W hereas, received radio message read 4 th above from the Deputy Superintendent of Police, ACB, Kurnool wherein it was reported that the Accused Officer Sri I.Shashikanth, Town Planning Building Overseer ,Banaganapalli N.P. was trapped by the ACB Officials when he demanded and accepted a bribe of Rs.5000/- from the complainant Sri Mista Mohammed Shakir, Banaganapalle for doing an official favour.

2. The Accused Officer Sri I.Shashikanth, Town Planning Building Overseer, Banagapalli was arrested on 11-09-2014 and produced before the Hon'ble Court of Special Judge for SPE and ACB cases , Kurnool for Judicial custody and remanded to judicial custody in terms of Rule 8(2) of APCS (CC&A) Rules, 1991.

3. And whereas, on receipt of the radio message, the matter has been examined by the appointing authority and the said Sri I.Shashikanth, Town Planning Building Overseer has been kept under suspension vide this office Proceedings read (5) above pending enquiry.

4. And whereas, the Government vide Memo read 8 th above have reviewed the suspension of said Sri I.Shashikanth, Town Planning Building Overseer (u/s) and has revoked the suspension orders with immediate effect, pending finalization of the criminal / disciplinary proceedings against the Accused Officer and also issued directions to the Director of Town and Country Planning to take immediate necessary action accordingly and on reinstatement post him to a non focal post.

5. And whereas, the appointing authority vide this office proceedings 8 th read above sanctioned prosecution of the said Sri I.Shashikanth, Town Planning Building Overseer (u/s) for the offences punishable u/s 7 and 13 (2) r/w 13(1 )(d) of the Prevention of Corruption Act, 1988.

6. And whereas, the department vide this office proceedings 10 th read above has issued orders revoking the suspension of the individual and on reinstatement he has been posted to Dhone Municipality.

7. And whereas the Special Judge for SPE & ACB cases, Kurnool has delivered the judgment on 25-06-2019 in C.C.No. 07/2016. The Spl. Judge convicted the A.O. Sri I.Shashikanth, for Town Planning Building Overseer, Banaganapally N.P.,Kurnool Dist. The Special Judge sentenced the A.O. to undergo rigorous imprisonment for a period of two years and also to pay a fine of Rs.5,000/- for the offence punishable u/s 7 of P.C. Act, 1988 and in default of payment of fine amount , the Accused Officer shall undergo simple imprisonment for a period of three months. Further, the A.O. was also sentenced to undergo rigorous imprisonment for a period of two years and to pay a fine of Rs. 5,000/- for the offences u/s 13 (1) (d) r/w 13(2)of P.C. Act, 1988 and in default of payment ofANDHRA PRADESH GAZETTE, October 4, 2019 3 fine amount ,the A.O. shall undergo simple imprisonment for a period of three months and the both substantive sentences of imprisonment imposed again accused shall run concurrently.

The matter has been examined in detail and it has been decided to impose a punishment of dismissal from service against the accused officer Sri I.Shashikanth,Town Planning & Building Overseer, Dhone Municipality under Clause (x) of Rule 9 read with sub­rule (i) Rule.25 of A.P. Civil Services (CCA) Rules, 1991 read with G.O.Ms.No.2 GA (Ser.C) Department, Dt:04-01-1999, as he was convicted by the Judgment Dt:25-06-2019 of Hon'ble Special Judge for SPE & ACB Cases, Kurnool in C.C.No.7/2016. 9. Now, therefore, in exercise of the powers conferred on the Director of Town and Country Planning, A.P., Guntur vide the orders of the Government issued in G.Os read (1) to (3) above and in pursuance of the orders of the Government issued vide Memo read 11 th above, hereby imposed a punishment of 'Dismissal from Service' against Sri I.Shashikanth, Town Planning Building Overseer, Dhone Municipality with immediate effect under Clause (x) of Rule 9 read with sub-rule (i) Rule.25 of A.P. Civil Services (CCA) Rules, 1991 read with G.O.Ms.No.2 GA (Ser.C) Department Dt:04-01-1999, as he was convicted by the Judgment of Ho'ble Special Judge for SPE & ACB Cases, Kurnool in C.C.No.7/2016.
