No. GLR. 71 / 2016/L/49 . In continuation to this department's earlier notification issued vide GLR.71 / 2016 / L/38 dated 16.10.2016 , the Governor of Assam is pleased to allow joint inspection of the factories / industries under the following Acts by the Inspectorate of Factories , Assam and the Commissionerate of Labour to ease compliance by the industry and to achieve the interest of the workers as per the mandate of the Acts applicable to the factories /industries . Joint inspection shall be conducted under following Acts :
i. Maternity Benefit Act , 1961 .
ii. Minimum Wages Act , 1948.
Shops and Establishment Act , 1971
iv. Labour Welfare Fund Act ( as applicable)
V. Payment of Bonus Act , 1965.
vi . Payment of Wages Act , 1936 .
vii. Payment of Gratuity Act , 1972 .
viii . Contract Labour ( Regulation and Abolition ) Act , 1970.
Further , it is notified that the directions of the respective departmental online inspection schemes will be adhered to by the inspecting officers.
Apparently, the above mentioned subject doesn't involve amendment in any related Rules , Acts . If it is observed in future that , amendment of any Acts or Rules is required to give effect to the notification , it willbe done accordingly . The notification will be modified / cancelled accordingly .
This notification will come into force with immediate effect .

No. BW. 06/2006/96 . - Government of Assam hereby pleased to amend the following clauses of the " Revised Scheme for Constitution and Administration of the Consolidated Sinking Fund of Government of Assam" issued vide Notification No.BW.6/ 2006 dated the 21st November , 2007.
Theclause
4(d) The fund shall not be utilized for any purpose other than redemption of the outstanding liabilities of the Government.
Provided that the net incremental annual investment of States ( i.e. outstanding balance over and above the level in the corresponding period of the previous year) shall be eligible for availing Special WMA such that the availment of Special WMA under this provision does not exceed the Normal WMA .

In pursuance of the recommendation of the 7th Assam Pay and Productivity Pay Commission, 2015 and concurrence of the Finance ( PRU) Department , U /O Dtd . 19-06-2017, the Governor of Assam is pleased to amalgamate 15 ( Fifteen) posts of Geologist , 1 (one) post of Resident Geologist and 1 (one) post of Petrologist in the Cadre of Deputy Director/ Senior Geologist in the scale of PB -4 30000-110000/- P.M ; Grade Pay 14500/- by upgrading the Grade Pay of those posts from 13900/- to 14500/- of the Directorate of Geology And Mining with immediate effrct . Amalgamation increases the total number of posts in the Cadre of Deputy Director/ Senior Geologist to 22( Twenty two) from earlier 5 (five) .
Henceforth, the posts of Geologist, Resident Geologist and Petrologist are upgraded to the post of Deputy Director/ Senior Geologist .

The Executive Committee as constituted here in after will be responsible for acting for and doing all deeds on behalf of the Governing Body and for taking all decisions and exercising all the powers , vested in the Governing Body except those which the Governing Body may specifically specify to be excluded from the jurisdiction of the Executive Committee .
The Executive Committee may invite subject experts to its meetingsfrom time to time.
Meetings of the Executive Committee shall be convened by the Member Convenor by giving notice in writing along with the Agenda specifying the business to be transacted, the date , time and venue of the meeting.
Meetings of the Executive Committee shall be held at least once a month or more frequently if necessary . The minutes of the Executive Committee meetings willbe placed before the Governing Body at its next meeting .
The various Committees , if any, constituted by the Governing Body shall submittheir reports to the Executive Committee and to take decisions as deemed fit on their recommendations .

Themembers of the Governing Body of the Society shall hold office until a new Governing Body is appointed or present Governing Body is reconstituted by the Government of Assam .
Themanagement of the affairs of the Society shall lie with the Governing Body.
PROCEEDINGS OF THE GOVERNING BODY
(1) Themeetings of the Governing Body shall be held at least once every year and at such time and place as the President shall decide. If President receives a requisition for calling a meeting signedby one- third members of the Governing Body, the President shall call such a meeting as soon as may be reasonably possible and at such place as he/she may deem fit . At least 15 days notice shall be given for holding such a meeting except In cases of emergency where three day notice may be given .
(II) At the annual meeting of the Governing Body the following business shall be placed anddisposed of:
Audit Reports and Financial statements comprising of the receipt and payment account, Income and expenditure account and the Balance Sheet for the past financial year .
Annual report of the Society .
Budget for the next financial year .
Annual Action Plan for the next financial year.
Otherbusiness placed with the permission of the President.
(iii ) Every notice calling meeting of the Governing Body shall state the date, time and place at which such meeting will be held. Such notice shall be under the hand of the Member Secretary and shall be accompanied by an agenda of the business to be placed before the meeting provided that accidental omission to givesuch notice to any member shall not invalidate any resolution passed at such meeting . In the event of any urgent business the President may call the meeting of the Governing Body.
(IV) ThePresident shall take the Chair at the meetings of the Governing Body. In his/her absence President may nominate one from among the members to preside the meeting .
(v) One third of the members of the Governing Body shall form a quorum at every meeting of the Governing Body.
(vi) All disputed questions if any at the meeting of the Governing Body shall be determined by votes . Each member of the Governing Body shall have one vote and in case of any equality of votes the President shall have a casting vote.
(vil ) Any business outside the agenda of the Governing Body meeting may be taken up on consent of one third members present in the meeting.
(vill) Any member desirous of moving any resolution at a meeting of the Governing Body shall give notice thereof in writing to the Member Secretary of not less than seven clear days before the day of such meetings.

(ix) Inthe event of any urgent business, the President of the Governing Body may take a decision on behalf of the Governing Body. Such a decision shall be reported to the Governing Body at its next meeting.
(x) Acopy of the minutes of the proceedings of each meeting shall be furnished to themembers of the Governing Body as soon as possible after completion of the meeting.
POWERS OF THE GOVERNING BODY
(a) The Governing Body will have full control of the affairs of the Society and will have authority to exercise and perform all the powers , acts and deeds of the Society consistentwith the aims and objects of the Society.
(b) In particular and without prejudice to the generality of foregoing provision , the Governing Body may:
→ Make, amend , or repeal any bye laws relating to administration and management of the affairs of the Society subject to the observance of the provisions contained in the Act.
→ Consider the annual budget and the annual action plan , its subsequent alterations placed before it by the Member Secretary from time to time and to pass it with such modifications as the Governing Body may think fit . Annual Budget shall be prepared as per budgetary allocation made by the State Govt . for the society for the relevant financial year and may include fund received from other sources as mentioned at para 6.1 of the Draft Rules.
→ Monitor the financial position of the Society in order to ensure smooth fund flow and to review annual audited accounts .
→ Accept donations , voluntary contribution , grants and endowments in cash or kind from public or other organisation or give grants upon such terms as it thinks fit.
→ Delegate its powers to Executive Committee or other authorities of the Society as it may deem fit to exercise their support to the Executive Committee constitute here in under.
→ Appoint committees , sub - committees and boards etc. for such purpose and on such terms as it may deem fit, and to dissolve / remove any of them.
→ To develop and adopt its own rules and regulations for recruitment and appointment of experts and administrative / technical staff and set its own compensation package for such experts / staff to be recruited from the open marketand/or deputation basis . The compensation package for expert /staff shall be determined with prior approval of the Finance Department and all expenditure on this count including all other expenditure shall be limited to the annual grants received by the society from govt . in a particular financial year.
→ Develop and adopt procurement procedures for procurement of goods and services in line with the financial rules of the state.
→ Authorise the Member Secretary to execute such contracts on behalf of the Society as it may deem fit in the conduct of the business of the Society . All such contracts with financial involvement to be made from Govt . grants shall be placed before the Finance department for prior approval .
→ Do generally all such acts and things as may be necessary or incidental to carrying out the objectives of the Society, provided that nothing herein contained shall authorize the Governing Body to do any act or to pass any bye-laws which may be repugnant to the provisions hereof, to the powers hereby conferred on the Governing Body and other authorities, or which may be inconsistent with the objectives of the Society.
(c) POWERS AND FUNCTIONS OF THE PRESIDENT OF THE GOVERNING BODY ThePresident shall have the powers to call for and preside over all meetings of the Governing Body . ThePresident may himself/ herself call , or by a requisition call , a meeting of theGoverning Body at any time. ThePresident shall enjoy such powers as may be delegated to him by theGoverning Body.
ThePresident shall do all acts to achieve all aims and objective of the Societyas incorporated in the Memorandum of Association of the Society.

The President shall have the authority to review periodically the work and progress of the Society and to order inquiries into the affairs of the Society and to pass orders on the recommendations of the reviewing or inquiry Committee.
Nothing in these Rules shall prevent the President from exercising any or all the powers of the Governing Body in case of emergencies in furtherance of the objects of the Society. However, the action taken by the President on such occasions shall be reported to the Governing Body subsequently.

Singh, IPS , the then Deputy Inspector General of Police (CR), Diphu now Deputy Inspector General ofPolice (SR) Silchar Notification No. HMA . 318/2014/69 , dated 22nd November 2016 as the Inquiry Officer to enquire into the charges framed against Shri Navin Singh, APS , and ;
Whereas, the Inquiry Officer submitted his report vide No. SR/ FB / Appeal / 2017/ 824 , dated 15th May 2017, wherein he concluded that none of the charges framed against Shri Navin Singh, APS , the then Addl. Superintendent of Police (HQ ) Jorhat now Addl . Superintendent of Police (Security) , Duliajan, Dibrugarh could be proved , and;
Whereas , after careful consideration ofall the facts placed on record and after perusal of the report of the Inquiry Officer, the Government is pleased to accept the enquiry report of Shri A. K. Singh , IPS .
