ORDER:

It isproposedto hold an enquiry against Dr.P.Surya Chandra Rao , Deputy Director (AH ), for the acts done by him while working as Executive Officer , District Livestock Development Agency , Tadepalligudem , West Godavari District, in accordance with the procedurelaid down in Rule 20 of the Andhra Pradesh Civil Services (Classification , Control and Appeal ) Rules , 1991.

2. Thesubstance of the imputations of misconduct or misbehaviour in respect ofwhich theInquiry is proposed to be held is set out in the enclosed statement of Articles of Charges (Annexure- I ) . The statement of imputations of misconduct or misbehaviour in support of each article of charge is enclosed ( Annexure -II ) . The list of documents by which , and the listof witnesses by whom , the articles of charges are proposed to be sustained are also enclosed (Annexure - III & IV).

3. Dr. P. Surya Chandra Rao , Deputy Director (AH) is directed to submit a written statement of his defense, within 10 days of the receipt of this order.

4. Dr. P. Surya Chandra Rao, Deputy Director (AH ) is informed that an enquiry will be held only in respect of those articles of charges which are not admitted. He should therefore, specifically admit or deny each article of charge.

5. Itisfurther informed that if he fails to submit his Statement of Defense before the time stipulated by the Government in Para (3 ) above, further action will be processed based on the material available .

6. Attention of Dr. P.Surya Chandra Rao , Deputy Director (AH ) is invited to Rule 24 of A.P.C.S ( Conduct) Rules 1964, under which no Government servant shall bring or attempt to bring any political or outside influence to bear upon any superior authority to further his interests in respect of matters pertaining to his service under the Government. If any representation is received on his behalf from another person in respect of any matter dealt with in these proceedings, it willbe presumed thatDr.P. Surya Chandra Rao,

DeputyDirector (AH ) is aware of such a representation and that it has been made at his instance and action will be taken against him for violation of Rule 24 of the Andhra Pradesh CivilServices(Conduct ) Rules , 1964.

STATEMENT OF ARTICLE OF CHARGES FRAMED AGAINST Dr. P. SURYA CHANDRA RAO , DEPUTY DIRECTOR ( AH )

CHARGE-I :

"thatDr. P. Surya Chandra Rao, Deputy Director ( AH ) while working as Executive Officer on deputation at District Livestock Development Agency, Tadepalligdem has not attended his duties w.e.f. February, 2019 to May, 2019 (upto 12.05.2019) and produced the fabricated physical attendance register which is unbecoming of Government servant in violation of Rule 4( 1 ) of Andhra Pradesh Civil Services (Conduct) Rules, 1964" .

CHARGE - II :

"that Dr. P. Surya Chandra Rao , Deputy Director ( AH ) while working as Executive Officer on deputation at District Livestock Development Agency , Tadepalligdem has exhibited gross negligence of his legitimate duties which resulted in poor implementation of the Bovine Breeding Activities and Government of India schemes that effected the Department badly, which is unbecoming of Government servant in violation of Rule 3 (General ) of Andhra Pradesh Civil Services ( Conduct) Rules, 1964".

CHARGE-III :

"thatDr. P. Surya Chandra Rao , Deputy Director (AH ) while working on deputation as Executive Officer at District Livestock Development Agency,Tadepalligdem has drawn the salary upto 14-07-2019including themonths for which he has not attended to duty from February - 2019to May-2019, which is unbecoming of Government servant in violation of Rule3 (General ) of Andhra Pradesh Civil Services (Conduct ) Rules, 1964".

ANNEXURE -II

STATEMENT OF IMPUTATIONS IN SUPPORT OF ARTICLE OF CHARGES FRAMED AGAINST Dr. P. SURYA CHANDRA RAO , DEPUTY DIRECTOR ( AH )

The Chief Executive Office , APLDA, Guntur in the letter Lr.Roc . No.2327/B/2019 ,Dt:20.11.2019 , has stated that Dr. P. Surya Chandra Rao, whileworking as Executive Officer at DLDA , Tadepalligudem has committed the following irregularities and requested the Director of Animal Husbandry , A.P. , Vijayawada to initiate disciplinary action as per APCS ( CCA) Rules , 1991.

Asper the Bio Metric attendance of Dr.P. Surya Chandra Rao , Executive Officer atDLDA, Tadepalligudem , he has not attended to the duties from February, 2019 to May, 2019 (up to 12.05.2019) as detailed below: -

(a) During February, 2019 , he has attended the office for one day i.e. , on 25.02.2019 at 11.48 AM and left the office at 01.18 PM .

(b) During the month of March , 2019 , he has attended the office for (9 ) days only.

(d) During the month of May, 2019 ( up to 12.05.2019 ) he has attended the office for one day on 12.05.2019 .

(e) The Officer has not submitted tour diaries , not attended the monthly review meetings and failed to submit compliance.

(f) The overall performance of the Officer is not .

(g) Due to the above reasons , Dr. P. Surya Chandara Rao , Deputy Director (AH), the then Executive Officer, DLDA, W.G. District was repatriated to parent department on administrative grounds and posted as Deputy Director (AH) Paderu .

(i ) Orders were issued for the relief of the above Officer on 15.07.2019 . But the said officer has not handed over the charge of hispost of EO , DLDA , Tadepalligudem and proceeded on leave from 15.07.2019.

( ii) Government have issued orders retaining Dr. P. Surya Chandara Rao , E.O , DLDA , Tadepalligudem at same place i.e. , at DLDA, Tadepallligudem.

(iii) Dr. P. Surya Chandara Rao, E.O. has re - joined duty at DLDA , Tadepalligudem on 07.10.2019 .

(iv) Dr. P. Surya Chandara Rao, E.O. , has drawn the salary up to 14.07.2019 ( including the months he has not attended to duty from February, 2019to May , 2019 as mentioned above) 2. TheDirector ofAnimal Husbandry , A.P. , Vijayawada has instructed the Joint Director (AH ) Eluru , West Godavari District to conduct enquiry and submit detailed report on the allegations levelled against Dr. P. Surya Chandra Rao , Deputy Director (AH) , while working on deputation as Executive Officer at DLDA, Tadepalligudem , West Godavari District , for taking further necessary action in the matter. The Joint Director (AH) , Eluru , West Godavari District has submitted his report vide Lr . Roc.No.1 /GOMWG/2020 ,Dt: 15.06.2020 and opined that Dr. P. Surya Chandra Rao , Deputy Director ( AH) , while working as Executive Officer, DLDA , Tadepalligudem has been irregular in attending the office , not submitted the tour diaries within the stipulatedtime, not attended the DLDA activities properly and his performance is very poor in convergence with the Animal Husbandry Department. The physical attendance register produced during enquiry is fabricated.

3. Further, the Director of Animal Husbandry, A.P. , Vijayawada has forwarded the enquiry report submitted by the Inquiry Officer Joint Director (AH ) , Eluru , West Godavari District to the Chief Executive Officer, Andhra Pradesh Livestock Development Agency , Guntur, Andhra Pradesh and requested to offer his specific remarksto this office immediately for taking further necessary action in the matter. The Chief Executive Officer, APLDA , Guntur, vide Lr. Roc . No.2327/B/2021 , Dated: 21.04.2022 , has given his specific remarks on the enquiry report submitted by the Inquiry Officer & Joint Director ( AH ) , Eluru , West Godavari District and he opined that Dr. P. Surya Chandra Rao , while working as Executive Officer , District Livestock Development Association , Tadepalligudem was irregular in attending to duties and has not performed legitimate duties .

4. Dr. P. Surya Chandra Rao , while working as Executive Officer, District Livestock Development Association , Tadepalligudem has exhibited lack of integrity, devotion to duty and his conduct was unbecoming of a Government Servant and thereby violating Rule 3 of the A.P. Civil Services ( Conduct ) Rules , 1964. Hence , the charges.
