ORDER :
Whereas , it was brought to the notice of the Government that Sri . K.Ammaji Asst . P & E Superintendent West Godavari Dist . ( Retd ) while he was in service involved in disciplinarily case pertaining to liquor syndicate cases of Krishna District No.2788mong the other AMARAVATI TUESDAY NOVEMBER 20ing detailed enqu2674 the Director General , Anti Corruption Bureau in his final report Dt.06.11.2012 recommended to place Sri . K. Ammaji on his defence before Tribunal for Disciplinary Proceedings NOTIFICATIONS BY GOVERNMENT
2. After careful examination of the recommendations of the D.G. , ACB , Government have taken a decision to entrust the case to the Tribunal for Disciplinarl Proceedings (TDP ) including Sri . K.Ammaji Asst . P &E Superintendent West Godavari Dist . ( Retd ) , vide Memo 2nd read above . Further Part - B Notes duly signed by the competent authority were sent to the TDP for regular Inquiry along with other prohibition and Excise Officials vide Govt. Memo dated : 17.06.2013.Charge Memo was issued by the Tribunal for Disciplinary Proceedings vide Tribunal Enquiry Case No.82 of 2013 .
3. In the G.O. 3rd read above , Smt . K.Ammaji Asst . P & E Superintendent West Godavari Dist . (Retd ) was sanctioned provisional pension @ 75 % of normal pension entitled to him under Rule 52 of A.P. Revised Pension Rules , 1980 , pending finalisation of disciplinary proceedings initiated against her .
4. Smt . K.Ammaji Asst . P &E Superintendent West Godavari Dist . ( Retd ) has filed Writ Petition No.1443 of 2020 before the Hon'ble High Court with a prayer to set aside the above said charge memo and requested for pensionery benefits . The Hon'ble High Court has passed the following order on 30.12.2020 in the above Writ Petition : -
""In view of the request made by learned counsel for the petitioner and learned Government Pleader for Services - I , by applying the principle laid down in the judgment of the Apex Court reported in P.V. Mahadevan.v.M.D .. Tamil Nadu Housing Board ( referred supra ) and G.O.Ms.No. 679General Administration (Services - C) Department dated : 01.11.2008 , concerned authority/third respondent is directed to complete the enquiry within six weeks from the date of receipt of copy of this order .
With the above direction , writ petition is disposed of . No costs . "
5 . Smt . K.Ammaji Asst . P & E Superintendent West Godavari Dist . ( Retd ) has filed C.C.No.1768 / 2021 for not implementing the orders dt : 30.12.2021 of learned single Judgepassed in W.P. No.1443 of 2020 .
7 . The Commissioner of Prohibition and Excise shall take necessary further action in the matter accordingly .
