DECLARATION
The 2nd September, 2024
(Under Section 19 (1) of the Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act, 2013)
No. LMD-13011/30/2023/900.— WHEREAS, It appears to the Governor of Arunachal Pradesh that a total of 174.655 Hectares (17,46550 Sq Mtrs) of land is required at Nisso, Chello, Tabumha, Pingang, Riya, Buyang, Chomi, Chote and Tai Village under Koloriang Circle of Kurung Kumey District for public purposes namely:- Construction of Frontier Highway in the State of Arunachal Pradesh (Lada to Sarli) from KM 123.500 to KM 183.450 (Pkg-II) by the State PWD (Highway Zone).
WHEREAS, a preliminary notification as required under Section 11(1) read with Section 40 (1) of LARR Act, 2013 was issued by the Department of Land Management vide Memo No. LMD-13011/30/2023/1920 dated Itanagar the 1st February, 2024 notifying the intention of the State Government for acquiring of 174.655 Hectares (17,46,550 Sq Mtrs) of the said land and inviting public claims and objections to the proposed acquisition of land if any.
AND WHEREAS, the Deputy Commissioner, Kurung Kumey District vide his Memo No. KKD/LM/FH/43/ 2023-24/1704 dated the Koloriang on 3rd January, 2023 certified that land is a private land and free from public and Government projects and that there are no project affected families and therefore no compensation towards Rehabilitation and Resettlement of Nisso, Chello, Tabumha, Pingang, Riya, Buyang, Chomi, Chote and Tai Villages are required to be paid under Section 31 of the LARR Act and has requested the State Government to issue the draft declaration under Section 19 of the LARR Act, 2013.
AND WHEREAS, the Appropraite Government is pleased to note that it is satisfied that Chapters-II and III and Section -15 and 18 shall not apply to acquisition process in respect of the said land at Nisso, Chello, Tabumha, Pingang, Riya, Buyang, Chomi, Chote and Tai Villages for construction of Frontier Highway in the State of Arunachal Pradesh (Lada to Sarli).
AND NOW, therefore the Governor of Arunachal Pradesh is pleased to issue the Declaration under Section 19 of the Act specifying that the piece of land measuring 174.655 Hectares (17,46,550 Sq Mtrs ) located at Nisso , Chello, Tabumha, Pingang, Riya, Buyang, Chomi, Chote and Tai Villages under Koloriang Circle of Kurung Kumey District is being acquired, the detailed description whereof is as follows:-

The Governor of Arunachal Pradesh is further pleased to order as under:-
(i) Except such parts of the mines and minerals which may be required to be dug or removed or used during construction phase of the project for the purpose of which land is being acquired, no mines, minerals, iron, stone, slate and other minerals lying under the said land shall be extracted or removed.
(ii) A plan of the land may be inspected in the office of the Collector and DLRSO, Kurung Kumey District on any working day during the working hours. The provisions of the chapter-II and III and Section 15 to 18 of the Act shall not apply to the acquisition in respect of the above land since the land is acquired by the MoRTH in exercise of the powers conferred by sub- section (1) and (4) of Section 40 of the LARR Act, 2013.
(iii) The Collector (Deputy Commissioner) through no award has been made, may, on expiration of thirty days from the date of publication of the notice mentioned in Section 21, take possession of any land needed for a public purpose and such land shall thereupon vest absolutely in the Government free from all encumbrances.
(iv) No additional compensation will be paid as per Section 40 (5) of the LARR Act, 2013 since the acquisition affects the sovereignty and integrity of India and the security and strategic interest of the State.
