THE ARUANCHAL PRADESH GOODS AND SERVICES TAX

(AMENDMENT) BILL, 2020

further to amend the Arunachal Pradesh Goods and Services Tax Act, 2017.

Be it enacted by the Legislative Assembly of Arunachal Pradesh in the Seventieth

year of the Republic of India as follows; -

1. (1) This Act may be called the Arunachal Pradesh Goods and Services Tax

(Amendment) Act, 2020.

Short title and

commence-

ment.

(2) Save as otherwise provided in this Act, the provisions of this Act shall be deemed to

have come into force with effect from 1st January, 2020.

Provided that different dates may be appointed for different provisions of this Act and any reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision.

Amendment of

section 2.

2. In the principal Act, in section 2, in clause (4), after the words "the Appellate Authority for Advance Ruling,", the words "the National Appellate Authority for Advance Ruling," shall be inserted.

3. In the principal Act, in section 10, ––

Amendment

of section 10.

(1) in sub-section (1), after the second proviso, the following Explanation shall be

inserted, namely : —

"Explanation –– For the purposes of second proviso, the value of exempt supply of services provided by way of extending deposits, loans or advances in so far as the consideration is represented by way of interest or discount shall not be taken into account for determining the value of turnover in the State.";

(2) in sub-section (2), —

(a) in clause (d), the word ''and'' occurring at the end shall be omitted ;

(b) in clause (e), for the word ''Council:'', the words ''Council ; and'' shall be

substituted;

(c) after clause (e), the following clause shall be inserted, namely: ––

"(f) he is neither a casual taxable person nor a non-resident taxable person:";

(3) after sub-section (2), the following new sub-section shall be inserted,

namely : ––

"(2A) Notwithstanding anything to the contrary contained in this Act, but subject to the provisions of sub-sections (3) and (4) of section 9, a registered person, not eligible to opt to pay tax under sub-section (1) and sub-section (2), whose aggregate turnover in the preceding financial year did not exceed fifty lakh rupees, may opt to pay, in lieu of the tax payable by him under sub-section (1) of section 9, an amount of tax calculated at such rate as may be prescribed, but not exceeding three per cent. of the turnover in the State, if he is not––

(a) engaged in making any supply of goods or services which

are not leviable to tax under this Act ;

(b) engaged in making any inter-State outward supplies of

goods or services ;

(c) engaged in making any supply of goods or services through an electronic commerce operator who is required to collect tax at source under section 52 ;

(d) a manufacturer of such goods or supplier of such services as may be notified by the Government on the recommendations of the Council ; and

(e) a casual taxable person or a non-resident taxable person:

Provided that where more than one registered person is having the same Permanent Account Number issued under the Income-tax Act, 1961, the registered person shall not be eligible to opt for the scheme under this sub-section unless all such registered persons opt to pay tax under this sub-section.";

(4) in sub-section (3), after the words, brackets and figure "under sub- section (1)" at both the places where they occur, the words, brackets, figure and letter "or sub-section (2A), as the case may be," shall be inserted.

(5) in sub-section (4), after the words, brackets and figure "of sub-section (1)", the words, brackets, figure and letter "or, as the case may be, sub-section (2A)" shall be inserted.

(6) in sub-section (5), after the words, brackets and figure "under sub- section (1)", the words, brackets, figure and letter "or sub-section (2A), as the case may be," shall be inserted.

(7) after sub-section (5), the following Explanations shall be inserted,

namely: —

"Explanation 1.–– For the purposes of computing aggregate turnover of a person for determining his eligibility to pay tax under this section, the expression "aggregate turnover" shall include the value of supplies made by such person from the 1st day of April of a financial year up to the date when he becomes liable for registration under this Act, but shall not include the value of exempt supply of services provided by way of extending deposits, loans or advances in so far as the consideration is represented by way of interest or discount.

Explanation 2. –– For the purposes of determining the tax payable by a person under this section, the expression "turnover in State" shall not include the value of following supplies, namely : ––

(a) supplies from the first day of April of a financial year up to the date when such person becomes liable for registration under this Act; and

(b) exempt supply of services provided by way of extending deposits, loans or advances in so far as the consideration is represented by way of interest or discount."

Amendment of

section 22.

4. In the Principal Act, in section 22, in sub-section (1), in the second proviso, for the punctuation mark ".", the punctuation mark (:) shall be substituted and thereafter the following new proviso shall be inserted, namely: ––The Arunachal Pradesh Extraordinary Gazette, January 7, 2020 3 "Provided also that the Governm ent may, on the recommendations of the Council, enhance the aggregate turnover from twenty lakh rupees to such amount not exceeding forty lakh rupees in case of supplier who is engaged exclusively in the supply of goods, subject to such conditions and limitations, as may be notified.

Explanation.–– For the purposes of this sub-section, a person shall be considered to be engaged exclusively in the supply of goods even if he is engaged in exempt supply of services provided by way of extending deposits, loans or advances in so far as the consideration is represented by way of interest or discount.".

5. In the principal Act, in section 25, after sub-section (6), the following Amendment of section 25.

new sub-sections shall be inserted, namely: —

"(6A) Every registered person shall undergo authentication, or furnish proof of possession of Aadhaar number, in such form and manner and within such time as may be prescribed:

Provided that if an Aadhaar number is not assigned to the registered person, such person shall be offered alternate and viable means of identification in such manner as Government may, on the recommendations of the Council, prescribe:

Provided further that in case of failure to undergo authentication or furnish proof of possession of Aadhaar number or furnish alternate and viable means of identification, registration allotted to such person shall be deemed to be invalid and the other provisions of this Act shall apply as if such person does not have a registration.

(6B) On and from the date of notification, every individual shall, in order to be eligible for grant of registration, undergo authentication, or furnish proof of possession of Aadhaar number, in such manner as the Government m ay, on the recommendations of the Council, specify in the said notification:

Provided that if an Aadhaar number is not assigned to an individual, such individual shall be offered alternate and viable means of identification in such manner as the Government may, on the recommendations of the Council, specify in the said notification.

(6C) On and from the date of notification, every person, other than an individual, shall, in order to be eligible for grant of registration, undergo authentication, or furnish proof of possession of Aadhaar number of the Karta, Managing Director, whole time Director, such number of partners, Members of Managing Committee of Association, Board of Trustees, authorised representative, authorised signatory and such other class of persons, in such manner, as the Government may, on the recommendations of the Council, specify in the said notification:

Provided that where such person or class of persons have not been assigned the Aadhaar Number, such person or class of persons shall be offered alternate and viable means of identification in such manner as the Government may, on the recommendations of the Council, specify in the said notification.

(6D) The provisions of sub-section (6A) or sub-section (6B) or sub- section (6C) shall not apply to such person or class of persons or part of the State, as the Government may, on the recommendations of the Council, specify by notification.

Central Act

18 of 2016.

Explanation. — For the purposes of this section, the expression "Aadhaar number" shall have the same meaning as assigned to it in clause (a) of section 2 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016.".

6. In the Principal Act, after section 31, the following new section shall be inserted, namely: —

"31A. The Government may, on the recommendations of the Council, prescribe a class of registered persons who shall provide prescribed modes of electronic payment to the recipient of supply of goods or services or both made by him and give option to such recipient to make payment accordingly, in such manner and subject to such conditions and restrictions, as may be prescribed."

7. In the Principal Act, in section 39, ––

section 39.

(1) for sub-sections (1) and (2), the following sub-sections shall be substituted, namely: ––

''(1) Every registered person, other than an Input Service Distributor or a non- resident taxable person or a person paying tax under the provisions of section 10 or section 51 or section 52 shall, for every calendar month or part thereof, furnish, a return, electronically, of inward and outward supplies of goods or services or both, input tax credit availed, tax payable, tax paid and such other particulars, in such form and manner, and within such time, as may be prescribed:

Provided that the Government may, on the recommendations of the Council, notify certain class of registered persons who shall furnish a return for every quarter or part thereof, subject to such conditions and restrictions as may be specified therein.

(2) A registered person paying tax under the provisions of section 10, shall, for each financial year or part thereof, furnish a return, electronically, of turnover in the State, inward supplies of goods or services or both, tax payable, tax paid and such other particulars in such form and manner, and within such time, as may be prescribed.'';

(2) for sub-section (7), the following sub-section shall be substituted, namely: —

"(7) Every registered person who is required to furnish a return under sub-section (1), other than the person referred to in the proviso thereto, or sub-section (3) or sub- section (5), shall pay to the Government the tax due as per such return not later than the last date on which he is required to furnish such return:

Provided that every registered person furnishing return under the proviso to sub-section (1) shall pay to the Government, the tax due taking into account inward and outward supplies of goods or services or both, input tax credit availed, tax payable and such other particulars during a month, in such form and manner, and within such time, as may be prescribed:

Provided further that every registered person furnishing return under sub- section (2) shall pay to the Government, the tax due taking into account turnover in the State, inward supplies of goods or services or both, tax payable, and such other particulars during a quarter, in such form and manner, and within such time, as may be prescribed.".

Amendment of

section 44.

8. In the Principal Act, in section 44, in sub-section (1), for the punctuation mark ".", the punctuation mark (:) shall be substituted and thereafter the following new provisos shall be inserted, namely: –

"Provided that the Commissioner may, on the recommendations of the Council and for reasons to be recorded in writing, by notification, extend the time limit for furnishing the annual return for such class of registered persons as may be specified therein:

Provided further that any extension of time limit notified by the Commissioner of Central tax shall be deemed to be notified by the Commissioner.".

9. In the Principal Act, in section 49, after sub-section (9), the following new sub-sections Amendment of section 49.

shall be inserted, namely: —

"(10) A registered person may, on the common portal, transfer any amount of tax, interest, penalty, fee or any other amount available in the electronic cash ledger under this Act, to the electronic cash ledger for integrated tax, central tax, State tax or cess, in such form and manner and subject to such conditions and restrictions as may be prescribed and such transfer shall be deemed to be a refund from the electronic cash ledger under this Act.

(11) Where any amount has been transferred to the electronic cash ledger under this Act, the same shall be deemed to be deposited in the said ledger as provided in sub-section (1).".

10. In the Principal Act, in section 50, in sub-section (1), for the punctuation mark ".", the Amendment of section 50.

punctuation mark (:) shall be substituted and thereafter the following new proviso shall

be inserted, namely: ––

"Provided that the interest on tax payable in respect of supplies made during a tax

period and declared in the return for the said period furnished after the due date in

accordance with the provisions of section 39, except where such return is furnished

after commencement of any proceedings under section 73 or section 74 in respect of

the said period, shall be levied on that portion of the tax that is paid by debiting the

electronic cash ledger.".

11. In the Principal Act, in section 52, ––

(1) in sub-section (4), for the punctuation mark ".", the punctuation mark (:) shall be

substituted and thereafter the following new provisos shall be inserted, namely: –

"Provided that the Commissioner may, for reasons to be recorded in writing,

by notification, extend the time limit for furnishing the statement for such class of

registered persons as may be specified therein:

Provided further that any extension of time limit notified by the Commissioner

of Central tax shall be deemed to be notified by the Commissioner.";

(2) in sub-section (5), for the punctuation mark ".", the punctuation mark (:) shall be

substituted and thereafter the following new provisos shall be inserted, namely: –

"Provided that the Commissioner may, on the recommendations of the Council

and for reasons to be recorded in writing, by notification, extend the time limit for

furnishing the annual statement for such class of registered persons as may be

specified therein:

Provided further that any extension of time limit notified by the Commissioner

of Central tax shall be deemed to be notified by the Commissioner.".

12. In the Principal Act, after section 53, the following new section shall be inserted,

namely: —

"53A. Where any amount has been transferred from the electronic cash ledger under

this Act to the electronic cash ledger under the Arunachal Pradesh Goods

and Services Tax Act or under the Integrated Goods and Services Tax Act or

under the Goods and Services Tax (Compensation to States) Act, the

Government shall, transfer to the central tax account or integrated tax account

or cess account, an amount equal to the amount transferred from the electronic

cash ledger, in such manner and within such time as may be prescribed."

13. In the Principal Act, in section 54, after sub-section (8), the following new sub-section Amendment of section 54.

shall be inserted with effect from the 1st of September, 2019, namely: ––

"(8A) Where the Central Government has disbursed the refund of State tax, the

Government shall transfer an amount equal to the amount so refunded, to the

Central Government".

14. In the principal Act, in section 95, ––

(1) in clause (a), ––

(a) after the words "Appellate Authority", the words "or the National Appellate

Authority" shall be inserted;

(b) after the words and figures "of section 100", the words, figures and letter "or

of section 101C of the the Central Goods and Services Tax Act" shall be

inserted;

(2) in clause (e), for the punctuation mark ".", the punctuation mark (;) shall be

substituted and thereafter the following new clause shall be inserted, namely: ––

'(f) "National Appellate Authority" means the National Appellate Authority for

Advance Ruling referred to in section 101A.".

15. In the Principal Act, after section 101, the following new section shall be inserted,

namely: ––

"101A. Subject to the provisions of this chapter, for the purposes of this Act, the National Appellate Authority for Advance Ruling constituted under section 101A of the Central Goods and Services Act shall be deemed to be the National Appellate Authority for Advance Ruling under this Act".

16. In the Principal Act, in section 102, in the opening portion, : ––

(1) after the words "Appellate Authority", at both the places where they occur, the words "or the National Appellate Authority" shall be inserted;

(2) after the words and figures "or section 101", the words, figures and letter "or section 101C of the Central Goods and Services Tax Act, respectively," shall be inserted;

(3) for the words "or the appellant", the words ", appellant, the Authority or the Appellate Authority" shall be substituted.

17. In the Principal Act, in section 103, ––

(1) after sub-section (1), the following new sub-section shall be

inserted, namely: ––

"(1A) The Advance Ruling pronounced by the National Appellate Authority under this Chapter shall be binding on—

(a) the applicants, being distinct persons, who had sought the ruling under sub-section (1) of section 101B of the Arunachal Pradesh goods and Services Tax Act and all registered persons having the same Permanent Account Number issued under the Income-tax Act, 1961;

(b) the concerned officers and the jurisdictional officers in respect of the applicants referred to in clause (a) and the registered persons having the same Permanent Account Number issued under the Income-tax Act, 1961.";

(2) in sub-section (2), after the words, brackets and figure "in sub- section (1)", the words, brackets, figure and letter "and sub- section (1A)" shall be inserted.

18. In the Principal Act, in section 104, in sub-section (1),––

(1) after the words "Authority or the Appellate Authority", the words

"or the National Appellate Authority" shall be inserted;

(2) after the words and figures "of section 101", the words, figures and letter "or under section 101C of the Central Goods and Services Tax Act" shall be inserted.

19. In the Principal Act, in section 105, ––

(1) for the marginal heading, the following marginal heading shall be

substituted, namely: ––

"Powers of Authority, Appellate Authority and National Appellate Authority.";

(2) in sub-section (1), after the words "Appellate Authority", the words

"or the National Appellate Authority" shall be inserted;

(3) in sub-section (2), after the words "Appellate Authority" at both the places where they occur, the words "or the National Appellate Authority" shall be inserted.

20. In the Principal Act, in section 106, ––

(1) for the marginal heading, the following marginal heading shall be

substituted, namely: ––

"Procedure of Authority, Appellate Authority and National Appellate Authority.";

(2) after the words "Appellate Authority", the words "or the National Appellate

Authority" shall be inserted.

21. In the Principal Act, in section 171, after sub-section (3), the following new sub-

section shall be inserted, namely: ––

"(3A) Where the Authority referred to in sub-section (2), after holding examination as required under the said sub-section comes to the conclusion that any registered person has profiteered under sub-section (1), such person shall be liable to pay penalty equivalent to ten per cent of the amount so profiteered:

Provided that no penalty shall be leviable if the profiteered amount is deposited within thirty days of the date of passing of the order by the Authority.

Explanation.— For the purposes of this section, the expression "profiteered" shall mean the mount determined on account of not passing the benefit of reduction in rate of tax on supply of goods or services or both or the benefit of input tax credit to the recipient by way of commensurate reduction in the price of the goods or services or both.".

Notification No. 42 / 2019 (State Tax)

The 13th December, 2019

No. GST/23/2017/VOL-II.—In exercise of the powers conferred by section 164 of the Arunachal Pradesh Goods and Services Tax Act, 2017 (7 of 2017), the State Government hereby makes the following rules further to amend the Arunachal Pradesh Goods and Services Tax Rules, 2017, namely: -

1. (1) These rules may be called the Arunachal Pradesh Goods and Services Tax (Eighth Amendment) Rules, 2019.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Arunachal Pradesh Goods and Services Tax Rules, 2017 (hereinafter referred to as the said rules), in rule 48, after sub-rule (3), the following sub-rules shall be inserted, namely:-

"(4) The invoice shall be prepared by such class of registered persons as may be notified by the Government, on the recommendations of the Council, by including such particulars contained in FORM GST INV-01 after obtaining an Invoice Reference Number by uploading information contained therein on the Common Goods and Services Tax Electronic Portal in such manner and subject to such conditions and restrictions as may be specified in the notification.

(5) Every invoice issued by a person to whom sub-rule (4) applies in any manner other than the manner specified in the said sub-rule shall not be treated as an invoice.

(6) The provisions of sub-rules (1) and (2) shall not apply to an invoice prepared in the manner specified in sub-rule (4)".

No. GST/23/2017/VOL-II.—In exercise of the powers conferred by section 146 of the Arunachal Pradesh Goods and Services Tax Act, 2017 (7 of 2017) read with sub-rule(4) of rule 48 of the Arunachal Pradesh Goods and Services Tax Rules, 2017 and section 20 of the Integrated Goods and Services Tax Act, 2017 (13 of 2017), the State Government, on the recommendations of the Council, hereby, notifies the following as the Common Goods and Services Tax Electronic Portal for the purpose of preparation of the invoice in terms of sub-rule(4) of rule 48 of the aforesaid rules, namely:-

(i) www.einvoice1.gst.gov.in;

(ii) www.einvoice2.gst.gov.in;

(iii) www.einvoice3.gst.gov.in;

(iv) www.einvoice4.gst.gov.in;

(v) www.einvoice5.gst.gov.in;

(vi) www.einvoice6.gst.gov.in;

(vii) www.einvoice7.gst.gov.in;

(viii) www.einvoice8.gst.gov.in;

(ix) www.einvoice9.gst.gov.in;

(x) www.einvoice10.gst.gov.in.

Explanation.- For the purposes of this notification, the above mentioned websites mean the websites managed by the Goods and Services Tax Network, a company incorporated under the provisions of section 8 of the Companies Act, 2013 (18 of 2013).

2. This notification shall come into force with effect from the 1st day of January, 2020.

Notification No. 44 / 2019 (State Tax)

The 13th December, 2019

No. GST/23/2017/VOL-II.—In exercise of the powers conferred by sub-rule (4) to rule 48 of the Arunachal Pradesh Goods and Services Tax Rules, 2017, the Government, on the recommendations of the Council, hereby notifies registered person, whose aggregate turnover in a financial year exceeds one hundred crore rupees, as a class of registered person who shall prepare invoice in terms of sub-rule (4) of rule 48 of the said rules in respect of supply of goods or services or both to a registered person.

3. This notification shall come into force from the 1st day of April, 2020.

No. GST/23/2017/VOL-II.—In exercise of the powers conferred by the sixth proviso to rule 46 of the Arunachal Pradesh Goods and Services Tax Rules, 2017 (hereinafter referred to as the said rules), the Government, on the recommendations of the Council, hereby notifies that an invoice issued by a registered person, whose aggregate turnover in a financial year exceeds five hundred crore rupees, to an unregistered person (hereinafter referred to as B2C invoice), shall have Quick Response (QR) code:

Provided that where such registered person makes a Dynamic Quick Response (QR) code available to the recipient through a digital display, such B2C invoice issued by such registered person containing cross- reference of the payment using a Dynamic Quick Response (QR) code, shall be deemed to be having Quick Response (QR) code.

2. This notification shall come into force from the 1st day of April, 2020.

No. GST/23/2017/VOL-II.—In exercise of the powers conferred by section 168 of the Arunachal Pradesh Goods and Services Tax Act, 2017 (7 of 2017) read with sub-rule (5) of rule 61 of the Arunachal Pradesh Goods and Services Tax Rules, 2017 (hereafter in this notification referred to as the said rules), the Commissioner, on the recommendations of the Council, hereby makes the following further amendment in notification of the Government of Arunachal Pradesh, Department of Tax, Excise & Narcotics, No. 30 /2019 – State Tax, dated the 9th October, 2019, published in the Gazette of Arunachal Pradesh, Extraordinary, No. 436, Vol. XXVI, Naharlagun, Tuesday, November 5, 2019 vide File No. GST/23/2017/Vol-II, dated the 9th October, 2019, namely:–

In the said notification, after the proviso, the following proviso shall be inserted, namely: –

"Provided further that the return in FORM GSTR-3B of the said rules for the month of November, 2019 shall be furnished electronically through the common portal, on or before the 23rd December, 2019."

2. This notification shall be deemed to have come into force with effect from the 20th day of December, 2019.

No. LM-63/2011/1442.—WHEREAS, the land more fully described in the schedule below have been voluntarily donated/gifted on free of cost by the villagers of Bath village and Jote Poma village under Capital Complex and Papum Pare District of Arunachal Pradesh for the purpose namely for up gradation of Itanagar- Sangdupota road to State Highways [CH: No. 0.00 KM (Gohpur Tinali) to CH: No. 24.960 KM (CO HQ. Sangdupota).

NOW, THEREFORE, the land described in the schedule shall be used for the purpose of up gradation of Itanagar-Sangdupota road to State Highways by the State Public Works Department, Doimukh Division.

Any person who has any objection to the notification of the said land for the purpose may file such objection in writing to the office of the Deputy Commissioner, Yupia, Papum Pare district within 30 (thirty) days from the publication of this notification by clearly stating the reason for such objections and the Deputy Commissioner in his capacity shall dispose off the same giving reasonable opportunity of hearing to extinguish the claim.

No. DAD-69/2019.—WHEREAS, the Registrar General and Census Commissioner of India, Ministry of Hom e Affairs, Government of India, New Delhi vide Letter No. 9/36/2017-CD (CEN) dated 22nd December, 2017, requested that if the State Government has any proposal for making changes of Administrative boundaries of existing Municipalities, Revenue Villages, Police Stations, Development Blocks, Circles, Sub-divisions and Districts etc., or for forming New Administrative Units which are pending or may be taken up in near future may be finalised and given effect to by 31st December, 2019. Changes, if any, may be informed to the Directorate of Census Operations as well as Registrar General and Census Commissioner of India, New Delhi by 31st December, 2019.

AND WHEREAS, Government of India has requested the State Government to ensure that there should not be any effective changes to the administrative boundaries of the aforesaid units during 1st January, 2020 to 31st March, 2021.

NOW THEREFORE, in exercise of the powers conferred by the Census Act, 1948 (Act No. 37 of 1948) Section 18, Sub-Section 1, read with the Census Rules, 1990, Sub-Rule 4 of Rule 8, the Governor of Arunachal Pradesh directs that there will be no changes in the administrative boundaries of Municipalities, Villages, Police Stations, Development Blocks, Circles, Sub-divisions and Districts of Arunachal Pradesh with effect from 1st January, 2020 to 31st March, 2021.

WHEREAS, under section 67, 68 and section 164 of the Electricity Act - 2003 read with section 10 and section 16 of the India Telegraph Act, 1885 provides for payment of compensation towards surface damages caused due to laying of transmission line in the land falling in the Right of Way of the transmission line.

WHEREAS, the mode of payment/calculation of compensation shall be as per the government of Arunachal Pradesh notification No. PWRS/E-2462/2013(Pt-II) dated 29th August, 2019. However, the payment of compensation for land value is not permission inside the Reserve Forest.

AND NOW THEREFORE, any person who has any claims to the surface damage of said land for the said purpose may file such claims in writing to the office of the Deputy Commissioner, Capital Complex, Itanagar within 30 (thirty) days from the date of Publication of this Notification by clearly stating the reason for such claims; and the Deputy Commissioner, Capital Complex, Itanagar in his capacity shall dispose off the same

No. FOR.104/E-A/2014/Pt-II/ 139-259.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, and in supersession of all Service Rules in respect of Arunachal Pradesh Forest Services Rules/Recruitment Rules, amended from time to time except as respects things done or omitted to be done before such supersession, the Governor of Arunachal Pradesh is pleased to make the following rules to regulate the method of recruitment and other conditions of Service of the Arunachal Pradesh Forest Service, in the Department of Environment and Forests under the Government of Arunachal Pradesh namely;

PART-I

1. Short title and commencement :

(1) These Rules may be called the Arunachal Pradesh Forest Service Rules, 2019.

(2) They shall come into force on the date of their publication in the Arunachal Pradesh Gazette.

2. Definitions:

(1) In these Rules, unless the context otherwise requires -

(a) "Commission" means the Arunachal Pradesh Public Service Commission.

(b) "Committee" means the Departmental Promotion Committee/Department Confirmation Committee as constituted under Rule-13 of these Rules.

(c) "Government" means the Government of Arunachal Pradesh.

(d) "Appointing Authority" in relation to any grade, means the authority empowered to make appointment to that grade;

(e) "State" means the State of Arunachal Pradesh;

(f) "Member of Service" means a person appointed on a regular basis to A runachal Pradesh Forest Service.

(g) "Duty Post" means any post specified in Schedule-I;

(h) "Departmental Promotion Committee/Departmental Confirmation Committee" means a Committee constituted to consider promotion and confirmation in any grade as specified in Schedule-I.

(i) The expression "Schedule Tribe" shall have the same meaning as are assigned to them by clause (25) of Article 366 of the Constitution of India.

(j) "Service" means the Arunachal Pradesh Forest Service.

3. Constitution of service and its classification:

(1) There shall be constituted a State Forests Service to be known as Arunachal Pradesh Forest Service.

(2) The service shall have the following 4(four) grades namely:-

(a) Entry Grade

(b) Senior Grade

(c) Selection Grade

(d) Administrative Grade

(3) The posts specified in all Grades shall be State Civil Services Group –"A" (Gazetted) posts.

(AUTHORISED PERMANENT STRENGTH OF THE POSTS)

4. Strength of the Service:

The authorised permanent strength of the service and the posts included therein shall be as specified in Schedule-I.

(i) The number of posts in Senior Grade of the service shall be 30% of the duty posts inclusive of Deputation Reserve, Training Reserve and Leave Reserve.

(ii) The number of posts in Selection Grade of the service shall be 20% of the duty posts inclusive of Deputation Reserve, Training Reserve and Leave Reserve mentioned in Schedule-I.

(iii) The strength of the posts in the 'Administrative Grade' shall be as specified in Schedule-I. (However, this strength should not exceed 15% of the duty posts, inclusive of Deputation Reserve, Training Reserve and Leave Reserve).

(iv) Subject to such conditions and limitations as may be specified by the Government, duty posts for such period by order may be created.

(v) The Government may, in consultation with the Commission, include in the service, any posts other than those included in the said schedule.

(vi) The Government may, in consultation with the Commission, appoint to the service the regular incumbent of such post which has been included in the service to permanent or temporary capacity, as may be deemed fit. The suitability of such officers for appointment shall be assessed by the Departmental Promotion Committee constituted under Rule-14.

(vii) Notwithstanding, anything contained in sub-rule (iv) and (v) of these Rules, in case any regular incumbent of such post which has been included in the service under sub-rule (v) is not found suitable for appointment to the service under sub-rule (vi), he will continue to hold the post and for the purpose, the post will be treated to have been excluded from the service till it is held by such incumbent. Such person may be reconsidered by the Committee at appropriate occasions.

PART-III

(METHOD OF RECRUITMENT)

5. Method of Recruitment: Save as provided in Rule-17 or 18 or sub-rule (vii) of Rule-4, appointment to the service shall be made by the following methods, namely;

(i) 50% of the substantive vacancies which occur from time to time in the authorised permanent strength of the service shall be filled by direct recruitment in the manner specified in Part-IV of these Rules, and "out of 50% of the vacancies available for the direct recruitment, 50% of the vacancies shall be filled up from Bachelor of Science in Forestry from a recognized University and 50% from other science graduates as provided in Rule 6 (2) (a).

(ii) the remaining 50% of such substantive vacancies shall be filled by promotion on the basis of selection in the manner specified in Part-V of these Rules from amongst;

(a) Officers who are substantively holding the post of Range Forest Officer, Group-B (Gazetted) and possess the minimum educational qualification of Graduation/Bachelor Degree in Science/ B.Sc. (Forestry) from a recognized University as provided in Rule 6 (2) (a).

(b) Provided that, the posts actually filled by direct recruitment and promotion in the Entry Grade, at any time should not exceed 50:50 ratio in the authorized permanent strength.

PART-IV

(DIRECT RECRUITMENT)

6. Competitive examination:

(1) A competitive examination for direct recruitment to the posts/services shall be held at such intervals as the Government may, in consultation with the Commission from time to time determine. The dates on which and the places at which the examination shall be held, shall be fixed by the commission.

(2) The required educational and other qualifications shall be as below :-

(a) Educational qualification: The candidates must possess a Bachelor's Degree in Science from a recognised University or Institution with at least one of the following subjects:-

Agriculture, Botany, Chemistry, Physics, Mathematics, Statistics, Zoology, Forestry, Geology, Horticulture, Engineering (Agriculture/Chemical/Civil/Electrical/Electronics/Mechanical, Computer ScienceApplication, Environmental Science, Veterinary Science and Computer Science & Engineering).

The vacancies meant for Forestry Graduates shall be filled up on the basis of the merit adjudged amongst the Forestry Graduates in the same pattern as described for other science graduates through a written Competitive Examination to be conducted by the Commission.

(b) Age: In case of direct recruitment, the minimum and maximum age limit will be 18 to 32 years respectively on the 1st January of the year of the recruitment. Upper age limit will be relaxable by 5 (five) years in case of APST/Government Servant ( 37 years).

(3) Special provisions for the members of Scheduled Tribes (ST): The appointment to the service made by Direct Recruitment shall be as per order regarding special representation in the service for Scheduled Tribes issued by Government of Arunachal Pradesh from time to time.

7. Nature of Examination:

(1) In case of direct recruitment, the candidates shall be selected on the basis of a Competitive Examination to be conducted by the Commission in the following subjects followed by Walking Test of a distance of not less than 25 Km and 14 Km to be completed in 4(four) hours by Male and Female candidates respectively, followed by medical examination and interview:-

Compulsory Subjects:

(i) General Knowledge                     :       100 Marks
(ii) English (Essay & Precis writing, etc) :      100 Marks

(iii) Mathematics (Secondary/Matriculation/equivalent standards) : 100 Marks

Optional Subjects:

Any two subjects out of the following : 200 Marks each.

   (i)  Agriculture
   (ii) Botany
  (iii) Zoology
  (iv)  Mathematics
   (v)  Chemistry
  (vi)  Physics
  (vii) Geology
 (viii) Computer Application/ Science
  (ix)  Mechanical Engineering
  (x)   Civil Engineering
  (xi)  Chemical Engineering
 (xii)  Agriculture Engineering
 (xiii) Electrical Engineering
 (xiv)  Electronics Engineering
  (xv)  Computer Science Engineering
 (xvi)  Environmental Science
 (xvii) Forestry
(xviii) Statistics

 (xx)   Veterinary Science

(The Standard of the subject shall be that of a Bachelor's Degree)

(2) No candidate shall be allowed to take more than one subject from the following groups:-

(i) Agriculture, Agriculture Engineering and Veterinary Science

(ii) Chemical Engineering and Chemistry

(iii) Computer Application/ Science and Computer Science and Engineering

(iv) Electrical Engineering and Statistics.

INTERVIEW:

8. The commission shall conduct an Interview/ Viva-Voce for the candidate(s) who qualifies in the written examination. The maximum marks for Interview/Viva-Voce shall be 80 (eighty) marks.

9. Decision of the Commission to be final:-

The decision of the Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final and no candidate(s) to whom a certificate of admission has not been issued by the Commission shall be admitted to the examination.

(1) Subject to the provisions of sub-rule (2) of these rules, the Commission shall forward to the Government a list arranged in order of merit of the candidates who have qualified by such standards as the commission may determine.

(2) The candidates belonging to Scheduled Tribes may, to the extent the number of vacancies reserved for Scheduled Tribes, (cannot be filled on the basis of the general standards), be recommended by the Commission by a relaxed standard to make up the deficiency in the reserved quota, subject to the fitness of these candidates for selection to the service irrespective of their ranks in the order of merit at the examination.

11. Physical fitness:

No candidates shall be appointed to the service unless he/she is declared fit after such Medical Examination(s) as the Government may prescribe to be in good mental and bodily health and free from any mental and physical defect likely to interfere with the discharge of the duties of the service.

Minimum Physical Standard for appointment to the service is prescribed below:-

Provided that a separate minimum height standards shall be allowed in the case of candidates belonging to Scheduled Tribes of Arunachal Pradesh.

12. Inclusion in the list not confers right to appointment:

The inclusion of a candidate(s) name in the list referred to in Rule-10 shall confer no right to appointment unless the Government is satisfied after such inquiry as may be considered necessary that, the candidate is suitable in all respect for appointment to the service and an actual offer of appointment is made to the candidate.

Provided that, where a candidate(s) whose name is included in the list referred to in Rule-10 is not appointed to the service, the reasons for the same shall be recorded in writing by the Government.

13. Order of Appointment:

(i) Subject to the provision of these Rules, the candidates included in the lists referred to in Rule-10 shall be appointed to the service in order of merit.

(ii) In filling the vacancies reserved for the Scheduled Tribes, shall be considered for appointment to the available vacancies in the order in which their name appear in the list referred to in Rule-10.

PART-V

(COMPOSITION OF THE DEPARTMENTAL PROMOTION COMMITTEE).

14. Departmental Promotion Committee/Departmental Confirmation Committee:

Recruitment under Part-III sub-rule (ii) of Rule 5 of these rules shall be made on the recommendation of Departmental Promotion Committee/Departmental Confirmation Committee (hereinafter referred to as the Committee) notified by the Government of Arunachal Pradesh Vide No.OM-34/85, dated 17th January, 2001 and consisting of the following:

(i) Chief Secretary

: Chairman

(ii) Principal Secretary (E&F)/PCCF : Member

(iii) Commissioner/ Secretary not connected : Member

with the work of the department.

(iv) One Group - A APST Officer not below the rank of : Member

Secretary to the Govt. if none of the above member belongs to APST

15. Condition for eligibility and procedure for Promotion by selection:

(1) The Committee shall consider from time to time, the cases of officers eligible under sub-rule (ii) of Rule-5, who have served in the respective cadre or posts, as the case may be, for not less than 5 (five) years and prepare a list of officers recommended for appointment after taking into account the actual vacancies at the time of selection and those likely to occur during the next one year. The selection for inclusion in the list shall be based on merit and suitability in all respects for appointment to the service with due regard to seniority.

(2) The seniority of the officers eligible for consideration by the committee under sub-rule (1) above shall be determined by the Government with due regard to the date (s) of their appointments on a regular basis to the respective cadre or posts.

(3) The names of persons included in the list shall be arranged in order of merit.

(4) The list so prepared by the committee shall be submitted to the Commission which in turn shall forward the same with or without modification as it deem necessary to the Government.

(5) The list shall thereafter be approved by the Government with or without modifications if any.

Provided that, if the Government propose/ suggest any change/ modification in the list forwarded by the Commission, it shall do so with prior consultation of the Commission. The Government shall forward to the Commission all relevant records while making suggestion to any modification or change along with the reasons to be recorded in writing.

(6) If the Commission considers it necessary to make any change in the list received from the Government, the Commission shall inform the Government of the changes proposed by it or otherwise.

(7) The list shall finally be approved by the Government after taking into consideration the changes. If any change or recommendations made by the Commission is not accepted, the reasons for such non-acceptance shall be recorded in writing.

(8) The list, thus finally approved shall be in force for 12 months extendable to another 6 months or until a fresh list is prepared for the purpose in accordance with these rules whichever is earlier.

16. Appointment to the service :

Appointment to the service shall be made in order of merit in the list referred to in sub-rule (5) of Rule-15 with due regard to the ratio/proportion specified in Rule-5.

PART-VI

(INITIAL CONSTITUTION OF SERVICE)

17. Initial appointment of persons to the service:

1. The Service Personnel who had been appointed on regular basis in each grade of service, as per the provisions of Arunachal Pradesh Forest Service Rules,1990 immediately before the commencement of these rules, shall be deemed to have been appointed in accordance with the provisions of these rules.

2. The regular continuous service personnel holding the posts at the time of commencement of these rules shall count for the purpose of probationary period, qualifying service for promotion and pension.

3. Notwithstanding anything contained in these rules, the initial appointment to the service, after coming into force of these rules, shall be made in order of merit included in the finally approved list referred to in sub-rule (8) of Rule 15.

PART-VII

(APPOINTMENT, PROBATION, TRAINING & CONFIRMATION)

18. Appointment:

All appointment to the service shall be made to the Entry Grade, Senior Grade, Selection Grade and Administrative Grade of the service and not against any specified post included in the service.

19. Disqualification:

No person,

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who have a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the Service.

Provided that, the Government may if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

20. Other conditions of services:

The other conditions of service of members of the service in respect of matter for which no specific provision has been made in these rules shall be the same as are applicable, from time to time, to the employees of Government of Arunachal Pradesh.

21. Period of probation:

(1) Every person appointed under Rule-5 or Rule-16 to the Arunachal Pradesh Forest Service Entry Grade of the service, shall be on probation as below :-

(a) Officers appointed to the service by direct recruitment shall be on probation for a period of 3 years i.e. 2 years for training in the State Forests Service Course and 1 year for on the job training in the Department.

(b) Officers appointed to the service by promotion from Range Forest Officer will be on probation for a period of 2 years.

(3) A probationer who has no lien on any post under the Central Government or any State Government shall be liable to be discharged from the service at any time without any notice if;

(a) On the basis of his/her performance or conduct during probation, he/she is considered unfit for further retention in the service, or

(b) If on the receipt of any information relating to his nationality, age, health or antecedents, the Appointing Authority is satisfied that he/she is ineligible or otherwise unfit for being a member of the service.

(4) A probationer, who holds a lien on a post under the Central Government or any State Government may be reverted to such a substantive post at any time in any of the circumstance specified in sub- rule (3) (a) (b).

(5) A probationer who is not considered suitable for confirmation at the end of the period of probation in sub-rule (1) or at the end of extended period of probation, if any under sub-rule (2), shall be discharged or reverted in accordance with sub-rule (3) or sub- rule (4), as the case may be.

22. Execution of Agreement:

A probationer who is required to undergo training, shall, on appointment to the service execute an agreement in such form as may be prescribed by Government from time to time, binding himself/herself any one surety, jointly and severely, in the event of his failing to comply with any of the provisions of these rules to the satisfaction of the Government to refund any money paid to him/her consequent on his appointment as probationer.

23. Training and Departmental Examination:

A person appointed under rule -5 or Rule-16 to the service shall undergo such training and pass during the period of probation such departmental examination as the Government may from time to time prescribe.

Provided that, the Government may, subject to such conditions, as it may impose and having regard to his past service, experience or academic qualifications exempt any person appointed under Rule-5 or Rule- 16, either wholly or partly from any such training or departmental examination.

24. Confirmation in service:

A person who has been declared to have satisfactorily completed his/ her probation period may be confirmed in the service by the Departmental Confirmation Committee prescribed at Rule -14.

PART-VIII

(OFFICIATING APPOINTMENTS)

25. Selection for officiating appointment:

If at any time the Government is of the opinion that the number of officers available in the list referred to in sub-rule (7) of Rule-15 for appointment to duty posts is not adequate having regard to the vacancies in such posts, it may direct the committee to consider the case of officers who have officiated for a period of not less than 5 (five) years in any of the posts mentioned in Schedule-I and prepare a separate list of officers selected. The selection for inclusion in the list shall be based on merit and suitability in respects for officiating appointments to duty posts with due regard to seniority. The provision of sub- rule (3) to (8) of Rule-15 shall apply mutatis- mutandis in the preparation of the list under this rule.

26. Officiating appointments to duty posts of the service:

(1) If any member of the service is not available for holding a duty post, the post may be filled on an officiating basis:-

(a) by the appointment of an officer included in the list referred to in sub- rule (7) of Rule-15, or

(b) if no such officer is available, by the appointment of an officer included in the list prepared under Rule-25.

(2) Notwithstanding anything contained in these rules, if the exigencies of public service so require, a duty post for which a member of the service is not available, may be filled on an officiating basis with prior consultation with the Commission by an officer belonging to a Forest Service of any of the State/UT Government on deputation for such period or periods ordinarily not exceeding 3 (Three) years as the Government may consider it necessary.

(3) Notwithstanding anything contained in these rules, where appointment to a duty post is to be made purely as a local arrangement for a period of not exceeding 6 (Six) months, such appointments may be made by the Government from persons who are included in the list prepared under sub- rule (7) of Rule-15 or who are eligible for inclusion in such a list.

(4) Any appointment made under sub-rule (3) above shall be reported by the Government to the Commission forthwith.

PART-IX

(MISCELLANIOUS)

27. Posting of member of the service:

(i) Every member of the service shall, unless he/she is appointed to an ex-cadre post, or is otherwise not available for holding a duty post owing to the exigencies of public service, be posted against

a duty post under the Government of Arunachal Pradesh in or outside the State by the Government.

28. Duty post to be held by a member of the service:

Every duty post shall be held by a member of the service.

Provided that a duty post in Entry Grade or Senior Grade of the service may also be held by an officer in the Junior scale of the Indian Forest Service Cadre of joint AGMUT cadre and a duty post in the Administrative Grade by an Officer in the Senior Scale of the same IFS Cadre, and in that event, such duty post shall be treated to have been excluded from the service till it is held by such officer.

29. Seniority:

(i) The relative seniority of Members of the Service appointed to a Grade of the Service, at the time of initial constitution of the Service under Rule 6, shall be as existing on the date of commencement of these rules;

Provided that if the seniority of any such Member has not been specifically determined on the commencement of these rules, the same shall be as determined on the basis of the Rules governing the fixation of seniority as were applicable to the Members of the Service prior to the commencement of these rules.

(ii) The Seniority of the persons recruited to the Service after the initial constitution of the service shall be determined in accordance with the merit list and general instruction issued by the Government in this regard from time to time.

30. Pay and Allowances:

(1) The Pay Level in the Pay Matrix admissible to a member of the service shall be as follows:-

(i) Arunachal Pradesh Forest Service (Entry Grade): Level-10, ` 56100-177500

(ii) Arunachal Pradesh Forest Service (Senior Grade): Level-11, ` 67700-208700

(iii) Arunachal Pradesh Forest Service (Selection Grade): Level-12, ` 78800-209200

(iv) Arunachal Pradesh Forest Service (Administrative Grade): Level-13, ` 123100-215900

(2) A person recruited on the basis of the results of the competitive examination shall on appointment to the service draw pay at the minimum of the Pay Matrix of Arunachal Pradesh Forest Service Entry Grade (56100-177500).

Provided that, if he/she held a permanent post other than a tenure post in substantive capacity prior to his appointment to the service, his/her pay during the gap period of his/her probation in the service shall be regulated under the provisions of Fundamental Rule-22.The pay and increment in the case of other persons/appointed to the service shall be regulated in accordance with the Fundamental Rules.

Provided further that, it shall be open to the Government to determine the pay of any member of the service in such manner as the Government may deem fit and proper if the special circumstances of his/ her case so require.

(3) The Dearness and other Allowances shall be paid to persons holding duty post at such rates as may be determined by the Government from time to time.

31. Appointment to the Arunachal Pradesh Forest Service (Senior Grade):

(i) Appointment of the member to the service in Arunachal Pradesh Forest Service (Entry Grade) who possess Graduation/Bachelor's degree in Science/B.Sc. (Forestry) from a recognised University/ Institution shall be considered for promotion to Arunachal Pradesh Forest Service (Senior Grade) on completion of 5 (Five) years of regular service in Arunachal Pradesh Forest Service (Entry Grade) including 2 years period of training in State Forest Service Colleges in respect of direct recruits, subject to fitness and mutatis mutandis fulfilling the conditions specified in Rule 15.

Provided that where a person is considered for such appointment, all persons senior to him in the Arunachal Pradesh Forest Service (Entry Grade) shall also be considered irrespective of the fact whether or not they fulfil the requirement of the minimum 5 (five) years service.

32. Appointment to the Arunachal Pradesh Forest Service (Selection Grade):

(1) Appointment of the member to the Selection Grade shall be made on the basis of merit cum- seniority subject to fitness.

(2) An officer with a minimum 5 (five) years of regular service with Graduation/Bachelor Degree in Science/B.Sc. (Forestry) from a recognised University/Institution in the Senior Grade shall be eligible for being considered for appointment to the Selection Grade i.e. in the rank of Dy. Conservator of Forest (State Forest Service).

Provided that service in duty posts of any equivalent posts in Entry Grade of the Arunachal Pradesh Forest Service, shall count towards the 5 (five) years qualifying period.

Provided further that where a person is considered for such appointment, all persons senior to him in Senior Grade shall also be considered irrespective of the fact whether or not they fulfil the requirement as to the minimum of 5 (Five) years service.

(3) The crucial date for determining the eligibility of officers for promotion to the Arunachal Pradesh Forest Service Selection Grade shall be 31st December of the year preceding the year in which the vacancy has occurred.

(1) Appointment of the member(s) of the service to the Administrative Grade shall be made by promotion on selection basis on the recommendations of the Departmental Promotion Committee. The composition of Departmental Promotion Committee shall be the same as provided under Rule-14 of these Rules.

(2) An officer with a minimum 5 (five) years of regular service in Selection Grade shall be eligible for being considered for promotion to the Administrative Grade.

Provided that where a junior person is considered for such appointment all persons senior to him shall be considered for promotion to the Administrative Grade, provided that they have put in a minimum of 10 (ten) years of combined regular service in Senior Grade and Selection Grade inclusive of at least 5 (Five) years of regular service in Selection Grade.

(3) The crucial date of determining the eligibility of officer for promotion to the Administrative Grade shall be 31st December of the preceding year in which the vacancy has occurred.

(4) The Departmental Promotion Committee shall prepare a list of persons recommended for appointment to the Administrative Grade and the names of persons included in the list shall be arranged in order of merit. The provision of sub- rule (4) to (8) of rule-15 shall apply mutatis-mutandis in the preparation of the list under these rules.

(5) The minimum Educational Qualification of Graduation/Bachelor's Degree in Science /B.Sc. (Forestry) from a recognized University for appointment/promotion as prescribed under clause (a) of sub-rule (2) of Rule 6.

34. Regulation:

The Government may make regulations or issue instructions, not inconsistent with these rules, to provide for all matters for which provision is necessary or expedient for the purpose of giving effect to these rules.

35. Residuary matters:

In regard to matters not specifically covered by these rules or by regulations or orders issued thereunder or by special orders, the members of the service shall be governed by rules, regulations and orders applicable to corresponding officers serving in connection with the affairs of the state.

36. Interpretation:

If any question arises relating to the interpretation of these rules, it shall be decided by the Government in consultation with the Commission if required.

PART-IX

(TRANSITIONAL ARRANGEMENTS)

37. Transitional Provision:

On and from the commencement of these rules and until persons are appointed to hold the duty posts in accordance with the provisions of these rules, such posts may be continued to be held by officers appointed thereto, as if these rules have not come into force.

38. Power to relax:

Where the Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, and in consultation with the Commission, relax any of the provisions of these rules with respect to any class or category of persons or posts.

39. Saving:

Nothing in these rules shall affect reservations and other concessions required to be provided for the Arunachal Pradesh Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

40. Repeal:

The Arunachal Pradesh Forest Service Rules, 1990 and subsequent amendment made vide notification No. FOR/391/E(A)/90,PT, dated 08.01.1997, No. FOR./391/E(A)/90/32,343, dated 24.9.1999, No. FOR-120/E-A/2010/7209-12, dated 16.6.2010, FOR.259/E/(A)/2013/3682, dated 24.02.2016 are hereby repealed.

No. FOR.104/E-A/2014/Pt-II/ 260-300 :— In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all Range Forest Officer recruitment rules notified prior to this notification, except as respect things done or omitted to be done before such supersession, the Governor of Arunachal Pradesh hereby makes the following rules to regulate the method of recruitment to the post of Range Forest Officer, Group-B, Gazetted (Non-Ministerial) in the Department of Environment and Forests under the Government of Arunachal Pradesh namely:-

1. Short title and commencement: - (1) These rules may be called " The Range Forest Officer Recruitment Rules, 2019".

(2) They shall come into force on the date of their publication in the Arunachal Pradesh Gazette.

2. These rules shall apply to the posts as specified in column 1 of the Schedule annexed to

these rules.

3. Number of posts, classification and Pay Level in the Pay Matrix: - The number of posts, their classification and the Pay Level in the Pay Matrix attached thereto shall be as specified in columns 2 to 4 in the Schedule aforesaid.

4. Method of recruitment, age limit and other qualifications etc:- The method of recruitment to the said post, age limit, educational qualification and other matters relating thereto shall be as specified in columns 5 to 13 of the Schedule aforesaid.

5. Disqualification: - No person,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living has entered into or contracted a marriage with any person shall be eligible for appointment to the said posts.

Provided that the Governor of Arunachal Pradesh may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing exempt any person from the operation of these rules.

6. Power to relax: - Where the Governor of Arunachal Pradesh is of the opinion that it is necessary or expedient so to do, he may, by order for reasons to be recorded in writing and observing the procedures as prescribed under OM No. AR-89/2012 dated 6th March, 2013 and in consultation with the Commission relax any of the Provisions of these Rules with respect to any class or category of persons.

7. Repeal & Savings: - All rules and procedures corresponding to these rules and procedures in force immediately before the commencement of these rules are hereby repealed, provided that any order made or action taken under the rules so repealed shall be deemed to have been validly made or taken under the corresponding provisions of these Rules.

Nothing in these rules shall affect reservation/relaxation of age limit and other concessions required to be provided for the Arunachal Pradesh Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Government of Arunachal Pradesh from time to time in this regard.

Out of 66 2/3% for direct recruitment or by deputation /absorption recruitment vacancies, 50% of the vacancies shall and percentage of the vacancies to be be filled up by Bachelor of Science in Forestry from filled by various methods. a recognized University and remaining 50% of posts/

vacancies shall be filled up from other Science Graduates.

: (b) The vacancies meant for Forestry Graduates shall

be filled up on the basis of the merit adjudged amongst the Forestry Graduates on the same pattern as prescribed for other science graduates through a written competitive examination conducted by the Commission.

11. In case of recruitment by promotion / : (a) 33 1/3 % by promotion from amongst Deputy deputation / grades from which promotion/ Forest Ranger of the Department with a minimum deputation / absorption to be made. of 5 (five) years of regular service in the grade,

on seniority- cum- merit basis, failing which by promotion from the post of Dy. Forest Ranger who have completed not less than 15 (fifteen) years of combined service as Dy. Forest Ranger and Forester.

No. FOR.APBRDA/GB/02/2018-19.——The Governor of Arunachal Pradesh is pleased to frame the following Memorandum & Bye Laws of Arunachal Pradesh Bamboo Resources Development Agency (APBRDA), Government of Arunachal Pradesh, namely :-

1. Memorandum of Association :

The name of the society shall be Arunachal Pradesh Bamboo Resources & Development Agency, (hereinafter called "Agency").

(a) The Agency will have its registered office at State Forest Research Institute Complex, Van Vihar, Chimpu Itanagar, Arunachal Pradesh.

(b) Its area of operation shall be throughout Arunachal Pradesh.

2. The objectives: The main objectives of the Agency are Resources and Enterprise Development, Economic upliftment, Training, Employment, Trade and Technology Development and Resources Mobilization on bamboo based activities and perform such functions as the government may prescribe from time to time. Without prejudice to the general objectives as stated above, the objectives, in particular, of the Agency will be:

(i) To develop bamboo resources in Arunachal Pradesh.

(ii) Trade and technology development on bamboo based activities.

(iii) To obtain fund, assistance, grant, contribution and loans toward development of bamboo and its applications.

(iv) Disburse grant, assistance, loan, advance to individuals, groups, firms or organizations having objectives similar to that of the Agency.

(v) To encourage, assist, lease, carry on and venture jointly on bamboo based industries and to carry on trade or business in bamboo based activities and in the matters incidental to such trade or business.

(vi) To encourage or undertake manufacture of bamboo based value added products and application including wood substitutes, composites, structural, processed bamboo shoots, industrial products, fibers and fabric and other utility items.

(vii) To encourage, assist and undertake scientific management of natural bamboo resources for economic upliftment of the people and for protection of environment and ecology, encourage, assist and undertake plantation of suitable bamboo species in degraded and non –forest areas.

(viii) To undertake any work and function in bamboo sector development and related fields.

(ix) To collaborate with any other institutions/organizations/persons having objectives wholly or partly similar to that of the Agency.

(x) To help the people by way of training, quality control, standardization, assistance, market support, publicity, education, incentives and patronizing in bamboo based activities.

(xi) To provide marketing linkages and to arrange for sale of bamboo based products.

(xii) To acquire patent or license relating to any inventions, improvements or designs.

(xiii) To undertake and encourage research, development and application work in bamboo sector development and utilization.

(xiv) To discharge such other duties and to perform such other functions as the Government may direct for the purpose of carrying out the object of the Agency.

3. Governing Body of Arunachal Pradesh Bamboo Resources & Development Agency :

4. The APBRDA may co-opt any other Government functionary or any such person outside

Government :

(i) The income and property of the Agency shall be applied towards the promotion of the objectives as set in this Memorandum of Association subject to conditions stipulated for grants made by Government of Arunachal Pradesh from time to time. No portion of the income and property of the Agency shall be paid or transferred directly by way of dividends, bonus or otherwise.

Provided that nothing therein contained shall prevent in good faith any payment of remuneration in return for any service rendered to the Agency.

(ii) On the winding up or dissolution of the Agency, there remains after the satisfaction of its liabilities, any property whatsoever, the same shall not be paid or disbursed amongst the members of the Agency or any of them but shall be dealt with in such a manner as the Government of Arunachal Pradesh through concerned department may determine.

(iii) There shall be a Governing Body and an Executive Committee and such other functionaries as may be prescribed by rules of the Agency.

(iv) All residuary matters including conduct of business of the Agency shall be provided in the rules of the Agency.

(v) The Governing body of the Agency may, by a special resolution passed by a majority not less than three-fifth of the total membership of the Agency, alter its memorandum of association.

(vi) Provide that no such alteration of the memorandum of association shall take effect until it is sanctioned by the Registrar of the Firm and Societies, Arunachal Pradesh, who shall, before granting such sanction, satisfy himself that the alteration is not such as would have the effect of marketing the Agency ineligible for registration under the Societies Registration Act, 1860 (21 of 1860) as extended to Arunachal Pradesh.

(vii) Member Secretary of the Governing Body shall be the Chief Executive Officer of the Agency.

5. Rules of Arunachal Pradesh Bamboo Resources and Development Agency :

Short Title : These rules may be called the Rules of the Arunachal Pradesh Bamboo Resources & Development Agency (APBRDA).

6. Definition and Interpretations :

(i) Chairman shall mean Chairman of the Governing Body of the Agency referred to in these rules.

(ii) Vice-Chairman shall mean Vice-Chairman of Governing Body of the Agency referred to in the rules.

(iii) "Executive Chairman" shall mean Chairman of Executive Committee

(iv) "Executive Committee" shall mean Executive Committee of the Agency referred to in these rules.

(v) Governing Body shall mean the Governing Body constituted under these rules.

(vi) "Member Secretary" shall mean Secretary of the Governing Body of the Agency referred to in these rules.

(vii) "State Government" means Government of Arunachal Pradesh.

(viii) Nodal Officer (Resources Development) shall mean Nodal Officer of Bamboo Resource Development.

(ix) Nodal Officer (Enterprise/Application) shall mean Nodal officer of Enterprise/Application of Bamboo.

7. Member of the Society :

The Agency shall consist of the following members -

• First member of the Agency as specified in the memorandum of association of the Agency, and

• Members nominated by the State Government.

8. The Agency may admit further members subject to the approval of the Governing Body :

(i) When a person is nominated as member of the Agency by virtue of an office held by him, his membership of the Agency shall terminate when he ceases to hold that office and the vacancy so caused shall be filled by his successor in that office.

(ii) Whenever a member desires to resign from the membership of the Agency, he shall address his resignation to the Member Secretary and submit the same to him. His resignation shall take effect only on its acceptance by the Chairman.

(iii) Any vacancies in the membership of the Agency, either by resignation or otherwise, may be filled up by the Body subject to approval of the State Government.

(iv) The Agency shall function notwithstanding that any person entitled to be a member by reason of his office is not represented the Agency for the time being. Proceeding of the Agency shall not be invalidated by the reason of any vacancy or defect in nomination of any of the members or constitution of members.

(v) If a member of the Agency by virtue of the office held him becomes unable to attend meeting of the Agency, a substitute to take his place at that meeting may be nominated by him. Such substitutes shall be entitled to take part in the proceedings of these meetings for which he has been nominated and shall also have the right to vote therein.

9. Manner of selection and appointment of the Chairman and Vice-Chairman :

(i) The Chairman and Vice-Chairman of the Agency will be appointed / nominated by the State Government having adequate knowledge and experience in the field of bamboo and its development.

(ii) The Vice Chairman of the Agency will be appointed / nominated by the State Government having adequate knowledge and experience in the field of bamboo and its development. He will assist the Chairman in performing the objectives of Agency.

10. Terms of the Office of the Chairman and Vice-Chairman :

(i) The tenure of the Chairman and Vice-Chairman shall be co-terminus with the Government which appointed.

(ii) The tenure of the Chairman and Vice-Chairman shall function at the pleasure of the Government.

11. Pay and allowances of the Chairman and Vice Chairman :

The Chairman and Vice-Chairman of the agency other than ex-officio shall be entitled to salary and other allowances as notified guideline by the State Government Notification No. GA 10/2019 dated 17th December, 2018 for providing Perks, Facilities, and other Entitlements to the MLA's and Non-MLA's appointed as Chairman / Vice-Chairman of various Boards / Corporation / Agencies and Adviser to Hon'ble Chief Minister in the State of Arunachal Pradesh.

12. Member Secretary for the Agency :

(i) The Member Secretary shall be appointed by State Government who have served in the relevant department in Group –A ( Gazatted) post and having experience in bamboo sector for more than 15 (Fifteen) years. He / She shall be responsible for the day to day administration of the Agency, management of funds and implementation of various activities / programmes of the Agency.

(ii) All orders or instructions to be issued by the Agency shall be issued under the signature of the Member Secretary or any other officer authorized in this behalf by the Agency.

(iii) The Member Secretary shall have the powers to give administrative and technical sanctions to the estimates in the approved and en-block sanctioned budget and work programme of the Agency.

(iv) The Member Secretary shall have the powers to sign Memorandum of Understanding with various Local, National and International Organizations after due approval of the Agency / Government.

(v) The Member Secretary shall exercise such other powers and perform such other functions as may be delegated to him from time to time by the Agency.

(vi) The Member Secretary shall be the Chief Executive Officer (CEO) of the Agency.

13. Nodal Officer for the Agency : The Nodal Officer shall be appointed by the State Govt. on the recommendation of the Governing Body.

(i) A person can be considered for appointment as Nodal Officer if he/she has served in the relevant department in Group –A (Gazatted) post and is having experience in bamboo sector for more than 10 (ten) years.

(ii) He / She shall be the custodian of all office records/documents and responsible for the day to day working under the guidance of the Member Secretary.

(iii) The Nodal Officer shall be in charge of all the confidential papers of the Agency and shall be responsible for their safe custody. He/she shall produce such papers whenever so directed by the Member Secretary.

14. Register of members :

(i) The Agency shall maintain a register of members at its registered office and every member shall sign the required form stating their occupation and address. The register would be kept open for inspection by the members of the Agency.

(ii) It shall be incumbent upon a member of the agency to notify to the Member Secretary any change of his address or occupation.

(iii) The Agency shall enter in the register of members the following particulars -

(1) Name and address of each members

(2) The date on which the member was admitted

(3) The date on which the member ceases to be a member.

15. Termination of Membership :

Notwithstanding anything contained in rule 7 and 8, a member of the Agency shall cease to continue as a member if he -

(i) Expires

(ii) Resigns from his membership

(iii) Becomes unsound in mind

(iv) Becomes insolvent

(v) Is convicted of any criminal offence or

(vi) Is removed by the State Government

The State Government and the Government of India shall be entitled to obtain information, advice and assistance of the Agency on all matter connected with the objectives of the society and on related matters.

16. Governing Body :

(i) The Governing Body will consist of all members including Chairman and Member Secretary of the Agency.

(ii) Chairman and the Vice-Chairman of the Governing Body shall be appointed by the State Government and shall be the Chairman and Vice-Chairman of the Agency

(iii) The Member Secretary-cum-Chief Executive Officer (CEO) of Arunachal Pradesh Bamboo Resources and Development Agency (APBRDA) will be Member Secretary of the Governing Body.

(iv) The term of office of the Governing Body will be Five (5) years from the date of its constitution.

(v) The Governing Body shall meet at least once in six months. Quorum for the meeting will be 2/3rd of the members present. A fresh meeting must be convened immediately by the Chairman in case the requirement of quorum is not met at that meeting so convened.

(vi) The Governing Body shall function notwithstanding that any person entitled to member by reason of his office is not represented on the Governing Body for the time being and proceedings of the Governing Body shall not be invalidated by the above reason or by reason of any vacancy or defect in nomination of any of the members.

(vii) Should a member of the Governing Body by virtue of the office held by him be unable in attending the meetings of the Governing Body, a substitute to take his place at that meeting may be nominated by such member. Such substitute then shall be entitled to take part in the proceedings of that meeting for which he has been nominated and shall also have the right to vote therein.

17. Powers of Governing Body :

(i) Same as herein expressly provided as having to be passed by the Agency in its general meeting, general management, policy making, administration and control of the Agency shall be exercised or performed by the Governing Body subject to such limitation as the State Government may from time to time impose by directions.

(ii) In particular and without prejudice to the generality of the forgoing provisions, the Governing Body may:

(a) Consider the annual budget and its subsequent alterations and annual report placed before it by the Member Secretary from time to time and pass it with such modifications as the Governing Body may think fit.

(b) Delegate any of its powers other than those of making rules to the Executive Chairman of Executive Committee, as it may deem fit.

(c) Appoint committees, board and sub-committee etc., for such purpose and on such terms as it may deem fit and remove any or all of them, subject to sub-rule (i).

(d) Perform and carry out such functions and duties as may from time to time, as may be directed by the State Government.

18. Proceedings of the Governing Body :

(i) The Chairman shall preside at all meetings of the Governing Body. In his absence, the Vice- Chairman shall preside over the meetings.

(ii) Not less than 5 (five) clear day's notice of every meeting of the Governing Body shall be given to each member.

(iii) The Chairman may himself call or by a requisition in writing signed by him, may require the Member Secretary to call of Governing Body at any time and on receipt of such requisition, the Member Secretary shall forthwith call such a meeting.

(iv) Each member of the Governing Body will have one vote and in the event of equality of votes in any question to be decided, the Chairman will have a casting vote.

(v) Any business which may be necessary for the Governing Body to perform may be performed by a resolution in writing circulated among its members and any such resolution so circulated and approved by a majority of the member signing shall be as effective and binding as are solution passed at a meeting of the Governing Body.

19. Annual General Meeting :

(i) The Agency shall hold an Annual General Meeting at least once in every year and not more than 15 (fifteen) months shall lapse between two successive Annual General Meetings.

(ii) Balance-sheet and auditor's report shall be placed at the Annual General Meeting of the Agency.

(iii) At least one third members of the Agency present at the Annual General Meeting shall form a quorum.

20. Composition of Executive Committee of Arunachal Pradesh Bamboo Resources & Development Agency : There shall be two Executive Committees for Resource Development and Application respectively.

(i) There shall be a body called Executive Committee appointed to look after the operational affairs and day to day functions of the Agency.

(ii) Executive committee will consist of not more than 5 members including Executive Committee Chairman and Member Secretary. All members shall be appointed by the Governing Body with approval or in consultation with the State Government.

(iii) The Executive Committee members will be appointed from most experienced officers in related field.

(iv) The Member Secretary-cum-Chief Executive Officer, Arunachal Pradesh Bamboo Resources and Development Agency (APBRDA) appointed by State Government will be the Chairman of the Executive Committee of Arunachal Pradesh Bamboo Resources and Development Agency.

(v) The Executive Committee shall meet at least once in two months. Quorum for the meeting shall be three members present. A fresh meeting must be convened immediately by the Member Secretary, Executive Committee in case the requirement of quorum is not met at that meeting convened.

(vi) The Executive Committee shall function notwithstanding that any person entitled to be a member by reason of his office is not represented on the Executive Committee for the time being. Proceedings of the Executive Committee shall not be invalidated by the above reason or by reason of any vacancy or defect on nomination of any of the member.

(vii) Should a member of the Executive Committee by virtue of the office held by him be unable in attending the meetings of the Executive Committee, substitute to take his place at that meeting may be nominated by the authority that nominated or appointed that member. Such substitute shall be entitled to take part in the proceedings of that meeting for which he has been nominated and shall also have the right to vote therein.

(viii) RESOURCE DEVELOPMENT :

(ix) ENTERPRISE / APPLICATION :

21. Power of the Executive Committee :

(i) Same as herein expressly provided as having to be passed by the Agency in its General Meeting and Governing Body Meeting, all duties, powers, functions and rights whatsoever or consequential to carrying out the objectives of the Agency shall be exercised or performed on delegation by the Executive Committee subject to such limitation as the Governing Body in consultation with the State Government may, from time to time, impose.

(ii) In particular and without prejudice to the generality of the foregoing provisions, the Executive Committee may:

(a) Receive and disburse grants, contributions, funds, assistance, donations and endowment, for fulfillment of the objectives of the Agency.

(b) Delegate any of its powers than those of making rules to the Chairman, Member Secretary or other authorities of the Agency, as it may deem fit for the purpose of fulfilling the objectives of the Agency.

(c) Appoint Committees and sub-committees for such purposes and on such terms, as it may deem fit and also remove any or all of them.

(d) Do generally such acts and things as may be necessary or incidental to carry out the objectives of the Agency or any of them, provided that nothing herein contained authorizes the Executive Committee to do any act or to pass any bye-laws which may be repugnant to the provisions hereof or to the powers hereby conferred on the Governing Body and other authorities or which may be inconsistent with the objectives of the Agency.

(e) Perform and carry out such functions and duties as may from time to time, be directed by the government or outside for seeking expert advice.

22. Proceedings of the Executive Committee :

(i) Executive Committee Chairman shall preside at all meetings of the Executive Committee. In his absence, members present may authorize one of them (other than the Secretary) to preside over the meeting.

(ii) Not less than 3(three) clear days notice of every meeting of the Executive Committee shall be given to each member.

(iii) The Executive Committee Chairman may himself call or by requisition in writing signed by him, may require the Member Secretary to call a meeting of the Executive Committee at any time and on receipt of such requisition, the Member Secretary shall forthwith call such a meeting.

(iv) Each member of the Executive Committee shall have one vote and in the event of equality of votes on any question to be decided, the Chairman of the meeting shall have a casting vote.

(v) Any business which shall be necessary for the Executive Committee to perform may be performed by a resolution in writing and approved by a majority of the members signing shall be as effective and binding as a resolution passed at a meeting of Executive Committee.

23. Funds of the Agency :

The Fund of the Agency shall consist of the following :

(i) Grants, assistance, loan received from State and Central government.

(ii) Donation, assistance, Grants and loan received from person or bodies.

(iii) Income from investigation and services.

(iv) Income from other sources.

(v) The Agency may charge 12.5% on all projects handled by it as overhead for Arunachal Pradesh Bamboo Resources & Development Agency.

24. Account and Audit:

(a) The APBRDA will maintain account in any of the nationalized bank in Itanagar, which will be jointly operated by the Member Secretary / Chief Executive Officer and Nodal Officer (APBRDA).

(b) The Accounts of the Agency shall be audited by a Chartered Accountant to be appointed by the Governing Body.

(c) Annual Report of the proceedings of the Agency and of all work undertaken during the year shall be prepared by the Governing Body for the information of the State Government and the members of the Agency. This report and the audited account of the Agency shall be placed before the Agency at the Annual General Meeting.

Within 30 (thirty) days after the holding of Annual General Meeting, the following shall be filed, with the registrar of firms and societies:

(i) A list of names, addresses and occupations of the members of the Governing Body. The Chairman, Member-Secretary and of other office bearers of the Agency.

(ii) An annual report of the previous year and

(iii) A copy of the balance sheet and the annual report shall be certified by the Chairman and the Member Secretary of the Agency.

If any change occurs in the composition of the Governing Body or in the holder of the office of the Chairman or the Member Secretary at any time for any reason arising such change shall, within 30 (thirty) days be notified to the Registrar of Firm and Societies.

25. Property of the Agency :

All property belonging to the Agency shall be the property of the State Government. In case of winding off of the Agency, the State Government has the right over the property.

26. Suits and proceedings by and against the Agency :

(i) The Agency may sue or may be sued in the name of the Executive Chairman or Member Secretary of the Executive Committee.

(ii) No suit or proceeding shall abate by reason of any vacancy or change in the holder of office of the Executive Chairman or the Member Secretary.

(iii) Every decree/order against the agency in any suit or proceeding shall be executable against the property of the Agency and not against the person or the property of the Executive- Chairman or the Secretary.

(iv) Subject to the provisions of these rules, every member of the Governing Body or Executive Committee, Member Secretary and other officers or employees of the Agency shall be indemnified by the Agency against, and it shall be the duty of Executive Committee to pay out the funds of the Agency all costs, losses and expenses which such officer or employees may have to incur or become liable to, by reason of any contract entered into, or act, or thing done by him in the discharge of his duties by such officer or employee.

(v) Every member of the Agency may be sued or prosecuted by the Agency for any loss or damage caused to the Agency or its property or for anything done by him detriment to the interests of the Agency.

(vi) The Agency shall keep at its registered office proper books of accounts, in which, should enter all sums of money received and the sources thereof and all sum of money expended by the Agency and the object or purpose for which such sums are expended.

(vii) The Agency's assets and liabilities.

Every member of the Governing Body shall have the right of inspection of accounts and register maintained by the Agency and proceedings of the meeting of the Agency at any time during the office hours.

No member shall receive profits upon dissolution of the Agency on its claims and liabilities. If there are any surplus assets, such assets shall not be paid to or disbursed amongst the members of the Agency or any of them but shall be disposed of as directed by the State Government in consultation with the Registrar of the Firm and Societies.

A notice may be served upon any member of the Agency either personally or by sending it through it in an envelope addressed to such member at the address mentioned in the register of the member.

Any notice so served by post shall be deemed to have been served on the day following that on which the letter envelope or wrapper containing the same is posted. In providing such service it shall be sufficient to prove that the cover containing such notice was properly addressed and put into the post office.

The rules of the Agency may be amended subject to the approval of Governing Body at any time by a resolution passed by a majority of the member of the Agency present at any annual general meeting of the agency, which shall have been duly convened for the purpose.

The amended rules be deemed to have come into force in accordance with provisions contained in Societies Registration Act, 1860 (Act. No.21 of 1860) extended to Arunachal Pradesh.

27. Source of Funding :

The State Government will provide initial grant of ` 100.00 Lakhs for setting up the office of the Agency. Annual expenditure on running the Agency office shall be made part of the projects handled by it. In case of delay in receipt of funds from Government of India or due to short fall, the State Government will provide necessary fiscal support so that bamboo development works do not suffer.

28. Appointment of Staff of the Agency Office :

With the approval of Governing Body, new manpower may be inducted in the Agency office and Member Secretary of the Governing Body shall be the appointing authority of all such persons. The Member Secretary of the Governing Body shall engage all such persons initially for a period of 5 (five) years on contractual basis on fixed monthly emoluments after following eligibility criteria as mentioned against each below. The period of contract may be extended for a further period subject to satisfactory performance rendered by the respective contract appointees during their first term of contract service. All staffs of the Agency will be entitled to leave and medical benefits as applicable to State Government employees incase he/she does not claim such benefits from any other Government/State Government / PSU / Semi Government organization.

The agency Office: It will be situated at Van Vihar, Chimpu, Itanagar

29. Any amendment in the Bye laws shall be made only with the prior approval of the state

No. LM-100/2012(Pt-II).—

1. Whereas, the Chakma Relief & Rehabilitation Committee had submitted representation to the State Government for making DBT mode of payment for R&R amount due to them against displacement of Hollongi Airport Project vide No. Nil dated CRCC/2019 dated 25th November, 2019. The Chakma R&R Committee had taken the responsibility of shifting/vacating the Airport sites by 156 displaced Chakma families within 2-3 months from the date of released of payment to their account.

2. And whereas, the Hon'ble MLA, 14th Doimukh S/T Constituencies vide U.O. No. THT/MLA/14-DMK dated 23rd December, 2019 addresses to Chief Minister, Government of Arunachal Pradesh had categorically requested for consideration for DBT payment mode of Chakma RR Project amount through Chakma R&R Committee in the interest of Hollongi Airport Project.

3. And Whereas, the Deputy Commissioner, Papum Pare District, Yupia has requested vide No. LM/PP/ GFA-12(Pt-I) 2019 dated 3rd January, 2020 stating that there is likely to arise law and order problem situation if NIT/tender is floated for construction of R&R Project for these Chakma Refugees due to on- going protest against Citizenship Amendment Act.

4 Therefore, in the public interest of Green Field Airport, Hollongi Project the competent Authority vide its U.O. No. HCM, 3798 dated 14th January, 2020 hereby directs the Deputy Commissioner, Papum Pare District shall disburse the entire R&R Project amount through Chakma R&R Committee in the manner stated herein :-

(i) The entire housing amount for each 156 Chakma families should be deposited through the Chakma R&R Committee account. The amount be deposited into two instalment @ 70% as first instal- ment and 30% as second instalment after complete vacation of plot from the airport site by the 156 families.

(ii) The amount for construction of internal road, school, dispensary, Chakma Mandir and others should be released 70% in 1st instalment through Chakma RR Committee account and remaining 30% to be released only after completion of the above infrastructure works.

(iii) The Deputy Commissioner, Papum Pare District should ensure that a separate undertaking with Chakma R&R Committee regarding complete vacation of airport site be taken and entire exercise for release of R&R amount should be completed within a period of 15 (fifteen) days from issue of this order and a report in this regard should be submitted to Government.

No. JUD-25/2017.—In exercise of the powers conferred by article 309 of the Constitution of India, the Governor of Arunachal Pradesh is pleased to make the following rules further to amend the Senior Research Assistant (Law) Recruitment Rules, 2005, namely,-

1. Short title and commencement,- (1) These rules may be called the Senior Research Assistant (Law) Recruitment (Amendment) Rules, 2017.

(2) They shall come into force on the date of their notification in the Official Gazette.

2. In the Senior Research Assistant (Law) Recruitment Rules, 2005 (hereinafter called the principal rules) the words "Pay Scale" wherever appears shall be substituted by the words "Pay Matrix".

(i) In the principal Rules, in column 2 of the Schedule, for the existing entries, the entries, "2(two) posts subject to variation dapendent on work load" shall be substituted.

(ii) In column 4 for the existing entries, the entries, "Pay Matrix Level 8, ` 47,600-1,51,100" shall be substituted.

(iii) In column 11, for the existing entries, the entries, "100% by transfer on deputation" shall be substituted.

(iv) In column 12, for the existing entries, the following entries shall be substituted,- "By transfer on deputation, from the grade of Assistant or equivalent having experience of at least 5 (five) years dealing in scheme related works".

No. JUD-25/2017.—In exercise of the powers conferred by article 309 of the Constitution of India, the Governor of Arunachal Pradesh is pleased to make the following rules to regulate the method of Recruitment to the post of Junior Librarian (Law), Group-"B" (Non-Gazetted) (Ministrial) in the Department of Law, Legislative and Justice under the Government of Arunachal Pradesh, namely,-

1. Short title and Commencement : (1) These rules may be called "the Junior Librarian (Law) Recruitment Rules, 2020".

(2) They shall come into force on the date of their notification in the Official Gazette.

2. These Rules shall apply to the post as specified in column 1 of the Schedule annexed to the Rules.

3. Number of post(s), Classification and Pay Matrix : The number of post(s), their classification and Pay Matrix attached thereto shall be as specified in columns 2 to 4 in the Schedule aforesaid.

4. Method of recruitment, age limit and other qualifications etc : The method of recruitment to the said post(s), age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the Schedule aforesaid.

5. Initial Constitution : (1) The Personnel holding the post specified in column 1 on long term basis, before commencement of these rules, shall be deemed to have been appointed in accordance with the provisions of these rules.

(2) The regular continous service personnel holding the post at the commencement of these rules shall count for the purpose of probationary period, qualifying service for promotion and pension.

6. Disqualification : No person,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a person living has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said post.

Provided that the Governor of Arunachal Pradesh may, if satisfied that such marriage is permissible under the Personal Law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of these rules.

7. Power to relax : Where the Governor of Arunachal Pradesh is of the opinion that it is necessary or expedient so to do, he may, by order for reasons to be recorded in writing and in consultation with the Arunachal Pradesh Public Service Commission relax any of the provisions of these rules with respect to any class or category of person(s).

8. Savings : Nothing in these rules shall affect reservation/relaxation of upper age limit and other concessions required to be provided to the Arunachal Pradesh Scheduled Tribes and other special categories of persons in accordance with the order issued by the State Government/Central Government from time to time in this regard.
