ORDER
No. GLR . 104 / 2005/ Pt - III/ 16 . - Whereas the Labour & Employment Department vide Notification No. GLR.104 / 2005/ 157 , dated 11-03-2016 had transferred Shri Bijoy Kumar Thakur , Labour Inspector , Tinsukia to Sarupathar vice Shri T.B. Chetri , Labour Inspector , Sarupathar transferred , in pursuance of Elecion Commission of India guidelines communicated vide No. 437/ 6/ 1 / 2015 - CCs / 957 , dated 15-12-2015 and whereas Shri B.K. Thakur filed a Writ Petition before the Hon'ble High Court vide WP( C) No. 2694/2016 .
Whereas , the order from Hon'ble Gauhati High Court dated 12-08- 2016 in the WP( C) No. 2694/2016 states that: -
"A perusal of the transfer order issued vide Notification dated 11-03-2016 also clearly shows that the transfer has been made in pursuance of the guidelines of the Election Commission of India . It , thus , shows that the transfer was not made in the normal exigencies of service . It was neither a routine transfer , but made only for the purpose of ensuing election . As the elections are over , the State Government has to take a decision with regard to the posting of the petitioner as the very basis of the notification dated 11-03-2016 has become infructuous . Accordingly , in view of the reasons stated above , the State respondents , especially the respondent No. 1 & 3 , are directed to examine whether the petitioner's transfer by way of the impugned notification dated 11-03-2006 is to be cancelled or retained and take a decision thereon by a speaking order within a period of one month from the date of receipt of a certified copy of this order . " .
Whereas , it is felt that the order dated 11-03-2016 was purely in pursuance of the guidelines of Election Commission of India , and now it has lost further relevance .
In view of the above , the Notification dated 11-03-2016 in respect of transfer of Shri B.K. Thakur , Labour Inspector , Tinsukia placed in Sl . No. - 5 of Labour Inspector category hereby stands cancelled.

v. Appraise and take advice of local MPs / MLAs /PRI Members periodically as and when necessary.

No. FRE.101 /2016/55.- Whereas a departmental proceeding was drawn up against Shri Mufakhkher Ali , IFS , Director , Kaziranga National Park , Bokakhat vide Memorandum No.FRE.101 /2016/28 dtd . 25.07.2016 in connection with negligence of duties pertaining to protection of Rhinos of Kaziranga National Park and tampering of evidence related to the incident of Rhino Poaching on 7th June , 2016 by misleading the Authoritiesetc ; and Whereas Shri Mufakhkher Ali , IFS submitted his written statement in defence vide his letterdtd. 3rd August , 2016 wherein he has denied the charges framed against him; and Whereas having being satisfied with the written statement in defence submitted by Shri Mufakhkher Ali , IFS to the charges framed against him and after careful examination of all aspects ; and Whereas the Disciplinary Authority after careful consideration of the written statement of the officer concerned and on perusal of all materials on record have decided to accept the reply of the officer concerned and to exonerate Shri Mufakhkher Ali , IFS from the charges thereof; and Accordingly, the Governor of Assam is pleased to accept the written statement of the officer concerned and exonerate Shri Mufakhkher Ali , IFS , Chief Conservator of Forests; And therefore, the Departmental Proceeding drawn up vide Memorandum No.FRE.101 /2016/28 dtd . 25.07.2016 against Shri Mufakhkher Ali , IFS is thus finallydisposed of. Further, the suspension order as issued vide No. FRE.101/2016/ 1 dtd. 15.06.2016 is hereby revoked and the period of suspension in respect of the officer concerned is treated as on duty for all purposes under the provision of F.R. 54 B ( 1 ) .
