Case No. 114/13 / U / S 13 ( 1 ) ( e ) / 13 (2 ) and placed under suspension with effect from 12th April, 2013 vide Govt . Notification No.AGA. 126/2013/10 , dated 23rd April , 2013 .

Whereas , Shri Gopal Chandra Barthakur, the then SDAO , Dhubri was reinstated in his service pending drawl ofdepartmental proceedings and posted as DAIO ( in the rank of SDAO) , Tinsukia vide Govt. Notification No. AGA.25 / 2013 ( 24 - A) / Pt/34 , dated 19th October , 2018 .

Whereas , Department vide letter No.AGA.25/ 2013 ( 24 - A)/29 , dated 27th July, 2015 issued show cause notice to Golap Chandra Barthakur , the then SDAO , Dhubri and subsequently Gopal Chandra Borthakur has submitted his reply on 6th August, 2015 .

Whereas , Govt . vide notification No. AGA.25 / 2013 / ( 24 - A)/Pt/34 , dated 19th October , 2015 appointed the State enquiry Officer , Assam to make an enquiry into the charges framed against Sri Gopal Chandra Barthakur , the then SDAO , Dhubri .

Whereas , the State Enquiry Officer, Assam has submitted his Enquiry Report in respect of Shri GopalChandra Barthakur, the then SDAO , Dhubri vide letter No. ABE.16/2015/ 83 , dated 17th November, 2016 based on which Departmental Proceeding is supposed to be concluded.
And
Whereas , Gopal Chandra Barthakur , DAIO ( in the rank of SDAO ) , Tinsukia expired on 28th December , 2017 .
And
Whereas , the Personnel ( B) Department vide their U /O 481/2018 , dated 27th August , 2018 advised to the Agriculture Department to conclude the Departmental Proceeding drawn against Late GopalChandra Barthakur as Per F.R.54 (B ) -(2 ) of F.R.s and S. R. s .
Therefore , the Agriculture Department , Govt . of Assam as per Provisio F. R. 54 ( B ) - (2) of F. R. s and S. R. s . Conclude the Departmental Proceeding drawn against Late Gopal Chandra Barthakur and the period of between the date of suspension i.e , 12th April, 2013 and date of death i.e. 28th December, 2017 shall be treated as duty for all purposes and his family would be paid full pay and allowances for that period to which he would have been suspended, subject to adjustment in respect of subsistence allowancealready paid .

No. HMA . 356. 2015 /48.- Whereas a Departmental Proceeding was drawn up against Shri Mukheswar Borbaruah , APS , Asstt . Comndt . , 2nd APBn , Makum , vide letter No.HMA.356/ 2015 / 13 dated 16th September , 2017 for gross negligence of duty, gross misconduct and indiscipline conduct on hispart; and,
Whereas Shri Mukheswar Borbaruah , APS , submitted his written statement in defence vide memo No. Bn.2 /C/ 2017 /477 dated 16th October , 20 17 and denied the charges framed against him and ;
Whereas having not been satisfied with the written statement in defence submitted , by Shri Mukheswar Borbaruah , APS , and after careful consideration of all aspects , the Govt . decided to enquire into the allegations and therefore appointed Shri Abu Sufian, IPS , Commandant , BTC , Dergaon as Inquiry Officer to enquire into the charges framed against Shri Mukheswar Borbaruah , APS , vide Notification No. HMA.356/ 2015 / 24 dated 21st November, 2017 , and;
Whereas the Inquiry Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide Memo No. BTC/ C /Findings/ 2018 / 25 dated 26th April , 2018 , wherein the Inquiry Officer concluded . that the charges gross negligence of duty , gross misconduct and indiscipline conduct against the delinquent officer has been proved beyond all reasonable doubts .
Whereas , the charged officer was served the enquiry report submitted by the Inquiry Officer and the charged officer submitted his representation by accepting that he took a small quantity of liquor for treatment which does not mean that he avoided duty. However, he denied the charges of manipulation of records . The Govt . after examining representation , could not find any biasness on the finding or the InquiryOfficer.
Now therefore , after careful examination of the report of the Inquiry Officer and materials on records and also in consideration of the facts and circumstances and the Governor ofAssam is pleased to order the minor penalty of " withholding of 1 ( one ) increment without cumulative effect " as provided under the Assam Services (Discipline & Appeal) Rules , 1964.
The Governor ofAssam is therefore pleased to order " withholding of 1 (one) increment without cumulative effect " with effect from the date of next increment due to Shri Mukheswar Borbaruah , APS . Asstt. Comndt. , 2nd APBn , Makum , and the Departmental Proceedings drawn up against Shri Mukheswar Borbaruah , APS, are thus finally disposed off .
