The State Election Commission issued Notification for conduct of ordinary elections to Members of Mandal Parishad Territorial Constituencies (MPTCs) and Zilla Parishad Territorial Constituencies (ZPTCs) vide Ref. No. 68/SEC-B1/2020, dt.07.03.2020. The election process was completed up to the stage of declaration of results of unanimously elected candidates and publication of final list of contesting candidates on 14.03.2020. The Commission stopped the election process due to the threat of COVID-19 and ordered that the election process shall be continued after six weeks from 15.03.2020 or after the pandemic recedes, whichever is earlier, and decided to continue the election process from the stage where it was halted. The Commission further ordered that the paused election process shall remain continue until further orders and decided to resume the election process when the situation conducive for conduct of elections is restored vide its Notification dt.06.05.2020. The Commission resumed the election process of MPTCs and ZPTCs vide Notification No. 1503/SEC-B1/2021, dt.01.04.2021 from the stage where it was halted and completed it with declaration of results on 19.09.2021. Thereafter, the indirect elections to Members (Co-opted), Presidents and Vice-Presidents of Mandal Praja Parishads and Members (Co-opted), Chairpersons and Vice-Chairpersons of Zilla Praja Parishads were conducted on 24.09.2021 and 25.09.2021 respectively.

However, the election process could not be taken up in some MPTCs and ZPTCs, where candidates set up by Recognized Political Parties and Registered Political Parties with reserved symbols passed away after the date of publication of list of contesting candidates on 14.03.2020 and before the poll.

Rule 17(2)(c) of A.P. Panchayat Raj (Conduct of Elections) Rules, 2006 stipulates that the State Election Commission shall call upon the Recognized or Registered Political Party with a reserved symbol, as the case may be, whose candidate has died, to nominate another candidate for the said poll within three days of issue of such notice to such recognized or registered political party and the provisions of the Rules 4 to 15 shall, as far as may be, apply in relation to such nomination as they would apply to other nominations.

The State Election Commission has now decided to notify schedule for conduct of elections in all such 81 MPTCs and 11 ZPTCs.

Now, therefore, in exercise of the powers conferred under Article 243-K of the Constitution of India, Sections 151(1), 179(1), 200 and 201 of A.P. Panchayat Raj Act, 1994 and Rule 17(2) of A.P. Panchayat Raj (Conduct of Elections) Rules, 2006, the State Election Commission, hereby, calls upon the registered voters of Mandal Parishad Territorial Constituencies and Zilla Parishad Territorial Constituencies indicated in Annexure-II to this Notification, to elect their respective Members of MPTCs or Members of ZPTCs, as the case may be, and under Section 201-A (2) of the A.P. Panchayat Raj Act, 1994 and Rule 4 of A.P. Panchayat Raj (Conduct of Elections) Rules 2006, specifies the election schedule in Annexure-I appended to this Notification.

The Recognised or Registered Political Party with a reserved symbol concerned is only entitled to nominate a candidate in place of the deceased contesting candidate as per the provisions of Rule 17(2)(c) of A.P. Panchayat Raj (Conduct of Elections) Rules, 2006. The Returning Officer shall only receive the nomination form from the candidate nominated by the same Recognised or Registered Political Party with a reserved symbol, whose candidate had died as a contesting candidate of such MPTC / ZPTC, as the case may be, and the provisions of Rules 4 to 15 of said Rules shall be applied in relation to such nomination as they would apply to other nominations.

The State Election Commission issued Notification in the reference cited for conduct of elections to (81) MPTCs and (11) ZPTCs, where the candidates set up by the Recognised or Registered Political Parties with reserved symbol, died as contesting candidates subsequent to the publication of list of contesting candidates on 14.03.2020 and before the poll. A copy of the Notification is appended to this Notice.

Under Rule 17 (2)© of A.P. Panchayat Raj (Conduct of Elections) Rules, 2006, the State Election Commission, hereby, calls upon you to nominate another candidate in place of the deceased contesting candidate set up by your party within the last day appointed for receipt of nominations. The nomination of such candidate shall be done in the prescribed form before the Returning Officer concerned and such candidate shall have to make a fresh deposit. Form-A / Form-B shall be produced from the party concerned as per the instructions in force. All other requirements relating to nomination, scrutiny, appeal, withdrawal of candidature, etc., shall be followed.

The party-wise list of MPTCs/ZPTCs is also appended as Annexure to this Notice.
