ORDER:

In the letter 1st read above , the Government of India , Ministry of Environment & Forests , have accorded Stage - II approval under section- 2 of Forest ( Conservation) Act, 1980 for diversion of 2.6624 ha of forest land in Compartment No.313 of Gulamaliabad South RF , Dhone Range , Kurnool Division for grant of quarry lease for Road Metal in favour of M/ sG.M.R.Stone Crushers , Prop. Sri G.Maddileti Reddy, Banaganapalle for a period of 10 years , subject to certain conditions stipulated therein . In the G.O.2nd read above , State Government have issued orders for diversion of the above said forest land for a period of 10 years . The forest clearance is valid from 03.10.2012 to 02.10.2022.

2. In the proceedings 3rd read above , the Deputy Director of Mines & Geology, Kurnool has granted a Quarry Lease for Road Metal over an extent of 2.662 Ha . in Compartment No.313 of Gulamaliabad South RF , Dhone Range , Kurnool Division and District for a period of 10 years in favour of M / s GMR Stone Crushers , Prop:G.Maddilety Reddy, subject to certain conditions stipulated therein. Subsequently , the Asst . Director of Mines & Geology, Banaganapalle , has executed agreement with User Agency and accorded permission to commence the quarrying operations for Road Metal over an extent of 2.662 Ha . in Compartment No.313 of Gulamaliabad South RF , Dhone Range, Kurnool Division and District for a period of 10 years i.e. from 01.05.2013 to 30.04.2022 in the proceedings 4th read above .

3. In the letter 6th read above , Sri G.Maddilety Reddy , Prop :GMR Stone Crushers has requested for extension of validity of forest clearance coterminous with the period of mining lease granted by the Mines & Geology Department as per the GoI , MOEF &CC

Contd.p.2 guidelines in the 5th read above . In turn , the Principal Chief Conservator of Forests & Head of Forest Force has been requested to furnish compliance report on the Stage - II conditions stipulated by the Gol , MoEF & CC, in its letter dated.03.10.2012 for taking further action in the matter vide in the Memo . 7th read above .

4. In the letter 8th read above , the Principal Chief Conservator of Forests & Head of Forest Force has furnished the compliance report on the Stage - II conditions stipulated by the Gol, MoEF &CC , in its letter dated.03.10.2012 and requested to take suitable decision for extending the forest clearance co - terminus with the period of mining lease. In this regard, the Principal Chief Conservator of Forests & Head of Forest Force has been requested to furnish the DGPS survey report of the safety zone area in respect of the proposal for diversion of 2.6624 ha of forest land in Compartment no.313 of Gulamaliabad South RF , Dhone Range , Kurnool Division for grant of quarry Lease for Road metal in favour of M / s . G.M.R. Stone Crushers , Proprietor: Sri G. Maddileti Reddy, for taking further action on extension of forest clearance co- terminus with the mining lease period granted under MMDR Act , 1957 vide in the Memo.9th read above .

5. Inthe letter 10th read above , the Principal Chief Conservator of Forests & Head of Forest Force has furnished DGPS survey report of the safety zone area and informed that the mining lease granted in Compartment no.313 of Gulamaliabad South RF, Dhone Range , Kurnool Division to (1 ) Sri Venkateswara Stone Crushers , Proprietor- K.Sulochana ( 2.246 ha) . ( 2) Sri Y. Balathimma Reddy (2.625 ha) and (3) M/ s GMR Stone Crushers , Proprietor-G.Maddileti Reddy (2.6624 ha) , are in cluster . Since the mining lease area of the M/ s GMR Stone Crushers comes under cluster mining , the safety zone area is possible to maintain at the southern and eastern sides of the M / s GMR mine only. The DGPS survey data report submitted by the Conservator of Forests, Kurnool was verified and authenticated. As per the authenticated map , the Mining area is 2.56 ha . , Road area is 0.10 ha . and Safety zone area is 0.25 ha . Thus , the total area for mining lease is 2.91 ha . Regarding safety zone area of 0.25 ha , instructions have been issued by the PCCF & HoFF, to the District Forest Officer , Nandyal to advise the User Agency to initiate proposal for obtaining approval under F (C) Act , 1980 for diversion of forest area located in the safety zone , as per the guidelines by the Gol , MoEF & CC (FC -Division) , New Delhi in F.No.8-67/ 1996- FC (pt ) ,dt.02.08.2017.

6. After careful examination of the proposal and as per para 7.3 (vi ) of Chapter - 7 of Comprehensive Guidelines issued by the GoI , MoEF & CC , in the letter 5th read above, Government hereby order that the validity of forest clearance accorded by the GoI, MoEF&CC in its letter dated.03.10.2012 under Section- 2 ( ii ) of Forest ( Conservation) Act, 1980 for diversion of 2.6624 ha of forest land in Compt.No.313 of Gulamaliabad South RF , Dhone Range , Kurnool Division for grant of quarry lease for Road Metal in favour of M / sG.M.R.Stone Crushers , Prop . Sri G.Maddileti Reddy , Banaganapalle , shall be for a period co - terminus with the period of mining lease i.e. up to 30.04.2023 granted by the Mines & Geology Department, subject to the following conditions:

i. The State Forest Department shall realize from the User Agency the Net Present Value (NPV) of the forest land so diverted , if not realized so far , within two years in two equal installments from the date such Rules became enforceable .

ii. The State Forest Department shall ensure maintenance of safety zone of 7.5 mts width all along the outside the cluster as per the guidelines issued under Forest ( Conservation ) Act , 1980 from the amount which has already been realized from the User Agency;

iii. The State Forest Department shall issue instructions to the User Agency to initiate proposal for obtaining approval under F(C) Act, 1980 for diversion of 0.25 ha of forest area located in the safety zone , as per the guidelines issued by

Contd.p.3 the GoI , MOEF & CC (FC Division ) , New Delhi in F.No.8-67 / 1996 - FC (pt ) , dt.02.08.2017 .

iv. All levies under the project shall be deposited with " State CA fund " of the Andhra Pradesh State;

V. The State Forest Department / User Agency shall comply with all conditions stipulated in the Stage - II approval dated.03.10.2012 in addition to the conditions mentioned above . In the event of failure to comply with any of the above conditions the User Agency is liable for penal action as decided by the State Government .

7. The Principal Chief Conservator of Forests & Head of Forest Force , Andhra Pradesh , shall take further necessary action in the matter accordingly .
