BIENNIAL ELECTION TO THE ANDHRA PRADESH LEGISLATIVE COUNCIL BY THE MEMBERS OF LEGISLATIVE ASSEMBLY (By MLAs), 2023.

The following notification will be published in an extraordinary issue of the Andhra Pradesh Gazette, dated 06th March, 2023 / Phalguna 15, 1944 (Saka):

NOTIFICATION

WHEREAS, the seats of 07(seven) members of the Legislative Council of the State of Andhra Pradesh, elected by the Members of Legislative Assembly of the State are due to fall vacant on 29th March, 2023 on retirement of those members, on the expiration of their term of office as detailed below;

WHEREAS, a Biennial election has to be held for the purpose of filling the above vacancies so arising;

NOW, THEREFORE, as recommended by the Election Commission of India, in pursuance of Section 16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the State of Andhra Pradesh is, hereby, pleased to call upon the Members of the Legislative Assembly of the State, to elect seven members to the Legislative Council of the State, for the purpose of filling the above said vacancies, in accordance with the provisions of the said Act and of the rules and orders made thereunder.

The following notification of the Election Commission of India, New Delhi, No.322/AP- LC/2023 (MLAs) (1), dated 06th March, 2023 / Phalguna 15, 1944 (Saka) is published:-

NOTIFICATION

No.322/AP-LC/2023 (MLAs) (1): - WHEREAS, the Governor of the State of Andhra Pradesh has, by notification issued under Section 16 of the Representation of the People Act, 1951 (43 of 1951) and published in the official Gazette of the State on 06th March, 2023 been pleased to call upon the members of the Legislative Assembly of the State, to elect seven members to the Legislative Council of the State: -

Now, therefore, in pursuance of sub-section (1) of Section 39 and Section 56 of the said Act, the Election Commission of India hereby –

(A) appoints, with respect to the said election –

(a) the 13th March, 2023 (Monday), as the last date for making nominations;

(b) the 14th March, 2023 (Tuesday), as the date for the scrutiny of the nominations;

(c) the 16th March, 2023 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 23rd March, 2023 (Thursday), as the date on which a poll shall, if necessary, be taken;

and

(e) the 25th March, 2023 (Saturday), as the date before which the election shall be completed;

and3 ANDHRA PRADESH GAZETTE EXTRAORDINARY [PART-V (B) fixes the hours from 09:00 am to 04:00 pm, as the hours during which the poll shall, if necessary, be taken in the State on the date specified above, for the election.

APPOINTMENT OF RETURNING OFFICER AND ASSISTANT RETURNING OFFICER FOR BIENNIAL ELECTION TO THE ANDHRA PRADESH LEGISLATIVE COUNCIL BY THE MEMBERS OF LEGISLATIVE ASSEMBLY, 2023.

The following notification of the Election Commission of India, New Delhi, No.322/AP- LC/2023 (MLAs) (2), dated 06th March, 2023 / Phalguna 15, 1944 (Saka) is published:-

NOTIFICATION

No.322/AP-LC/2023 (MLAs) (2): - In pursuance of Section 21, and in exercise of the powers conferred by sub-section (1) of Section 22, of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, in consultation with the Government of Andhra Pradesh, hereby:–

(i) designates the officer, specified in column (1) of the TABLE below, to be the Returning Officer; and

(ii) appoints the officer, specified in column (2) of the said Table, to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;

in respect of the biennial election to the Legislative Council of the State of Andhra Pradesh, by the members of Legislative Assembly of the State, to be held in pursuance of the Governor's notification published in the official Gazette of the State on 06th March, 2023:-
