No. WR (CON) 4/ 2018 / 9.- Whereas the Deputy Chief Engineer , Water Resources Department had submitted proposal for retention of temporary personal post under Mangaldai W.R. Division for the year 2018-19 , On scrutiny it was found that one Shri Anup Sarma , Khalasi whose service was regularized in 2005 by creating personal post was illegally promoted to the post of S.A. by Shri Bhogeswar Saikia , Superintending Engineer , Southern Assam W. R. Circle vide Office Order No. 334 dated 1st March , 2018 and communicated vide Memo No. SE/SAC/E -24/94 dated 1st March , 2018 ; and Whereas in 2005 , the services of MR / WC workers who were engaged prior to 1st April , 1993 and continuously in service were regularized by creating ex - cadre personal post which are personal to the incumbent concerned and are abolishment when the incumbent concerned relinquish the post . Since these are ex - cadre post and in absence of any Govt . policy a person holding personal post cannot be promoted to a higher post or bring to a regular cadre; and Whereas Hon'ble Gauhati High Court's Division Bench order dated 10th February, 2017 in common Judgment in W. A. No. 124/2015 and W. A. No. 111/2016 has opined that claim for promotion ofpersons holding personal post is not legally tenable .

Whereas Departmental Proceeding was drawn up against Shri Bhogeswar Saikia, Superintending Engineer, Southern Assam W.R. Circle vide Show Cause Notice No. WR (CON ) 4/2018/5 dated 13th August , 2018 for gross negligence in duties , lack of devotion to duty and misuse of powers conferredto himwhich amounts to violation of Rule 3 ( 1 ) ( i ), 3 (1 ) (ii ) & 3 ( 1 ) (iii ) and Rule 3 (2) ( ii ) of the Assam Civil Services (Conduct) Rules , 1965 ; and

Whereas Shri Bhogeswar Saikia , Superintending Engineer, Southern Assam W. R Circle vide his representation No. SE/ SAC /E - 24/mangaldai Esstt/ 5 dated 14th August, 2018 submitted written statement where he accepted his mistake by stating it as unintentional and also informed that vide Office Order No , 357dated 14th August , 2018 he has reverted back Shri Anup Sarma to his original Personal Post and directed the Executive Engineer, Mangaldai W. R Division to recover the excess drawn amount due to this illegal promotion fromShri Anup Sarma . He also apologies for his mistake and requested to give a pardon to his mistake ; and

Whereas after careful consideration/ examination of the written statement submitted by Shri Bhogeswar Saikia, Superintending Engineer , Southern Assam W. R. Circle , it has been decided that no further enquiry in this case is required as the delinquent officer has admitted his mistake ; and

Therefore , considering all aspects of the matter and having regard to the confession and apology ofthe delinquent officer, the Governor of Assam is pleased to impose a penalty of Censure of the Assam Services (Discipline & Appeal ) Rules , 1964 against Shri Bhogeswar Saikia, Superintending Engineer , Southern Assam W. R. Circle and warned him not to repeat such act in future ; and With the above order the proceeding is concluded.

(now expired ) Labour Inspector, Mazbat vide Show Cause Notice No. GLr . 463/90/ 139, Dated 28th December , 2015 for negligence of entrusted duties deliberatily to the prejudice ofthe Interest ofthe tea garden workers; and Whereas , Late Bimal Kr. Baruah , Retd . Labour Inspector , Mazbat vide letter dated 30th January, 2016 submitted his wrirten statement in defence to the charges framed against him by explaining the facts and circumstances of his case; and

Whereas after careful examination of the written statement in defence submitted by Late Bimal Kr . Baruah, Retd. Labour Inspector, Mazbat and the materials on record , it was decided to hold an enquiry into the matter and accordingly Shri Omar Ali Badshah , ACS . , the then Deputy Secretary, Labour Welfare Department was appointed as the Inquiry Officer by an order issued vide No. GLR.463/90/233 , dated 30th January, 2017 ; and

Whereas the Inquiry Officer vide letter dated 22nd September, 2017 submitted his inquiry report ofthe Departmental Proceeding against Late Bimal Kr . Baruah, Retd. Labour Inspector , Muzbat has been partially proved true but the second charge have not been proved; and

Whereas after careful examination of the enquiry report submitted by the Inquiry Officer and on the materials on record , it has been decided to drop the Departmental Proceeding drawn up against Late Bimal Kr . Baruah , Retd . Labour Inspector , Mazbat by exonerating him from the charges framed against him:

Now, therefore, the Governor ofAssam is pleased to exonerate Late Bimal Kr. Baruah , Retd . Labour Inspector, Mazbat from the charges framed against him and drop the Departrnental Proceeding drawn up vide Show Cause Notice No. GLR . 463/90/139 , dated 28th December , 2015 and thus the proceeding is disposed off. The period of suspension shall be treated as on duty for all purpose.

2. The Contractor/bidder must be registered with the Electronic Tendering System (ETS ) of the Govt . of Assam (website http /assamtenders.gov.in Contractors can download documents free ofcost . Contractors have to necessarily down load the bidding document from the ETS using their own ID (Digital Signature Certificate ) . Bid documents not procured ( downloaded ) through the ETS/not using the contractor's own user ID will be considered invalid and summarily rejected.
