AMENDMENT TO RULE 7 OF THE ANDHRA PRADESH COOPERATIVE TRIBUNAL (PROCEDURE) RULES, 1994.

NOTIFICATION

In exercise of the powers conferred by sub-section (1) of Section 130 of the Andhra Pradesh Cooperative Societies Act 1994, the Governor of Andhra Pradesh hereby makes the following amendments to the Andhra Pradesh Cooperative Tribunal (Procedure) Rules, 1994 issued in G.O.Ms.No. 266 Agriculture & Cooperation (Coop.IV) Department, Dated : 25.06.1994 and published in the Andhra Pradesh Gazette RS to Part II (Ext.) Dated : 05.07.1994 as subsequently amended from time to time.

AMENDMENTS

In the said Rule 7,

(1) In sub-rule (1), after the words " a registered post ", the following shall be added namely,-"duly issuing prior notice to the Presenting Officer or the counsel appearing for the State, Where Government is a party, in all proceedings including out of order proceedings" duly Serving the petition, application accompanying affidavit and documents that are relied on by the petitioners". [1] 2 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-I (2) After sub-rule (4), the following shall be added namely,-

"(5) The Secretary of the Tribunal shall ensure the service of notice either on Presenting Officer or the counsel at Tribunal representing the state before registering the case.

(6) On receipt of notices, the Presenting Officer is competent to present the case in all, proceedings before the Tribunal including the out of order proceedings as referred to in clause 2 (ga) of the Rules".
