On recommendation of the Assam Public Service Commission , Khanapara , Guwahati - 22 vide their letter No.98PSC/PS - 15 / 2017-2018 , dated 2nd May 2018, the Governor of Assam is pleased to appoint Shri Kaustuv Saikia temporarily and until further order as District Museum Officer, Diphu ( District Headquarter ) which is temporarily attached at the Assam State Museum, Guwahati , under Cultural Affairs Department , Assam in the scale of Pay Rs.30,000/- 1,10,000/- (Pay Band - 4) and Grade Pay Rs . 12,700/- plus other allowances as admissible as per the Rules of the Govt . of Assam.

The appointee joining the State Government on or after 1st February, 2005 shall not be governed by the existing Assam Services ( Pension ) Rules , 1969 and orders issued there under from time to time . So far as the pension and retirement benefits are concerned they will be governed by a new set of pension rules which are being formulated in line with the Contributory Pension Scheme announced by the Govt . of India recently.

Heshould join in his new place of posting within 15 ( fifteen ) days from the date of receipt of the Notification.

No T.A/D.A is admissible either on joining the post or in termination of Notification.

No. HMA . 272 / 2015 / 70.- Whereas , a Departmental Proceeding was drawn up against Md . Imdad Ali , APS , the then Addl . S.P (Security ) , Lakhimpur now Addl . S.P (Security ) , Jorhat vide letter No.HMA.272 / 2015 /23 dated 10/08/2015 for gross negligence, misconduct , dereliction of duty and act of unbecoming on his part; and,

Whereas , Md. Imdad Ali , APS submitted his written statement in defence vide his letter dated 05/10/2015 and denied the charges framed against him and;

Whereas , having not been satisfied with the written statement in defence submitted by Md. Imdad Ali , APS and after careful consideration of all aspects , the Govt . decided to enquire into the allegations and therefore appointed Shri Brajenjit Sinha, IPS , the then S.P. , Biswanath Chariali now DCP (Admn) , Guwahati as Inquiry Officer to enquire into the charges framed against Md . Imdad Ali , APS vide Notification No. HMA.272/ 2015 /40 dated 22/11/2016 , and ;

Whereas, the Inquiry Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide Memo . No.DCP ( A) /DP / 2018 / 55 dated 23/03/2018 wherein the Inquiry Officer concluded that the charges for gross negligence , misconduct , dereliction of duty is proved beyond reasonable doubt from the available materials and records .

Whereas , the enquiry report was served to the delinquent officer for submitting his representation if any against the report vide letter No. HMA . 272/2015/55 dated 28/03/2018.

Whereas , Md . Imdad Ali , APS submitted his representation against enquiry report vide dated 07/04/2018 showing his dissatisfaction upon the enquiry report .

Now therefore , after having considered the representation of the delinquent officer and after careful examination of the report of the Inquiry Officer and materials on records and also in consideration of the facts and circumstances of the case and in consultation with Assam Public Service Commission , the Governor of Assam is pleased to award minor penalty of " withholding of 1 (one) increment without cumulative effect " as provided under the Assam Services (Discipline & Appeal ) Rules , 1964 to the Delinquent Officer.

The Governor of Assam is therefore pleased to withhold 1 (one) increment without cumulative effect with effect from the date of next increment due to Md . Imdad Ali , APS , the then Addl . S.P ( Security ) , Lakhimpur now Addl . S.P ( Security ) , Jorhat and the Departmental Proceedings drawn up against Md . Imdad Ali , APS , are thus accordingly disposed off.

Wherever it is necessary to print and publish a notification on a specified date ( excluding such Notification or communicate as are to be published in Gazette extraordinary ) clear instruction of that effect must be given to the Deputy Director , Assam Government Press , both on the body of such notification within the indication at the top in the red ink and is a separate covering .

4. To achieve the objective in papers 2 and 3 , it is essential that proper discretion should be exercised by the concerned officers in the Department or office and all matters for publication in the Gazette should scrutinised and sent to the Press after careful application .

5. As for publication of any matters in a Gazette , Extraordinary , the existing procedure whereby the prior approval of the General Administration Department is to be obtained will continue.
