Bibha Gogoi , the then Child Development Project Officer (CDPO) , Nazira ICDS Project , Sivasagar ( now retired) was placed under suspension vide Notification No. SWD.4 / 2008/ 29 , dated 16.02.2008 as per report received from the Director , Social Welfare , Assam vide No. DSW( G ) 242/2007/27 , dated . 26/12/2007.
Subsequently the Director , Social Welfare , Assam vide this Department's Suspension Notification cited above was asked to furnish draft charge sheet vide memo of the said Notification but the Director , Social Welfare Assam failed to furnish the same even after reported reminders .
Smt. Bibha Gogoi was re- instated in service vide No. SWD.4/ 2008 / 65 , dated . 14.11.2008 and posted as CDPO , North West ICDS Project ,Jorhat which was later modified vide Notification No. SWD.4 /2008 / 70 , dated 26/12/2008 by placing her as CDPO , Nazira ICDS Project , Sivasagar .
Smt . Bibha Gogoi ( the then CDPO ) now retired hed taken over charge as CDPO , Nazira ICDS Project , Sivasagar on 30.12.2008 .
Thus , appeared to be a gap period from 16.02.2008 to 30. 12. 2008 without regularization .
Smt . Bibha Gogoi ( now retired) had an another gap- period w. e . f. 01.04.2013 to 30.09.2013 in connection with extension of joning time pending for regularization . Smt . Gogoi filed a case before the Hon'ble High court vide W.P. ( C) No. 3262/2014 ( Smt . Bibha Gogoi -Vs - State of Assam & Others ) due to non - regularization of both the gap period .
The Hon'ble High Court Order dated 12.03.2015 directed Respondent No. 1 and 2 i.e. the Commissioner & Secretary , Social Welfare Department and the Director , Social Welfare , Assam to regularize the service of the petitioner , Smt . Bibha Gogoi for the period from 16.02.2008 to 30.12.2008 and 01.04.2013 to 30.09.2013 and to release full salary for the aforesaid period within 3 ( three ) months from the receipt of the certified copy of the order.
Accordingly , the Department vide a Speaking Order No. SWD.2152014 / 23 , dated 02.07.2015 asked amt . Bibha Gogoi to submit prayer for extension of joining time, in compliance of Hon'ble High Court's Order dated. 12.02.2015 .
In the meantime , Smt . Bibha Gogoi retired from service as District Social Welfare officer on attaining the age of Superannuation on 31.01.2015 (Α.Ν) .
Later on , the period of extension of joining time w.e.f. 01.04.2013 to 30.09.2013 was regularized vide this Department's Notification No. Social Welfare Department.378 / 2014 / 53 , dated 09.03.2016 in the strength of Finance Depertment O.M. No. FEG , 14/95/37 , dated 20.08.2008.

Wherease , as per order dated 05.07.2013 by the Chief Judicial Magistrate , Sivasagar Court of CJM , Sivasagar Smt . Bibha Gogoi was acquitted in G.R. Case No. 1351/2007.
Now, in compliance of Hon'ble High Court's Order dated 12.02.2015 passed in W.P. (C ) 3262/2014 , it is now decided to conclude the Departmental Proceeding drawn against Smt . Bibha Gogoi ( now retired as DSWO) as the charges leveled against her could not be substantiated. Her period of suspension w.e.f. 16.02.2008 to 30.12.2008 shall be regularized by treating the period as on duty for all purposes .

Dutta, the then Chairman , Pollution Control Board to enquire into the irregularities committed during the execution of works atMatmora and Jiadhal embankment , Shri Jayneswar Chutia , the then Junior Engineer, Dhakuakhana W.R. Division was placed under suspension with immediate effect vide Notification No. WR (E) 54/2008/63 dated 29-08-2008 pending drawal of Departmental Proceeding and subsequently reinstated in service vide Notification No. WR (CON ) 26/2008/13 dated 30-03-2009 ; and
Whereas Departmental Proceeding was drawn up against Shri Jayneswar Chutia, the then Junior Engineer (under suspension) , Dhakuakhana W.R. Division vide Show Cause Notice No. WR (CON) 26/2008/2 dated 11-12-2008 for gross dereliction in duties , misuse of power and adopting malpractice with malafide intention in violation of Govt. rules and procedures and standard practice of measurement in the execution of theSchemes " Immediate measures for closing of breach of B/dyke from Sisikalghar to Tekeliphuta for 2007- 08 ( at 19th KM Matmora ) " as the then Junior Engineer , Dhakuakhana W.R. Division ; and Whereas Shri Jayneswar Chutia vide his representation No.JC/ 2008 /2 dated 19-12-2008 submitted written statement in defence to the charges framed against him by explaining the facts and circumstances of his case; and Whereas after careful consideration/examination of the defence statement submitted by Shri Jayneswar Chutia, it has been decided to enquire into the matter by appointing Enquiry Officer and nominating Presenting Officers namely Shri T K Roy, the then Additional Chief Engineer, Kokrajhar W.R. Zone and Shri B.K. Agarwala , the then Additional Chief Engineer , River Research Station respectively vide notification no. WR ( CON ) 26/2008/11 dated 21-01-2009; and
Whereas the Enquiry Officer has submitted his enquiry report vide letter no . ACE/ KE / ENQ/16 Dated 24-09-2009 where the charges leveled against Shri Jayneswar Chutia have been stated to be not tenable ; and Whereas a copy of the enquiry report was provided to Shri Jayneswar Chutia vide WR (CON) 26/2008/38 dated 29-09-2014 to furnish his representation if any on the findings of the Enquiry Officer; and Whereas Shri Jayneswar Chutia vide letter No. JC/ 2014 dated 13-10-2014 has submitted his representation on the findings of the Enquiry Officer; and
Whereas considering all aspects of the matter and having regard to the findings of the Enquiry Officer aswell as findings of the two men enquiry committee and defence statement of Shri Jayneswar Chutia and also the fact that though as per enquiry officer's report the charges are not tenable as the evidence both documentary and oral could not be substantiated in all the charges and there are no financial irregularities in any form but the case has indirectly tainted the image of the Department, it has been decided to impose a penalty of Censure with immediate effect under the provision of Rule 7 (1 ) of the Assam Services ( Discipline & Appeal) Rules , 1964 on Shri Jayneswar Chutia ; and
Therefore, the Governor of Assam is pleased to impose a penalty of Censure with immediate effect under the provision of Rule 7 ( 1 ) of the Assam Services ( Discipline & Appeal ) Rules, 1964 on Shri Jayneswar Chutia, the then Junior Engineer, Dhakuakhana W.R. Division and presently working as Junior Engineer, Lakhimpur W.R. Division , North Lakhimpur .
Theperiod of suspension w.e.f. 29-08-2008 to 30-03-2009 is treated as on duty for all purposes . It is also decided to pay proportionate pay under the provision of Sub - rule 8 of the F.R. 54 (B ) which is restricted to the subsistence allowance already paid to Shri Jayneswar Chutia for the period of suspension .
With the above order the proceeding is concluded.

Officer , Shri Anil Hazarika , Junior Engineer vide his letter No. AH/ 2008/ 2 dated . 19-12-2008 with reference to Show Cause Notice served vide No. WR ( CON) 25/2008/2 dtd . 11-12-2008.

FINDINGS:
Theproceeding in brief is that on the basis of report of the Two Men Enquiry Committee constituted with Sri P.P. Varma, I.A.S, the then Additional Chief Secretary and Sri A.K. Dutta , the then Chairman , Pollution Control Board, Shri Anil Hazarika , the then Junior Engineer, Dhakuakhana W.R. Division was found to be involved in for the works, preparation of the estimates and supervision of works of the scheme under the nomenclature " Immediate measures for closing of breach of B/ dyke from Sissikalghar to Tekeliphuta for 2007-08 ( at 19th Km . Matmara )" . Based on the Enquiry Report, Shri Anil Hazarika was placed under suspension on 29-08-2008 pending drawal of Departmental Proceeding . Accordingly Departmental Proceeding was drawn up against the Delinquent Officer Shri Anil Hazarika and on receipt of reply to show cause notice, Shri Tapan Kumar Roy , the then Additional Chief Engineer , Kokrajhar W.R. Zone and Shri B.K. Agarwalla, the then Additional Chief Engineer , River Research Station were appointed as Inquiring Officer and Presenting Officer respectively vide notification no . WR ( CON) 25/2008/14 dated 21-01-2009 . Subsequently suspension order of the Delinquent Officer Shri Anil Hazarika was vacated without prejudice to the Departmental Proceeding drawn up against him videnotification no . WR ( CON ) 25/2008/17 dated 26-03-2009 .
Having gone through the report of the Inquiring Officer , it appears that the Inquiring officer concluded the proceeding with the remarks that the charges are not tenable.
However before the Department come to a conclusion of the Departmental Proceeding Shri Anil Hazarika expired on 04-02-2017.
ORDER:
After careful examination of all papers relating to the Departmental Proceeding against Shri Anil Hazarika , Junior Engineer, Dhemaji W.R. Division and subsequent to his death on 04-02-2017 , the Governor of Assam is pleased to order that the Departmental Proceeding against Late Anil Hazarika is hereby dropped and to treat the period of suspension w.e.f. 29/08/2008 to 26/03/2009 as on duty for all purpose as perSub Rule-8 of the F.R. 54-B .
With the above order, the proceeding is concluded .

No. Bn4/Q/AT/2016-17/612-22.- Sealed tender affixing non refundable Court Fee Stamp of Rs.
8.25/- (Rupees eight and twenty five paisa) only are invited from the Suppliers /Contractors for supply ofBuilding Materials to this unit for the financial year of 2017-18 . The quotations will be received by the undersigned at 4th A.P. Battalion , Kahilipara , Guwahati - 19 up to 12:00 Hrs on 27th March 2017 and will be open on the same day at 01:00 Hrs . in presence of the tenderer or their representatives.
The Tenderer must be supported together with earnest money of Rs . 5,000/- (Rupees five thousand) only in the form of KVP / NSC/FDR /Bank Draftetc. duly pledged in favour of undersigned without which tender will not to be considered.
The Tenderer will have to furnish up to date VAT registration certificate , VAT Clearance Certificate, Firms /Contractors registration certificate, PAN Card , Tin No. and without which tender will not be accepted. All documents submitted by the tenderer should be attested by a Govt . Gazetted Officer.
Tenderer must quoted their rates in the prescribe form which is available in the Office of the undersigned neatly written/typed in both figures and words inclusive of all taxes and transportation charge, destination being 4th A.P. Battalion, Kahilipara , Guwahati - 19 and the rates must be tallied with the market rates .
Thesuccessful tenderer will have to deposit security money of Rs . 2,000/ -( Rupees two thousand) only which will be released on completion of the duration to supply.
The selected tenderer will have to the supply the intending articles within 3 (three) days on receipt of the supply order. The supplier will have to replace the rejected articles immediately attheir own cost.
Theundersigned is not bound to accept the lowest rates tender if not reasonable . He also reserve the right to accept or cancel any or all the tenders without assigning any reason thereof.
The details list of supply articles are enclosed herewith . In case of holiday on the receiving day, the tender/ quotation will be received on the next working day and terms and condition will remain same .

1. Contractors should quote their rates both in figures & in words on flat percentage basis i.e. as per / above/ below the scheduleof rates for building (Civil , Sanitary & Water Supply and Electrical works) for 2013-14 of all Divisions under Assam PWD Building .
2. No labours under 14 (fourteen ) years of age shall be employed on the work and all labours employed should have to bepaid at rates not less than those generally paid for similar works in the neighborhood.
3. Detailed particulars and tender papers will be issued to the contractor who have produced Pan Card / up-to-date Registrationfor the year 2016-17 along with application duly approved by the undersigned at the time of issuing tender paper or their authorized person on 18.03.2017 up to 4.00 Pm
4. At the time of the receiving tender Form , the tenderer will have to submit the following documents along with the tenderwithout which tender shallbe rejected: - (a) PAN Card
(b) Upto date Registration Certificate for the year 2016-17
(c) Upto date VAT (GRN)
(d) Upto date labour License and (e) Partnership Deep / Power of Attorney in case of Proprietorship firm attestedby Govt , Gazetted Officer etc. 5. IPO and Bid Security mustbe payable in favour of Executive Engineer P.W.D. Silchat Building Division , Silchar , 6. Bid security of the amount as specified for the work in the table above in the form of NSC / KVP / FD /TD / Call Deposit received from any Nationalized Bank & Post Office . Tender without requisite bid security shall be summarily rejected . 7. If for any reason , date of issuing tender paper is declared holiday / band , tender paper will be issued the next working day upto 4.00 Pm . 8. If the date of receiving of tender is a holiday / band , the next working day will be the date of receiving and opening of tender at the same time and place . 9. The undersigned will be the sole authority to cancel or accept any tender without showing any reason ,
