ORDER :
Inthe letter 1st read above , the Principal Chief Conservator of Forests & HoFF, A.P. , Guntur has informed that the following Article of Charge was issued to Sri B. Dhananjaya Rao , Assistant Conservator of Forests , earlier Divisional Forest Officer, Social Forestry Division , Srikakulam , Visakhapatnam Circle by the Principal Chief Conservator of Forests & HoFF, A.P. , Guntur in Ref . No.12767/ 2019/ Vig -1 , dated 21.03.2020 , under Rule 20 of Andhra Pradesh Civil Services ( Classification , Control and Appeal ) Rules , 1991: -
Article - I : " That the said Sri Balivada Dhananjaya Rao , ACF/ Divisional Forest Officer , Social Forestry Division , Srikakulam had misused his official position and borrowed huge amounts in violation to Rule 8 of AP Civil Services ( Conduct ) Rules , 1964 and got decree from the Hon'ble Senior Civil Judge Court , Ramachandrapuram in Order through ΕΡ Νο.139/ 2018 dt.19.10.2018 in OS No.326/ 2016 for rs.10,83,658/ - attachment of salary of Sri B. Dhananjaya Rao and monthly deduction of Rs.27,144/- P.M. , from the salary for a period of 24 months" .
2. The Charged Officer acknowledged the receipt of the Article of Charge on 24.03.2020 but did not submit his written defence statement . The Principal Chief Conservator of Forests & HoFF , A.P. , Guntur appointed the Conservator of Forests , Visakhapatnam Circle as Inquiry Officer and the Divisional Forest Officer , Srikakulam as Presenting Officer in Proc . No.12767/ 2019/ Vig - 1 ( i ⅈ ) , dated 21.06.2020 , for conducting the regular enquiry .
[ P.T.O ] 3. TheInquiry Officer & Conservator of Forests , Visakhapatnam Circle has completed the inquiry and submitted his findings along with the connected case record in Rc.No.17/ 2020/M8 , dated 03.12.2020 , wherein the Inquiry Officer has concluded that the charge levelled against the Charged Officer is proved beyond any doubt .
4. ThePrincipal Chief Conservator of Forests & HoFF , A.P. , Guntur has communicated the findings of the Inquiry Officer to the Charged Officer in Ref.No.12767/2019 /A & DC - 2 , dated 20.12.2020 , for submission of further defence. The Charged Officer acknowledged the receipt of Final Notice on 29.11.2021 and submitted further defence statement on 13.12.2021 wherein, he did not submit any new/ fresh points.
5. Thedisciplinary proceedings are continued under Rule 9 of Andhra Pradesh Revised Pension Rules, 1980, since the Charged Officer has retired from Government Service on attaining the age of superannuation on 31.03.2020 .
6. After careful examination of the matter , Government have taken a provisional decision to impose a punishment of "withholding of 10% ( ten percent) of pension permanently " against Sri B. Dhananjaya Rao , Assistant Conservator of Forests ( Retired ) , earlier Divisional Forest Officer , Social Forestry Division , Srikakulam , Visakhapatnam Circle , under Rule 9 of Andhra Pradesh Revised Pension Rules , 1980. Accordingly , in Memo . , 2nd read above, a Show- cause Notice was issued to the Charged Officer through Principal Chief Conservator of Forests & HoFF , A.P. , Guntur . The Charged Officer has acknowledged the Show- cause Notice on 11.09.2022 and submitted his defense statement vide reference 4th read above wherein , he did not submit any new/valid points .
7 . The Secretary , Andhra Pradesh Public Service Commission , in the letter 6th read above , has stated that the Commission agreed with the proposal of the Government , to impose a punishment of " withholding of 10% (ten percent) of pension permanently " , against Sri B. Dhananjaya Rao , Assistant Conservator of Forests ( Retired) , earlier Divisional Forest Officer , Social Forestry Division , Srikakulam , Visakhapatnam Circle .
8. After careful examination of the entire issue , the Government hereby order to impose a punishment of " withholding of 10% (ten percent) of pension permanently " against Sri B. Dhananjaya Rao , Assistant Conservator ofForests ( Retired ) , earlier Divisional Forest Officer , Social Forestry Division , Srikakulam , Visakhapatnam Circle , under Rule 9 of Andhra Pradesh Revised Pension Rules , 1980 .
9 . The Principal Chief Conservator of Forests & HoFF , A.P. , Guntur shall take necessary action accordingly .
