No.PRD.12019/117/ 2017 - PRD ( B ) /20.- Whereas , a report received from the Chief Executive Officer, ZillaParishad Hailakandi & Project Director , DRDA , Hailakandi that Shri Dipak Ranjan Deb , Junior Engineer , South Hailakandi Development Block , Hailakandi District had been arrested by the police in connection with the case No.152/2017 u/ s 420/406/ IPC dated 14/07/2017 and he was under Judicial Custody w.e.f. 14/07/2017 and subsequently he was released on bail from jail on 05/08/2017.
And whereas the officer was detained in police custody for a period exceeding 48(forty eight) hours, therefore , he is deemed to have been suspended w.e.f. the date of the detention .
Accordingly Shri Dipak Ranjan Deb , Junior Engineer , South Hailakandi Development Block , Hailakandi is placed under suspension under Rule 6 (2) of the Assam Services (Discipline & Appeal ) Rules, 1964 w.e.f. the date of his arrest, i.e. 14/07/2017, pending drawal of Departmental Proceeding.
TheHead Quarter during the period of suspension shall be South Hailakandi Development Block , Hailakandi . He will not leave the Head quarter without permission of the competent authority.
Heshall be allowed subsistence allowances admissible and as per rules .

No. HMB . 160/ 2011/219. - PERUSED the Departmental Proceedings drawn up against Shri Sadhan Kumar Baishya , Jailor , Mohendra Nagar , Open Air Jail ( the then Jailor , District Jail , Karimganj ) by the Inspector General of Prisons , Assam vide their letter No.PRI.132/ 2008 /3 dated 04.06.2011 who was placed under suspension with effect from 27.06.2011 ; and
PERUSED the observations of Hon'ble Gauhati High Court order in W.P. ( C ) No.676/2009 [ Taken - UP] in RE the State of Assam and other connected papers including the reports dated 17.09.2008 and 01.10.2008 submitted to the Registrar (Vigilance) ,Gauhati High Court by the then learned Chief Judicial Magistrate , Karimganj and the then learned District & Sessions Judge , Karimganj complaining about some illegal activities of Jailor , Shri Sadhan Kumar Baishya , Jailor , Mohendra Nagar, Open Air Jail ( the then Jailor, District Jail , Karimganj ) and also this Department's earlier order No.HMB.160 / 2011 /Pt/ 105 dated 07.03.2012 imposing major penalty of Compulsory retirement to Shri Sadhan Kumar Baishya , Jailor ; and
ALSO PERUSED the observation of Hon'ble Gauhati High Court in W.P. (C).1797/2012 dated 14.07.2015 ; and
WHEREAS a copy of the enquiry report of the Departmental Proceeding against Sri Sadhan Kumar Baishya , Jailor( under Suspension ) drawn up by the Inspector General of Prisons , Assam vide No.PRI.48 /2009/ 3 dated 4.6.2011 was served upon Shri Sadhan Kumar Baishya , Jailor , vide letter No.HMB.160/ 2011 / 206 dated 17.10.2015 as per the order of the Hon'ble Gauhati High Court in W.P. (C) . 1797/2012 dated 14.07.2015 ; and
PERUSED the petition of Shri Sadhan Kumar Baishya dated 10.08.2015 addressed to the Commissioner & Secretary to the Govt. of Assam , Home & Political Department and Judgment of Hon'ble Gauhati High Court in W.P. ( C ) 1797/2012 in pursuance of which the impugned order of penalty imposing Compulsory retirement to Shri Sadhan Kumar Baishya dated 07.03.2012 was set aside and quashed and Shri Baishya was ordered to be in suspension under Rule 6 ( 1 ) of the Assam Services (Discipline & Appeal ) Rules , 1964 till the case is finally disposed off vide this Department's order dated HMB.160/ 2011 / 207 dated 24.12.2015 and as per the order of Inspector General of Prisons , Assam PRI.132 / 2008 / 48 dated 05.03.2016 Shri Baishya was placed under suspension w.e.f.07.03.2012 and posted him as Jailor District Jail.Majuli w.e.f. 24.12.2015 until further order ; and
WHEREAS as per the report of the Enquiry Officer it has been found that out of the six charges , charge No.1 i.e. gross violation of Rules572 and 580 of Assam Jail Manual had been proved against Shri Sadhan Kumar Baishya , Jailor (under suspension ) ; and PART II A. ]

After careful examination of the enquiry report and materials on records , the
Govt . of Assam in Home & Political Department decided to accept the enquiry report
submitted by the enquiry officer ,Shri Madhab Ch . Saikia , ( the then Assistant Inspector General of Prisons) on the Departmental proceedings against Shri Sadhan Kumar Baishya , Jailor (under suspension ) drawn up by the Inspector General of Prisons . Assam vide their letter No.PRI.48 /2009 /3 dated 4.06.2011 ; and WHEREAS Shri Sadhan Kumar Baishya, Jailor ( under suspension ) , District Jail.Majuli appeared before the Principal Secretary to the Govt . of Assam . Home & Political Department for a hearing dated 23.06.2017 and after carefully hearing his statements and recording his statements ; and After carefully considering all aspects of the case and facts and material of record of hearing , the Govt . of Assam in Home & Political Department hereby decides to impose the penalty of withholding of increments for three years as per clause ( ii ) of Rule 7 of the Assam Services ( Discipline & Appeal ) Rules , 1964 w.e.f the original date of his suspension i.e27.06.2011 and Shri Sadhan Kumar Baishya , Jailor( under suspension ) , District Jail , Majuli is hereby reinstated in service with immediate effect . His period of suspension will be treated as on duty . The Departmental Proceedings is disposed of accordingly.
This order comes into force with immediate effect .
