Division vide letter No. WR ( CON ) 8/2016/6 dated 29/07/2016 for negligence in duty and loss of public property due to the breach occurred in the Brahmaputra Dyke from Bessamora to Haldibari under Majuli Water Resources Division on 26th July, 2016 at 4.30 pm; and Whereas the delinquent officer vide his representation No. EE (M ) E - 186/1403 dated 08-08-2016 denied the charges leveled against him ; and Whereas after careful consideration/examination of the defence statement given by the delinquent officer, it has been decided to enquire into the matter by appointing Inquiry Officer and accordingly Shri S. G. Goswami , Additional Chief Engineer , Diphu W.R. Zone was directed to cause an inclusive and efficacious enquiry for fixing of responsibilities for occurrence of breach to Brahmaputra Dyke from Bessamora to Haldibari under Majuli Water Resources Division on 26/07/2016 vide letter No. WR ( CON ) 10/2016/43- dtd.18/10/2016 : and Whereas the Inquiry Officer has submitted his inquiry reports vide letter no. SES/MISC - 9 /M.E./ 2016/446 Dated 28/11/2016 and letter no. SES /MISC- 9/M.E./2016/04 Dated 11/01/2017 where the charges leveled against Shri Budhinath Shyam , Executive Engineer , Majuli W. R. Division have not been proved. Considering all aspect of the matter and having regard to the findings of the Inquiry Officer, the Governor of Assam is pleased to exonerate the officer from the charges . The officer is adviced to be careful so that no such incident occurs in future.
With the above order the proceeding is concluded .

No. GLR . 21/2017/16 . Whereas an Industrial dispute has arisen in the matter specified in the Schedule below between the Management of M/ S. Hindustan Samachar (Multi Lingual National News Agency ) and their 4 nos . of workmen Shri Chandan Bhagawati & others .
In whereas it is considered expedient by the Government of Assam to refer the dispute for adjudication to Presiding Officer . Labour Court , Guwahati , constituted under Section 7 of the Industrial Dispute Act , 1947 ( Act XIV of 1947 ) .
Now , therefore , in exercise of the powers conferred by Clause ( c) / ( d ) Sub- Section( 1 ) of Section 10 of the Industrial Disputes Act , 1947 ( Act - XIV of 1947 ) as amended the Governor of Assam is pleased to refer the said Dispute to the Presiding Officer, Labour Court , Guwahati appointed under the provisions of the said act .

No. WR( CON) 10/2016/123 . Whereas on the basis of report of the Additional Chief Engineer , Upper Assam (WR) Zone , Shri Hari Prasad Gogoi , Junior Engineer , Majuli W.R. Division was placed under suspension under Rule 6 ( i ) of Assam Services (Discipline and Appeal ) Rules , 1964 vide Notification No. WR( CON ) 8/2016/4 dtd. 29/07/2016 for the charge of unauthorized absence during the high flood season and during the period of absence a breach occurred in the Brahmaputra Dyke from Bessamora to Haldibari under Majuli Water Resources Division on 26th July, 2016 at 4.30 pm due to lack of supervision in his sectional jurisdiction ; and
Whereas Shri Hari Prasad Gogoi , the delinquent officer vide his representations denied the charges leveled against him and informed that he was doing GPS survey alongwith the Assistant Executive Engineer , Kamalabari W.R. Sub - Division on the day when breach occurred in the Brahmaputra Dyke from Bessamora to Haldibari . Further , the site where the breach occurred is not under his sectional jurisdiction; and
Whereas after careful consideration/examination of the defence statement given by the delinquent officer, it has been decided to enquire into the matter by appointing Inquiry Officer and accordingly Shri S.G. Goswami , Additional Chief Engineer , Diphu W.R. Zone was directed to cause an inclusive and efficacious enquiry for fixing of responsibilities for occurrence of breach to Brahmaputra Dyke from Bessamora to Haldibari under Majuli Water Resources Division on 26/07/2016 vide letter No. WR (CON ) 10/2016/43 dtd.18 /10/2016 : and
Whereas the Inquiry Officer has submitted his inquiry report vide letter no . SES /MISC- 9/Μ.Ε. /2016/446 Dated 28/11/2016 and letter no. SES/MISC - 9/M.E./2016/04 Dated 11/01/2017 where the charges leveled against Shri Hari Prasad Gogoi, Junior Engineer, Majuli W.R. Division have notbeen proved .
Considering all aspects of the matter and having regard to the findings of the Inquiry Officer , the Governor of Assam is pleased to exonerate the officer from the charges and reinstate as Junior Engineer, Majuli W.R. Division. The officer is adviced to be careful so that no such incident occurs in future.
The period of suspension is treated as on duty for all purposes . It is also decided to pay proportionate pay under the provision of Sub- rule 8 of the F.R. 54 (B) which is restricted to the subsistence allowance already paid to Shri Hari Prasad Gogoi , Junior Engineer for the period of suspension.
With the above order the proceeding is concluded .
