In the reference 1 st cited, the Dist. Medical & Health Officer, Anantapur has informed that certain Female staff and Asha's of Primary Health Centre, Rayalacheruvu have submitted a complaint against Sri B. Kodandarami Reddy who is working as MPHEO in the same Primary Health Centre stating that he is harassing them in various means and they are suffering a lot with his attitude. Basing on the complaint from the Female staff members and Asha's, the District Medical and Health Officer, Ananthapuramu has appointed Dr. K. Purushotham (retired on 30.04.2018) the then District Immunisation Officer as an Enquiry Officer with a request to submit the enquiry report on the allegations levelled against Sri B. Kodandarami Reddy, MPHEO.
October 25, 2019] ANDHRA PRADESH GAZETTE EXTRAORDINARY 3The Enquiry Officer conducted enquiry and collected the written statements from the staff and Asha's of the Primary Health centre, Rayalacheruvu and submitted his enquiry report on the allegations levelled against Sri B. Kodandarami Reddy, MPHEO with the following observations: -
> He is involved in other activities which are not related to this Department which degrades the image of the department.
> He is creating un healthy atmosphere among the staff members and public.
> Tampering of Attendance register duly overwriting in the ABSENT mark marked by the Medical Officer and make it signed.
> Not obeying the Orders of the Medical Officer.
> He is creating unnecessary complications with his attitude and tarnishing the image of the Department and causing inconvenience to the administration.
> He is in the habit of creating nuisance and complications as revealed in his service history.
The details of the written statements obtained by the Enquiry Officer at the time of conducting enquiry against Sri B. Kodandarami Reddy, MPHEO, from the staff of working at the same place are mentioned vide reference 1 st & 2 nd cited.
Further, The District Medical and Health Officer, Ananthapuramu has surrendered the services of Sri B. Kodandarami Reddy, MPHEO, Primary Health Centre, Rayalacheruvu, Ananthapuramu district basing on the enquiry report submitted by Dr.K.Purushotham the then District Immunization Officer (Retired on 30.04.2018) and also requested not to post the individual in Ananthapuramu district vide reference 1st cited.
Therefore, in view of women employees harassment presented by Enquiry Officer, Office of the District Medical and Health Officer, Ananthapuramu and considering the request of the District Medical and Health Officer, Ananthapuramu, the Regional Director of Medical and Health Services, Kadapa has posted Sri B. Kodandarami Reddy, MPHEO to NMEP, Koyalakuntla, Kurnool district on administrative grounds pending enquiry and disciplinary action vide reference 3rd cited.
Further, In the reference 4 th cited the District Medical and Health Officer, Ananthapuramu has submitted the leave application of Sri.B.Kodandarami Reddy, MPHEO.
Instead of joining at the place of posting, Sri.B.Kodandarami Reddy, MPHEO has represented to post him at his same place of working on spouse grounds as his wife is working as MPHA(F) at PHC, Betapalli, Anantapur District (Spouse certificate not enclosed) vide reference 5th cited. Again he has represented the same4 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-II subject as mentioned in the reference 5 th cited alongwith spouse certificate dt:09/05/2017 vide reference 6 th cited. Further, He filed O.A.No.1843/2018, dt: 19/11 /2018 before the Honourable Administrative Tribunal, A.P., Hyderabad and the said O.A. is dismissed vide ref 13th cited.
In the reference 8th cited, the D.P.H.&F.W., A.P., Vijayawada has instructed to initiate disciplinary action against Sri.B.Kodandarami Reddy, MPHEO. The Memo was issued to the individual for the allegations levelled against him by the staff of PHC, Rayalacheruvu, Anantapur District vide reference 9 th cited.
He has not submitted the explanation as on date i.e., 06/12/2018. Due to the above reasons, he was reposted to PHC, Hussanapuram, Kurnool District vide this office reference 12th cited. But, he has not joined at his place of posting and not submitted any explanation for the Memo issued to him.
Further, it is also observed that the attitude and personality of Sri.
B. Kodandarami Reddy, MPHEO as per the Service record is as follows:-
1. The individual initially appointed was as MPHA(M) and reported for duty on F.N. of 13.11.1992 at Primary Health Centre, PAMDURTHY, Anantapur District.
2. Absconded for duty i.e. from 26.12.1992 to 14.03.1993 and the period is not yet regularised.
3. CHARGES FRAMED :- As per Rc.No.1132/E2/1995, dt.01.12.1995 of the Dist. Medical & Health Officer, Ananthapuramu.
Charge No. 1:- NOT ATTENDING TO HIS DUTIES REGULARLY.
He has not attended to G.E.Cases at Chinnavaduguru, Dimmagudi, Kandlaguduru due to which the affectted people were taken treatment at Peddavaduguru Gooty and Ananthapuramu. When the people questioned the MPHA(M), he used to threaten the staff and public by stating that he is a news reporter. He is not cooperating with the staff and public in the field work and further more he troubles and became an obstacle for smooth running of administration of this institution.
Charge No. 2 :- Working as News Reporter.
It is alleged in the petition and also in the enquiry report that Sri B. Kodandarami Reddy, MPHA(M) Sub.Centre, Dimmagudi, PHC, Peddavadugur is working as NEWS REPORTER which is contrary to the conduct rules of the Government servant. Further, it is brought to the notice of Enquiry Officer, that he used to attend the mandal meetings as a News Reporter and giving false statements against the teachers.
October 25, 2019] ANDHRA PRADESH GAZETTE EXTRAORDINARY 5The Mandal Parishad Development Officer, Mandal Parishad, Peddavadugur has also confirmed that Sri B. Kodandarami Reddy, MPHA(M), Peddavadugur is attending the Mandal meetings in the capacity of press reporter. This act of working as a news reporter by a Government Servant is against to CCA rules.
The individual in his explanation has stated that he is not at fault and denied the allegations against him. The explanation submitted by the individual was not satisfactory and not convincing. Hence, Sri B.Kodandarami Reddy, MPHA(M) S/c. Dimmagudi, PHC, Peddavadugur was hereby issued a show cause notice by the DM&HO, ATP that why two increments with cumulative effect should not be stopped for the above charges which are confirmed by the Enquiry Officer vide show cause notice Rc.No. 1132/E2/95, dt. 06.02.96 of the Dist. Medical & Health Officer, Ananthapuramu.
UNDER SUSPENSION:- He was kept under suspension until further orders and detailed enquiry if necessary as per Rule 8 (1) (a) of C.C.A. rules. He will be paid subsistence allowance during the suspension period from 29.4.96 vide Proc. Rc.No. 1132/E2/96, dt. 21.4.96 of the Dist. Medical & Health Officer, Ananthapuramu.
Sri. B. Kodandarami Reddy, MPHA(M), S/C.Dimmagudi,PHC, Peddavadugur who was kept under suspension was reinstated into service pending disciplinary action.
On reinstatement he was transferred on administrative grounds and posted to S/C. Bethapalli of PHC, Bethapalli vide Proc.Rc.No.1132/E2/96, dt. 4.6.96 of the Dist. Medical and Health Officer, Ananthapuramu.
AWARDED CENSURE:- The individual who was under orders of suspension for his lapse period from 29.04.1996 to 09.06.1996 (BDI) is now awarded "CENSURE" vide Proc. Rc.No. 1132/E2/95, dt. 27.03.1997 of the DM&HO, Ananthapuramu.
POLICE CASE (P.No.23 Vol. I) :- Sri B. Kodandarami Reddy, MPHA(M), S/c. Bethapalli of PHC, Bethapalli abused the Harijan VC Jaya Prasad Rao, MPHA(M), PHC, Kristipadu in filthy language and by touching his caste at main entrance gate of Govt.
Hospital, Gooty on 23.12.2002 at 11.00 am. He has lodged a police complaint against
Sri B. Kodandarami Reddy, MPHA(M), S/C. Bethapalli of PHC Bethapalli on 23.12.2002
at 6-30 pm and Police registered a case vide in CR no.156/2002, u/s 3(1) (x) SC/ST
(POA) Act. 1989 against him and he was arrested by the Police on 13.01.2003 at about
5.00 pm and he was sent to Judicial Custody and where disciplinary proceedings
against the individual contemplated. And the District Medical and Health Officer, Ananthapuramu after careful consideration of available material and having regard to the circumstances of the case is satisfied & felt that it was necessary to6 ANDHRA PRADESH GAZETTE EXTRAORDINARY [Part-II place Sri B. Kodandarami Reddy, MPHA(M), ), S/c. Bethapalli of PHC, Bethapalli under suspension. Therefore in exercise of the powers conferred by sub.rule (i) of Rule 8 of the A.P. Civil Services (CC & A) 1991 the DM&HO, Ananthapuram placed the individual under suspension w.e.f. 14.01.2003 and he shall continue to be under suspension till the conclusion of the disciplinary proceedings.
The individual was reinstated into service with pending disciplinary action and pending disposal of Criminal No. 156/02 U/s 3-(1) SC/ST (POA) Act. 1989 pending against him. On reinstatement he is transferred and posted to S/C. Zinzurampalli of PHC, Gummagatta on administrative grounds vide Rc.No.57/E2/2003, dt. 08.08.2003 of the Dist. Medical and Health Officer, Ananthapuramu.
Copy of complaint submitted to the Superintendent of Police, Ananthapuramu by some of the public of Gooty town, Ananthapuramu district against Sri B. Kodandarami Reddy stating that:-
1) Sri B. Kodandarami Reddy who is working as MPHEO at PHC, Rayalacheruvu, Ananthapuramu district is working as AGENT to Max Life insurance company with PAN No.BKDPK4572K, Agency Code:
516352 and date of appointment as agent is 01/04/2015.
2) He was arrested and imprisoned at Sub -Jail, Gooty under Crime No. 156/2002 U/s S.C.&S.T POA Act 1989 from 16/01/2003 to 31/03/2003. Hence, he was kept under suspension from 16/01/2003 to 31/03/2003 by the DM&HO, Anantapur vide Rc.No.57/E1/2003, dt:20/01/2003 for the above period of imprisonment.
3) On complaint of Sri.Gangadhar, Gooty for issue of loan on high interest rates & threatening, the F.I.R. No.58/2016, dt:26/10/2017 under Section 506 filed at Police Station, Gooty against Sri. B. Kodandarami Reddy, MPHEO.
4) On complaint of Sri.V.Laxminarayana, Area Manager of Andhra Prabha Daily News Paper, Anantapur, the F.I.R. No.262/2017, dt:26/10/2017 filed at Police Station, Gooty, Anantapur District, Under IPC 506 for threatening the journalist to publish news in his favour.
5) Copies of complaint received from Sri Tanneru Srinivasulu, Reporter, Andhra Prabha Daily news paper(Telugu), Gooty, Ananthapuramu district (Address on the postal cover) with enclosures consisting of a) Paper clipping dt. 20.06.2018, b) Copy of complaint submitted to the Superintendent of Police, S.P.Office, Ananthapuramu district, c) Complaint submitted to the O/o. Addl. Commissioner of Incometax, Ananthapuramu district (no from address and no signatures), d) Copy of First Information Report (FIR) of Gooty Police Station, Gooty along with complaint copy submitted by Sri V.Laxminarayana, Branch Manager, Andhra Prabha daily news paper, Ananthapuramu Cell No. 9493422033.
October 25, 2019] ANDHRA PRADESH GAZETTE EXTRAORDINARY 7There upon disciplinary proceedings against Sri.B.Kodandarami Reddy, MPHEO formerly at phc, Rayalacheruvu, ananthapur District is contemplated.
And whereas the undersigned after careful consideration of the available material and having due regard to the circumstances of the case is satisfied that it is necessary to place Sri.B.Kodandarami Reddy, formerly MPHEO at PHC, Rayalacheruvu, Anantapur District under suspension pending detailed enquiry.
Further Sri.B.Kodandarami Reddy, MPHEO, PHC, Rayalacheruvu, Ananthapuramu District, whose services are surrendered to the RDM&HS, Kadapa is reposted to PHC, Hussainapuramu, Kurnool District on administrative grounds with pending disciplinary action and enquiry vide reference Rc.No.0960/B2/2018 Dated: 24.11.2018.
In the reference 17 th cited, Sri.B.Kodandarami Reddy, MPHEO, PHC, Hussainapuramu, Kurnool district was placed under suspension under Rule 8(1) of APCS (CCA) Rules, 1991 with pending disciplinary proceedings.
Further the Medical Officer, PHC, Hussainapuramu, Kurnool District has informed through the District Medical and Health Officer, Kurnool that Sri.
B.Kodandarami Reddy, MPHEO, who has reposted to PHC, Hussapinapuramu, Kurnool District has not reported for duty even after physically appearing before the Medical Officer on 17.12.2018 & 18.12.2018 and refused to take suspension orders and went away without any information vide reference Rc.No.E3/2018 Dated: 25.01.2019 of District Medical & Health Officer, Kurnool.
In the reference 19 th cited, the Departmental proceedings initiated against Sri.B.Kodandarami Reddy, MPHEO, PHC, Hussainapuramu, Kurnool District under rule 20 of the Andhra Pradesh Civil Services (CCA) rules 1991. As the charged officer is on unauthorised absence, the charge memo is published in Andhra Pradesh Gazette, Amaravathi on 25.06.2019. However the explanation of the individual is not received till to date.
In the reference 20th cited, the Director of Public Health and Family Welfare, AP, Vijayawada has directed to take necessary disciplinary action against Sri.
B. Kodandarami Reddy, MPHEO, as per the finding of the Enquiry Officer at para 8 of page No.22 of enquiry report. The para No.8 of enquiry report as follows:
" It is observed the Sri.B.Kodanda Rami Reddy, after getting surrendered to the Regional Director of Medical and Health Services, Kadapa for women harassment & various complaints received against him, which were defaming the Department and organization, he has filed so many petition's against different officials on different dates Sri.Kodandarami Reddy allegating officer himself is facing so many allegation as follows:

09. Forging Signatures.
10. Using false letter Heads.
11. Money laundering
12. Threatening the officials of different Departments.
13. Cheating of the pubic in name of the jobs.
14. Continuously releasing adverse news against the higher authorities, leading to wastage of their precious time and also leading them to undergo stress and also defaming the department."
Sri.B.Kodandarami Reddy, MPHEO, has also lodged fake complaints against his superior officers through fake letter head of AP Telugunadu Medical & Health Employees Union.
In the reference 21st cited, Dr.K.Bhaskar, Civil Surgeon Specialist, District Programme Manager(NPCB), Govt. General Hospital, Ananthapuramu was appointed as enquiry authority to enquiry into the charges in detail framed against the said Sri. B. Kodandarami Reddy, MPHEO.
Further the enquiry officer has submitted enquiry report vide reference 22 nd cited, stating that the charged officer Sri.B.Kodandarami Reddy, MPHEO, (Under Suspension) has failed to attend for enquiry conducted on 24.05.2019 willfully proves his guilty in the allegations. Hence necessary disciplinary action to be initiated against Sri.B.Kodandarami Reddy, MPHEO, as per CCA rules in force for the welfare of the Medical and Health Department.
In the reference 23 rd cited,stating that the Show cause notice of Sri.
B.Kodanda Rami Reddy, MPHEO(Under suspension), PHC, Hussapinapuramu, Kurnool District has been served. But explanation for the Show cause notice not recived so far till date to this office.
October 25, 2019] ANDHRA PRADESH GAZETTE EXTRAORDINARY 9Therefore, Sri.B.Kodanda Rami Reddy, MPHEO, PHC, Hussapinapuramu, Kurnool District is hereby informed as to why the disciplinary action of removal from service should not be initiated against him as per under rule 9 of Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 for the above lapses and submit his explanation alongwith evidence if any within 15 days from the date of receipt of this notice. If he has failed to submit his explanation within stipulated time major punishment shall be initiated against him as per rules in force.
