ORDER :
It is proposed to hold an enquiry against Sri K.Siva Sankara Rao , formerly Project Director, DRDA , Eluru and now working as Director , Andhra Pradesh State Development Society ( APSDPS ) in accordance with the procedure laid down in the Rule 20 of the Andhra Pradesh Civil Services ( Classification , Control and Appeal ) Rules , 1991 .
2. The statement of articles of charges and statement of imputations of misconduct of misbehaviour in respect of which the inquiry is proposed to be held is set out in the enclosed Annexures I & II . A list of witnesses by whom and a list of documents by which , the articles of charges proposed to be sustained are also enclosed in Annexure III & IV respectively .
3. Sri K.Siva Sankara Rao , formerly Project Director , DRDA , Eluru and now working as Director , Andhra Pradesh State Development Planning Society ( APSDPS ) is directed to submit his Written Statement of Defense , within 10 days from the date of receipt of this order .
4. Sri K.Siva Sankara Rao , formerly Project Director, DRDA , Eluru and now working as Director, Andhra Pradesh State Development Planning Society ( APSDPS ) is informed that , an inquiry will be held only in respect of those articles of charges are not admitted . He should , therefore , specifically admit or deny each article of charge.
5. Sri K.Siva Sankara Rao , formerly Project Director , DRDA , Eluru and now working as Director, Andhra Pradesh State Development Planning Society ( APSDPS ) is further informed that , if he does not submit his written statement of Defense on or before the date as specified in the Para ( 3 ) above , further action will be processed based on the material available.
6. Attention of Sri K.Siva Sankara Rao , formerly Project Director , DRDA, Eluru and now working as Director , Andhra Pradesh State Development Planning Society ( APSDPS ) is invited to Rule 24 of the Andhra Pradesh Civil Services ( conduct ) Rules , 1964 , under which no Government Servant shall bring or attempt to bring any political or Outside influence to bear upon any superior authority to further his interest in respect of matters pertaining to his service under the Government . SECTION OFFICER Sri Kotla Siva Sankara Rao , is a native of Krishna District . His date of Birth is 01.06.1967 . He entered into Government Service on 24.08.1992 as Deputy Statistical Officer and worked in the same capacity at office of CPO , Krishna District , from 24.08.1992 to 24.04.1992 , from 25.04.1995 to 24.04.1997 worked as same cadre in the O / o District SC Cooperative Society , Krishna District , from 24.04.1997 to 03.05.1999 worked as same cadre in the O/o CPO , Krishna District and promoted as Statistical officer and worked in Eluru , and promoted as Assistant Director and worked in Machilipatnam and subsequently promoted as Deputy Director and posted in the O/ o Project Director , MEPMA , Krishna District from 20.07.2012 to 25.06.2013 Vijayawada and transferred , posted as Project Director , DRDA , Krishna District from 26.06.2013 to 10.02.2014.Later , he was transferred and posted as Project Director , DRDA , West Godavari , Eluru from 10.02.2014 till suspension i.e. , 14.03.2014 . He is drawing a pay ( Scale ) of Rs.21 , 820-48,160 . His basic pay is Rs.30 , 750 /- . He is due to retire on attaining the age of superannuation on 31.05.2027. While working as such he committed grave misconduct in as much as :
CHARGE - I
1. That on 20.02.2015 , he was found in possession of unaccounted an amount of Rs.20 , 00,000/ - with him and he failed to account for the same .
2. He failed to intimate to competent authority to do the real estate business by his wife .
Thus Sri Kotla Siva Sankar Rao , the then Project Director , DRDA , Eluru , West Godavari District ( under suspension ) by his above mentioned acts has exhibited lack of integrity , devotion of duty and conduct unbecoming of Government Servant and thereby violated Rule 9 ( 8A ) , 10 ( 1 ) ( 1 - A) r / w . 3 ( 1 ) & ( 2 ) of A.P.C.S ( Conduct ) Rules , 1964 .

ALLEGATION
That the Government Servant while working as Project Director , DRDA , West Godavari District ( Under Suspension ) , on the date of surprise check on 20.02.2015 , committed grave misconduct in as much as he was in abuse of his official position being a public servant possessed un accounted amount of Rs.20,00,000/- with him and failed to account for the same . He also failed to obtain prior permission from the competent authority to do the real estate business by his wife .
FACTS IN EVIDENCE
Brief facts of that on 20.02.2015 , the DSP ACB Vijayawada received reliable information that GS was carrying huge amount and proceedings towards Eluru Road , via Congress Office Road , Vijayawada , in a vehicle bearing No. AP 05 BT 2899. On which the DSP secure two mediators and along with his staff and mediators reached the vicinity of Congress Office Vijayawada at 13.45 hrs and started watching the cards playing along the way . At about 13.55 hrs the checking party observed that one Volkswagan car bearing No. AP 05 BT 2899 is coming from Navarang Theatre side . On instructions of the DSP his staff stopped the said car . Soon after the car is stopped the DSP along with his staff and the mediators approached the car and found only middle aged person in driving seat and a white coloured fabric bag by the side of driving seat . The DSP disclosed his identity to the said person and requested him to disclose his identity . On that the said person became nervous for some time and slowly disclosed his identity as Sri Kotla Siva Sankar Rao S/o Subbarao , 48 years, previously worked as Project Director , DRDA , Eluru , West Godavari ( now under suspension ) R / o flat No.231 , Indira Towers , Near St Anns Hospital , Vijayawada , Krishna District . Then at request of DSP he kept the car on the left side margin of the road . On Thus the Government Servant by his above mentioned acts , has exhibited lack of integrity , devotion to duty and conduct unbecoming of a Government Servant and thereby contravened Rule 3 ( 1 ) & ( 2 ) , 9 ( 8A ) of APCS ( Conduct ) Rules 1964.
The Government Servant has therefore rendered himself liable for regular departmental action for major penalty .
