THE ARUNACHAL PRADESH LOCAL AUTHORITIES (PROHIBITION OF DEFECTION)

(AMENDMENT) BILL, 2026

BILL

further to amend the Arunachal Pradesh Local Authorities (Prohibition of Defection) Act, 2003 (Act No. 3 of 2003).

BE it enacted by the Legislative Assembly of Arunachal Pradesh in the Seventy- Seventh Year of the Republic of India as follows: -

1. Short title, extend and commencement : (1) This Act may be called the Arunachal Pradesh Local Authorities (Prohibition of Defection) (Amendment) Act, 2026.

(2) It extends to the whole of the Arunachal Pradesh.

(3) It shall come into force on such date as the Government may by notification appoint.

2. Deletion of Section 2 (ii), - In the Arunachal Pradesh Local Authorities (Prohibition of Defection) Act, 2003 (Act No. 3 of 2003) (hereinafter referred to as the principal Act), clause (ii) of Section 2 shall be deleted.

3. Amendment of Section 2 (iv), - In the principal Act, in clause (iv) of Section 2 the words, "Anchal Samiti" shall be deleted.

4. Amendment of Section 3 (1)(b), - In the principal Act, in clause (b) of sub -section (1) of Section 3 the words, "or Anchal Samiti" shall be deleted.

5. Insertion of sub-section (1) of Section 3, - In the principal Act, in sub-section (1) of Section 3, after the clause (b) the following clause shall be inserted, -

"(c) if in a Gram Panchayat Chairperson election or a Zilla Parishad Chairperson election, a member, after the issuance of whip by his/her political party, engages in any activity that undermines their party nominee".

6. Amendment of Section 6, -In the principal Act, in clause (b) of sub-section (1) of Section 6 after the words "under clause (b)" the words "or ( c)" shall be inserted.

7. Amendment of Section 6, -In the principal Act, in sub-section (2) of Section 6, for the words, "within twenty-four hours" the words, "within forty-eight hours" and for the words, "State Election Commissioner" the words, "Deputy Commissioner" shall be substituted. 2 The Arunachal Pradesh Extraordinary Gazette, March 6, 2026 8. Amendment of Section 8 (1) and (2), - In the principal Act, in Section 8 (1) and (2), the words, "Anchal Samiti" wherever appear shall be deleted. 9. Repeal and saving :- The Arunachal Pradesh Local Authorities (Prohibition of Defection) (Amendment) Ordinance, 2025 is hereby repealed.

Notwithstanding such repeal, any order issued or action taken under the Ordinance shall be construed to have been validly issued or taken under the corresponding provisions of the Act.
