It is proposed to hold a Joint Oral Enquiry against Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension and 2) Sri R.Anka Babu, Inspector of Police, formerly Maredumilli Circle of East Godavari District and now under suspension in accordance with the procedure laid down in Rule-20 of the Andhra Pradesh Civil Services (Classification, Control and appeal) Rules, 1991.

The substance of the imputations of misconduct or misbehaviour in respect of which the inquiry is proposed to be held as set out in the enclosed statements of articles of charges (Annexure-I) and a list of documents by which, and a list of witnesses by whom, the articles of charges are proposed to be sustained are also enclosed (Annexure-II and III).

3. Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension is directed to submit within 10 working days of the receipt of this order, a written statement of his defence.

4. Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension is informed that an inquiry will be held only in respect of those articles of charges as are not admitted. He should, therefore, specifically admit or deny each article of charge.

5. Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension is further informed that if he does not submit his written statement of defence on or before the date specified in para-3 above, further action will be processed based on the material available.

6. Attention of Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension is invited to Rule-24 of the Andhra Pradesh Civil Services (Conduct) Rules, 1964 under which no Government Servant shall bring or attempt to bring any political or outside influence to bear upon any superior authority to further his interest in respect of matters pertaining to his service under the Government. If any representation is received on his behalf from another person in respect of any matter dealt within these proceedings it will be presumed that Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension is aware of such a representation and that it has been made at his instance and action will be taken against him for violation of Rule-24 of the Andhra Pradesh Civil Services (Conduct) Rules, 1964.

7. The receipt of the Memorandum should be acknowledged.

ANNEXURE-I

Statement of Articles of Charge framed against Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension "for exhibiting gross misconduct in indulging in corrupt practices in extorting an amount of Rs.40,000/- by forcibly entering into the house of one Pallala Mangireddy of Chintakoyya(v) of Y.Ramavaram(M) and further colluded with Sri R.Anka Babu, Inspector of Police, Maredumilli Circle and two other private persons namely Prasad of Kadiyam and Bheesetti Appaji of Maredumilli(v) and threatened Sri Pallala Mangireddy of Chintakoyya(v) of Y.Ramavaram(M) and Maddeti Anjireddy, Mohanapuram(v) of Gangavaram(M) with dire consequences at Maredumilli PS that they were doing ancient coins business and demanded an amount of Rs.2,40,000/- from Pallala Mangireddy and also Rs.1,00,000/- from Maddeti Anjireddy respectively, otherwise, they would foist a Ganja case against them and the CI accepted an amount of Rs.2,00,000/- from Mangireddy and Rs.1,00,000/- from one Karri Sanyasireddy of Maredumilli(v) who is the brother-in-law of the said Anjireddy as illegal gratification through the mediator Bheesetti Appaji of Maredumilli(v) and also obtained their signatures on the blank papers and further threatened them to not to inform the matter to anybody and thereby violated Rule.3(1)(2)(3) of A.P.C.S. Conduct Rules, 1964".

ARTICLE-I

That, Sri B.Satyanarayana, PC.3759, now under suspension had previously worked Maredumilli PS of East Godavari District from 07.06.2015 to 31.05.2017.

That, one Pallala Mangireddy is a native of Chintakoyya (v) of Y.Ramavaram(M), which is under the jurisdiction of Y.Ramavaram PS. He has been residing with his wife Ashajyothi and 3-children and eking out his livelihood by doing agricultural coolie works. About 3-months back, some persons came to his village in search of ancient coins and asked him about ancient coins and when he replied that he had no knowledge about old coins, they left the place. While so, on 03.10.2016, while he was present in his house, PC.3473 Sri S.Balaji and Sri Gorle Prem Dasam Babu, Home Guard.940 of Maredumilli PS went to the house of said Pallala Mangireddy and informed him that the Inspector of Police Sri R.Ankababu of Maredumilli Circle had summoned him to Maredumilli PS, as there is a report against him that he was selling old coins. After some time, the PC.3759 Sri B.Satyanarayana of Maredumilli PS also went to his house and informed that some persons reported against him alleging that he is selling ancient coins and the Inspector of Police Sri R.Ankababu summoned him to Maredumilli PS. By saying that, he forcibly entered into the house of Mangireddy and extracted an amount of Rs.40,000/- from him.

Then, as per the instructions of Inspector of Police, Pallala Mangireddy along with his wife Ashajyothi went to the Maredumilli PS at about 10.00 AM and noticed that his friend Maddeti Anjireddy was present in the Maredumilli PS at that time. The SI4 ANDHRA PRADESH GAZETTE, October 7, 2019 of Police Sri S.Tulasi Ram of Maredumilli PS who was present in the PS asked him why they came to Police Station, for which he replied that Sri R.Ankababu, Inspector of Police had called him to the PS.

In the meantime, Sri R.Ankababu, Inspector of Police came into the Police Station from his Circle Office which is located in the upstairs of the Police Station and instructed the SI of Police, Maredumilli PS to go and check the vehicles in front of the Police Station. Both the Inspector of Police and the PC.3759, then threatened the said Mangireddy as to why he cheated one Prasad of Kadiyam by taking Rs.4.00 lakhs from him on the guise to give ancient coins and also compelled him to say that he gave the said amount to Anjireddy. But, Mangireddy stated that he did not take the said amount and also did not give any amount to the said Anjireddy, but he gave only a sum of Rs.20,000/- to him as a hand loan. At that time, the said Prasad came to the Police Station and threatened the said Mangireddy to give the ancient coins; otherwise he would get foist a Ganja case against them by the Inspector of Police.

In the meantime, one Bheesetti Appaji of Maredumilli(v) also came to the Police Station, approached Mangireddy and Anjireddy and suggested them to give an amount of Rs.2,40,000/- and Rs.1,00,000/- respectively so that he could manage that no case is foisted against them by mediating with Sri R.Ankababu, Inspector of Police. The PC.3759 Sri B.Satyanarayana had also supported their version and threatened them. W hen, they refused to pay the said amounts, the CI Sri R.Ankababu and the PC.3759 Sri B.Satyanarayana beat them indiscriminately. Due to fear of Ganja case, on 05.10.2016, Sri Pallala Mangireddy had withdrawn an amount of Rs.2,00,000/- from the Andhra Bank Account of his mother-in-law Kondla Lakshmamma and given the same to the Inspector of Police Sri R.Ankababu through Bheesetti Appaji in the presence of his younger brother Sri Pallala Devireddy and his wife Ashajyothi. At the same time, one Sanyasi Reddy, who is the brother-in-law of Anjireddy had also given an amount of Rs.1,00,000/- to Sri R.Ankababu, Inspector of Police. The Inspector of Police Sri R.Ankababu and PC.3759 Sri B.Satyanarayana have created the above transaction as if the settlement was made in the presence of village elders and prepared a fabricated settlement papers accordingly. The Inspector of Police and the PC.3759 along with Prasad of Kadiyam and Appaji have obtained their signatures on the blank white papers by threatening them with dire consequences of foisting Ganja case. Later, Sri R.Ankababu, Inspector of Police and PC.3759 Sri B.Satyanarayana threatened them to not to reveal the above transaction to anybody.

Sri R.Ankababu, Inspector of Police and PC.3759 Sri B.Satyanarayana of Maredumilli Circle without having any jurisdiction and without any complaint have interfered into the issue and made settlement. Thus, Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension had exhibited gross misconduct in indulging in corrupt practices in extorting an amount of Rs.40,000/- by forcibly entering into the house of one Pallala Mangireddy of Chintakoyya(v) of Y.Ramavaram(M) and further colluded with Sri R.Anka Babu,ANDHRA PRADESH GAZETTE, October 7, 2019 5 Inspector of Police, Maredumilli Circle and two other private persons namely Prasad of Kadiyam and Bheesetti Appaji of Maredumilli(v) and threatened Sri Pallala Mangireddy of Chintakoyya(v) of Y.Ramavaram(M) and Maddeti Anjireddy, Mohanapuram(v) of Gangavaram(M) with dire consequences at Maredumilli PS that they were doing ancient coins business and demanded an amount of Rs.2,40,000/- from Pallala Mangireddy and also Rs.1,00,000/- from Maddeti Anjireddy respectively, otherwise, they would foist a Ganja case against them and the CI accepted an amount of Rs.2,00,000/- from Mangireddy and Rs.1,00,000/- from one Karri Sanyasireddy of Maredumilli(v) who is the brother-in-law of the said Anjireddy as illegal gratification through the mediator Bheesetti Appaji of Maredumilli(v) and also obtained their signatures on the blank papers and further threatened them to not to inform the matter to anybody, which is quite unbecoming on the part of a member of a disciplined force and thereby failed to maintain absolute integrity.

Thus, Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension by his above acts, has exhibited lack of integrity and reprehensible conduct and thereby violated Rule.3(1)(2)(3) of A.P.C.S. Conduct Rules, 1964.

Whereas disciplinary proceedings under Rule-20 of the A.P. Civil Services (Classification Control; and Appeal) Rules, 1991 have been initiated and accordingly Articles of charge was framed against the charged officers Sri R.Anka Babu, Inspector of Police, formerly Maredumilli Circle of East Godavari District and now under suspension and 2) Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension vide reference cited with instructions to submit their Written Statement of Defence within 10 working days of the receipt of the Articles of charges.

And whereas, the Rule 20[5(d)] of the A.P.C.S. (CC & A) Rules, 1991 envisaged that;

The disciplinary authority shall inform the Government Servant

to submit within five days a list of documents, which he requires

to be discovered or produced by Government for the purpose

of his defence indicating the relevance of the documents so

required.

Hence, the charged officers Sri R.Anka Babu, Inspector of Police, formerly Maredumilli Circle of East Godavari District and now under suspension and 2) Sri B.Satyanarayana, PC.3759, formerly Maredumilli PS of East Godavari District and now under suspension are hereby directed to furnish the documents, if any required for the purpose of submitting their defence, indicating the relevance of the documents so required, within 5 (five) days from the date of receipt of this Memo. Receipt of the memo should be acknowledged.
