ORDER
1. The Government of Andhra Pradesh is committed to provide impetus to the growth of data centers and strongly believes that data centers have the potential to catalyze the overall development of IT/ ITeS industry in the State .
2. In the G.O. 1st read above , the Government of Andhra Pradesh , approved the allotment of land and certain package of incentives to M/s Adani Enterprises Ltd, for establishing an Integrated Data Center Park and Technology/ Business Park including a 200 MW Data Center Park , IT Business Park , Skill University , and Recreation Center in Madhurawada , Visakhapatnam , with an overall committed investment of INR 14,634 Cr . and committed direct employment of 24,990 .
3. In the G.O. 2nd read above , the Government has issued the operational guidelines for the administration of the incentives approved vide G.O. Ms. No.5 , ITE & C (Promotions ) Department , dated 23.11.2020 .
4. In the reference 3rd read above , the M/s . Adani Enterprises Ltd , has represented that they have made the payment of INR 130 Cr. against the allocation of 130 acres of land in Survey no . 409, Madhurawada , Visakhapatnam for establishing an integrated Data Center Park including a 200 MW Data Center Park , IT Business Park, Skill University , and Recreation Center. Further , the project proponent requested to allot the land in the name of M/s . Vizag Tech Park Limited (VTPL ) , a 100% wholly owned subsidiary of M / s . Adani Enterprises Ltd. ) so as to enable to prepare the infrastructure development plan including roads , utilities like Electricity, Water etc. 5 . The request of M/ s Adani Enterprises Ltd. was placed before the 48th CCITEI where in the committee recommended for placing the matter before the State Investment Promotion Committee ( SIPC) to take a view on the current request, vide reference 5th cited .

6. In the reference 7th read above , the State Investment Promotion Board ( SIPB ) approved the recommendations of the State Investment Promotion Committee ( SIPC ) vide ref 6th read above and made the following decisions:
(a) To induct M/ s Vizag Tech Park Limited ( VTPL a 100 % subsidiary of M/ s Adani Enterprises Ltd. ) as project proponent in the place of M/ s Adani Enterprises Ltd. , subject to the condition that M/ s VTPL is created as a Special Purpose Vehicle ( SPV) for the purpose of implementation of this project .
(b) G.O. Ms. No. 5 dated 23.11.2020 and G.O.Ms. No. 3 dated 03.02.2021 earlier issued by ITE & C Department shall be applicable to the changed legal entity also.
(c) The SPV i.e. , M/s VTPL shall be bound by the commitments of the Detailed Project Report ( DPR) submitted by the original project proponent i.e. , M/s Adani Enterprises Ltd. 7. Accordingly , the Government after careful examination , issues the following orders :
(a) To induct M/ s Vizag Tech Park Limited (VTPL a 100 % subsidiary of M/s Adani Enterprises Ltd. ) as project proponent in the place of M /s Adani Enterprises Ltd , subject to the condition that M/s VTPL is created as a Special Purpose Vehicle ( SPV) for the purpose of implementation of this project . (b) G.O. Ms. No. 5 dated 23.11.2020 and G.O.Ms. No. 3 dated 03.02.2021 earlier issued by ITE & C Department shall be applicable to the changed legal entity also .
(c) The SPV formed i.e. , M/s VTPL shallbe bound by the commitments of the Detailed Project Report (DPR) submitted by the original project proponent i.e. , M/s Adani Enterprises Ltd.
8. Wherever the name and style of unit "M/s Adani Enterprises Ltd " occurs in the G.O. Ms. No. 5 , ITE & C (Promotions ) Department , dated 23.11.2020 and G.O. Ms. No. 3 , ITE& C (Promotions) Department , dated 03.02.2021 , the name " M/ s . Vizag Tech Park Limited (M/ s VTPL - 100% subsidiary of M / s Adani Enterprises Ltd. ) " shall be substituted .
9. The VC & MD APIIC is requested to take necessary action in the matter.
