[1]2 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-VII Memo No.G.Section/9622/2013-, In view of revision of confirmed seniority list of Deputy Executive Engineers, PR from Zone.I to Zone.IV, issued in the references 3 rd to 6th cited, existing confirmed state wide integrated seniority list of Graduate Deputy Executive Engineers, PR was revised provisionally and communicated vide this office reference 10th cited and invited objections.

In turn, the following individuals have submitted their objections and the same are discussed and disposed here under keeping in view of the existing rules / Hon'ble Court orders and Govt., instructions from time to time.

1) Sri D.Venakta Ramana, EE, RWS&S, Kurnool:

The above individual has enclosed the Hon'ble High Court of AP orders, dt:24.04.2018 issued in W.P.No.14565 of 2018 filed by him and the Hon;ble HC has issued following orders:

"the Writ Petition is accordingly disposed of directing the ENC, PR, Govt of AP, Vijayawada, the second respondent to consider the petitioner-applicant's objections and representations on their own merits and in accordance with law and pass appropriate reasoned orders thereon under communication to the petitioner-applicant. The petitioner- applicant shall also be provided a personal hearing by the second respondent before final orders are passed. The exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this orders.

Remarks: In view of the above Hon'ble HC orders, the above individual was requested to attend for personal hearing before ENC, PR, Vijayawada vide this office Lr.No.G. Section/9622/2013, dt:28.05.18. Accordingly, he has attended on 06.06.2018 before the ENC, PR, Vijayawada and submitted the following:

1. In the seniority list mentioned, as per G.O.MS.N0.6IO, he was placed below the last candidate in the native zone like zonal transfer.

2. As he has allotted to AP State by the Kamalanathan Committee and kindly apply the State Re-organization Clause 79(1) Section.

3. He came from State Bifurcation as Executive Engineer and State cadre post and keep the seniority as Executive Engineer in State vide integrated seniority list separately.

4. Finally, requested, not to disturb the seniority.

The objection was examined and the following reply was issued to the above individual vide this office Lr.No.G.Section/9622/2013, dt:07.06.18

1. The ENC, RW S&S, Vijayawada, vide Lr.No.PRR06-27022(31)/29/2018-July 12, 2018] ANDHRA PRADESH GAZETTE EXTRAORDINARY 3 G.ECRWSS, dt:25.04.2018, has shown his native zone as Zone.I, being competent authority. Therefore, his name was placed in Zone.I

2. ENC, RWS&S, Vijayawada, vide Lr.No.PRR06-27022(31)/29/2018-G.ECRWSS, dt:25.04.2018 has informed that, the above individual was allotted to the RWS&S Department to the residual State of AP, based on his option in the state cadre post and presently working in RWS&S Dept. The ENC, RWS&S, Vijayawada, being the competent authority is concerned to continue his service under SRC Act. 3. The above individual was promoted as Executive Engineer after bifurcation of the P.R. Department as PR and RWS&S Departments i.e. after 01.04.2008 and the Engineer-in-Chief, PR, Vijayawada is not competent to issue seniority list of Executive Engineers pertains to RWS&S Department separately.

4. The State wide integrated seniority list of DEEs was issued during 2014 for Zone.I to VI in the unified State of AP. Later, certain Engineers of PR Dept., are approached Hon'ble APAT to implement the orders of the Hon'ble Supreme Court in Civil Appeal Nos.9856-9860/2016 & 9861/2016, dt:27.09.16 in respect of implementation of Rule 16 (h) of APSSS Rules. In turn, the Hon'ble APAT, in its judgment dt:03.11.16 in OA No.5223/2013 has directed to consider the judgment of Hon'ble Supreme Court and set aside the said seniority lists and consider the promotions to the applicants. In view of the above Hon'ble Court orders, the Govt., vide G.O.Ms.No.17, dt:26.02.18 of PR & RD (E.I) Department, have issued amendment to the APPR Engineering Service Rules. In the mean while, the Govt., of Telangana, vide G.O.Rt.No.746, dt:30.11.17 of PR & RD (PR.I) Department, have issued orders for year wise panels from 2000-01 to 2016-17 for the post of Executive Engineer and above cadres.

In view of the orders issued by the Govt., of AP in respect of Rule. 16 (h), the seniority lists in the cadre of Assistant Executive Engineer and Deputy Executive Engineer, PR are revised for Zone.I to IV only, since the State was bifurcated on 02.06.2014. As such, the above individual name was not included in the said lists, since he belongs to Zone.VI in the cadre of Asst. Executive Engineer and Deputy Executive Engineer. But, based on the ENC, RWS&S, Vijayawada, Lr.No.PRR06- 27022(31)/29/2018-G.ECRWSS, dt:25.04.2018, the above individual name was discussed in the provisional state wide integrated seniority list of Graduate DEEs list. Now, the above individual has objected on his place in the said list, as he was allotted to AP State in the State cadre post.

The PR Department was bifurcated in to PR & RWS&S Departments on 01.04.2008. Later, the above individual was promoted as Executive Engineer in RWS&S Department only. Later, the A.P. State was bifurcated in to AP &4 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-VII
