ORDER :
The Government of Andhra Pradesh is committed to provide impetus to the growth of data centres and strongly believes that data centres have the potential to catalyze the overall development of Information Technology ( IT)/ Information Technology - enabled Services ( ITeS ) industry in the State . India's ever - growing data consumption has spurred the need to store and process data , which has increased the demand for data centres in the country . With data protection and security becoming the top priority for countries , local storage of data has become increasingly critical . The Indian data industry is currently worth $ 5.6 billion dollars with 138 data centers overall spanning 11 million square feet and with 737 megawatt ( MW) of IT capacity . It is expected that by 2025 , the country will have 183 data centres totaling approximately 24 million square feet and , with 1,752 MW of total IT capacity . Thus , it
1 is important to promote this industry that has immense potential for accelerated growth ofdigital economy of the state¹ .
2. Andhra Pradesh should aspire to have at least 20-25% of data center capacity of the country . Data centers have been accorded infrastructure status by Government ofIndia 2.
3. Inthe reference 1 , the Government of Andhra Pradesh approved " the allocation of 130 acres of land and a specific package of incentives to M/s Vizag Tech Park Limited for the establishment of 200 MW Integrated Data Centre Park, IT business Park skill university and recreation centre in Madhurawada , Visakhapatnam , with a commitmentto invest a total of INR 14,634 Crore . and to create 24,990 direct jobs" .
4. The operational guidelines for " the administration of the incentives authorized by G.O. Ms. No. 5, ITE&C ( Promotions) Department, dated 23.11.2020 " , was published in reference 2 .
5. In the reference 4, the Government of Andhra Pradesh has issued orders " for execution of sale deed of 130 acres of land to M/s Vizag Tech Park Limited ( M/s VTPL) for the establishment of Integrated Data Centre Park including 200 MW data Centre park, IT business park , skill university , and recreation Centre at Madhurawada, Visakhapatnam Dist. , Andhra Pradesh and ... to safeguard the interest of the Government of Andhra Pradesh , while considering the request of the project proponent , ... to incorporate the conditions of the Government order read at reference 1,2 and 3 issued in the present allotment and timelines prescribed for implementation , as ' condition super added' in the sale deed in terms of Section 31 of Transfer of the Property Act 1822 " .
6. In the reference 5 , M /s . Vizag Tech Park Ltd (VTPL) submitted a proposal " to set up 100 MW Data Center , IT and Business Park , Skill Center and Recreation Center with an investment of Rs. 7,210 Cr. and direct employment to 14,825 people and requested for certain package of incentives as below:
a. Allot 60-70 acres of land parcel at Kapulappada (V) , Bheemunipatnam ( Mandal ) by including 8.01 acres land in Sy No. 405 .
b . Execute Sale Deed in the proposed 60-70 acres land at Kapulappada (V) , Bheemunipatnam (Mandal )
c. Allow residential accommodation under "Walk to work concept " by suitably amending the term " Social infrastructure " and enhancing its scope while allotment of integrated data center park 130 Acres at Madhurawada and subsequent approvals for 60-70 Acres land allotment.
d . Provide incentives for the 60-70 Acres land allotment for setting up of Hyper Scale Data Centre and IT Park on par with the incentives awarded earlier for allotment of 130 acres land " .

2 7. The State Investment Promotion Board , in its meeting held on 07.02.2023 , issued the following instructions in reference 8:
a. " To allot 60.29 acres of land including 52.28 acres land in Sy. No. 401/1 , 414/1 and 421 and 8.01 acres of land in Sy. No. 405 at Kapulappada ( V) , Bheemunipatnam ( Mandal) as per the timelines for 100 MW Data Center as given below from the date of handing over such land.
Implementation Timelines :
Phase I 10 MW within 3 years of date of handing over the land
Phase II 20 MW within 4 years of date of handing over the land
Phase III 40 MW within 5 years of date of handing over the land
Phase IV 70 MW within 6 years of date of handing over the land
Phase V 100 MW within 7 years of date of handing over the land
The timelines for other project components and corresponding employment generation shall be as projected in the DPR.
b . Execution of sale deed for the proposed allotment duly keeping the terms as perG.O.Ms.No. 1 , Dt: 07.02.2022 .
c. Residential accommodation provided within the project to promote walk to work on extending residential development under Social Infrastructure making applicable for both the earlier allotment of 130 acres of land and present proposal of land allotment under consideration . The extent of land for Social Infrastructure (and within that the land for Residential Accommodation ) maybe restricted within the land earmarked for Recreation Centers under both the projects . The layout approval for such social infrastructure ( including residential accommodation) shall be given as per applicable VMRDA / APIIC norms .
d. Incentives are extended for this proposal on par with the incentives awarded to M/s Vizag Tech park Pvt Ltd ( VTPL) , Madhurawada vide G.O.Ms.No.5, dated: 23.11.2020" .
8. In reference 9 , the 1328th Council of Ministers meeting in the Council Resolution No : 20/2023 held on 08.02.2023 has approved as follows:
"Approval of the Honorable Council of Ministers is accorded on the request of M/s Vizag Tech Park Limited for allocation of additional 60.29 acres of land including 52.28 acres land in Sy . No. 401/1 , 414/1 and 421 and 8.01 acres of land in Sy. No. 405 at Kapulappada ( V) , Bheemunipatnam (Mandal) ; Execution of sale deed for the proposed allotment duly keeping the terms as per G.O.Ms.No. 1 , Dt: 07.02.2022; allowing residential accommodation restricted within the land earmarked for Recreation Centers under both the projects ; and approval of incentives for this
3 proposal on par with the incentives awarded to M/s Vizag Tech Park Pvt. Ltd (VTPL ) , Madhurawada vide G.O.Ms. No.5, dated: 23.11.2020 ".
9.Accordingly, the Government hereby extends the special package of incentives to M/s. Vizag Tech Park Pvt Ltd (VTPL ) , as follows:
a . " Allotment of 60.29 acres of land including 52.28 acres ' land in Sy. No. 401/1 , 414/1 and 421 and 8.01 acres of land in Sy. No. 405 at Kapulappada (V), Bheemunipatnam ( Mandal ) to set up 100 MW Data Center, IT and Business Park, Skill Centre and Recreation Centre to M /s Vizag Tech Park Pvt Ltd (VTPL).
b . Execution of sale deed for the proposed allotment duly keeping the terms as perG.O.Ms.No. 1 , Dt: 07.02.2022 .
c. Residential accommodation to be provided within the project to promote walk to work on extending residential development under Social Infrastructure , making applicable for both the earlier allotment of 130 acres of land and present proposal of land allotment under consideration . The extent of land for Social Infrastructure ( and within that the land for Residential Accommodation ) may be restricted within the land earmarked for Recreation Centres under both the projects . e. The above incentives shall be made applicable upon achieving the proposed investment and direct employment target for the data center park and IT business park . Guidelines for claiming the incentives will be issued separately. " 10. The Andhra Pradesh Electronics and Information Technology Agency (APEITA) and the VC& MD , APIIC , Mangalagiri shall take necessary action , and intimate the progress of work and activities of M / s . VTPL periodically to the Government .
