It is to inform that, Sri Sk. Akbar Ali was appointed as Junior Accountant and reported to duty on 05.11.1998 A.N. at Sub Treasury, Pedakurapadu, Guntur District. His services were regularized in the cadre of Junior Accountant w.e.f. 06.11.1998. The individual has passed Accounts Test Part I on 14.05.2000 and Part II on 13.05.2001. His probation period in the category of Junior Acct. was declared on the A.N. of 05-11-2000.

As such, at the time of preparation of combined seniority list of Junior Accountants and Typists of the Treasury Unit of Guntur District, the name of the individual has not been mentioned in the seniority list. As a result his name was not included in the panel of Junior Accountant / Typist for promotion to the categoiy of Junior Accountant for the year 2001-02 even though he is eligible. His immediate Junior Sri A. Venkateswara Rao was promoted to the category of Senior Accountant vide Deputy Director of District Treasury, Guntur Procgs. No.A3/1610/2001, Dtd: 14.09.2001 and his services were regularized in the category of Senior Accountant w.e.f., 22.10.2001. Later, Sri Sk. Akbar Ali was promoted to the category of Senior Accountant w.e.f. 27.12.2002 during the P.Y 2002- 03.
Since, Sri Sk. Akbar Ali has represented for Notional Seniority on 24.05.2011 after a lapse of (08) years, this office vide Memo. No. A3/13180/2011, dated 09.12.2015 has rejected the request of Sri Sk. Akbar Ali, Senior Accountant received vide Deputy Director, District Treasury, Guntur Rc.No.2509/A 1/2011, Dated: 25.03.2014 for assigning notional seniority in the category of Senior Accountant in terms of Govt. Circular Memo No. 57759/Ser. A/2004-1, Dated: 20.05.2004.
Furtfier, the Government have also rejected the request of the above individual vide Memo.
No.386/23/A2/Admin.I/2016, Dated: 06.06.2016 .
Aggrieved by this, Sri Sk. Akbar Ali has filed O.A. No. 135/2017 in Hon' ble APAT.
The Hon'ble APAT in its orders dated 15.03.2018 have pronounced the following Judgement in the said O.A.
"..........Therefore, for the above reasons stated, the impugned proceedings Dt: 09.12.2015
and 06.06.2016 are liable to be declared as illegal and arbitrary and hence, they are accordingly
set aside. Consequently, the respondents are directed to extend the benefit of notional promotion
to the applicant with effect from 22.10.2001 on par with his juniors Sri A. Venkateswara Rao,
P. Sivaleela and D. Vijayalakshmi with consequential benefits of pay. Appropriate orders
shall be passed within a period of 8 weeks from the date of receipt of a copy of this order."
The above position was brought to the notice of the Government vide this Office Lr. No. A2/13180/2011, dated 16.07.2018 ( e- Office File No.FIN02-11036/4/2018-A Sec-DTA) for appropriate orders in this regard. The Government vide Memo. No.23022/41/Admn.I/2018, Dated:17.07.2018 have directed to implement the orders of Hon'ble APAT in O.A. No. 135/2017 filed by Sri Sk. Akbar Ali, Senior Accountant and requested to take further necessary action immediately with an intimation to the Government.
In view of the above position, Sri Sk. Akbar Ali became eligible for inclusion in the panel as on 01.09.2001 and consequently become eligible for assigning the notional seniority w.e.f. 22.10.2001 in the category of Senior Accountant from the date of regularization of his immediate junior Sri A. Venkateswara Rao. The proposal to this effect was furnished to the Government and the Government vide G.O.Rt. No. 1253, Fin. (Admn.I) Dept., Dated: 17.07.2019 have issued orders for assigning notional seniority to Sri Sk. Akbar Ali, the then Senior Accountant, presently working at Divl. Sub Treasury, Gurazala in the category of Senior Accountant w.e.f. 22.10.2001 i.e., the date of regularization of his immediate junior Sri A. Venkateswara Rao duly relaxing Rule 33 (a) of APS & SS Rules, 1996.
ANDHRA PRADESH GAZETTE, November 10, 2020 3Further, Sri Sk. Akbar Ali was promoted to the category of Sub Treasury Officer during the panel year 2016-17 and his Services were regularized in the category of Sub Treasury Officer w.e.f. 01.05.2017.
Consequent on assigning of notional seniority in the category of Senior Accountant, Sri Sk. Akbar Ali, STO, ST, Gurazala, Guntur District is eligible for inclusion of panel of Senior Accountants for promotion to the category of STO for the year 2011-12 and he became eligible for assigning of notional seniority in the category of Sub Treasury Officer w.e.f, 28.06.2012 on par with his junior Smt. D. Vijaya Laksmi, STO ( Retd.) as his immediate junior Sri A. Venkateswara Rao was retired from service on 31.12.2010 on attaining the age of superannuation without getting STO promotion.
The Government vide reference 5th cited have permitted to issue notices to the affected individuals under Rule 24 of APS & SS Rules, 1996 and also review the panel 2011-12 for for prmotion to the category of Sub Treasury Officer for assigning notional seniority to Sri Sk. Akbar Ali, Sub Treasury Officer, Sub Treasury, Gurazala, Guntur District on par with his junior Smt. D. Vijaya Laksmi, STO (Retd.) w.e.f. 28.06.2012.
In view of the above, on assigning of notional seniority to Sri Sk. Akbar Ali, Sub Treasury Officer, Sub Treasury, Gurazala, Guntur District on par with his junior Smt. D. Vijaya Laksmi, STO (Retd.) w.e.f. 28.06.2012, the following (76) individuals are likely to be affected.

Akbar Ali, Sub Treasury Officer, Sub Treasury, Gurazala, Guntur Distirct on par with his junior Smt. D. Vijaya Laksmi, STO (Retd.) w.e.f., 28.06.2012, within (15) days from the date of receipt of this memo, failing which, it will be construed that, they have no objections in the matter and further action will be taken accordingly.
