CHOWK MASJID AND ITS ATTACHED WAQF PROPERTY - Sri P.V.H IMRAN HUSSAIN S/o. P.V.H ABDUL RAZAK MIAH - PLACED UNDER SUSPENSION U/S. 64(5) OF THE WAQF ACT,1995- FOR TEN (10) DAYS AT NANDYAL TOWN & MANDAL , KURNOOL DISTRICT.
ORDER :-
F.No.26/APSWB/KNL/Budget/2016-17/Towliath-., The Waqf institution known as Chowk Masjid & Masjid-e-Lathufia situated at Nandyal Town and Mandal, Kurnool District and its attached properties in Sy.No. 2179 an extent of Ac. 1-77 Cts of Nandyal under T.D No. 4455, Sy.No. 338 an extent of Ac.12-42 Cts and Sy. No. 473 an extent of Ac. 12-68 Cts of Moolasagaram H/ o. Nandyal under TD No. 4456 is a notified Waqf got published in the A.P Gazette No. 43-A Part-ll, dated: 24.10.1963 at SI.No. 3402.
The Board has recognized Sri P.V.H Imran Hussain S/o. Late P.V.H.A. Razak Miah as Muthawally subject to condition that the Muthawally should discharge his legitimate duties in accordance with the provisions of Waqf Act, 1995 and Rules made there under and to pay the Waqf fund @ 7% regularly as per the deriving income U/s. 72 of the Waqf Act, 1995 and to show true income & expenditure and submit the Budget time to time.
During scrutiny of accounts on verification, it is found that the muthawally of Waqf institution neglected his duties and committed breach of trust in performing his duties furnishing false statement of income and expenditure for the year 2014-15 and Budget for the year 2016-17. !n the statement of income & Expenditure, the income for the year 2014-15 is shown as Rs.1,12,300/- and in the Budget for 2016-17, the actual income for the year 2014-15 is shown as Rs. 3,28,300/-. Moreover, he has furnished the defective lease agreements after expiry of the stipulated period as per Rules 14 & 15 of Waqf Properties Lease Rules, 2014. He also violated the Rule 18 of Waqf Properties Lease Rules, 2014 by mentioning a condition of renewal of lease after expiry (of eleven months) Lease period with 10% enhancement.
Furthermore, he failed to pay the Waqf fund as per income.
For the year 2014-15, he paid the Waqf fund of Rs. 10,000/- instead of Rs.22,960/- got assessed on the income of Rs. 3,28,300/-.
For the year 2015-16, he paid the Waqf fund of Rs. 35,000/- instead of Rs. 36,764/- got assessed on the income of Rs. 5,25,200/-. ,
For the year 2016-17, he paid the Waqf fund of Rs. 27,870/- instead of Rs. 37,656/- got assessed on the income of Rs. 5,37,940/-.
For the year 2017-18, he paid the Waqf fund of Rs. 7,000/- instead tentative demand of Rs. 38,696/- on the estimated income of Rs.5,52,800/-.
8 ANDHRA PRADESH GAZETTE, June 14, 2018The AP State Waqf Board has observed that the Muthawally being a public servant as defined under section 101 of Waqf Act, 1995 is accountable for every single rupees and to maintain the accounts diligently and scrupulously and to follow the provisions of law as enunciated above.
The Muthawally continuously neglected his duties and committed breach of trust in performing his duties to the said Waqf and in respect of moneys received as income and furnished false information.
The matter was placed before the Board and after a detail discussion the Board has unanimously Resolved to suspend the Muthawalli U/s. 64(5) of Waqf Act,1995 for the period of Ten (10) days. .
Therefore, the Muthawalli Sri P.V.H Imran Hussain is placed under suspension with immediate effect under section 64(5) of the Waqf Act, 1995 for the period of Ten (10) days from the date of receipt of this orders.
Sri.L.Abdul Khadir, Chief Executive Officer, A.P. State Waqf Board, Vijayawada is hereby appointed as Enquiry Officer for conducting enquiry in to the allegations against suspended Muthawallies Sri.P.V.H. Imran Hussain.

ABDUL RAZAK M I A H , A N D S R I A Z E E M U D D I N B A S H A A P P O I N T E D T H E M A S MUTHAWALLIES U/SEC. 42 & 63 OF WAQF ACT, 1995 ARE WITHDRAWN AT NANDYAL TOWN & MANDAL , KURNOOL DISTRICT.
ORDER:
1. F.No.12/KLN/M/2007/Z-IV-.,The Waqf institution Mosque known as Chowk Masjid situated at Nandyal Town and Mandal, Kurnool District and its attached properties in SY.No.2179 and extent of AC.1.77 Cents of Nandyal under T.D.No.4455, Sy.No.388 an extent of Ac12.42 Centsand Sy.No.473 an extent of Ac.12.68 Cents of Moolasagaram H/O of Nandyal under T.D.No.4456 are notified Waqf got published in the A.P. Gazette No.43-A, Part-ll, Dated:24-10-1963 at SI.No.3402. A further Mosque known as Masjid-e- Lathufiya and Iqra School constructed within Sy.No.2179 of Nandyal are a part and parcel of said notified Waqf institution.
ANDHRA PRADESH GAZETTE, June 14, 2018 92. The Waqf Board has appointed three (3) Muthawallies by name (1) Sri P.V.H. Mohiuddin Basha (2) Sri P.V.H. Abdul Razzack Miah and (3) Sri P.V.H. Azeemuddin Basha U/s.63 of Waqf Act, 1995 in place of the deceased notif ied Muthawalli Sri P.V.H. Abdul Lateef as per A.P.Gazette No.12, Dt:20-03-1997 without mentioning the specific period of the term of the above three Muthawallies which is mandatory U/s.63 of Waqf Act, 1995.
3. On 05-01-2007, Sri P.V.H. Mohiuddin Basha was expired and his legal heirs have given No Objection Certificate in favor of their Cousin Sri P.V.H. Javid Miah S/o. Sri P.V.H. Abdul Razzack Miah for succession to the office of the muthawalli since the Rule of Secession to the Office of the Mutahwalli has been recorded as "Hereditary" in Survey Commissioner's Report, dated:24-04-1956. Therefore, the Waqf Board, instead of "recognizing" Sri P.V.H.Javid Miah as Muthawalli U/s.42 of Waqf Act, 1995, the Board has erroneously "appointed" him as Muthawalli under the said provision in the reference 1 st read above in place of deceased notified Mutahwalli Sri P.V.H. Mohiuddin Basha.
4. Further, one Sri P.V.H.Imran Hussain, S/o. P.V.H. Abdul Razzak Miah was also "appointed" as Muthawalli erroneously in the reference 2 nd read above instead of "recognizing" him as Muthawalli U/s.42 of Waqf Act, 1995 in place of his deceased father P.V.H.Abdul Razzak Miah.
5. Sec. 42 of Waqf Act, 1995 does not deal with "appointment" of Muthawalli. Infact Sec. 42 is being dealt with "reorganization" of Muthawalliship under Hereditary and therefore the Waqf Board would have "recognized" the successor of the deceased muthawalli under the said provision of Waqf Act, instead of "appointing" him as Muthawalli.
Hence, the proceedings issued in favor of Sri P.V.H.Javid Miah and Sri P.V.H.Imran Hussain duly "appointing" them as Muthawallies by proceedings No.12/KNL/M/07/Z-IV, Dt: 29-03-2007 and Dt:23-02-2017 in the references 1st & 2nd read above respectively are defective in the eye of Law and under the said Provision of Waqf Act, 1995.
6. So, there is a need for rectifying the aforesaid defective proceedings including the proceeding dated: 21-01-1997 published in A.P.Gazette No.12, dated: 20-03-1997 mentioned above issued in favor of all the Three (3) Muthawallies issued U/s.63 of Waqf Act, 1995 without mentioning the "period" of Muthawalliship as required U/s. 63.
7. As a follow-up action for rectifying the above defects, the Waqf Board has to withdraw all the above said defective proceedings issued U/s.63 and U/s.42 of Waqf Act, 1995 including its relevant Gazette notifications so as to issue fresh modified proceedings duly rectifying the defects mentioned above and to get it published in the Gazette afresh.

In this course of action, during the scrutiny of the relevant record, it has been noted that the above mentioned Muthawallies are not performing their legitimate duties bound to be performed by them under the provisions of Waqf Act, 1995 and moreover the annual budget and accounts submitted by one of the Muthawallies Sri P.V.H.Imran Hussain is found false, and therefore he kept under suspension U/s.64(5) of waqf Act, 1995 by proceedings No.26/APSWB/KNL/Budget/2016- 17/ Towliath, dated:29-05-2018 in accordance with Board's Resolution No:046/2018, Dated: 05-05-2018.
9. In the issue of defective proceedings of the muthawallies Sri P.V.H.Javid Miah and Sri. P.V.H. Azeemuddin Basha, the matter has been placed before the Hon'ble Chairperson who after careful examination of entire case, has passed orders in the reference 4 th read above to put up for appropriate Resolution by Hon'ble Board Members in the matter.
10. Accordingly, the Hon'ble Board Members, after gone through in to the entire issue, have passed an unanimous Resolution in the reference 5th read above to withdraw the defective Towliath (Muthawallies) proceedings of Sri P.V.H.Javid Miah and Sri. P.V.H.Azeemuddin Basha provided that both the said individuals are at liberty to approach the Board with their fresh applications for their recognization under relevant provision of the Waqf Act.
11. In accordance with the above said Resolution / Orders of the Board, the defective proceedings of Sri P.V.H.Javid Miah duly appointed him as muthawalli vide reference 1 st read above issued U/s. 42 of Waqf Act, 1995 and Sri. P.V.H.Azeemuddin Basha, appointed as muthawalli U/s. 63 of the said Waqf Act vide A.P.Gazette No. 12, dated:20-03-1997 are hereby withdrawn, provided that both the said individuals are at liberty to approach the Board with their fresh applications for their recognization under relevant provision of the Waqf Act.
12. Therefore, Sri.D.AItaf, Inspector Auditor Waqfs, Kurnool District is hereby kept in-charge of the management of both the institutions and its entire attached Waqf properties as time gap arrangement till further orders. Hence, the Inspector Auditor shall assume charge and report compliance.
