No.VFV.256/2018/ 6 . -Whereas report has been received from Dist. A.H. & Vety. Officer , Darrang, through the Director , A.H. & Veterinary , Assam that Dr. Afzal Hussain , Vety. Officer , State Vety. Dispesnary, Bhakatpara , Darrang was arrested by the O /C , Sipajhar Police Station on 25.3.18 in connection with Sipajhar P.S. Case No.224/2018 Under Section 14/15 Assam Gambling and Betting Act 1970 and was detained in judicial custody and was released on bail on 7.4.18 .
Whereas Dr. Afzal Hussaion , V.O. State Vety. Dispensary, Bhakatpara was kept under detention for more than 48 hours since his arrest on 25.3.2018 , the Governor of Assam in exercise of the powers conferred under Rule 6 (2 ) of the Assam Services ( Discipline & Appeal ) Rules , 1964 is pleased to order that Dr. Afzal Hussain , V.O is deemed to have been placed under suspension w.e.f. the date of arrest .
Therefore , pending drawal of Departmental Proceeding , as per provision of Rule 6(2) of the Assam Services ( Discipline & appeal ) Rules , 1964 , the Governor of Assam is pleased to place Dr. Afzal Hussain , V.O. , State Vety. Dispensary, Bhakatpara under suspension w.e.f. the date of arrest i.e. 25.3.2018 until further order .

No. SWD . 14 / 1988 / 255. - Whereas Late Jhandilal Upadhyaya, the then CDPO was arrested by Police in connection with a Lanka Police Case No. 59/54 under Section 406/409 IPC on 18.06.1994 (A.N) and was in police custody for more than 48 hours , he was placed under suspension vide Notification No. SWD.230 /1984 / Pt.II / 141 , dated 12.07.1994.
Whereas , vide Notification No.SWD.245 / 94/Pt.1 / 107 - F, dated 30.07.1997 late Jhandilal Upadhyaya, the then CDPO , Lanka ICDS project was re - instated in the service pending drawal of DP and posted as CDPO , Ujani - Majuli ICDS Project , Jorhat District .
Whereas , late Jhandilal Upadhyaya , retired from his service on 29.02.2012 and expired on 20.04.2013.
Whereas , his suspension period have to be regularized w.e.f. 19.06.1994 to 15.09.1997 to release full salary for the aforesaid period .
Now, therefore , in view of the order of Sub - Divisional Judicial Magistrate , Hojai , dated 09.04.1997 U / S 406/409 IPC , Late Upadhyaya was found not guilty for offence and was acquitted and set at liberty, it is decided to conclude the Departmental Proceeding drawn against late Jhandilal Upadhyaya . As the Charges leveled against him could not be substantiated , his period of suspension with effect from 19.06.1994 to 15.09.1997 shall be regularized by treating the period as spent on duty for all purposes .
This is in modification of this Deptt's earlier Order No. SWD.14 /1988 / 252 , dated 14.03.2018 .
