[1]2 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-II 1. Whereas, Sri K. Sudhakar Reddy has been appointed as DAO(W) Grade-ll during combined State of Andhra Pradesh vide this office Proceedings No.DWA/HYD/SN.I/EC.1/2012-13/32, dt 24-04-2012 selecting from the APPSC vide Lr.No.1313/RS-15/2007, dt 21-04-2012 & Lr.No.1374/Rs-15/2008, dt 21-04-2012. He has reported to the Director of Works Accounts, AP on 27-04-2012.
After completion of training at MCRHRD, he was posted as DAO(W ) Gr-ll, Monitoring Division, Tekuulapally and joined in said division on 19-11-2012.
2. And whereas, the individual proceeded on leave from 23-05-2013 to 29-09-2013 on Medical Grounds and subsequently, he has not extended any kind of leave and his where abouts were also not known to the department. 3. And whereas, this office letter No. DWA/HYD/SN.I/EC.1/2016-17/205, dt 20-08- 2016, the Executive Engineer, Monitoring Division, Tekulapally was also requested to furnish the service book and other details of the individual for further action. In turn, the Executive Engineer vide reference 4 th cited, has submitted that, the DAO(W) Gr-ll was on leave from 23-05-2013 to 28-05-2013 and extended upto 29-09-2013 on Medical Grounds and his whereabouts are not known beyond that period.
4. Further, in this office Memo.No. DWA/HYD/SN.l/EC.1/2016-17/215, dt 24-08-2016, Sri K. Sudhakar Reddy, DAO(W) Gr-ll is directed to report before the Director of Works Accounts, AP by 15-09-2016, otherwise further action will be taken as per Rule 20 of APCS (CC&A) Rules, 1991 and also as per the instructions issued by the Government vide G.O.Ms.No.260 GA(Ser.C) Department, dt 04-09-2003. The said Memo, was sent to the individual by Register post to two different addresses which are available in this office records. One cover containing the address of "H.No. 12-51, Acharla Colony, Proddutur" returned to this office and another cover containing the address of " Srinivasa Residency, Besides Dr. Reddy's Foundation, Madinaguda, Hyderabad " is not returned.
5. And whereas, the individual has been allotted to the State of AP during bifurcation of erstwhile state of AP w.e.f. 02-06-2014. "Till to date the individual has not turned out from the unauthorised absence from 30-09-2013.
6. And whereas the individual have been framed the articles of charges for his unauthorised absence, beside absconding duty from 30-09-2013 vide this office Proceedings No.DWA/VJA/Sn.l/EC.1./2016-17/309, dt 13-12-2016 with a direction to submit the written statement of defence. The same have been sent to the DAO(W) to two (2) different addresses which are available in this officeSeptember 27, 2019] ANDHRA PRADESH GAZETTE EXTRAORDINARY 3 records through RP Ack. due. It is informed that, the charge memo, sent to one address (i.e. Plot No.903, dt SKD Nagar, Vanastalipuram, Hyderabad ) is served and charge memo, sent to another address (i.e. Flat No.209, Srinivasa Residency, Beside Dr. Reddy Foundation, Madinaguda, Hyderabad) has been returned by the postal authorities on 30-08-2016, stating "No such address".
7. And whereas, as per the directions of the Government vide Memo.
No.848/149/WA/Admn.ll/2017, dt 12-05-2017, the charge Memo, has been published in the AP Ex-ordinary Gazettee No.G110, dt 15-05-2017 of Part II, Page No.1, due to individual was not at all available.
8. And whereas, this office has proceeded to enquire on the facts of absconding from 30-9-2013 under Rules 20 (2) of APCCA Rules, 1991. Sri P. Gangadhara Rao, JDWA., Dowlaiswaram has been appointed as Enquiry Officer, besides Smt. E. Kalavathi, PAO., Vijayawada has been appointed as Presenting Officer vide reference 6th & 8th cited.
9. And whereas, the findings of the Inquiry Officer is as follows.
"In pursuance of the inquiry to be held on the charge made against the charged officer i.e. Sri K. Sudhakar Reddy, notice No.lO/K Sudhakar Reddy/NQ/2019/335, dt 27-02-2019 was sent to the Charged Officer to the two addresses available vide register post with ack. due duly informing to attend premilinary inquiry to be held at 10.30 AM in the chamber of Joint Director of Works Accounts, Dowlaiswaram on 16- 03-2019. One notice sent to the address "Flat No.209, Srinivasa Residency, Beside Dr. Reddy Foundation, Madinaguda, Hyderabad" was returned to the IO/JDWA/Dowlaiswaram duly endorsed by the postal department "No such person" and received on 11-03-2019. The copy of the notice sent to the address "Flat No.903, SKD Nagar, Vanastalipuram, Hyderabad" was not returned by the postal department. The acknowledgement card was received from the postal department duly signed by some person by name N. Venkata Reddy. It is assumed that the notice sent to the above address might have been received by the Charged Officer and it may be construed that the Charged Officer is not interested to attend the inquiry.
In view of the above, I am convinced with the arguments of the presenting officer and also the Charged Officer has not attended the inquiry, I am of the opinion that there is not point that not to take action against the Charged Officer.
Specifically, the charge against the charged officer is proved."4 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-II 10. And whereas, as per the orders of the Government in G.O.Ms.No.260 GA(Ser) Department, dt 04-09-2003, that, in case of unauthorised absence to duty for a continuous period exceeding one year, the penalty of removal from service shall be imposed on the Government employees, after duly following the procedure laid down in APCS (CCA) Rules, 1991.
11. And whereas, accordingly the necessary due procedure is also followed in conducting enquiry Ex-parte under rule 20(14) to (19) of APCCA Rules, 1991 on the allegations made with unauthorised absence, it is clearly noticed that the said DAO(W) deliberately absconded from the duty without intimation to the Department (or) without permission for about 6 years" which act is imposable with the penalty of removal from service in terms of G.O.Ms.No.260 GA(Ser) Department, dt 04-09-2003, read with Rule 9 (ix) of APCCA Rules, 1991.
12. And whereas, the facts of the case have been submitted to the Government for according permission to impose punishment of removal from service against Sri K. Sudhakar Reddy, DAO(W) Grade-ll, based on the report of the enquiry officer in terms of G.O.Ms.No.260 GAD, dt 04-09-2003 read with Rule 9 (ix) of APCS (CCA) Rules, 1991.
13. And whereas, the Government vide reference 10 th cited, have accorded permission to impose penalty of removal from service against Sri K. Sudhakar Reddy, DAO(W ) Gr-ll, after duly following the procedure laid down in APCS(CCA) Rules, 1991.
14. Accordingly, a penalty of "Removal from Service" is hereby imposed against Sri K. Sudhakar Reddy, DAO(W) Grade-ll under Rule 9(ix) of Andhra Pradesh Civil Services (Classification, Control & Appeal) Rules, 1991 read with G.O.Ms.No.260, General Administration(Ser.C) Department, dt 04-09-2003 and as per the instructions of the Government vide U.O.Note 10 th cited, from the date of unauthorised absence.
