.
C.N. 51/OEPR/A2/2017,- It is proposed to hold an enquiry against Sri T. Krishnam Raju, PC 1240 of 'SDRF' Company, 5th Bn. APSP, in accordance with the procedure laid down in Rule 20 of the APCS (CC & A) Rules, 1991.
The substance of the imputations of misconduct or misbehavior in respect of which the inquiry is proposed to be held is set out in enclosed statement of articles of charges (Annexure-I). A list of documents by which and a list of witnesses by whom, the articles of charges are proposed to be substantiated are also enclosed (Annexure-II, III).
Sri T. Krishnam Raju, PC 1240 of 'SDRF' Company, 5th Bn. APSP, is directed to submit written statement of defense within 10 days from the date of receipt of this memo and also to statement whether he desires to be heard in person.
Sri T. Krishnam Raju, PC 1240 of 'SDRF' Company, 5th Bn. APSP, is informed that an inquiry will be held only in respect of those articles of charges are not admitted. He should, therefore, specifically admit or deny each article of charge.
Sri T. Krishnam Raju, PC 1240 of 'SDRF' Company, 5th Bn. APSP, is further informed that if he does not submit his written statement of defense on or before the date specified in para-3 above further action will be proceeded based on the material available.

APSP, is invited to Rule-21, of the APCS (Conduct) Rules, 1961 under which no Government Servent shall bring or attempt to bring any political or outside influence to bear upon any superior authority to further his interest in respect of matters pertaining to his service under the Government. If any representation is received on his behalf from any other person in respect of any matter dealt with in these proceedings, it will be presumed that Sri T. Krishnam Raju, PC 1240 of 'SDRF' Company, 5th Bn. APSP, is aware of such representation and that it has been made at his instance and action will be taken against him for violation of Rule-24 of APCS (Conduct) Rules, 1964.
The receipt of the memorandum may be acknowledged.
ARTICLE OF CHARGE FRAMED AGAINS Sri.T. KRISHNAM RAJU OF 'D'
COMPANY 5th BN, APSP, VIZIANAGARAM UNDER
RULE 20 OF APCS ( CC & A ) RULES, 1991.
ANNEXURE - I
Article - I
That, Sri T. Krishnam Raju, PC 1240 of 'SDRP' Company, was declared as deserter w.e. from 21-01-2017 by the Addl. DGP, Operation(OCTOPUS), A.P., Hyd. In H.O.O. No. 90/2017, (Rc.No. A4/18/Des./OCTO-AP/2017) dated : 18-02-2017 while he was working in OCTOPUS on deputation basis. Later he was taken to duty on 13-07-17 A.N. vide this office DO.No.440/2017, (C.No.801/A6/2017) dt. 14-07-2017 on his repatriation to 5th Bn. APSP, Vizianagaram.
Basis of charges :-
Sri T. Krishnam Raju, PC 1240/2462 of this unit was found absent without leave or permission w.e. from 21-01-2017 while he was deputation in OCTOPUS., A.P., Hyderabad. A report was submitted by the R.I., Delta Team, OCTOPUS, A.P., Hyd. to the Addl. DGP., Operations, OCTOPUS, A.P., Hyderabad stating that Sri T. Krishnam Raju, PC 1240/2462 found absent for duties w.e. from 21-1-2017 to 13-2-2017 and completed 24 days absent continuously without any information he has completed the 21 days as on 10-2-2017 and the above PC was deserve to declare as 'Deserter' and requested to declare the above PC as 'desertion'. On the above report, the Addl. DGP, Operation(OCTOPUS), A.P., Hyd. has declared the above PC as a deserter w.e. from 21-01-2017 in H.O.O. No.90/2017, (Rc.No. A4/18/Des./ OCTO-AP/2017) dated : 18-02-2017. He was given opportunity to join duty within one month from the date of receipt of the desertion order or within two months from the date of desertion which ever is earlier as per the Order No. 184 of APPM Volume-I.
Further, the above PC was repatriated by the Addl. DGP., Operations (OCTOPUS), A.P., Hyd. on deeming provision in H.O.O. No.93/2017, (Rc.No. A1/18/Des./ OCTO-AP/2017) dated : 18-02-2017 of the Addl. DGP., Operations (OCTOPUS), A.P., Hyderabad.
But, he reported before the Kind DIG-IV APSP Bns., FAC of Commandant after lapse of 6 months with a representation dtd. 13-7-2017 stating that he became desertion due to his family problemsANDHRA PRADESH GAZETTE, March 12, 2018 3 and his Psychological depression and requested to take him into duty by treating his guilts as first one. On his representation, he was taken to duty on 13-07-17 AN vide this office DO. No. 440/2017, (C.No. 801/A6/2017) dt. 14-07-17. Deserting the force is highly irregular and not tolerable in the disciplined force like APSP.
Thus, Sri T. Krishnam Raju, PC 1240 of 'SDRP' Company, exhibited gross negligence of duties unbecoming on the part of Government Servant and violated the Rule 3 of APCS (Conduct) Rule 1964.
