ORDER :
In the letter 1st read above , the Government of India , Ministry of Environment & Forests , has accorded State - II approval under section - 2 of Forest ( Conservation) Act, 1980, for diversion of 12.14 ha of forest land in Sy.No.675 , Permullapadu (V) , Thummala RF , Rapur Taluk , Venkatagiri Range , Nellore Forest Division , Nellore District in favour of M / s Nagendra Mines and Minerals for mining purposes for a period of 10 years with effect from i.e.23.02.2001 , subject to certain conditions stipulated therein . Accordingly , State Government issued orders for diversion of the above said forest land in the G.O. 2nd read above .

In the G.O.3rd read above , State Government issued orders that the validity of the forest clearance accorded by the Government of India , Ministry of Environment & Forests letter dt.23.02.2001 under Section - 2 ( ii ) of Forest (Conservation) Act , 1980 for diversion of 12.14 ha . of forest land in Sy.No.675 of Perumallapadu Village , Thummalatalupur RF , Sydapuram Mandal , SPSR Nellore District for extraction of Quartz , Mica & Vermiculite in favour of M/ s . Nagendra Mines & Minerals , shall be for a period co- terminus with the period of mining lease i.e. , 03.06.2027 granted by the Industries & Commerce (M.III) dept . , vide G.O.Ms.No.103 / I & C(M.III) Dept. ,dt.24.07.2017 , under section 15 of MMDR Act , 1957, subject to compliance of conditions stipulated in the Stage - II approval accorded by the Government of India , Ministry of Environment , Forests & Climate Change , Lr.dt.23.02.2001 duly taking undertakings for the conditions that were non - complied and also the conditions stipulated under Para 7.3 ( vi) of Chapter 7 of the Comprehensive Guidelines issued by the Government of India , Ministry of Environment , Forests & Climate Change in the letter dt.28.03.2019.
3 . In the letter 4th read above , the Principal Chief Conservator of Forests & Head of Forest Force , Andhra Pradesh, Guntur has stated the original lease holder i.e. , Sri Sk . Abdul Khuddus of M / s Nagendra Mines and Minerals has expired on 21.03.2020 and the Assistant Director of Mines & Geology , Nellore in his proceedings No.615/M/1977 , dt.8.10.2020 declared Smt . Sk . Jubeda Begum as successor lessee of mining lease held by her husband in the name of M/ s Nagendra Mines and Minerals . Eventhough the name of the successor lessee i.e. , Smt.Sk.Jubeda Begum is changed in the records of Mines and Geology Department , prior permission is required to be taken from the Government of India for change of the name of the proprietor of the User Agency i.e. , Smt . Sk . Jubeda Begum , due to inheritance as per para No.5.2 , Chapter- 5 of comprehensive guidelines issued by the Government of India , Ministry of Environment, Forests & Climate Change ( FC - Division) in F.No.5-2/ 2017-FC, dt.28.03.2019 .

4. In the letter 5th read above , the State Government requested the Government of India, Ministry of Environment , Forests & Climate Change , IRO , Vijayawada to accord permission for change of the name of the proprietor of the User Agency i.e. , Sri Sk . Abdul Khuddus ( late ) , M / s Nagendra Mines & Minerals to Smt.Sk.Jubeda Begum W / o Late Sri Sk .Abdul Khuddus , M / s.Nagendra Mines & Minerals in respect of diversion of 12.14 ha of forest land in Sy.No.675 , Perumallapadu Village , Thummallur RF , Sydapuram Mandal , SPSR Nellore District for extraction of Quartz , Mica and Vermiculite .

In the letter 6th read above , the Government of India , Ministry of Environment , Forests & Climate Change , IRO , Vijayawada has requested the State Government to consider Smt.Sk.Jubeda Begum W / o Late Sri Sk.Abdul Khuddus as proprietor of the User Agency i.e. , M / s Nagendra Mines & Minerals , in view of Assistant Director of Mines & Geology, Nellore proceedings No.615 / M / 1977 , dt.08.10.2020 after ensuring the required documents like legal heir certificate , undertakings to comply with the conditions stipulated in Stage - II approval etc. , and copies of such documents may be submitted to Integrated Regional Office , Vijayawada for record purpose .
6. After careful examination of the issue , Government hereby accord permission to the Principal Chief Conservator of Forests & Head of Forest Force , Andhra Pradesh , Guntur for change of name of the proprietor of the User Agency i.e. , Sri Sk . Abdul Khuddus (late) , M / s Nagendra Mines & Minerals to Smt.Sk.Jubeda Begum W / o Late Sri Sk.Abdul Khuddus , M / s.Nagendra Mines & Minerals in view of Assistant Director of Mines & Geology, Nellore proceedings No.615 / M / 1977 , dt.08.10.2020 after ensuring the required documents like legal heir certificate , undertakings to comply with the conditions stipulated in Stage - II approval accorded by Government of India , Ministry of Environment, Forests & Climate Change in its letter dt.23.02.2001 etc. , and copies of such documents shall be submitted to Integrated Regional Office , Vijayawada for information.
7. The Principal Chief Conservator of Forests & Head of Forest Force, Andhra Pradesh, Guntur , shall take further necessary action in the matter accordingly .
