No.PDP.84/2017/ 57 . It is to be stated that the National Institution for Transforming India (NITI Aayog ) , Government of India has identified 115 backward districts of the country for convergence, integration and focused attention which includes 7(seven) districts of Assam viz . Darrang , Dhubri , Barpeta , Goalpara , Baksa , Udalguri and Hailakandi , Accordingly, the Government of India has nominated Prabhari Officers for each of the districts including for the 7 (seven) identified districts ofAssam and suggestted the State Government also to appoint State Prabhari Officers for the 7 ( seven) districts.
In view of this , the matter was taken up with Personnel ( A) Department to suggest name of officers for appointing as State Prabhari Officer for each of the 7 ( seven ) identified district ofAssam . Based on the name of the officers suggested vide their Notification No.AAI.18 /2013 / 72 , date 29th December , 2017 and with partial modification thereon consequent upon preoccupation of some of the officers with other activities the following officers have been nominated as State Prabhari Officers for the districts shown against their names .

Clause3 ( in original)
Term of Office:
i) The term of office of the Council shall be as the Government of Assam may decide from time to time, but shall not exceed five years . The term of office shall be reckoned from the date of notification constituting the Council .
Provided that , if the Government is of the opinion that circumstance exist whereby the orderly conduct of business in the Council is not possible, the Govt . may by notification dissolve the Council .
Provided further that , Govt . may if it is satisfied that circumstances exist , which render reconstitution of the Council , as provided , impracticable , extend the term for a period not exceeding one year .
ii) TheChairman and the Vice- Chairman of the Council shall cease to hold their office forthwith , if he/ she, for any reason , ceases to be a member .
The Chairman , Vice - Chairman or a Member shall also cease to be a member in the event of his / her death .
Clause 3 "as modified "
Term of Office :
(i) The Development Councils shall function at the pleasure of the Government of Assam.
(ii) The Chairman/ Vice - Chairman and members of the Councils shall hold their position in the Councils at the pleasure of the State Government . The State Government may remove / replace the Chairman/ Vice-Chairman or any member of any Council at any time .

No. WR ( CON) 10/2017 /17 -Whereas it was come to know that Shri . Budhinath Shyam , the then Executive Engineer , Majuli W.R. Division has unauthorisedly communicated to the electronic media bringing false allegations against the Water Resources Department for pressing him to mis - utilize fund allotted for flood management works and thereby tinted the image of the Department in public ; and
Whereas Shri . Budhinath Shyam , the then Executive Engineer, Majuli W.R. Division was placed under suspension with immediate effect vide Notification No. WR (CON ) 10/2017/1 dated 28-06-2017 pending drawal of Departmental Proceeding and subsequently reinstated in service vide Notification No. WR (CON ) 10/2017/16 dated 13-04-2018 ; and
Whereas Departmental Proceeding was drawn up against Shri . Budhinath Shyam , the then Executive Engineer , Majuli W.R. Division vide Show Cause Notice No. WR ( CON ) 10/2017/2 dated 24-07-2017 for gross negligence in duties and unauthorized communication to electronic media which amounts to violation of Rule 3 (1) ( i ) & ( iii ) and Rule 16 ( 1 ) & (2 ) of the Assam Civil Services ( Conduct ) Rules , 1965 ; and Whereas Shri . Budhinath Shyam , the then Executive Engineer , Majuli W.R. Division vide his representation No. Nil dated 09-08-2017 submitted written statement where he accepted his mistake by stating it as unintentional and was made out of his ill health. He also apologies for his mistake and requested to give a pardon to his mistake done due to unstable health condition ; and Whereas after careful consideration/examination of the written statement submitted by Shri . Budhinath Shyam, the then Executive Engineer , Majuli W.R. Division , it has been decided that no further enquiry in this case is required as the delinquent officer has admitted his mistake ; and Whereas considering all aspects of the matter and having regard to the confession and apology of the delinquent officer, it has been decided to impose a penalty of withholding of one increment without cumulative effect under Rule 7 (2 ) of the Assam Services (Discipline & Appeal ) Rules , 1964 against Shri . The period of suspension w.e.f. 29-06-2017 to 20-04-2018 is treated as on duty for all purposes . It is also decided to pay proportionate pay under the provision of Sub - rule 8 of the F.R. 54 (B ) which is restricted to the subsistence allowance already paid to Shri Budhinath Shyam for the period of suspension . With a view to evolve a mechanism to minimize the pendency of cases at lower courts and to provide the litigants with speedy delivery of justice for the welfare of the residents of Assam , the Governor of Assam ispleased to constitute a District Level Committee comprising of the following members :

Terms of Reference:
The Terms of Reference of the District Level Committee so constituted above shall be as follows:
1) The Public Prosecutor shall present a list of pending cases which have been pending for morethan two years before the meeting in different courts of the district along with necessary information . The committee will consider each case and will forward to the Government for withdrawal of such cases through the Public Prosecutor who would thereafter file application forwithdrawal before the court .
2) Priority shall be given to cases in which the prosecution witness has turned hostile or for any other reasons, in the opinion of the Public Prosecutor , there is no hope of the success of the casein court .
3) While recommending the withdrawal of cases , the committee shall have the responsibility to ensure that the withdrawal of the case does not result in a case of malicious prosecution against the State Government.
4) In cases of general nature that can be withdrawn, where the accused falls in the category of habitual criminal , if the committee constituted at the district level makes a decision , then such cases shall be sent to the State Government for consideration of withdrawal from Court .
5) In the matter of recommendation , the committee shall specify the opinion and the grounds of either recommendation / rejection .
6) If the number of cases is excessive then a cell may be formed to assist the members of the committee so that the work can be done promptly and easily.
7) The cases which fall under the following categories will be considered by the Committee:
a) All the cases under Section 34 of Police Act .
b) Case of Section 29 of Assam Shops and Commercial Establishment Act, 1971 .
c) The cases under section 294, 323 , 279 , 336 , 341 , 342 , 337 , 447, 448 and 506 of IPC .
d) Under section 34 (A) of the Excise Act in cases where the quantity of items seized is less than 5 liters and cases falling under section 36 .
e) Under the Motor Vehicles Act .
f) Public Gambling Act cases under Section 13 .
g) Other such offences, having provision of imprisonment up to 6 months with fine which may extend up to Rs 5,000/ - 630

h) Petty cases under Section 206 ( 3 ) Cr.P.C.
i) The cases in which the accused has already undergone imprisonment equal to or more than the prescribed period .
Provided,
(a) the accused will not be liable to be subjected to more/ increased punishment under Section 75 of IPC or any other provision for any subsequent offence.
(b) any observation / order / judgment with regard to acquittal or conviction will not be awaited for , keeping in view the nature of crime and the criminal / offender , for practical purpose .
(c) Such criminal cases in which the accused and complainant have come to a compromise and only the charges of section 147, 148 and 149 of the Indian Penal code have remained .
(d) All the criminal cases that are under consideration for more than the prescribed period of trial under Trial Magistrate , unless the case is of critical nature , which can be sent to the court of Chief Judicial Magistrate under section 325 of the Cr.P.C.
8) The Committee shall hold a meeting once in two months and send report of the progress of withdrawal of cases at the district level to the Govt . in Home & Political Department .
9) Detailed instructions regarding the functioning of the Committee shall be disseminated separately by the Judicial Department , Dispur .

The candidate must be a citizen of India ( as defined in Article 5-8 of the Constitution of India) . The selected candidates will be required to undergo a 6 months training course in the Central Training Institute, Guwahati , Assam followed by 3 months attachment period . If a candidate selected for training is a Govt . servant he shall be treated as on deputation to the Finance Depertment on the grade pay of the post which he held prior to his selection, for training. If the candidate selected for the said training is not a Govt . servant he shall be given a monthly stipend to be determined by the Govt .
The candidates will be required to appear in a Departmental Examination and on the conclusion of the period of training and those who come out successful according to the standards prescribed by Govt . will be eligible for appointment as TO / FAO against available vacancies in the revised pay band ( P.B. - 4 ) Rs.30,000 /-1,10,000 with Grade Pay Rs.12,700 / - per month plus the usual allowances , as admissible under the existing rules . In the case of those candidates who are already Govt . servants and who may be appointed to the A.F.S. the pay will be fixed under the rules prescribed under the FR & SR .
Mere selection by the APSC or the candidates ' passing the Departmental Examination will not establish or imply the establishment of any right for appointment to the A.F.S. The posts of TO and FAO are interchangeable . Selected candidates will have to give an undertaking that they will abide by all the rules and regulations of the training and , that, on their posting , at the conclusion of their training , they will serve the Govt . of Assam if required to do so as TO /FAO or in any other equivalent post in any place within the State of Assam for a period not less than 5 ( five ) years , failing which they shall forthwith refund to Government , on demand , an amount equivalent to the money paid to them or spent on their account during the period of the said training and any other expenses on account in respect of the aforesaid training together with the interest thereon from the date of demand atthe government rates for the time being in force on government loans.

FEE EXEMPTION :
1. BPL: As per Govt . Notification No. FEG.32 / 2016 / 8 - A dated Dispur the 28th October , 2016, the application fees for all posts under the State Govt . of Assam for candidates having BPL certificate is nil ( Candidates having BPL certificate should enclose photocopy of the certificate along with the application form) .
2. PWD: As per Govt . Notification No. ABP 144/95/121 dated Dispur the 28th October , 2015 for persons with disabilities ( PWD ) candidates , the application fees for all posts under the Govt . of Assam is nil . (PWD candidates should enclose along with the application form photocopy of the relevant certificate from a competent authority) .
ii . One copy of recent passport size photograph to be properly pasted on the space provided in the application form with good quality adhesive / glue . Another copy should also be enclosed with the application .
iii . Age - proof certificate (Admit Card/ Certificate of HSLC or equivalent exam) .
iv . Degree - pass Certificate .
v. Caste Certificate in respect of candidates belonging to SC/ ST/ OBC /MOBC community issued by the competent authority.
vi . ID Card/ Certificate in respect of PWD candidates issued by the competent authority.
Since the practice of furnishing attested copies of certificates has since been discontinued by the Government , the applicant shall furnish photostat copies of the above mentioned documents declared by the candidate himself / herself as ' Certified to be true copy of the original ' along with the application.
However, in case of detection of any false declaration made by the candidate / applicant , he / she will be penalized as per rules/ law .
Acandidate should not submit more than one application . The envelope sending the application should be superscripted ' Assam Finance Service Examination , 2018 on top of the envelope and it should be addressed to the Secretary , APSC , Jawahamagar, Khanapara , Guwahati - 22.

PWD ( Persons with Disabilities ) are to inform the Commission in writing , for services of scribe, if required , within 15 (Fifteen ) days of the expiry of the closing date for submission of application . Applications not signed by the candidates will be summarily rejected .
Application for the Examination duly filled will be received till 24th August , 2018 only during office hours .
APPLICATIONS ( INCLUDING THROUGH POST) RECEIVED AFTER THE LAST DATE SHALL NOT BE ENTERTAINED
All candidates whether in Govt . Service or in Govt . owned undertaking or other similar organizations / Corporations / Boards or in private employment may intimate their controlling authority instead of routing the applications through the same . Eligibility:
(a) Nationality : The candidate must be an Indian citizen .
(b) Age: The candidate should not be less than 21 years of age and more than 38 years of age as on 1st January, 2018 .
Relaxation of age : The upper age limit is relaxable
( i ) By 5 years for SC / ST candidates i.e. upto 43 years .
( ii ) By 3 years for OBC /MOBC candidates i.e. upto 41 years as per Govt . Notification No. ABP.6/2016/9 dated Dispur the 25th April , 2018 .
( iii) For Persons with Disabilities ( PWD ) by 10 years i.e. upto 48 years irrespective of SC /ST/ OBC and General category of candidates as per Govt . OM No. ABP 144/95/121 dated Dispur the 28th October , 2015 .
The age limit of the candidates will be calculated on the basis of the Matriculation/ HSLC Admit Card/ Certificate issued by a recognized Board / Council , and no other document shall be accepted in lieu of the above mentioned documents .
(c) The minimum educational qualification of a candidate shall be a degree in Arts / Science /Commerce of a University recognized by the State Government.
(d) Candidates must possess the prescribed qualification on the date of submission of their applications .
( e) Candidates awaiting results of the qualifying examination for eligibility on the closing date of submission of application need not apply .
(f) Persons with Disabilities should ascertain the post for which a particular category of disability is entitled for reservation as per the advertisement and should apply / opt for the preference accordingly atthe time of filling up the forms for Examination.
GENERAL CONDITIONS :
( 1) No candidate will be admitted to the examination without an admission certificate from the Commission.
(2) A candidate shall be of sound health and shall be required to undergo medical examination to certify his medical fitness before he is appointed to the A.F.S.
(3) Any form of canvassing will result in the disqualification of the candidates .
(4) The decision of the Commission regarding eligibility of a candidate for admission to the examination shall be final .
(5) No travelling allowance is admissible for the journey performed in connection with the above examination.
(6) All correspondences must be addressed to the Secretary , Assam public Service Commission, Khanapara , Guwahati - 22 and not to any person by name .
(7) Applications which are not duly signed by the candidate in the space provided for the purpose will also be summarily rejected . The application must be accompanied by all relevant particulars as indicated in the application form/ advertisement .
(8) Incomplete application forms in terms of the advertisement will be summarily rejected . No documents will be entertained after the last date of submission of application.

ADMISSION CERTIFICATES ( ADMIT CARD)
(a) Admission Certificate indicating the eligible candidate's roll number , venue and programme of the exam will be uploaded in the Commission's website , for appearing in the Preliminary / Main examination .
(b) The mere fact that a certificate of admission has been issued will not imply that his/ her candidature has been finally cleared by the Commission . Candidates may note that the Commission can take up the verification of eligibility conditions only after the candidates have qualified for the examination .
( c) Candidates must produce a photo identity proof of any of the following in the examination hall :
i. Pan Card
ii . Driving License
iii . Voters ID Card
iv . Bank Passbook containing photograph
V. ID Card issued by the educational Institution where he/ she is studying presently.
vi . ID Card issued by Government or public sector undertaking .
vii . Indian passport .
(d) The Commission reserves the right to cancel the candidature of any candidate as and when any ineligibility condition is detected. If any information declared by the candidate is found to be false at any stage , the candidate will be penalized as per prevailing laws / rules .
(e) The decision of the Commission as to the eligibility or otherwise of a candidate for admission to the examination shall be final .
CANVASSING DIRECTLY OR INDIRECTLY SHALL DISQUALIFY A CANDIDATE
The list of candidates whose applications are found valid or rejected after scrutiny will be made available in the APSC's website ( www.apsc.nic.in) showing grounds of rejection in due course.
The advertisement is issued on the basis of the draft advertisement sent by the Government of Assam .
