NOTIFICATIONSBY GOVERNMENT
Whereas it was brought to the notice of the Government that Smt . R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare Department presently working as Section Officer , YAT & C Department , A.Ρ. Secretariat , Velagapudi , Guntur district was trapped by the Anti Corruption Bureau authorities when she demanded and accepted a bribe of Rs.6,000/- ( Rupees six thousand only) from the Complainant Sri M. Prabhudas , S/ o Sri M. Naganna for processing the file to grant Indian Christian Marriage License under ICM Act .
2. And whereas , in the reference first read above , the Director General , Anti- Corruption Bureau , A.P. , Hyderabad has furnished final report and recommended to prosecute the Accused Officer , Smt . R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare Department presently working as Section Officer , YAT & C Department , A.P. Secretariat , Velagapudi , Guntur district in the Court of Law , since she has committed an offence punishable under Section 7, 13 , ( 2 ) r / w Section 13 ( 1) ( d ) of the Prevention of Corruption Act , 1988 .
3. And whereas , in the reference second read above , Government after careful examination of the matter , accorded sanction to the Director General , Anti - Corruption Bureau to prosecute Smt . R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare Department presently working as Section Officer , YAT & C Department , A.P. Secretariat , Velagapudi , Guntur district , in a Court of Law .

And whereas , in the reference fourth read above , the Director General , Anti- Corruption Bureau , Hyderabad has reported that the Hon'ble Principal Special Judge for SPE & ACB Cases , City Civil Court , Hyderabad , has pronounced judgment on 29.01.2020 in CC No.9/ 2012 and convicted Smt . R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare Department presently working as Section Officer , YAT & C Department , A.P. Secretariat , Velagapudi , Guntur district to undergo Rigorous Imprisonment for (2 ) years and to pay a fine of Rs.1,000/ - and in default payment of fine , she was ordered to undergo Simple Imprisonment for ( 2) months for the offence punishable under section 7 and 13 ( 1 ) (d ) r/w 13 ( 2) of Prevention of Corruption Act 1988. Both the sentences were ordered to run concurrently . He has also reported that the Government , vide G.O.Ms.No.2 , G.A ( Services.C) Dept. , dated 04.01.1999 has directed that in all proved cases of misappropriation , bribery , corruption etc. , the penalty of dismissal from service shall be imposed .

5. The Director General , Anti - Corruption Bureau , Hyderabad has therefore , requested the Government to dismiss the Accused Officer Smt . R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare department presently working as Section Officer, YAT & C Department , A.P. Secretariat , Velagapudi , Guntur district from service on the ground of conduct which has led to her conviction on a criminal charge under Rule 25 (1 ) of Andhra Pradesh Civil Services (Classification , Control & Appeal ) Rules , 1991 without any notice .
6. The Hon'ble Principal Special Judge for SPE & ACB Cases , City Civil Court , Hyderabad delivered the judgment on 29.01.2020 in C.C.No.9/ 2012 as follows :
"In the result , the Accused Officer is found guilty for the offences punishable u/ sections 7 and 13 ( 2) r/w 13 ( 1 ) (d ) of the Prevention of Corruption Act , 1988 and she is convicted u/ s.248 ( 2) Cr.P.C.
The Accused Officer is sentenced to undergo Rigorous Imprisonment for TWO YEARS and also to pay a fine of Rs.1,000/- ( Rupees one thousand only) for the offence u/ s . 7 of the P.C. Act , 1988 and in default of payment of fine amount , she shall undergo Simple imprisonment for (02) months . Further , the Accused Officer is also sentenced to undergo Rigorous imprisonment for TWO YEARS and also to pay a fine of Rs.1,000/ - ( Rupees one thousand only) for the offence u/ s . 13 ( 2) r/ w 13 ( 1 ) ( d ) of the P.C. Act , 1988 and in default of payment of fine amount , she shall undergo Simple Imprisonment for ( 02) months .
Both the above sentences shall run concurrently" .
7 . And whereas on consideration of facts and circumstances of the case , Government have decided that the major penalty of dismissal from Government service shall be imposed on Smt. R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare Department presently working as Section Officer , YAT & C Department , A.P. Secretariat , Velagapudi , Guntur district in terms of G.O. Ms.No.2 , G.A ( Services.C) Dept. , dated 04.01.1999 read with G.O.Ms.No.458 , G.A ( Services.C ) Dept. , dated 22.09.2009 , " provided that in all proved cases of misappropriation , bribery , bigamy , corruption , moral turpitude , forgery and outraging the modesty of women , the penalty of dismissal from service shall be imposed , with immediate effect .

Now , therefore , in exercise of the powers conferred under clause (x) of Rule 25 (i ) of Andhra Pradesh Civil Services ( Classification , Control and Appeal ) Rules , 1991 and G.O.Ms.No.2 , G.A (Services.C) Department , dated 04.01.1999 read with G.O.Ms.No.458 , G.A (Services.C) Dept. , dated 22.09.2009 , Government hereby dismiss Smt . R.K. Vijayalaxmi , formerly Section Officer , Indian Christian Minority Section - I , Minorities Welfare Department presently working as Section Officer , YAT & C Department , A.P. Secretariat , Velagapudi , Guntur district from Government Service with immediate effect , in view of the conviction of the Accused Officer vide Judgment dated 29.01.2020 in C.C. No.9/ 2012 , by the Hon'ble Principal Special Judge for SPE & ACB Cases , City Civil Court , Hyderabad .
9. The Special Chief Secretary to Government , YAT & C Dept. , shall take necessary further action accordingly and furnish the compliance report immediately .

Secretariat , Velagapudi , Guntur district from Government service with immediate effect in view of the conviction of the Accused Officer vide Judgment dated 29.01.2020 in C.C. No.9/ 2012 , by the Hon'ble Principal Special Judgefor SPE & ACB Cases , City Civil Court , Hyderabad .
