Whereas , Shri Atul Chandra Baruah , the then Sub - Divisional Agricultural Officer ( SDAO ) , Guwahati and now working as Assistant Director of Agriculture (R and FT) , Khanapara was placed under suspension with effect from 26th November , 2012 to 31st August , 2013 vide Government Notification No. AGA.475 / 2010/ 355 , dated 26th November , 2012 ; and
Whereas , Shri Atul Chandra Baruah , the then SDAO , Kamrup was reinstated in his service pending drawl of departmental proceedings and posted as SDAO , R.K. Nagar , Karimganj vide Government Notification No. AGA.25 / 2011 ( 7)/ 84 , dated 31st August , 2013 ; and
Whereas, fromthe letter of Superintendent of Police , Kamrup vide Memo No.crime/RSI/ SR- 410/2013/2015/19 , dated 9th April, 2015, it is seen that during the course of investigation , although the SDAO Shri Atul Ch . Baruah had been arrested but sufficient evidence was not collected in course of investigation against him as to be charge sheeted . Hence , no Departmental Proceeding was drawn against Shri Atul Ch . Baruah ; and

i) The Chairman and Members of the SEIAA , Assam & SEAC , Assam shall hold for a term of three years from the date of publication of the Notification in the Official Gazette of Ministry of Environment , Forest & Climate Change Department , Govt . Of India.

vii) The sitting fee , travelling allowances and dearness allowance to the Chairman and Members of the SEIAA, Assam and SEAC , Assam shall be paid in accordance with exixting Rules of the State Government .

7. Take any other decision in respect of matters related to the Project Implementation , 60 as to ensure timely completion of the Project within the scope of the Project .
8. Issue necessary direction , that the Project is implemented, as schedule , as per the Loanand Project Agreement signed with ADB and Procurement Guidelines of the ADB.
Thedecision of the Empowered Committee shall be complied with by the Project Management Unit ( PMU ) , AUIIP and the Departments as well as the Implementing Agenciesrelated to the Project .
The Committee shall meet at least once in 4 months or more frequently, if necessary . The Project Director, AUIIP shall ensure the holding of the EC Meetings accordingly. The tenure of the Committee shall be till the completion of the Project.

No. WR ( CON ) 5/2010/255. Whereas Departmental Proceeding was drawn up against Shri Utpal Hazarika , the then Assistant Engineer ( under suspension ) , Barpeta W.R. Division vide letter No. WR ( CON ) 5/2010/13 dated 29-10-2010 for dereliction of Govt. duties in the execution of the scheme" Immediate measures to protect Bahari Satra , Phulbari , Bhogerpar and its adjoining areas from the erosion of river Brahmaputra under C.R.F. for the year 2007-2008" .
And whereas the delinquent officer vide his representation dated 06-12-2010 denied the charges leveled against him ; and
Whereas after careful consideration /examination of the defence statement given by the delinquent officer, it has been decided to enquire into the matter by appointing Enquiry Officer and nominating Presenting Officers namely Shri Puspa Kumar Dutta , the then Superintending Engineer, Northern Assam W.R. Circle and Additional Chief Engineer, Kokrajhar W.R. Zone (i /c) and Shri Prasanta Dutta , Executive Engineer , Quality Control , Water Resources Department respectively vide notification no. WR ( CON ) 53/2010/95 dated 04-02-2011.
And whereas the Enquiry Officer has submitted his enquiry report vide letter no. SE ( NAC) A/ 56 / 35 Dated 30-06-2012 where the charges leveled against Shri Utpal Hazarika have been partially established .
Considering all aspect of the matter and having regard to the findings of the Enquiry Officer , the Governor of Assam is pleased to impose a penalty of withholding of one increment without cumulative effect ( from prospective date) under the provision of Rule 7 ( 2 ) of the Assam Services (Discipline & Appeal ) Rules , 1964 on the delinquent officer Shri Utpal Hazarika , the then Assistant Engineer , Barpeta W.R. Division (now Assistant Enginer , Morigaon W.R. Division , Morigaon).
The period of suspension w.e.f. 24-02-2010 to 09-11-2011 is treated as on duty for pensionary benefit . It is also decided to pay proportionate pay under the provision of Sub - rule 8 of the F.R. 54 (B ) which is restricted to the subsistence allowance already paid to the delinquent officer for the period of suspension .
With the above order the proceeding is concluded.

No. CON . 32/ 2017/Pt/4.- Whereas Sri Keshab Sonowal , Junior Engineer ( Civil ) , O/o the Executive Engineer , PWD, Tinsukia State Roads Division , Tinsukia , Assam was arrested by Superintendent of Police, Chief Minister's Special Vigilance Cell , Assam , Guwahati on 26.09.2017 in connection with the CM's SVC PS CASE NO.06/2017 and there is prima-facie evidence to proceed against him ;
And whereas disciplinary proceedings have been contemplated against Sri Keshab Sonowal for the act of his involvement in criminal activities;
Now, therefore, in exercise of the powers conferred under Rule 6 ( 2 ) 2.2.1 of the Assam Services( Discipline & Appeal ) Rules , 1964 , Sri Keshab Sonowal , Junior Engineer ( Civil ) , O/o the ExecutiveEngineer, PWD , Tinsukia State Roads Division , Tinsukia is deemed to have been suspended w.e.f. the date of his detention pending drawal of Departmental Proceedings against him.
It isnot permissible for him without previous sanction of the Govt . to accept private employment or to do business while under suspension in view of the provision of Rule 12 of the Assam CivilService( Conduct ) Rules ,1965. If while under suspension he accepts private employment, does business in violation of Rule 12 of the Assam Civil Services ( Conduct ) Rules , 1965, he will be guilty of misconduct and will be liable to be dealt with accordingly . He is also liable in that case to forfeit his claim for subsistence allowance . The Head Quarter of Sri Keshab Sonowal , Junior Engineer ( Civil ) , PWRD during the period of suspension will be Tinsukia . He will not leave the Head Quarter without prior writtenpermission of the competent authority .

I am directed to say that it has come to the notice of Government that important notification having bearing on statutes and matters of immediate public interest are sometimes published in the Official Gazette on date much later than prescribed . Government have decided , therefore , to introduce the following system with immediate effect , which must be strictly adhered to in sending notice to the Assam Government Press for publication in the official Gazette .
1. In the first instance , it has to be noted that the printing of the weekly Gazette must be completed by the end of every Tuesday so that it may be duly published on every Wednesday .

Every notification and every other matter which is required to be printed and published in a particular issue of the Official Gazette must , therefore , reach the Deputy Director, Assam Government Press on the Monday of the week preceding the week in which it is required to be published. If this is not done it is infrictuous requesting the Deputy Director , Assam Government Press to publish such notification or other matter in the next issue of the Gazette , the expression usually inserted in all endorsements made to the Deputy Director .
3.Wherever it is necessary to print and publish a notification on a specified date ( excluding such Notification or communicate as are to be published in Gazette extraordinary ) clear instruction ofthat effect must be given to the Deputy Director, Assam Government Press , both on the body of such notification within the indication at the top in the red ink and is a separate covering .
4. To achieve the objective in papers 2 and 3 , it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application .
5. As for publication of any matters in a Gazette , Extraordinary, the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue .
