No. ΗΜΑ.981 /2013 /30 . Whereas a Departmental Proceeding was drawn up against Md . Suleman Ali , APS , the then O/C , Panbazar P.S. now Dy, SP, V &AC, Assam , vide letter No.HMA.981 / 2013/6, dated 3rd November , 2016 for gross misconduct and dereliction of duty on his part; and,
Whereas Md . Suleman Ali , APS submitted his written statement in defence vide his letter dated 18/02/2017 and denied the charges framed against him and;
Whereas having not been satisfied with the written statement in defence submitted by Md. Suleman Ali , APS and after careful consideration of all aspects , the Government decided to enquire into the allegations and therefore appointed Dr. Shyamal Prasad Saikia, IPS , Superintendent ofPolice, BI (EO) , Assam , Guwahati as Inquiry Officer to enquire into the charges framed against Md . Suleman Ali ,APS vide Notification No.HΜΑ, 981/2013/12, dated 6th July, 2017, and;
Whereas the Inquiry Officer after causing an enquiry into the charges submitted his report to the Disciplinary Authority vide letter No.BI ( EO) /HΜΑ.981/2013/12/SA/2017/1238 , dated 9th April , 2018, wherein the Inquiry Officer concluded that the charges of gross misconduct and dereliction of duty against the delinquent officer has been proved.
Whereas , the charged officer was served the enquiry report submitted by the Inquiry Officer and the charged officer submitted his representation by stating his dissatisfaction on the finding ofthe enquiry report . The Government after examining representation , could not find any biasness on the finding of the Inquiry Officer .
Now thereof, after careful examination of the report of the Inquiry Officer and materials on records and also in consideration of the facts and circumstances and the Governor ofAssam is pleased to order the minor penalty of " withholding of 1 ( one ) increment, without cumulative effect " as provided under the Assam Services (Discipline and Appeal ) Rules , 1964 .
TheGovernor of Assam is therefore pleased to order " withholding of 1 ( one ) increment without cumulative effect " with effect from the date of next increment due to Md. Suleman Ali, APS , the then O/C Panbazar P.S. now Dy . SP, V & AC , Assam , and the Departmental Proceedings drawn up against Md. Suleman Ali , APS , are thus finally disposed off.

No. PEM. 64/2018/36.- In continuation of earlier Notification No. PEM . 83 / 2009/Pt -1/ 812, dated 4th January, 2014 under Provisions of rule 5 ( 1) of the Assam Minor Mineral Concession Rules , 2013 the Governor ofAssam is pleased to notify Airports Authority of India and Numaligarh Refinery Limited in list of the Central/ State Government as entitled Government Departmentsl Agencies for the purpose of grant of Mining Permit for mining of any minor minerals under the aforesaid rule for undertaking development works within the State ofAssam .
The grant of Mining Permit shall be subject to the following conditions:
(1) TheMining Permit granted to the notified Department / Agency for the quantity required as per detailed project report for execution of the works / projects shall be operated under the direct supervision of the notified Department / Agency concerned which will be responsible for maintenance of records of quantum of mineral production , dispatch and utilisation in the works / projects on day- to - day basis and furnishing the reports ofthe same every month to the competent authority granting the Mining Permit.
(2) The Department / Agency which has been granted a Mining Permit under the aforesaid rules shall be liable to pay royalty / dead rent / fee etc. in advance as notified by the Government from time to time and shall abide by the terms and conditions of such grant and the provisions ofthe AssamMinorMineral Concession Rules , 2013 as well as other laws as applicable to the lessee or any other mineral concession holder unless specifically relaxed.
(3) The Mining permit shall be granted by the competent authority for a period as considered appropriate but not exceeding two years or the period of completion of the work project ofthe notified Department /Agency, whichever is earlier.
(4) The Mining Operation should be carried out under the supervision of Govt. Department/Agency strictlyto following the conditions of approved mining plan.
