CR.No. 1133 /2019/CPE/B3,- Vide this office reference 1st cited Government was requested to accord permission for revision of panels approved by the DPC of the relevant years in the cadre of P&EIs and to prepare year wise panels as the seniority lists of its feeder category i.e. the P&ESIs have been revised.

Accordingly, Government vide its Memo in the reference 2 nd cited have accorded permission to revise the approved panels in the cadre of P&EI and to prepare year wise panels to maintain uniformity in application of law and to avoid litigation.

In pursuance of the above orders, the Nodal Deputy Commissioner, Visakhapatnam vide his orders 3rd cited above has issued provisional seniority list of P&EIs from the panel year 1996-97 onwards for Visakhapatnam zone inviting objections, if any on the said list.

While the matter stood thus, the Hon'ble APAT in O.A.No.1631 of 2018 and 1698 of 2018 issued its orders Dt.03.12.2018 holding that the CPE is Appointing Authority for the post of P&EI, but not the Deputy Commissioner. In view of the above orders of the Hon'ble APAT the provisional seniority list issued by the Nodal DC vide his reference 3rd cited above has become invalid.

In pursuance of the orders of the Hon'ble APAT, it is decided to issue revised seniority list in the cadre of P&EIs.

During the estimation of substantive vacancies in the cadre of P&EI in Zone-I, it is noticed that this office vide Cr.No. 10640/2007/CPE/B3 dated 27.09.2016 has clarified that the (17) posts created in Zone-I vide G.O.Ms.No. 558 Rev(X) Dept., dated 31.10.95 were not newly created and they are transferred from other zones in the State, as such they shall be treated as substantive vacancies as on 31.10.95 in 1995-96 panel year. Since the seniority of P&EIs is settled up to the year 1995-96, these vacancies are carried forward to the panel year i.e. 1996-97.

Similarly, the substantive vacancies have been worked out from the year 1982-83 onwards till the panel year 1995-96 duly following the procedure as enunciated under rule 6/ 4 of the AP SSS Rules 1961/ 1996 and it is estimated that (12) substantive vacancies were previously not taken into consideration. Thus all together (29) substantive vacancies are to be included in the panel year 1996-97.

Since the method of direct recruitment to the cadre of P&EI had been dispensed vide G.O. Ms. No. 453 Rev. (Ex.I) dated 30.05.97, all the above (29) vacancies are allotted to promotees as on 31.05.1997 i.e. for the panel year 1996- 97.

Keeping in view of the above facts, the provisional seniority list in the cadre of P&EIs has been prepared for the panel years from 1996-97 to 2007-08 duly following the Rules contained in the APSSS Rules 1996, A.P. Excise Service Rules 1961 and also the instructions issued in Govt. Memo No.16 GAD 21.04.1999, as shown in the statement annexed.

The provisional seniority list of Zone-I along with the provisional seniority list of Zone-II and also the integrated seniority list of these two Zones in the cadre of P&EI i.e. Multi Zone-I are communicated here with. These provisional seniority lists are subject to the outcome of various Appeals pending before various Authorities either in P&ESI cadre or P&EI cadre and also various OAs/ VVPs/ SLPs pending, if any.

Objections if any, on the above provisional seniority lists of Prohibition & Excise Inspectors (P&EIs) may be submitted to the undersigned within (10) days from the date of receipt of the lists or publication of this notice in the Andhra Pradesh Gazette.
