ORDERR
In the reference read above, the District Collector, Prakasam District has submitted
Sri Shaik Mahaboob Doula S/o Shaik Abdul Munaf, Mothi Masjid Estate Colony, 2d Block,
Markapur, Prakasam District for appointment him as Additional Kazi for Markapur Town
for performing of Marriages of Muslim Community. Further, the District Collector,
Prakasam District has obtained the reports of the RDO, Markapur Division, the Tahsildar
Markapur Town and the Inspector of Police Markapur Circle, Prakasam District and stated
that, Sri Shaik Doula, S/o Shaik Abdul Munaf, aged 53 years is residing at H.No.4-515- 25 A, Estate Colony, Markapur Town, Prakasam District and he belongs to Muslim (BC-
E) having S.S.C., Inter Mediate Qualification in Urdu Language and Hafiz Course. He has
also stated that he is teaching Urdu & Arabic language to Poor Muslim Children's for last
30 years. The applicant has performing Marriages of Muslim Community as a Nayab Kazi
in the Estate Colony as well as other Villages of Markoparum Mandal.
The District Collector, Prakasam has stated that, there is only two (2) Government
2 Kazis appointed by the Government are working. There is another (3o) Government Kazi is required for performing of Marriages of Muslim Community. But due to increasing of
Muslim population and as per the Presidents of all Mosques in Markapur Town, Muslim elders and consolers, Kazi is needed to perform the marriages and other functions of the
Muslim Community of Markapur Jurisdiction and they have no objection for appointing
another Kazi as per the section 2 of the Kazi Act, 1880, so that the Tahsildar, Markapur Mandal has again recommended Sri Shaik Mahaboob Doula, S/o Munaaf for requirement of 3rd Kazi for the Jurisdiction of Markapur Town. The Inspector of Police Markapur Circle Prakasam District has submitted his enquiry report and stated that the applicant has not
involved any Criminal cases and not involved in any antisocial activities and also reported
that, no adverse remarks found against the applicant in Markapur Town.
Finally, the District Collector, Prakasam has recommended to appoint Sri Shaik
3. Mahaboob Doula. S/o Shaik Munaf R/o Markapur as Government Kazi in Addition to the
existing Kazis U/s 2 of the Kazi s Act, 1880 to perform marriages for Muslim Community
for the Jurisdiction of Markapur Town.
After careful examination of the report of the District Collector, Prakasam, 4. Government hereby appoint Sri. Shaik Mahaboob Doula. S/o Shaik Munaf R/o Markapur as Government Kazi in Addition to the existing Kazis for Markapur Town, initially for a
period of three (3) years for performing Marriages of Muslim Community only, as per
Section-2 of the Kazis Act, 1880 (Central Act XII of 1880) subject to the following
conditions
1.The Kazi is answerable to the Government for his actions 2.The appointment of the Kazi can be revoked by the Government on receipt of
complaints/verification of records or in extreme cases without notice, if malafide is established as per record.

3. The Kazi shall not indulge any illegal activity in the conduct of marriages nor
infringe any law established by the Government.
4. The Kazi shall not carry out marriage of any minor. 5. The Kazi shall not act in any way which is prohibited in lslam or is not
permissible in Islam.
6. The Kazi shall not conduct contract marriages. 7. The Kazi or his Naib Kazi shall not perform any marriage, in any area, beyond
his specified Jurisdiction.
8. The Kazi shall charge the specified fee and nothing more than that. 9. The Kazi shall appoint not more than three (3) Naib Kazis and the names of
such Naib Kazis shall be informed to the Government.
10. Government shall have the right to take disciplinary action against the Kaz1, in case of any contravention of Law or of any conditions specified above. 11. The Kazi shall hand-over the Marriage Record to the Wakf Board, at the end
of the tenure
If any question arises whether any person has been rightly appointed as Kazi
5. under the above said Section, the decision thereof by the State Government shall be conclusive. The State Government may, if it thinks fit, suspend or remove any Ka2 appointed under this Section, who is guilty of any misconduct in the execution of his Office, or who is for a continuous period of six months absent from the local area for which he is appointed, or leaves such local area for the purpose of residing elsewhere, or is declared an insolvent or desires to be discharged from the office, or who refuses or becomes in the opinion of the State Government unfit, or personally incapable to
discharge the duties of office.

"In exercise of the powers conferred by Section-2 of the Kazis Act, 1880 (Central Act XIl of 1880), the Government of Andhra Pradesh, after consulting the Principal Muhammadans residents of local area, hereby appoint Sri Shaik Mahaboob Doula, S/o
Shaik Abdul Munaf, Estate Colony, Markapur Town, Prakasam as Government Kazi in
Addition to the existing Kazis for Markapur Town, Prakasam District, initially for a period
of three (3) years for performing Marriages of Muslim Community only".
