Ultra Tech Cement Limited in the Forest Clearance accorded by Government of India , Ministry of Environment , Forest & Climate Change letter No.F.No.8-93 / 2010 - FC , dt.05.12.2011 for diversion of 629.22 Ha of forest land in Sy.No.376 ( Compt.Nos.5 6) in Budawada Reserved Forest of Krishna Division in Krishna District of Andhra Pradesh for Limestone mining - Orders - Issued .

ORDER :
In the letter 1st read above , the Government of India , Ministry of Environment , Forest & Climate Change , have accorded approval under section 2 of the Forest (Conservation) Act, 1980 , for diversion of 629.22 Ha of forest land in Sy.No.376 (Compt.Nos.5-6) in Budawada Reserved Forest of Krishna Division in Krishna District of Andhra Pradesh , in favour of M/ s Jaypee Balaji Cement Project for Limestone mining , subject to certain conditions stipulated therein . Accordingly , State Government have issued orders for diversion of above said forest land vide in the G.O.2nd read above .
2. In the letter 3rd read above , the Principal Chief Conservator of Forests & Head of Forest Force , Andhra Pradesh , has reported the applicant M / s . Ultra Tech Cement Ltd. , has submitted a proposal for change of name of the User Agency from M / s . Jai Prakash Associates Limited to M/ s . Ultra Tech Cement Limited in the Forest Clearance accorded by the GoI , MoEF &CC letter No.F.No.8-93 /2010-FC , dt.05.12.2011 for diversion of 629.22 Ha of forest land in Sy.No.376 ( Compt.Nos.56) in Budawada Reserved Forest of Krishna Division in Krishna District of Andhra Pradesh for Limestone mining as per para 2.8 of compendium of Forest ( Conservation) Act , 1980 . The original User Agency ( Jaypee Balaji Cement Project transferor) has submitted no- objection certificate for transfer of the Forest Clearance to Ultra Tech Cement Ltd. , and the new User Agency ( Ultra Tech Cement Limited- Transferee) submitted an undertaking stating to comply with all the Environmental safeguards / the terms and conditions as stipulated in the forest clearance .
3. In the letter 4th read above , the proposal of the Principal Chief Conservator of Forests & Head of Forest Force , for change of name of the User Agency from M / s . Jai Prakash Associates Limited to M / s . Ultra Tech Cement Limited, was sent to Government of India , Ministry of Environment, Forests & Climate Change , New Delhi, for its approval in the matter .
4. In the letter 5th read above, the Government of India , Ministry of Environment , Forests & Climate Change, New Delhi has accorded its approval for change of name of the User Agency from M/ s . Jai Prakash Associates Limited to M / s . Ultra Tech Cement Limited in respect of diversion of 629.22 ha of forest land in Sy.No.376 (Compt.Nos.5-6) in Budawada Reserved Forest of Krishna Division in Krishna District of Andhra Pradesh , for Limestone mining, subject to certain conditions stipulated therein.

5. In the letter 6th read above , the Principal Chief Conservator of Forests & Head of Forest Force, has furnished the compliance report on the conditions stipulated by the Government of India , Ministry of Environment , Forest & Climate Change in its letter 5th read above and requested to forward the same to Government of India , Ministry of Environment, Forest & Climate Change for taking further action in the matter . Accordingly, in the letter 7th read above , the compliance report was forwarded to the Government of India , Ministry of Environment, Forest & Climate Change , New Delhi for its consideration and accord necessary approval in the matter .
6. In the letter 8th read above , the Government of India , Ministry of Environment , Forest & Climate Change , New Delhi , has informed the Competent Authority in the Central Government has already conveyed its approval vide Ministry's letter dt.07.05.2019 with certain conditions . The compliance report of the approval letter dt.07.05.2019 submitted by the State Government has been noted in the Ministry for future reference .
7. After careful examination of the proposal and in view of the approval accorded by the Government of India , Ministry of Environment, Forest & Climate Change in its letter dt.07.05.2019 , Government hereby accord permission to the Principal Chief Conservator of Forests & Head of Forest Force , A.P. , Guntur , for change of name of the User Agency from M / s . Jai Prakash Associates Limitedto M / s . Ultra Tech Cement Limited in the Forest Clearance accorded by the Government of India , Ministry of Environment , Forest & Climate Change letter No.F.No.8-93 / 2010- FC ,dt.05.12.2011 for diversion of 629.22 Ha of forest land in Sy.No.376 ( Compt.Nos.5 - 6 ) in Budawada Reserved Forest of Krishna Division in Krishna District of Andhra Pradesh for Limestone mining .
