NOTIFICATION

No. 30/SEC-B2/2021 Date: 13.02.2021

WHEREAS, the State Election Commission issued Notifications on 23.01.2021, 25.01.2021 and 28.01.2021 for conduct of Ordinary Elections to Gram Panchayats in the State in 4 Phases;

AND WHEREAS, the Collector and District Election Authority, Guntur in his Letter No.3609/2020-G9, dtd.09.02.2021 stated that Ward No.1 of Buthumalli Gram Panchayat is reserved for SC (W) and the same was mentioned in the Notice of the Elections also and during the nomination period the Stage-I Returning Officer has mistakenly received the nomination to the said Ward from SC (G) category instead of SC (W) and during scrutiny also, Returning Officer has accepted the Nomination and declared that SC (G) candidate was elected unanimously in Form X, since single nomination was filed to Ward No.1 and requested the Commission to issue instructions for taking necessary further action;

AND WHEREAS, the report also contain a copy of the letter from the candidate declared elected unanimously for Ward No.1 stating that he had filed Nomination under the impression that the said ward was reserved for SC (G), which was also erroneously accepted by the Returning Officer and processed it in further stages of Election till declaration of unanimous election and that he had returned the Form X back to the Returning Officer at his own will;

2 ANDHRA PRADEH GAZETTE EXTRAORDINARY _____________________________________________________________________________ AND WHEREAS, the State Election Commission after careful examination of the matter, came to the conclusion that the election process of Ward No.1 of Buthumalli Gram Panchayat was vitiated due to erroneous receipt of nomination paper and decided to set right the vitiated election process by re-notifying it afresh from the stage of issuance of Election Notice by the Returning Officer;

NOW, THEREFORE, the State Election Commission, in exercise of the powers conferred under Article 243K of the Constitution of India, Section 200(1), Section 201-A(1), sub-sec.(2) of Section 13 and sub-sec.(2) of Section 14 of the Andhra Pradesh Panchayat Raj Act, 1994 (Act 13 of 1994), the State Election Commission, Andhra Pradesh, hereby re- notifies the schedule for the election of Ward Member of 1st Ward of Buthumalli Gram Panchayat, Vemuru Mandal of Guntur District as indicated below.
