: Letter of Award for Selection of Agency (s ) for Supply & Installation ofHorizontal Ice Lined Refrigerators ( ILRs ) for a period of 2 years .
Ref.: Your Proposal ( L1 ) wrt . , reverse auction; dated: 02/09/2022
1. This has reference to the proposal (the capitalized terms used herein shall have the same meaning as set forth in the Request for Proposal ) submitted by your firm to Director of Animal Husbandry, Andhra Pradesh ( the "Authority" ) in response to the Request for Proposal Issued by Authority on 20/07/2022.
2. With reference to your aforesaid bid / proposalbeing the Lowest Quote ( L1 ) for supply of 1000 No's (approx. ) horizontal ILRs (as mentioned in the table below) and during the Agreement Period , the Authority , in its sole discretion , shall have the option (but shall not be obligated ) to purchase from the Supplier additional Goods i.e. , horizontal ILRsat the same price as quotedby you during the reverse auction process (as per the terms & conditions of GEM ) and the subject RFP by the Authority .

3. The performance security of 2% of the Final Bid value ( in terms of INR ) to be paid by the Selected/ Successful Bidder ( to be renewed and be valid at all times and shall remain valid for a period of 3 years beyond the warranty period ) so asto execute the assignment , shall be submitted in the form of Bank Guarantee / DD in the specified format Within 07 days from the data of receipt of notification of award which shall be one among the condition precedents for signing the Service provider agreement with the Authority.
4. The Performance Security shall be forfeited as Damages without prejudice to any other right or remedy that may be available to the Authority under the tender Documents or otherwise , under the following conditions:
i) Inthe case of Selected Applicant / Selected Bidder , if it fails to fulfil the assignment as mentioned in the Bid document / RFP.
ii ) In the case of Selected Applicant / Selected Bidder if it fails to execute the Assignment as per the deliverables agreed with the Authority in the agreement.
iii ) The Performance Security shall be valid for the entire period as mentioned in para [3 ] above . By accepting this LoA, it is deemed to agree that the same shall be renewed at least Fifteen ( 15) days prior to the date of expiry of such security deposit submitted to the Authority till the end of validity period as mentioned above .
iv) Make all necessary arrangements to sign and execute the Agreement with the Authority within Seven ( 07) days from the date of issue of this LoA.
v) The Supplier shall undertake to keep the Authority informed on regular basis , if it supplies the same Product / similar Product ( Goods ) to any other government departments across India. It further undertakes that , iftheProducts / goods are supplied to any other government department across India at price lesser than the price currently being offered to the Authority ( under this Agreement) , the Supplier shall ensure that , the subject goods shall be supplied to Authority at such price being offered with respect to the government department (s ) across India . It is further agreed that, price of all the Products / goods that are already supplied under this agreement shall be revised to the new price (lesser price ) , and the monies already paid shall be adjusted in the subsequent payments.
vi ) The supplier shall undertake to provide the warranty of 3 years + additional 2 years = 5 years warranty i.e. , " Warranty Period " to the department along with availability of spares for a period of 10 years under the subject tender.
vii ) The supplier shall undertake to provide ILRs without IOT (A Micro- processor-based control unit provided for setting of temperature ) for usage in agency areas & places where there is no internet facility as indented by the Authority . In such instances the differential amount of Rs. 18,000/- per unit of IOT facility shall be deducted / adjusted in subsequent payments made towards purchase of ILRs with IOT.
5. The price shall be inclusive of inclusive of Manufacturing , Packaging , delivery (transportation as per indents raised from time to time ) and any other taxes / levies including GST.
6. Please note that, your firm's failure or inability to fulfil any of the requirements stipulated in para [ 3 & 4] above shall render your proposal liable for rejection / disqualification and forfeiture of Bid Security furnished by you and this LoA shall stand withdrawn .
7. In addition to the above , you shall comply with all other provisions / requirements of the RFP in their entirety .
Welook forward to an early fulfilment of the above - mentioned requirements by you . Kindly acknowledge the receipt of this LoA by signing the duplicate copy as a token ofyour acceptance within three (3 ) days from the date of issue of this LoA.
